ABOUT
STUDY DUTY FOR CIVIL SERVANTS
IN THE MARINE MINISTRY ENVIRONMENT AND FISHERIES

WITH THE GRACE OF THE ALMIGHTY GOD

MINISTER OF MARINE AND FISHERIES REPUBLIC OF INDONESIA,

Weigh: a.   that in the application of employment management oriented towards improving the achievement and professionalism of human resources, it needs to provide the opportunity of study duty for civil servants in the environment of the Ministry of Oceans and Fisheries;
B.   that in the presence of an organizational arrangement followed by changes in duties and functions in the environment of the Ministry of Oceans and Fisheries, it needs to refine the Decision of the Minister of Marine and Fisheries Number KEP.35/MEN/2001 on the Task Guidelines Study for civil servants in the Environment of the Department of Marine and Fisheries;
c. that under consideration as intended in letter a and letter b need to specify the Ordinance of the Minister of the Marine and Fisheries of the Study of the Civil Service in the environment of the Ministry of Oceans and Fisheries;

DECIDED:

Establish: MARINE MINISTER AND FISHERIES REGULATIONS ON THE TASK OF LEARNING FOR CIVIL SERVANTS IN THE MARINE MINISTRY AND FISHERIES ENVIRONMENT.

BAB I
UMUM CONDITIONS
Section 1
In Regulation of the Minister this is referred to:
1. The task of learning is the assignment given by officials authorized to the PNS to continue education to higher levels both in the country and abroad, not at its own expense and leave duty   Everyday as a civil servant.
2. civil servants, later abbreviated as PNS, are civil servants of the Ministry.
3. The study task force is a civil servant in the Ministry environment in the status of getting a study assignment.
4. The leadership of the eselon I work unit is the Secretary General/Director General/Inspector General/Head of the Agency in the Ministry environment.
5. The work of the work unit is the leadership of the eselon II work unit or the Head of the Technical Managing Unit.
6. The Ministry is the Ministry of Oceans and Fisheries.
7. The Minister is the Minister of Oceans and Fisheries.
8. Agency is the Human Resource Development Board of Marine and Fisheries.
9. Secretariat of the work unit eselon I is the Bureau of Personnel, the General Directorate General/Secretariat of the Inspectorate General/Secretariat of the Agency in the environment of the Ministry of Oceans and Fisheries.
10. The educational institution is a college as a place of education play.

Section 2
The learning task grant aims:
a.   meets the needs of a particular skill or competency in order to perform tasks and functions as well as organizational development; and
B.   enhance knowledge, skills, skills, as well as attitude, and professional personality of PNS as an inseparable part in the career development of a civil servant.

Section 3
The scope of this Ministerial Regulation includes:
a.    planning;
B.    Education, programs, and educational timeframe;
C.    requirements;
D.    mechanism;
e.    authority;
f.     rights and obligations; and
G.    extension and cancellation.

BAB II
PLANNING
Section 4
(1) The preparation of a learning task needs plan is intended to meet the needs of improving knowledge, expertise, and skills required as a requirement in carrying out governance and development tasks in the field Marine and fishery.
(2) The plan of a learning task requirement as referred to in paragraph (1), compiled by the Marine and Fisheries Education Center and the secretariat of the eselon work unit I.

Section 5
(1) The plan needs study tasks as referred to in Section 4 of the paragraph (2), are compiled in the annual 5 (five) annual learning task plan, and are detailed in the annual learning task needs plan.
(2) The plan needs study tasks as referred to in paragraph (1) are compiled using Form 1 and contain information about:
a.    work fields/activities that require learning tasks;
B.    the type of skills, ability, and educational qualifications needed;
c. type of educational institution planned;
D.    Planned education programs;
e.    educational timeframe;
f.     The qualification of the prospective task employee is learning; and G.    the source of financing

Section 6
Drafting of the plan needs study tasks each year as referred to in Section 5 of the paragraph (1) adjusted to:
a.   employee needs plan;
B.   budget options available in the year-running Budgeting Implementation (DIPA) List of running years; and/or
c. The opportunity provided by the government and non-governmental agencies as well as the foreign countries to the employees in the Ministry environment.

