.,, b. that having regard to the ability of the economy, the potential of the area, land area, population and consideration of social aspects of political, social, cultural, defense and security as well as increasing the burden of the task as well as the volume of work in the areas of governance, development, and Sarmi Regency in community and district Waropen, viewed the need to form a District in Mamberamo area of Papua Province;
.,, c. Mamberamo Raya Regency that will hopefully be able to encourage the improvement of services in the areas of governance, development, and community, as well as provide capabilities in harnessing the potential of the region;
.,, d. that based on considerations as referred to in letter a, letter b, letter c, and the need to establish laws on the establishment of a Regency Mamberamo Raya in Papua Province;

CHAPTER I GENERAL PROVISIONS article 1 In this law is the:.,, 1. Central Government, hereinafter referred to as the Government, is the President of the Republic of Indonesia that holds the powers of the Government of the Republic of Indonesia as stipulated in the Constitution of the Republic of Indonesia in 1945.
., ,2. The autonomous region, hereinafter referred to as the area, is the unity of Community law which has territorial boundaries which authorities manage and administer the Affairs of Government and the interests of the local community according to its own initiative on the basis of the aspirations of the community in the system of unitary State of the Republic of Indonesia.
., ,3. Papua Province was a province of West Irian as stipulated in Act No. 12 Year 1969 about the formation of the autonomous province of West Irian and the autonomous province of West Irian (State Gazette of the Republic of Indonesia Number 47 in 1969, an additional Sheet of the Republic of Indonesia Number 2907) jo. Act No. 21 of 2001 on special autonomy for Papua Province (State Gazette of the Republic of Indonesia Number 135 in 2001, an additional Sheet of the Republic of Indonesia Number 4151).

Sarmi Regency is a Regency (kabupaten) as stipulated in Act No. 26 of 2002 on the establishment of Sarmi Regency Keerom Regency South Sorong Regency, Raja Ampat Islands, Mountainous Regency Yahukimo Regency Bintang Regency Tolikara, Waropen Regency, Regency Boven Digoel Regency Kaimana Regency Mappi Regency, Asmat Regency, Regency, and Bintuni Straits Bay Bay Wondama in Papua Province (State Gazette of the Republic of Indonesia Number 129 in 2002, an additional Sheet of the Republic of Indonesia Number 4245) , which is the origin of the Regency Mamberamo Raya Regency.

Waropen Regency is a Regency (kabupaten) as stipulated in Act No. 26 of 2002 on the establishment of Sarmi Regency Keerom Regency South Sorong Regency, Raja Ampat Islands, Mountainous Regency Yahukimo Regency Bintang Regency Tolikara, Waropen Regency, Regency Boven Digoel Regency Kaimana Regency Mappi Regency, Asmat Regency, Regency, and Bintuni Straits Bay Bay Wondama in Papua Province (State Gazette of the Republic of Indonesia Number 129 in 2002, an additional Sheet of the Republic of Indonesia Number 4245).

The second part of article 5 territorial boundaries (1) Regency Mamberamo Raya has territorial boundaries:.,, a. North bordering the Pacific Ocean;

b. East of Sarmi district;., c. South of Puncak Jaya district and Regency Tolikara; and d. West Waropen district and Regency Yapen.
.,, (2) the limits referred to in subsection (1) is described in the map of the region which is part an integral part of this Act.
.,, (3) the scope of the territory referred to in article 3, is depicted in a map of the area, which is a Regency Mamberamo Raya as contained in the annex to this Act.
.,, (4) Limits the scope of the area referred to in subsection (1) and the area contained within the boundaries described in the map of the region, which is the area of the Regency Mamberamo Raya as contained in the annex to this Act and part an integral part of this Act.
.,, (5) the determination of the boundaries of counties Mamberamo Raya with certainty in the field, as referred to in paragraph (1) and paragraph (2) is designated by the Minister of the Interior.
.,, (6) further Provisions regarding the determination of the limits for certain areas in the field referred to in paragraph (3) is controlled by a regulation of the Minister of the Interior.
Section 6.,, (1) with the formation of the Regency Mamberamo Raya as stipulated in article 2, the Government of the Regency Mamberamo Raya sets the Spatial Plan of the area in accordance with legislation.
.,, (2) the determination of the Spatial Plan of the Mamberamo Raya Regency Area referred to in subsection (1) is carried out in accordance with the plan of National Territory Spatial and Spatial Plan of the region of Papua Province as well as paying attention to the Spatial plans of Counties/cities in the vicinity.

g. countermeasures of social issues;

h. the Ministry field of employment;

i. facilitation of development of cooperatives, small and medium enterprises;

j. environmental control;

k. Ministry of land;

b. the Ministry of population, and civil registration;

d. the Ministry of General Administration of Government;

n. administrative capital investment services;

o. Organization of other basic services; and p. other mandatory Affairs mandated by legislation.

