CHAPTER I GENERAL PROVISIONS article 1 In this law is the:.,, 1. Central Government, hereinafter referred to as the Government, is the President of the Republic of Indonesia that holds the powers of the Government of the Republic of Indonesia as stipulated in the Constitution of the Republic of Indonesia in 1945.
., ,2. The autonomous region, hereinafter referred to as the area, is the unity of Community law which has territorial boundaries which authorities manage and administer the Affairs of Government and the interests of the local community according to its own initiative on the basis of the aspirations of the community in the system of unitary State of the Republic of Indonesia.
., ,3. Papua Province was a province of West Irian as stipulated in Act No. 12 Year 1969 about the formation of the autonomous province of West Irian and the autonomous province of West Irian (State Gazette of the Republic of Indonesia Number 47 in 1969, an additional Sheet of the Republic of Indonesia Number 2907) jo. Act No. 21 of 2001 on special autonomy for Papua Province (State Gazette of the Republic of Indonesia Number 135 in 2001, an additional Sheet of the Republic of Indonesia Number 4151).

Puncak Jaya Regency is a Regency (kabupaten) as stipulated in Act No. 45 of 1999 regarding the establishment of Central Irian Jaya Province, West Irian Jaya Province, Regency of Paniai, Mimika regency, a Regency of Puncak Jaya town of Sorong and (State Gazette of the Republic of Indonesia year 1999 Number 173, additional sheets of the Republic of Indonesia Number 3894), which is the origin of the Regency (Kabupaten) of the peak.

.,, (5) if within 1 (one) year as referred to in paragraph (2) has not been elected and not appointed Regent definitive, Minister of internal affairs can lift back the acting Regent for 1 (one) time the next longest term of 1 (one) year or replace it with another acting in accordance with the legislation.
.,, (6) the Governor do coaching, supervision, evaluation, facilitation and performance against the acting Regent in carrying out the duties of the Government, and the election of the Regent/Vice Regent.

Chapter V the PERSONNEL, assets, and documents Article 14.,, (1) the Regent of Puncak Jaya along the acting Regent Peak inventory, organize, and carry out the transfer of personnel, assets, as well as the submission of documents to the County Government.

.,, (6) salaries and fringe benefits of civil servants as referred to in paragraph (4) has not been established during the budget revenue and Expenditure charged on the Peak District area of budget revenues and expenditures from original work unit of the personnel concerned in accordance with the legislation. (7) the assets and documents referred to in subsection (1) and subsection (3) includes:.,,.,, a. owned/controlled moves and does not move and/or utilized by the County Government Summit who are in the Peak District area;
.,, b. County-owned enterprises Puncak Jaya which position, activities, and its location in the Regency of the Summit;
.,, c. debts the Puncak Jaya Regency its usefulness to the Peak District; and d. documents and records required by the County due to its Summit.
.,, (8) if the surrender and transfer of assets as well as the documents referred to in subsection (7) is not implemented by the Regent of Puncak Jaya, Papua Governor as the representative of the Government must solve them.
.,, (9) the implementation of the transfer of personnel as well as the delivery of assets and the documents referred to in subsection (1) is reported by the Governor of Papua to the Minister of the Interior.
CHAPTER VI income, EQUALIZATION FUNDS ALLOCATION, grants, and ASSISTANCE FUNDS Article 15.,, (1) the Peak District are entitled to Equalization Fund allocation in accordance with the legislation.
.,, (2) in fund balances referred to in paragraph (1), the Government allocates funds a special allocation of infrastructure in accordance with government regulations.
Article 16.,, (1) Puncak Jaya Regency Government in accordance with kesanggupannya gives grants in the form of money to support the activities of the Organization of the Summit County Government amounted to Rp 15.000.000.000 RP (fifteen billion dollars) every year for the past two years in a row.
.,, (2) the Government of Papua Province to provide assistance fund to support the activities of the Organization of the Summit County Government amounted to Rp RP 5 billion (five billion dollars) every year for the past two years in a row.
.,, (3) the awarding of the grant referred to in subsection (1) and the grant of aid as referred to in paragraph (2) was started since the inauguration of the acting Regent of the Summit.
.,, (4) when the Puncak Jaya Regency does not meet kesanggupannya grant in accordance with the provisions referred to in subsection (1), the Government reduced the General Allocation funds receipt Puncak Jaya Regency to give to the County Government.
.,, (5) when the Papua Province did not meet the kesanggupannya provide assistance funds in accordance with the provisions referred to in subsection (2), the Government reduced the allocation of funds to public acceptance of Papua Province to give to the County Government.
.,, (6) the acting Regent of the Summit delivered a realization grant referred to in subsection (1) to the Regent of Puncak Jaya.
.,, (7) the acting Regent of the Summit delivered a report of accountability for the realization of the use of the grant and the grant referred to in subsection (1) and paragraph (2) to the Governor of Papua.
Article 17 the acting Regent of the Summit shall be obliged to perform the administering regional finance in accordance with the legislation.

CHAPTER VII CONSTRUCTION of Article 18.,, (1) To streamline the Organization of local governance, the Government and the Government of Papua Province doing coaching and facilitation in particular towards the Peak District within 3 (three) years since it was inaugurated.
.,, (2) to after 7 (seven) years since it was inaugurated, the Government together with the Governor of Papua to evaluate against the holding of the Summit County Government.
.,, (3) the results of the evaluation as referred to in paragraph (2) be used as a reference for further policy by the Government and the Governor of Papua in accordance with legislation.
CHAPTER VIII TRANSITIONAL PROVISIONS article 19.,, (1) Before the formation of the regional people's representative Council, the acting Regent of the peak of drafting the regulations the Regents about the budget income and Expenditure the Peak District for the next fiscal year.

Article 20.,, (1) before the Peak District setting local regulations and rules the Regents as the implementation of this Act, all local regulations and rules of the Regent of Puncak Jaya along does not conflict with this Act remain in force and be implemented by the County Government.
.,, (2) All applicable local Regulations as well as Puncak Jaya Regency and the Regent of Puncak Jaya's decision as long as it applies in the Summit must be adjusted with this legislation.
CHAPTER IX CONCLUDING PROVISIONS Article 21 at the time of the enactment of this Act, all the provisions in the regulations relating to the Peak District has to be adapted to this Act.

Article 22 further Provisions as the implementation of these laws is regulated by legislation.

Article 23 this Act comes into force on the date of promulgation.

Papua Province, which has an area of approximately 309,934.40 km2 with a population in 2005 amounted to approximately 1,841,548 inhabitants consists of 20 (twenty) are regencies and one (1) city, the need to spur an increase in the Organization of the Government in the framework of the unitary State of the Republic of Indonesia reinforces.

The Peak District has an area of whole ± 8,055 km² with a population of approximately 60,294 inhabitants.
.,, With the formation of the Peak District as autonomous region of Papua Province, the Government is obliged to assist and facilitate the establishment of institutional Representatives of the regional and other regions that efficiently and effectively in accordance with needs and capabilities, as well as assist and facilitate the transfer of personnel, transfer of assets and documents for the purpose of organizing local governance in order to improve public services and accelerate the attainment of community welfare in the County of Summit.