BAB III
THE GENDER, PROGRAM, AND EDUCATIONAL TIMEFRAME
Section 7
The task of learning is given for higher education in the country and/or abroad.

Section 8
The higher education level in the country as referred to in Section 7 is provided for the program and the longest term as follows:
a.   Diploma program III (D. III), 6 (six) semesters;
B.   Program Diploma IV (D. IV), 8 (eight) semesters;
C.   Bachelor program (S1), 8 (eight) semesters;
D.   Master ' s Program (S2) or equivalent, 4 (four) semesters; and
e.   Doctoral program (S3), 6 (six) semesters.

Section 9
Higher education abroad as referred to in Section 7 is provided for the program and the longest term as follows:
a. Master ' s Program (S2) or equivalent, 4 (four) semesters; and
B. Doctoral program (S3), 6 (six) semesters.

BAB IV
REQUIREMENTS
Section 10
PNS who will follow the study task must meet the requirements as follows:
a.   has the shortest working period of 2 (two) years since being elevated to the PNS;
B.   The lowest level of the Young Replacement (II/a);
C.   (DP3) at least 2 (two) last year with the lowest value of either;
D.   pass the selection/test of the educational institution where the study task is implemented;
e.   not moderate:
1. undergo a leave of absence outside the country ' s dependents;
2. Carry out the task in full outside of its parent instance;
3. apply the objection to the Governing Body or the legal effort (lawsuit) to the court related to the execution of disciplinary punishment;
4. In the process of dropping moderate level disciplinary punishment or severe rates;
5. undergo moderate level disciplinary or severe level of discipline;
6. in the process of criminal proceedings;
7. undergo punishment for committing a criminal offence;
8. Carry out service bond obligations after study tasks; and/or
9. carry out the education and training of the screening.
f.     never:
1. sentenced to severe level of disciplinary punishment;
2. fail in the study task caused by its conduct; and/or
3. cancelled following the study task due to his mistake.
G.   The field of study that will be reached has a relationship or is compatible with the organization's needs;
h.   received approval from the Ministry of State Secretariat for the study of study abroad;
i.    signing a task agreement to learn according to the laws of the laws; and
J.    Physical and spiritual health as well as drug-free according to the doctor's letter in accordance with the applicable provisions.

Section 11
(1) The letter of the learning task agreement referred to in Article 10 of the letter i, it contains among others:
a.   Followed education programs;
B.   Time limit;
c. The rights and obligations of the parties;
D.   The amount of damages that the employee should pay to learn; and
e.   The willingness of family employees to learn to pay for damages.
(2) The learning task agreement was signed by the parties before the decision of the duty of study by authorized officials, by using Form 2.

Section 12
The PNS age limit that will follow the study task, that is:
a.    Diploma program III (D. III), at the highest of 25 years;
B.    Diploma program IV (D. IV), at the highest of 25 years;
C.    Bachelor program (S1), at best 25 years old;
D.    The Master ' s Program (S2) or equivalent, is 37 years tops; and
e.    The Doctoral program (S3), is 40 years tops.

Section 13
(1) The educational institution program for the implementation of study tasks within the country must have the lowest accreditation “B ” of the National Accreditation Board of Higher Education (BAN-PT).
(2) The education institution for the implementation of study tasks abroad must be coordinated with the Ministry of National Education.

