PRESIDENT OF THE REPUBLIC OF INDONESIA,

.,, weighed: a. That to spur the development and progress of the province of Papua in general and Sarmi and Waropen Regency in particular, as well as the growing aspirations of the community, are seen as needing to increase the governance of the government, the implementation of development, and public service in order to accelerate the well-being of the public welfare;
., b. that with regard to the economic capabilities, the potential of the region, the area of the region, the population and the consideration of the social aspects of politics, social culture, defense and security and the increasing burden of duty as well as the volume of work in the field of government, development, and Corrections in Sarmi County and Waropen County, seen needing to form the Greater Mamberamo County in the region of Papua Province;
.,, c. that the formation of the Greater Mamberamo County is expected to be able to encourage increased service in governance, development, and society, as well as provide capability in the utilization of the region ' s potential;
., d. that based on the consideration as referred to in the letter a, the letter b, and the letter c, need to form an Act on the Establishment of the Greater Mamberamo Regency in the Province of Papua;

BAB I
UMUM PROVISIONS

Section 1
In this Act referred to:
., 1. The central government, subsequently called the Government, is the President of the Republic of Indonesia which holds the power of government of the Republic of Indonesia as referred to in the Basic Law of the Republic of Indonesia in 1945.
., 2. An autonomous region, next called the area, is a unity of the legal society that has the boundaries of the region that authorities regulate and take care of the affairs of government and the interests of the local community according to its own initiative based on aspiration People in the State of the Republic of Indonesia system.
., 3. The province of Papua is West Irian Province as referred to in the Law Number 12 of the Year 1969 on the Establishment of the West Irian Autonomous Province and the Kabupaten-Autonomous County of West Irian Province (State of the Republic of Indonesia in 1969) Number 47, Additional Gazette Republic of Indonesia Number 2907) jo. Sarmi County is a county as referred to in Act No. 26 of 2002 on the Establishment of Sarmi County, Keerom County, South Sorong Regency, Raja Ampat Regency, Bintang Mountains, Yahukimo Regency, Tolikara County, Waropen County, Kaimana Regency, Boven Digoel County, Mappi County, Asmat County, Bintuni Bay Regency, and Wondama Bay County in Papua Province (State Of Indonesia 2002 Number 129, Additional) Sheet of State of Indonesia No. 4245), which is a county of origin District Mamberamo Raya.
. .5. Waropen County is a county as referred to in Act No. 26 of 2002 on the Establishment of Sarmi County, Keerom County, South Sorong Regency, Raja Ampat Regency, Bintang Mountain Regency, Yahukimo Regency, Tolikara County, Waropen County, Kaimana Regency, Boven Digoel County, Mappi County, Asmat County, Bintuni Bay Regency, and Wondama Bay County in Papua Province (State Of Indonesia 2002 Number 129, Additional) Sheet of State of Indonesia No. 4245).

BAB II
FORMATION, REGION BOUNDARY,
AND THE CAPITAL

The Kesatu section
The formation of

Section 2
With this Act formed Mamberamo Regency in the region of Papua Province in the State of the Republic of Indonesia.

Section 3
The Greater Mamberamo County is from:
., a., a. Part of Sarmi County, which consists of the area of Central Mamberamo District, Upper Mamberamo District, Rufaer District, East Central Mamberamo District, Lower Mamberamo District; and
., b. Most of the Waropen County, which consists of the areas of the Upper Waropen District, the Benuki District, and the Sawai District.

Section 4
With the creation of the Greater Mamberamo Regency, as referred to in Section 2, Sarmi Regency region is reduced with the area of the Greater Mamberamo Regency as referred to in Article 3 of the letter a and Waropen County is reduced by region The Greater Mamberamo Regency as referred to in Article 3 of the letter b.

The Region limit

Section 5
(1) The Greater Mamberamo regency has the boundaries of the region:

.,, (1) With the creation of the Greater Mamberamo regency as referred to in Section 2, the Government of the Greater Mamberamo Regency establishes the TerritArea Plan of the Region in accordance with the laws.
.,, (2) The Layout Plan Layout of the Greater Mamberamo District as referred to in paragraph (1) is done in accordance with the National Area Plan of the National Area and the Governance Plan of the Papua Provincial Area as well as pay attention to the Tata Room Plan County/City area around it.

The capital of the Greater Mamberamo Regency is located in Burmeso.

LOCAL GOVERNMENT AFFAIRS

Section 8

Section 9
The inauguration of the Greater Mamberamo County and the inauguration of the Great Mamberamo Regent Regency was conducted by the Minister of the Interior on behalf of the slowest President 6 (six) months after the Act was promulded.

Section 10

The Local Government

Section 11
.,, (1) To lead the holding of government in the Greater Mamberamo regency elected and validated by the Regent and Vice Regent, in accordance with the laws, the longest 1 (one) year since the creation of the Greater Mamberamo Regency.

