AND MEDIUM

PRESIDENT OF THE REPUBLIC OF INDONESIA,

.,, weighed: a. that in order to accelerate the process of healing and development of justice, it is necessary for the special efforts of rescue, protection and the health of Small and Medium Enterprises;
., b. that a special effort as referred to in the letter a is done with a restructuring of Small and Medium Enterprises credit that is jammed due to the crisis;
.,, c. that based on consideration as referred to in the letter a and b need to establish the President ' s Decision on Restructuring Small and Medium Venture Credit;

DECIDED:

., SETTING: THE PRESIDENT ' S DECISION ON RESTRUCTURING THE CREDIT OF SMALL AND MEDIUM ENTERPRISES.

Section 1
In this President ' s Decision, which is referred to by:
., 1. A credit restructuring is an attempt by the Bank and the National Banking Board of Health (BPPN) against Small and Medium Effort credit for both Small and Medium Enterprises to meet its obligations.
., 2. A bank is a bank whose entire stock or majority of its shares are owned by the Government.
., 3. The National Banking Health Organization (BPPN) is the Board of the Presidential Decree No. 27 of 1998.
., 4. The Directorate General of Pidebt and State Lelang is the General Directorate under the Treasury which handles both the debt and auction.
. .5. Credit is the provision of money or a bill that can be equated with it, based on approval or a deal to borrow between the bank and the other that the borrower is obligated to pay off its debt after a certain period of time. Flowers.
., 6. Small businesses are activities as set out in Law Number 9 of 1995 about Small Business.
., 7. Medium-class activities are activities as set out in the provisions of the laws regarding intermediate enterprises.

Section 2
.,, (1) Restructure of Small and Medium Enterprises credit is provided to individuals or business entities categorized as small and medium enterprises which have a total pagu credit as of December 31, 1997 and/or the rest of the underlying debt up to with Rp5,000.000.000.00 (five billion rupiah) per debitor on the bank and or the National Banking Health Board.
., (2) Small and Medium Business Credits as referred to in paragraph (1) are credits used for productive activities or Credit Owners of Simple Home/Very Simple Homes (KPR RS/RSS) acquired before December 31, 1997 It was reported to be jammed between January 1, 1998 and December 31, 2000.

Section 3
The individual or business entity as referred to in Article 2 must meet the following terms:
., a., a. are willing to cooperate (cooperative) and have good faith to resolve the debt;
., b. still have good business prospects going but experience the difficulty of payment of principal debt and or credit interest;
.,, c. credits obtained have been processed in accordance with the provisions of the applicable laws and in accordance with the policies and the procedures of the bank; and
., d. does not include a company that is a large subsidiary or a large business group.

Section 4
.,, (1) Implementation of the Small and Medium Business Credit restructuring as referred to in Section 2 is conducted by the Bank, in accordance with the provisions of the Bank of Indonesia and the respective Base Budget of the Bank, as well as the National Banking Vision Board (BPPN), in accordance with the provisions of the laws applicable to the National Banking Governing Body (BPPN).

Section 5
State Minister of State-owned Enterprises as a General Shareholders ' Meeting (RUPS) or a representative of the Government as a shareholder in the State-owned Enterprises/Perseroan Limited takes the necessary steps in order to restructure the credit Small and Medium Efforces.

Section 6
.,, (1) In the Small and Medium Business Credit Restructuring Program as referred to in Section 2 of the bank, to the debtors of Small and Medium Enterprises may be provided the following incentives:
.,
., a., a. in terms of debitors paying cash within 6 months of the release of this Presidential Decree, may be given the incentive of the principal debt as well as the removal of flowers and fines;
., b. In terms of the debitors unable to pay cash, the debtor may be granted an extension of the term of the softening with the release of interest and fines.
.,, (2) The benchmark incentives as referred to in paragraph (1) are set by the Bank.

Section 7
.,, (1) In the Small and Medium Enterprises credit restructuring program conducted by the National Banking Board of Health (BPPN) where the debitors can pay cash in the term 6 (six) months are counted since the President's Decision this, may be given the incentive of the cut over the underlying debt as well as the removal of interest and
., (2) The benchmark incentives as referred to in paragraph (1) are set forth by the National Banking-based Vision Board (BPPN).
.,, (3) In terms of debitors may not pay cash, it will be resolved by the way:
.,
., a., a. its credit portfolio sales and/or guarantees with the auction mechanism publicly and transparently according to the applicable provisions;
B. establishment of clearing house or joint venture.

Section 8
The supervision of the Small and Medium Business Credit restructuring program as referred to in this Presidential Decree is conducted by the State Minister of State-owned Enterprises in the applicable laws.

Section 9
.,, (1) Minister of State Koperating and Small and Medium Effort conducting the socialization of Small and Medium Venture Credit restructuring programs.
.,, (2) In conducting socialization, Minister of State Koperations and Small and Medium Enterprises can team up and request assistance with the relevant Government agencies and/or other parties deemed necessary.

Section 10
Further provisions for the implementation of the Presidential Decree are governed by the Minister of Finance, Minister of State for the State of the State, and the Minister of State for the State of Operations and Small and Medium Enterprises both individually and together accordingly. with the scope of the respective field of duty and authority, the slowest of 30 (thirty) days since the Presidential Decree is set.

Section 11
This President ' s decision comes into effect at the set date.
