Back NEWS REPUBLIC of INDONESIA No. 145, 2011 REGULATIONS the MINISTER of MARINE and FISHERIES of the REPUBLIC of INDONESIA NUMBER PER. 09/DOWNLOAD/2010 ABOUT the TASK of STUDYING for the CIVIL SERVANT at the MINISTRY of FISHERIES and the MARINE ENVIRONMENT with the GRACE of GOD ALMIGHTY the MINISTER of MARINE and FISHERIES of the REPUBLIC of INDONESIA, Considering: a. that it is in the application of staffing management oriented on improving achievement and professionalism of human resources , the need to provide opportunities for learning tasks of civil servant in the Ministry of Fisheries and the marine environment;
b. that the existence of the arrangement of the organization followed by a change of tasks and functions in the environment of the Ministry of maritime and fishery, the need to refine the return Decision the Minister of marine and Fisheries the number KEP. 35/DOWNLOAD/2001 on the guidelines of the task of studying for the civil servant at the Department of Marine and fisheries Environment;
c. that based on considerations as referred to in letter a and letter b needs to set a regulation of the Minister of marine and fisheries on the task of Studying for the civil servant at the Ministry of Fisheries and the marine environment;

Decide: define: REGULATION of the MINISTER of MARINE and FISHERIES on the TASK of STUDYING for the CIVIL SERVANT at the MINISTRY of FISHERIES and the MARINE ENVIRONMENT.

CHAPTER I GENERAL PROVISIONS article 1 In this ministerial regulation is: 1. a learning Task is the assignment given by the competent authority to CIVIL SERVANTS for continuing education to a higher level, both domestically and abroad, not at his own expense and leave the daily duties as CIVIL SERVANTS.
2. Civil servants, hereinafter abbreviated to civil servants, was a civil servant in the Ministry.
3. Employees of the learning tasks are CIVIL SERVANTS in the Ministry of the environment status got the task of learning.
4. The leadership of the work unit echelons I was Secretary-general/Director General/General/Head of Agency at the Ministry of environment.
5. The leadership of the unit of work is the work unit leader Echelon II or the head Unit Technical Implementers.
6. The Ministry is the Ministry of marine and fisheries.
7. the Minister is the Minister of marine and fisheries.
8. The Agency is an agency for human resource development and Maritime Fisheries.
9. The secretariat of the work unit echelons I was Personnel Bureau, the Secretariat of the Directorate General of the Inspectorate-General Secretariat/Secretariat/Environment Agency in the Ministry of marine and fisheries.
10. The institution is the College as a place to tackle education.

Article 2 grant of study aims to: a. meet the needs of power who have expertise or particular competence in the framework of the implementation of the tasks and functions as well as the development of the Organization; and b.  improve the knowledge, abilities, skills, attitudes, and personality traits as well as professional CIVIL SERVANTS as an integral part in the development of a career CIVIL SERVANTS.

Article 3 scope of the Regulations the Minister include: a. the planning;

b. level, program, and a period of education;

c. requirements;

d. mechanisms;

e. authority;

f. rights and obligations; and g.   renewal and cancellation.

PLANNING CHAPTER II article 4 (1) the preparation of a plan of learning task requirements are intended to meet the need for increased knowledge, expertise, and skills required as a requirement in implementing the stewardship of Government and development in the field of marine and fisheries.
(2) the plan of learning task requirements as referred to in paragraph (1), drawn up by the Marine and fisheries Education Centre and the Secretariat of the work units of Echelon I.

Article 5 (1) of the plan of learning task requirements referred to in article 4 paragraph (2), compiled in the plan needs a learning task 5 (five) yearly, and break down into annual learning plan task needs.
(2) the plan of learning task requirements referred to in subsection (1) prepared using Form 1 and contains information on: a. areas of work/activities that require study;

b. types of skills, abilities, and educational qualifications required;

c. type of institution was planned;

d. planned education programs;

e. period of education;

f. qualifications the prospective employee learning tasks; and g.   sources of financing.

Article 6 the preparation of learning task requirements plan each year as stipulated in article 5 clause (1) adapted to: a. the plan needs of employees;

b. budget available in Budget Implementation Checklist (DIPA) current year; and/or c.  the opportunity given by the Government as well as non-governmental agencies and institutions/countries foreign to the employees in the Ministry of environment.

CHAPTER III LEVEL, PROGRAM, and a PERIOD of study article 7 EDUCATION given to higher education level in the domestic and/or overseas.

Article 8 level of higher education in the country as stipulated in article 7 provided for the program and the longest period as follows: a. Program Diploma III (URD.III), 6 (six) of the semester;

b. Program Diploma IV (d. IV), 8 (eight) of the semester;

c. Bachelor (S1), 8 (eight) of the semester;

d. Program master (S2) or equivalent, four (4) semesters; and e.  Doctoral programme (S3), 6 (six) of the semester.