Section 12

PERSONNEL, ASSETS AND DOCUMENTS

Section 14

.,, c. debt receivable of Sarmi County and/or Waropen County whose useness to the Greater Mamberamo County becomes the responsibility of the Greater Mamberamo County; and
., d. documents and archives which are due to its nature required by the Greater Mamberamo County.
.,, (8) In terms of submission and transfer of assets as well as documents as referred to in paragraph (7) not exercised by the Regent Sarmi and/or Regent of the Waropen, the Governor of Papua as vice-government is obliged to complete.
.,, (9) The implementation of the transfer of personnel and the submission of assets as well as documents as referred to in paragraph (1), reported by the Governor of Papua to the Minister of the Interior.

BAB VI
REVENUE, REBALANCING FUND ALLOCATION,
GRANT AND FUND ASSISTANCE

Section 15
.,, (1) The Greater Mamberamo regency is entitled to an allocation of balancing funds in accordance with the laws regarding the balancing funds between the Government and local government.
.,, (2) In the balance funds as referred to in paragraph (1), the Government allocates special allocation funds of the government infrastructure in accordance with the laws.

Section 16
.,, (1) The Government of Sarmi County in accordance with its interference grant money to support the activities of the governance of the Greater Mamberamo Regency by Rp12,000,000,000 (twelve billion rupiah) every year for 3 (three) years In a row, and Waropen County corresponds to a grant of money to support the activities of the government of the Greater Mamberamo Regency of Rp9,000,000,000 (nine billion rupiah) every year for 3 (three) years A row
.,, (2) The Government of Papua Province provides financial assistance to support the activities of hosting the Government of the Greater Mamberamo Regency by Rp2,000,000,000 (two billion rupiah) every year for 3 (three) years in a row.

Section 17
Acting Regent Mamberamo Raya is obliged to do regional financial entrepreneurship in accordance with laws.

BAB VII
COACHING

Section 18
.,, (1) To fectest the holding of local government, Government and Government of Papua conducting coaching and facilitation specifically against the Greater Mamberamo regency within 3 (three) years since its inauguration.
.,, (2) After 5 (five) years since its inauguration, the Government with the Governor of Papua Province conducted an evaluation of the holding of the Government of the Greater Mamberamo Regency.
.,, (3) The results of the evaluation as referred to in paragraph (2) are made the reference of further policy by the Government and the Governor of Papua in accordance with the laws.

BAB VIII
THE TRANSITION PROVISION

Section 19
.,, (1) Before the establishment of the Regional People ' s Representative Council, the Regent Regency of Mamberamo Raya compiled the Bupati Regulation Design on the Budget and Shopping Budget of the Mamberamo County for the next budget year.
(2) The rule of the Regent Ordinance of the Greater Mamberamo as referred to in verse (1) is exercised after it was passed by the Governor of Papua.
.,, (3) the passage of the Greater Mamberamo Ordinance and the Ordinance of the Greater Mamberamo Ordinance as referred to in paragraph (2) are executed in accordance with the laws.

Section 20
.,, (1) Prior to the Greater Mamberamo Regency establishing the Regional Regulation and the Regent Ordinance as the implementation of this Act, all of the Regional Regulations and the Laws of the Sarmi and/or the Remaining Waropen Rules remain in effect and are exercised by Government of Greater Mamberamo Regency.
.,, (2) All of the Sarmi County District Rules and/or Waropen County Regional Regulations, the Rules and Decisions of Sarmi and/or the Rules and Decisions of the Waropen States that are as long as applicable in the Greater Mamberamo regency must be adjusted to This act.

BAB IX
CLOSING PROVISIONS

Section 21
At the time of the enactment of this Act, all provisions in the laws relating to the Greater Mamberamo Regency are adjusted to this Act.

Section 22
The further provisions are required as the implementation of this Act, set in accordance with the laws.

Section 23
This Act goes into effect on the promulgable date.

I. UMUM

.,, the province of Papua, which had an area of ± 309,934.40 km² with the population in 2005 amounted to ± 1. 841,548, consisting of 19 (nineteen) counties and 1 (one) cities, needed to spur an increase in governance in order to maintain the Union of the Republic of Indonesia.
.,, Sarmi County, which has a total area of 35,589 km², with a population in 2005 amounted to 31,383 inhabitants. Waropen County, which has a total area of 16,944 km², with a population in 2005 amounted to 21,503 inhabitants. The district has a potential development to support the increased governance of the government.
.,, with the area and large numbers of such residents above, the implementation of development and service to the public is not yet fully affordable. Such conditions need to be overcome by shortening the reins of government through the formation of new autonomous regions so that the public service can be improved to accelerate the well-being of the public welfare.

.,, based on this, the Government has conducted a deep and thorough study of the viability of regional formation and the conclusion that the Government needs to form a Greater Mamberamo County.
.,, the Establishment of the Greater Mamberamo Regency is the exchange of Sarmi County consisting of 5 (five) districts, namely the Upper Mamberamo District, Central Mamberamo District, East Mamberamo District, Lower Mamberamo District, Rufaer District and Waropen County, which consists of three districts, is the Upper Waropen District, Sawai District and Benuki District. The district of Mamberamo Raya has an area of total area of ± 23.813.91 km² with a population of ± 23,926 in 2006.
