REGULATIONS MINISTER OF THE REPUBLIC OF INDONESIA

NUMBER 60/M-IND/PER/6/2010 ON

THE SECOND CHANGE TO THE REGULATION OF INDUSTRY MINISTER NUMBER 45/M-IND/5/2009 ON THE STANDARD TREATMENT

NASNATIONAL INDONESIA (SNI) COCOA POWDER COMPULSORY

WITH THE GRACE OF GOD ALMIGHTY

THE MINISTER OF INDUSTRY OF THE REPUBLIC OF INDONESIA,

DRAWS: A. that in order to implement the Indonesian National Standard (SNI) Cocoa Powder is mandatory optimally including the Mixed Cocoa Powder Industry, the need to regulate industrial activity is meant by changing the Regulation of the Ministry of Industry Number 45/M-IND/PER/5/2009 as amended by the Regulation of the Minister of Industry No. 157 /M-IND/Per/11/2009;

b. that based on the consideration of the letter a, it needs to be issued by the Ministry of Industry Regulations;

DECIDED: Establishing: THE MINISTRY OF INDUSTRY RULES ON

THE SECOND CHANGE TO THE REGULATION OF INDUSTRY MINISTER NUMBER 45/M-IND/PER/5/2009 ON THE IMPLEMENTATION OF THE INDONESIAN NATIONAL STANDARD (SNI) COCOA POWDER IS MANDATORY.

Article I Some provisions in Regulation Minister Perindustrian Number 45 /M-IND/PER/5/2009 on the Treatment of Indonesian National Standards (SNI) Cocoa Powder Compulsory as amended by the Regulation of the Minister of Industry Number 45 157/M-IND/PER/11/2009, amended as follows: 1. Changing the provisions of Article 2 to as follows:

Article 2 (1) Memberdo National Standard Indonesia (SNI) 3747:2009 Kakao

powder is mandatory with the Tarif HS number of the Tarif HS 1805.00.00.00.

(2) The mandatory SNI application as referred to in paragraph (1) applies to the product: a. Cocoa powder in packaging and or bulk; b. Mixed powdered cocoa (Blending Kakao powder); and c. The processed cocoa powder was repackaged.

2. Changing the provisions of Article 3 to as follows: Section 3

(1) The Company that produces, imports or mixes (blending) the powder Kakao as referred to in Article 2 is mandatory: a. implement and have SPPT-SNI Kakao powder in accordance with

provisions of SNI Kakao powder; b. grow the SNI Kakao powder mark on each packaging as appropriate

the provisions of the laws. (2) The SNI sign recurrence as referred to in paragraph (1) letter b

against the powder Kakao in bulk form is done by attaching the SPPT-SNI document.

3. Changing the provisions of Article 3A to be as follows: Section 3A

(1) The quality of the powdered Kakao products is repackaged as referred to in Article 2 of the paragraph (2) letter c should be equal to the quality of the Kakao powder products of the manufacturer of Kakao powder.

(2) The management of SNI Kakao powder over quality quality of powdered Kakao products as referred to in paragraph (1) based on audits performed by the Standard Goods Officer of Goods and Services at the Factory (PPSP).

(3) The relation between the manufacturer Kakao powder with the reproducing company Kakao powder as referred to in paragraph (1) is poured in a co-contained cooperation contract that the manufacturer's party and the company's parties The return of the gilt is concerned to guarantee the quality of the products according to the SNI Kakao powder.

5. Adding new provisions between Article 11 and Section 12 to Article 11A which reads as follows:

Section 11A (1) SPPT-SNI Kakao powder which has been published before the Regulation

This minister is enacted in effect is valid with the expiration of the SPPT-SNI Kakao powder concerned.

(2) The issuance of the SPPT-SNI cocoa powder that is in the process after the Regulation of the Minister is enacted, applicable the provisions as referred to in this Minister Regulation.