Article 9 level of higher education in foreign countries as mentioned in article 7 provided for the program and the longest period as follows: a. Master Programs (S2) or equivalent, four (4) semesters; and b. the doctoral programme (S3), 6 (six) of the semester.

CHAPTER IV REQUIREMENTS article 10 CIVIL SERVANTS that will follow the learning tasks must meet the following requirements: a. has the shortest work period of 2 (two) years since appointed CIVIL SERVANTS;

b. rank/the least Young Manager (II/a);

c. assessment of the implementation of the work List (DP3) the shortest 2 (two) years with the lowest value of the good;

d. selection/pass the test from the institution of the place of learning tasks are implemented;
e. not are: 1. live on leave outside the country dependent;


2. perform the task in full outside its parent agency;
3. filing an objection to the consideration of the staffing Agency or remedy (the suit) to the court related to the overthrow of punishment discipline;
4. in the process of removal of public punishment discipline level of moderate or severe levels;
5. disciplinary punishment levels moderate or severe levels;
6. in the process of criminal cases;
7. the penalty for committing a criminal offence;
8. carry out the obligation bond after learning tasks; and/or 9.   carry out education and training penjenjangan.
f. never: 1. subject to the kind of punishment the discipline level of weight;

2. fail in the task of learning that is caused by negligence; and/or 3.  cancelled following the study because of his error.
g. areas of study that will be taken to have relationship or in accordance with the needs of the Organization;
h. approval from the Ministry of the Secretariat of State to task for studying abroad;
i. sign the treaty study in accordance with the regulations; and j.   healthy physical and spiritual as well as drug-free, according to a doctor's certificate in accordance with the applicable provisions.

Article 11 (1) of the agreement Letter learning tasks referred to in article 10 of the letter i, contains among others: a. education programme followed;

b. time limits;

c. rights and obligations of the parties;

d. the magnitude of the damages to be paid employees the task of learning; and e.  the willingness of the family to bear the learning task employee compensation.
(2) the task of learning Agreement signed by the parties before the establishment of the learning task decision by the competent authority, using Form 2.

Article 12 Limits the age of CIVIL SERVANTS that will follow the learning tasks, namely: a. Program Diploma III (URD.III), a 25-year high;

b. Program Diploma IV (d. IV), at most 25-year high;

c. Undergraduate Programs, most 25-year high;

d. Program master (S2) or equivalent, most high 37 years; and e.   Doctoral programme (S3), at least 40 years.

Article 13 (1) Program of the institution for the implementation of the tasks of learning in the country should have the lowest accreditation “ B ” from national accreditation agency for higher education (BAN-PT).
(2) educational institutions for the implementation of the tasks of studying abroad should be coordinated with the Ministry of national education.

Chapter V the MECHANISM of article 14 (1) of CIVIL SERVANTS that will follow the learning tasks must apply to the leadership of the work unit for selection/admission test institution using Form 3.
(2) the direction of work units based on a plea referred to in paragraph (1), conduct evaluation tailored to the needs of the plan.
(3) if the results of the evaluation as referred to in paragraph (2) in accordance with the plans, the leadership needs of the work unit gave recommendations for selection/institution admission test.
(4) if the results of the selection/institution admission test is declared admissible, the CIVIL SERVANTS concerned delivered a petition to the leadership of learning tasks work unit using the Form 4 and attach: a. an affidavit, made by using Form 5.

b. affidavit of continuing education, first made by using Form 6;

c. photocopy of decision letter of appointment as CIVIL SERVANTS and CPNS that have legalised;

d. photocopying the decision letter of appointment in rank and/or title that has legalised;

e. a photocopy of a diploma which has been legalised;
f. photocopying the accreditation program of the national accreditation agency for higher education (BAN-PT) which has been legalised by the leadership program, to study in the country;
g. certificate from the Ministry of national education regarding the accreditation of the institution, to the task of studying abroad;
h. photocopying accepted affidavits or pass selection that has legalised institution;
i. a photocopy of DP3 for 2 (two) years that have legalised;
j. Letter learning tasks that have been signed by the CIVIL SERVANTS concerned;
k. affidavits made by using Form 7, which contains the statement: 1. never subject to disciplinary punishment types good level of moderate or severe levels;