BAB V
MECHANISM
Section 14
(1) PNS who will follow the study task must apply to the leadership of the work unit to follow the selection/entry test of the educational institution using Form 3.
(2) The leadership of the work unit based on the request as referred to in paragraph (1), conducting an evaluation is adjusted to the plan of need.
(3) If the evaluation results are referred to in paragraph (2) in accordance with the plan of need, the work unit leadership provides recommendations for following the selection/entrance test of the educational institution.
(4) If the selection/test of the education institution is declared accepted, the PNS in question convees the application of the task of learning to the work unit leadership by using Form 4 and attaching it:
a.    statement letter, created by using Form 5.
B.    statement of statement continuing the education first time, created by using Form 6;
c. photocopy of the decision of appointment as CPNS and PNS which have been legalized;
D.    photocopy letter of appointment of appointment in the rank and/or final post that has been legalized;
e.    Legalized photocopies of the diplomas are legalized;
f.     photocopy of the program accreditation of the National Accreditation Board of Higher Education (BAN-PT) which has been legalized by the program leadership, for the study tasks within the country;
G.    A letter from the Ministry of National Education regarding the accreditation of educational institutions, for overseas study tasks;
h.    photocopies of the letter received or passed the legalized selection of the educational institution;
i.     photocopy DP3 for 2 (two) last year that has been legalized;
J.     The study of the learned task agreement that the PNS has signed in question;
No,    a caption letter made using Form 7, which contains a statement:
1. never been sentenced to any type of disciplinary punishment either moderate level or weight level;
2. Not on leave of absence outside the country ' s dependents;
3. Not to file an objection to the Board of Personnel or the legal effort (lawsuit) to the court related to the execution of disciplinary punishment;
4. Not in the process of dropping moderate or moderate level disciplinary punishment;
5. are not currently undergoing moderate level disciplinary or severe level of discipline;
6. Not in the criminal case process;
7. Not currently serving a penalty for committing a felony; and
8. Not currently carrying out the education and training of the screening.

(5) The request of a learning task as referred to in paragraph (4) that has met the requirements, delivered to the work unit leader eselon I.
(6) The leadership of the eselon I work unit forward the application as referred to in paragraph (5) to the Head of the Agency to be processed further.
(7) The head of the Agency based on the request of a learning task as referred to in paragraph (6) performs the evaluation of the completeness of the
(8) In conducting the evaluation of the completeness of the requirements as referred to in paragraph (7), the Head of the Agency may form a Selection Team involving the secretariat of the work unit eselon I.
(9) If the results of the evaluation as referred to in paragraph (7) for the duty of study in the country correspond to the requirements, the Head of the Agency convees a recommendation to the authorized officials to be specified.
(10) If the results of the evaluation as referred to in paragraph (7) for study duty abroad correspond to the requirements, the Head of the Agency delivered the evaluation results to the Head of the International Cooperation Analysis Center and the Interagency to get The approval of the task of studying abroad from the Ministry of State Secretariat.
(11) If the results of the evaluation as referred to in paragraph (7), do not comply with the requirements, the Head of the Agency convees a rejection accompanied by reason to the PNS concerned through the leadership of the work unit eselon I.
(12) Based on the approval of the study assignment abroad of the Ministry of State Secretariat as referred to in paragraph (10), the International Cooperation and Interagency Cooperation Analysis Center convees the recommendation to the authorized officials for Set.
(13) The request of a study assignment as referred to in paragraph (4) must be submitted before the execution of the study task.

BAB VI
Authorization
Section 15
(1) The Minister is authorized to establish the study duties with the Ministerial Decree.
(2) The assignment of learning tasks as referred to in paragraph (1) in its implementation is conducted by the Secretary General on behalf of the Minister by using Form 8.

BAB VII
RIGHTS AND OBLIGATIONS
Section 16
(1) The study task employee has the right to get:
a.   Study task cost;
B.   rise to the rank;
c. regular pay increase;
D.   assessment in DP3; and
e.   Study duty benefits.
(2) The charge of the study task as referred to in paragraph (1) the letter a consists of:
a.   journey goes home to and from the place of study assignment (for overseas study tasks and study tasks within a different country of educational location with its work unit);
B.   Lesson tools, books or other references;
c. tuition, exams, research, seminar and guided tour studies; and/or
D.   treatment and decent health care are borne.
(3) The improvement of the learning task as referred to in paragraph (1) the letter e is given to the family, number:
a.   100% (one hundred percent) of the net salary of a study duty worker or 100% (one hundred percent) of the highest net salary employee's husband/wife learns duty if both of them get a study assignment;
B.   50% (fifty percent) of the net salary of a bachelor's duty worker or who is married and does not become a breadwinner for his family.

