ABOUT FINANCIAL ASSISTANCE FOR THE WORKFORCE

PARTICIPANTS OF THE EXPERIENCED WORKFORCE SOCIAL SECURITY PROGRAM

TERMINATION OF WORK RELATIONSHIP

WITH THE GRACE OF GOD ALMIGHTY LABOR MINISTER AND TRANSMIGRATION

REPUBLIC OF INDONESIA,

DRAW: that to increase the number of benefits and the reach of the service of the financial assistance service for the workforce the participants of the workforce social security program that undergoes the termination of the working relationship, then it needs to fine-tune the provisions of the Minister Work and Transmigration Number PER. 31 /MEN/IX/2006 on Financial Assistance To Workforce Participant Labour Social Security Program Dissening of Employment Relations with the Minister Rule;

Government Regulation No. 14 of 1993 on the implementation of the Social Security Program (the Gazette of the Republic of Indonesia in 1993 No. 20, the addition of the Republic of Indonesia State of Indonesia Number 3520) as it has been changed several times, Last with Government Regulation No. 1 of 2009 (State Gazette of the Republic of Indonesia Year 2009 Number 6, Additional leaf country number 4961);

DECIDED:

SET: THE REGULATION OF THE MINISTER OF LABOR AND THE TRANSMIGRATION OF THE REPUBLIC OF INDONESIA ON FINANCIAL ASSISTANCE FOR THE PARTICIPANT WORKFORCE OF THE WORKFORCE SOCIAL SECURITY PROGRAM THAT IS EXPERIENCING THE SEVERING OF WORK RELATIONSHIPS.

Section 1

The workforce of participants of the workforce social security program undergoes the severing of work is given financial assistance from PT. Jamsostek (Persero).

Section 2

For the benefit of financial assistance as referred to in Article 1 of the workforce social security program must apply and qualify:

a. has been a participant in the social security program at least one year (one) of the year continuously;

b. no Old Day Guarantee; c. Last wage received by a maximum of 20% above the Minimum Upah

The local province in terms of a province is specified Upah Minimum Province; or

d. The last wage received by a maximum of 20% above the Minimum Upah of each district/city in terms of a province does not specify the minimum Upah of the Province; or

e. The last wage that is received at a maximum of 20% above the minimum Upah District/local city in terms of a province sets the minimum Upah of the Province and the Minimum Upah of the Regency/Kota;

f. the existence of a working relationship disconnect from the Industrial Relations Tribunal or the Joint Agreement (PB) that has been registered in the Industrial Relations Court;

g. Never got any financial help from the PT. Jamsostek (Persero).

section 3

(1) the financial assistance request as referred to in Section 1 and Section 2 is submitted by the participant workforce of the workforce social security program to PT. The Jamsostek (Persero) where the concerned workforce is registered in the term 1 (one) year since the labor force acquired the termination of the labor relationship.

(2) The termination of the labor relationship as referred to in paragraph (1) is based on the decision of the Industrial Relations Tribunal or the existence of the Joint Agreement that has been registered in the Industrial Relations Court.

(3) The application for financial assistance as referred to in paragraph (1) becomes expired after beyond the term 1 (one) year since the labor of the concerned obtained the termination of the termination of the work relationship.

Article 4

(1) The financial assistance as referred to in Article 1 is given by Rp. 500,000,-(five hundred thousand rupiah).

(2) Financial assistance as referred to in paragraph (1) must be provided directly to the workforce of the concerned workforce social security program.

(3) Financial assistance as contemplated on verse (1) is given only 1 (one) times during the workforce to be a participant of the workforce social security program.

(4) The severing financial assistance funds are charged on the budget of the Worker Welfare Improvement Fund (DPKP) The PT. Jamsostek (Persero) in accordance with the budget of the year in question.

(5) the implementation of the termination of the severing of labor relations at least 1 (one) months after the request as referred to as Article 3 paragraph (1) is accepted by PT. Jamsostek (Persero).

Section 5

The manner of payment of financial assistance as referred to in Section 4 is further set up with the Decision of the Board of Directors of PT. Jamsostek (Persero).

Article 6

PT. Jamsostek (Persero) is required to report the implementation of the Regulation of this Minister every 6 (six) months to the Minister of Labour and Transmigration.

Article 7

With the Ordinance of this Minister Regulation then the Regulation of the Minister of Labor and Transmigration Number .31/MEN/IX/2006 on Financial Aid for the Workforce Participant of the Social Security Program Participants Who experienced the termination of the Working Relationship was revoked and declared no longer applicable.

Article 8

This Minister Regulation starting to apply since the date is set.