2. not be seeking leave of absence beyond a dependent State;
3. not being filed objections to Agency Staffing Considerations or remedy (the suit) to the court related to the overthrow of punishment discipline;
4. There is in process of removal of public punishment discipline level of moderate or severe levels;
5. no disciplinary penalty is undergoing a level of moderate or severe levels;
6. not currently in the process of criminal cases;
7. not being punished for committing a criminal offence; and 8.   not currently implement education and training penjenjangan.
b.   affidavits of healthy physical and spiritual as well as drug-free from government doctors.
(5) the application for the learning tasks as referred to in paragraph (4) that have met the requirements, presented to the leadership of the work units of Echelon I.
(6) work unit Leader Echelon I continued application referred to in subsection (5) to the head of the Agency for further processing.
(7) the head of the agency based on the learning task application as referred to in paragraph (6) to evaluate the completeness of requirements.
(8) in conducting an evaluation of the completeness requirements as referred to in paragraph (7), the head of the Agency may establish selection team involving the secretariat work unit Echelon I.
(9) if the results of the evaluation as referred to in paragraph (7) to study in the country in accordance with the requirements, the head of the Agency to convey recommendations to the competent authority to set.
(10) When the results of the evaluation as referred to in paragraph (7) for the task of studying abroad in accordance with the requirements, the head of the Agency conveyed the results of the evaluation to the head of the Center for international cooperation and Analysis Antarlembaga task approval to study abroad of the Ministry of the Secretariat of State.
(11) When the results of the evaluation as referred to in paragraph (7), does not comply with the requirements, the head of the Agency delivered a rejection reason is accompanied to the CIVIL SERVANTS concerned through the leadership of the work units of Echelon I.
(12) Upon approval of the study abroad of the Ministry of the Secretariat of State as referred to in subsection (10), Center for international cooperation and Analysis Antarlembaga convey recommendations to the competent authority to set.
(13) Application for learning tasks as referred to in paragraph (4) must be filed before the implementation of a task to learn.

CHAPTER VI AUTHORITY of article 15 (1) the Minister is authorized to assign the task of learning with the Minister's decision.
(2) the determination of the study referred to in paragraph (1) in its implementation undertaken by the Secretary General on behalf of the Minister using the Form 8.

CHAPTER VII RIGHTS and OBLIGATIONS of article 16 (1) Employees have the right learning task obtain: a. the cost of learning tasks;

b. promotion;

c. periodic salary increases;

d. assessment in DP3; and e.  study allowances.
(2) the cost of learning tasks as referred to in paragraph (1) letter a consists of: a. return travel to and from the task of learning (for study abroad and study in a different country locations of education with the unit it works);
b. the instrument lessons, books or other references;
c. tuition fees, examinations, research, seminars and study tours are mandatory; and/or d.  treatment and decent health care covered.
(3) study Allowance referred to in subsection (1) the letter e is given to families, totalling: a. 100% (one hundred percent) of the employee's net salary study or 100% (one hundred percent) of the net salary of the highest officials of the task of learning a husband/wife when both got the task of learning;
b. 50% (fifty percent) of the net salary of the employees of the learning task Bachelors or mate and not be the breadwinner for his family.

Article 17 tasks of learning have a duty Officer: a. surrender the everyday duties and responsibilities to the employer directly or other appointed officials before carrying out the task of learning;
b. reported its existence to the representatives of the Republic of Indonesia in countries where the task of learning to employees the task of studying abroad;
c. report the address of the institution and to the leadership of the work unit;
d. report on the development of the learning tasks each semester to the leadership of the work unit concerned, with a copy to: 1. The head of the Agency; and 2.  An authorized officer assign.
e. reported on developments in the implementation of the study to the representatives of the Republic of Indonesia in countries where the task of learning to employees the task of studying abroad as a material consideration in the awarding of the DP3 officials;
f. education program that has been set out in the decision of tasks of study;
g. maintaining the good name of the nation, Indonesia, and State agencies;
h. complete the educational program with good and timely;
i. observe all provisions of the study including the provisions in force in the place of the institution;
j. return to work on the unit it works, provided that: 1. at least 2 (two) times the task of learning plus 1 (one) year, for those who have completed the task of studying abroad;
2. at least one (1) time period of study plus 1 (one) year, for those who have completed the task of learning in the country; or

3. at least one (1) time period of study in the country plus 2 (two) times the task of studying abroad plus 1 (one) year, for those who have completed the task of learning the double degree program.

report to the leadership of the work unit echelons I concerned no later than thirty (30) days after completion of the educational program, accompanied the submission of scientific papers (thesis/theses/dissertations) in the form of softcopy and hardcopy, with copy to: 1. The head of the Agency;

2. The head of the Bureau of Personnel;

3. The head of the Centre for international cooperation and Analysis Antarlembaga (for officers the task of studying abroad); and 4.   The leadership of the work unit concerned.
k. reporting to the Ministry of the State Secretariat at the latest 30 (thirty) days after completion of the education program, for employees the task of studying abroad;
b.   take care of the DP3 materials to the institution to be sent to the original instance on every end of the month of December for officers the task of learning in the country; and m. take care of materials representative of the Republic of Indonesia on the DP3 to delivered to the establishments of origin at the end of each month of December for duty officers studying abroad.