Section 17
The study task employee has an obligation:
a.   Submit your duties and day-to-day responsibilities to a direct supervisor or other appointed official before performing a study assignment;
B.   reported its existence to the representative of the Republic of Indonesia in the country where the task of learning for duty officers is studying abroad;
c. report on the address of the education institution and the residence to the work of the work unit;
D.   report on the progress of the study task each semester to the leadership of the work unit concerned, with the busan to:
1. Agency Head; and
2. Officials are authorized to establish.
e.   Report on the development of the task of learning to the representative of the Republic of Indonesia in the country where the task of learning for duty employees abroad as an official consideration of officials in the granting of DP3;
f.    following an education program that has been established in a learning task decision;
G.   keeping the name of the nation, the agency, and the State of Indonesia;
h.   complete the education program properly and on time;
i.    Comply with all applicable laws and regulations, including the applicable law, and the applicable law.
J.    back to work on its work unit, provided:
1. Minimum of 2 (two) times the study assignment plus 1 (one) year, for those that have completed study assignment abroad;
2. Minimum of 1 (one) times the learnable task of plus 1 (one) year, for which the task has completed the study task in the country; or
3. Minimum of 1 (one) times the domestic study tasks plus 2 (two) times overseas learning tasks plus 1 (one) year, for which has completed the task of learning program double degree.
Report to the leaders of the Eselon I work unit, who is at least 30 days after completing the education program, with the submission of scientific work (scripsych/tesis/dissertation) in the form softcopy and hardcopy, with a busan to:
1. Agency Head;
2. Head of the Bureau of Personnel;
3. Head of the International Cooperation and Interagency Cooperation Analysis Center (for foreign study duty employees); and
4. The leadership of the working unit is concerned.
No,   report to the Ministry of Secretariat of State at least 30 (thirty) days after completing the education program, for study duty officers abroad;
I.    take care of DP3 materials on educational institutions to be sent to the origin agency at any end of December for study duty employees within the country; and
M.  take care of the DP3 material on the local Indonesian representative of the Republic of Indonesia to be sent to the origin agency at every end of December for the staff of the study duty abroad.

BAB VIII
EXTENSION AND CANCELLATION
The Kesatu section
Extension
Section 18
(1) A learning task officer who is unable to complete a learning task in the predefined term may apply for an extension of the learning task term to the work unit leadership using Form 9.
(2) The extension of the learning task extension as referred to in paragraph (1) is delivered the slowest 3 (three) months prior to the expiration of the study term, accompanied by:
a.    A note stating that the delay in performing a study task occurred not at the speed;
B.    recommendations from the educational institution where the task employee learns to carry out a learning task; and
C.    Recommendations for the following:

(7) If the results of the evaluation as referred to in paragraph (6) for the study duties within the country correspond to the requirements, the Head of the Agency conveits the recommendation of an extension to the authorized official to be specified.
(8) If the results of the evaluation as referred to in paragraph (6) for study duty abroad correspond to the requirements, the Head of the Agency delivered the evaluation results to the Head of the International Cooperation Analysis Center and the Interagency to get approval of extension of the study ' s tenure of study abroad from the Ministry of State Secretariat.
(9) If the results of the evaluation as referred to in paragraph (6), do not comply with the requirements, the Head of the Agency convees the rejection accompanied by reason to the study duty officer concerned through the leadership of the eselon work unit I.
(10) Based on the approval of the extension of the study of the study abroad as referred to in paragraph (8), the Head of the International Cooperation Analysis Center and the Interagency delivered a recommendation to the authorized officials to be specified.
(11) Officials authorized under the recommendation as referred to in paragraph (7) and paragraph (10) establish an extension of the longest study term of 1 (one) year by using Form 10.