.,, (5) if within 1 (one) year as referred to in paragraph (2) has not been elected and not appointed Regent definitive, Minister of internal affairs can lift back the acting Regent for 1 (one) time the next longest term of 1 (one) year or replace it with another acting in accordance with the legislation.
.,, (6) the Governor do coaching, supervision, evaluation and facilitation on performance the acting Regent in carrying out the duties of the Government, the process of charging a member of the House of representatives and the election of the Regent/Vice Regent.
Article 12 for the first time the financing of the implementation of the election of the Regent and Vice Regent of Mamberamo Raya as referred to in article 11 paragraph (1) is charged to the income and Expenditure Budget County Memberamo Kingdom with the financial support of: a. .,, (6) salaries and fringe benefits of civil servants as referred to in paragraph (4) has not been established during the budget revenue and Shopping District Areas Mamberamo Raya charged to income and Expenditure Budget of the origin of a work unit of the personnel concerned in accordance with the legislation.
.,, (7) assets and documents referred to in subsection (1) and paragraph (3), includes the following:.,,.,, a. owned/controlled moves and does not move and/or utilized by the Sarmi Regency Government and/or the Regency Waropen Regency is in the Mamberamo Raya;
.,, b. Area owned enterprises (BUMD) Regency Sarmi Regency Waropen and/or the position, activity, and its location in the Regency Mamberamo Raya;
.,, c. Sarmi Regency debts and/or the Waropen Regency its usefulness for Regency Mamberamo Raya Regency Mamberamo responsibility Kingdom; and, d.., documents and archives which because of its nature required by the Regency Mamberamo Raya.
.,, (8) in the case of submission and transfer of assets as well as the documents referred to in subsection (7) is not implemented by Regent Sarmi and/or Regent Waropen, Papua Governor as the representative of the Government must solve them.
.,, (9) the implementation of the transfer of personnel and assets as well as the submission of the documents referred to in subsection (1), is reported by the Governor of Papua to the Minister of the Interior.
CHAPTER VI income, EQUALIZATION FUNDS, ALLOCATION of GRANTS and ASSISTANCE FUNDS Article 15.,, (1) Regency Mamberamo Raya are entitled to Equalization Fund allocation in accordance with the laws and regulations regarding equalization funds between the Government and the Government of the region.
.,, (2) in fund balances referred to in paragraph (1), the Government allocates funds a special allocation of infrastructure in accordance with government regulations.
Article 16.,, (1) Sarmi Regency Government according kesanggupannya provides grants in the form of money to support the activities of the Organization of the Mamberamo Raya Regency Government amounting to Rp 12.000.000.000 (twelve billion dollars) every year for the last three (3) consecutive years, and the Regency Waropen according kesanggupannya provides grants in the form of money to support the activities of the Organization of the Mamberamo Raya Regency Government of Rp 9.000.000.000 (nine billion dollars) every year for the last three (3) consecutive years.
.,, (2) the Government of Papua Province to provide assistance fund to support the activities of the Organization of the Mamberamo Raya Regency Government amounting to Rp 2.000.000.000,-(two billion dollars) each year for the next three (3) consecutive years.
.,, (3) grants and assistance funds as referred to in paragraph (1) and paragraph (2) was started since the inauguration of the acting Regent Mamberamo Raya.
.,, (4) when the Sarmi Regency Regency Waropen and/or does not meet kesanggupannya in accordance with the grant referred to in subsection (1) the Government of reducing the General Allocation funds acceptance of Sarmi Regency and/or Regency Waropen Regency Government to give to the Mamberamo Raya.
.,, (5) when the Papua Province did not meet the kesanggupannya provide assistance in accordance with the funds referred to in subsection (2) the Government reduced the allocation of public funds from acceptance of Papua Province to be given to the Government of the Regency Mamberamo Raya.
.,, (6) the acting Regent Mamberamo Raya delivered a realization grant referred to in subsection (1) to the Regent Bupati Waropen and Sarmi.

.,, (7) the acting Regent Mamberamo Raya delivered a report on accountability for the realization of the use of the grant and the grant referred to in subsection (1) and paragraph (2) to the Governor of Papua.
