Weighing: that in the presence of changes in the principal salary of civil servants in effect from 1 January 2007 as referred to in Government Regulation No. 9 of 2007 on the Ninth Amendment to the Government Regulation (GD1). Number 7 of 1977 on the Civil Servant Payroll Ordinance, need to establish a retirement principal and widow/dudanya pension with Government Regulation;

Remembering: 1. Section 5 of the paragraph (2) of the Basic Law of the Republic of Indonesia Year of 1945;
2. Act Number 11 of 1969 on Retirement of Employee and Retirement Widows/Duda Employees (Gazette Of State Of The Republic Of Indonesia In 1969 Number 42, Additional Gazette Of The Republic Of Indonesia Number 2906);
3. Act No. 8 of 1974 on the PoyPokok Keemployers (Sheet State Republic Indonesia Year 1974 Number 55, Additional Leaf Republic Of Indonesia Number 3041), as amended by Law Of 1999 Number 43 (sheet Of State Of The Republic Of Indonesia In 1999 Number 169, Additional Sheet Of The Republic Of Indonesia Indonesia Number 3890);
4. Government Regulation Number 7 of 1977 on the Regulation of the Salary Of Civil Servants (sheet Of State Of The Republic Of Indonesia In 1977 Number 11, Additional Sheet Of State Republic Indonesia Number 3908) As It Has last modified nine times with the Government Regulation 2007 No. 9 (State Gazette of the Republic of Indonesia Year 2007 Number 25);

SET: GOVERNMENT REGULATION ON THE DETERMINATION OF RETIREMENT OF THE RETIRED CIVIL SERVANT OF CIVIL SERVANTS AND THE JANDA/DUDANYA.

Section 1
Retired civil servant and his widow/Dudanya who was retired after the enactment of Government Regulation No. 9 of 2007 on the Ninth Amendment to Government Regulation No. 7 of 1977 on the Civil Servants Salary Ordinance, retired her point is set as follows;
a. For a retired civil servant who results in his retirement calculations as they are in line 2, is set to be as such in the 3 List of I-A to the I-Q List of Appendix I of this Government's Ordinance.
B. For the widow/Duda of the civil servant who results in a calculation of the pension as they are in line 2, it is set to be as such in the 3 II-A List to the II-Q List of Appendix II of this Government Regulation;
(C) For the retirement of the widow/Duda civil servant who was killed whose retirement calculations as such are in line 2, is set to be as such in the 3 III-A list to the III-Q List of Annex III of the Regulation III, the laws of the United States. This government.
D. For the retirement of the civil servants who are killed who are the result of their pension calculations as they are in line 2, are set to be as such in the 3-list IV-A list up to the IV-Q List. Appendix IV of the Rule of this Government.

Section 2
Counting from 1 January 2007:
a. For retired civil servants who were retired on January 1, 2007, and before January 1, 2007, the pension was adjusted as such in a 3-line line with the old principal pension as it was in a 2-2 line. List of V-A up to the V-Q List of Appendix V of this Government Regulation;
B. For the retired civil servant/duda civil servant who was retired on January 1, 2007, and before January 1, 2007, his pension was adjusted as such in a 3-line lajur with the old principal pension as it was in the first. 2 List of VI-A to the VI-Q List of Appendix VI of this Government Regulation;
C. For the retired widow/duda civil servant who was retired on 1 January 2007 and previously, his pension was adjusted as such in the 3-line line with the old principal pension as it was in a 2-2 course. VII-A list up to the VII-Q List of Appendix VII of this Government Regulation;
D. The retirement given to the parents of the civil servants who died on 1 January 2007 and before 1 January 2007, the pension was adjusted as such in the 2 List of VIII-A to the list of VIII-Q Attachment. VIII Regulation of this Government;

Section 3
(1) For Retired Civil Servants, Retired Widows/Duda Civil Servts, retired persons who were accepted to the child, the pension of the widow/child (children) and the pension that was published to parents who were retired before 1 July 2001, After the retirement of the government, this government ordinance turns out to be:
a. not a rise or decline in income, to him given an additional income the amount of his income decrease plus 15% (fifteen percent) of the income; or
B. Earning a yield of less than 15% (fifteen percent) of income, to him was given an additional income so that his income increase to be 15% (fifteen percent).
(2) Earnings as referred to in paragraph (1) are the income received in December 2006, excluding food allowances.
(3) In the event of a family mutation since January 2007, the income as referred to in paragraph (1) is paid by taking into account the income change according to the family mutation.
(4) Additional Income as defined in paragraph (1) in effect from 1 January 2007.

Section 4
The underlying pension adjustment as referred to in Article 2, is set with the Decree of the Head of the State Board of the State as the basis of the pension payment.

Section 5
In addition to the principal pension, to the retired recipient as contemplated in the Regulation the Government is provided for the family allowance and the food allowance applicable to the civil servants in accordance with the provisions of the Laws of the Law.

Section 6
Further provisions of the technical implementation of this Government Regulation are established by the Minister of Finance and/or the Head of the State Governing Body, both jointly and individually according to the field of their respective duties.

Section 7
At the time the Government ' s Ordinance comes into effect:
a. Government Regulation No. 69 of 2005 on the Termination Of The Principal Pension Of Retired Civil Servants and Widows/Dudanya (sheet of State of the Republic of Indonesia Year 2005 Number 154); and
B. Government Regulation No. 18 of 2006 on the Changes to Government Regulation No. 69 of 2005 on the Termination Of The Principal Pension Of Retired Civil Servants and Widows/Dudanya (State Sheet of the Republic of Indonesia Year 2006 Number 38), revoked and It's not valid.

Section 8
This Government Regulation shall come into effect on the date of the promulctest.