The Second Part
Cancellation
Section 19
(1) The learning task decision may be cancelled by authorized officials prior to departure to the execution of the study duty or during the following on the study task.
(2) The reason for cancellation of the study task decision:
a.    Later on the day there is evidence of a learning task force not eligible;
B.    Study duty employees are sentenced to moderate level discipline or severe level;
c. The learning task staff does not set out to the place of execution the task of learning as scheduled for the specified schedule;
D.    The study of the task force is applying for the resignation;
e.    The learnable employee does not report the development of her study duties at least one year despite being given a warning;
f.     task staff learn to work outside of the learning task activities;
G.    The learnable employee cannot carry out the task of learning due to an event beyond its capabilities;
h.    The spiritual and spiritual learning task force stated by the health examiner's team that results in learning tasks is not possible to complete a learning task program in accordance with the specified time; and/or
i.     There is interest in the organization or the interests of organizations that require that the task staff continue to perform tasks both in the Ministry's environment and other agencies.
(3) The leadership of the work unit proposes a cancellation of the decision of the task of learning to the head of the eselon I work unit by attaching evidence or the completeness of the supporting data in accordance with the reasons for the problem
(4) The head of the keja eselon unit I forwarded the proposed cancellation of the study task decision as referred to in paragraph (3) to the Head of the Agency to be evaluated.
(5) If the evaluation results are referred to in paragraph (5) in accordance with the reason of cancellation as set forth in paragraph (2), the Head of the Agency convees the cancellation of the study of the decision of the task of learning to the authorized officer to be specified.
(6) Against the application of cancellation of study duty abroad, the recommendation of the cancellation of the learning task decision as referred to in paragraph (5) is exhaled to the Head of the International Cooperation Analysis Center and the Interagency.
(7) If based on the results of the evaluation as referred to in paragraph (5), not in accordance with the reason of cancellation as set forth in paragraph (2), the Head of the Agency conveits the cancellation of the study task is accompanied by the reason for the unit leader Eselon work.
(8) The authorized officer based on the recommendation as referred to in paragraph (5) sets out the cancellation of the study assignment by using Form 11.
(9) Head of the Center for Analysis of International Cooperation and Interagencies delivers the decision of cancellation of the study task as referred to in verse (8) for the study duty abroad, to the Ministry of State Secretariat.

BAB IX
FINANCING
Section 20
(1) The financing of learning tasks is sourced from:
a.   State Shopping Revenue Budget (APBN);
B.   Regional Shopping Revenue Budget (APBD);
C.   Body/yayasan/institutions/private companies/private organizations both in and abroad; and/or
D.   Foreign government aid.
(2) The financing of a learning task derived from the help of a body/foundation/company/private organization both in and out of the country as referred to in paragraph (1) letter c that is not through APBN, first must be an agreement with The head of the Board/Head of the Technical Managing Unit is in accordance with its authority.

BAB X
MONITORING AND EVALUATION
Section 21
(1) The leadership of the work unit performs monitoring and evaluation of the advancement level of academic achievement of the study of the study task force in its working unit environment based on the report received as a staffing coaching material.
(2) The head of the Agency performs monitoring and evaluation of the advancement level of academic achievement of the employee who obtained the study task in the Ministry's environment based on reports received as a planning material and career development.
(3) The monitoring and evaluation results as referred to in paragraph (2) are reported to the official who authorized the study duty officer.

BAB XI
SANCTION
Section 22
(1) The employee of the study who violates the obligations as referred to in Article 17 of the letter b, letter b, letter e, letter h, letter i, letter k, letter l, letter m, and/or letter n are subject to disciplinary punishment according to the rules of the law. It's

(3) Learning task staff who do not report the progress of the shortest learning task every semester as referred to in Article 17 of the letter d are subject to delays granting the allowance of study duties.

BAB XII
LAIN PROVISIONS
Section 23
(1) Foreign study duty employees who follow the preparation of learning tasks in order to improve the capability, may be granted permission to leave the task by the work unit leader.
(2) The permission to leave the task as referred to in paragraph (1) is granted within the term in accordance with the provisions of the institution providing the financing.

BAB XIII
TRANSITION PROVISIONS
Section 24
(1) The employee of the study, who, by the time the Minister's Law has been assigned to the task of learning, is declared to remain in effect until the end of the term of the established study.
(2) The PNS which is in the process of filing a learning task must follow the provisions in this Minister ' s Regulation.

BAB XIV
CLOSING PROVISIONS
Section 25