CHAPTER VIII EXTENSION and CANCELLATION is considered Part of the extension of article 18 (1) employees of the learning task could not complete the task learned within the specified time period can apply for an extension of the task of learning to work with the leadership of the unit using the Form 9.
(2) the application for extension of period of study referred to in subsection (1) is submitted at least 3 (three) months before the expiration of the learning task, accompanied by: a. certificate stating that the delay in carrying out the task of learning occurs not over his indifference;

b. recommendations of the institution of the place of learning tasks employees carry out the task of learning; and c.   recommendations/warranty extension financing.
(3) leadership of the work units based on the application for an extension of the period of the assignment referred to in subsection (2) do the evaluation.
(4) if the results of the evaluation as referred to in paragraph (3), in accordance with the requirements, the work units give you a recommendation of approval of the extension.
(5) work unit Leader delivered a petition for extension of duty learning to work unit leader Echelon I accompanied with the requirements referred to in subsection (2) and the recommendation of approval of the extension referred to in paragraph (4).
(6) work unit Leader Echelon I forward the application for extension of period of study referred to in paragraph (5) to the head of the Agency to be evaluated.
(7) if the results of the evaluation as referred to in paragraph (6) to study in the country in accordance with the requirements, the head of the Agency delivered a recommendation of approval to the extension of the competent authority to set.
(8) if the results of the evaluation as referred to in paragraph (6) to task for studying abroad in accordance with the requirements, the head of the Agency conveyed the results of the evaluation to the head of Analysis Center of international cooperation and Antarlembaga to get the approval of the extension of the task of studying abroad of the Ministry of the Secretariat of State.
(9) if the results of the evaluation as referred to in paragraph (6), does not comply with the requirements, the head of the Agency delivered a rejection reason is accompanied to the employees the task of learning concerned through the leadership of the work units of Echelon I.
(10) Upon approval of the extension of the period of study abroad as referred to in paragraph (8), head of the Centre for international cooperation and Analysis Antarlembaga convey recommendations to the competent authority to set.
(11) On the recommendation of the competent authority referred to in subsection (7) and paragraph (10) set an extension of duty learning most of the old one (1) year using the Form 10.

The second part to the cancellation of article 19 (1) decisions of the study may be cancelled by the competent authority before departure to the place of execution of tasks of study or during the learning tasks in the following.
(2) the reasons for the cancellation of the decision task learning: a. in the future there is evidence of employee learning assignments are not eligible;

b. learning tasks employees sentenced to discipline level of moderate or severe levels;

c. officers of the study did not set out to the place of execution of tasks of study specified in the schedule;

d. learning tasks employees apply for resignation;
e. officers of the study did not report the development of their learning tasks most 1 (one) year though has been given a warning;
f. employees study work outside study activities;
g. employee learning task cannot perform the task of learning because of events outside its ability;
h. employee tasks learn unhealthy physical and spiritual is stated by a team of health examiners which resulted in employees learning impossible task of completing the task of learning programmes in accordance with a specified time;  and/or i.    There are the interests of the service or the interests of the organization that requires that employees keep learning tasks execute good surroundings of the Ministry as well as other agencies.
(3) leadership of the work unit proposes annulment of decision of tasks of learning to work unit leader Echelon I attaching evidence or completeness of supporting data in accordance with the reason for its cancellation.
(4) the leadership Echelon serious unit I forward the proposed cancellation of the decision of tasks of study referred to in paragraph (3) to the head of the Agency to be evaluated.
(5) if the results of the evaluation as referred to in subsection (5) in accordance with the reason for cancellation as referred to in paragraph (2), the head of the Agency conveyed the recommendation of revocation of decision of tasks of learning to an authorized officer to set.
(6) the petition Against cancellation of study abroad, cancellation task learning decision recommendation referred to in subsection (5) ditembuskan to the head of the Center for international cooperation and Analysis Antarlembaga.
(7) If on the basis of the results of the evaluation as referred to in paragraph (5), does not comply with the cancellation reason referred to in subsection (2), the head of the Agency delivered a denial reason cancellation study accompanied to work unit leader Echelon I.
(8) the competent authority on the basis of the recommendation referred to in subsection (5) the cancellation of the decision setting the task of learning using the Form 11.
(9) the head of the Centre for international cooperation and Analysis Antarlembaga conveyed the decision of the cancellation of the study referred to in paragraph (8) to task for studying abroad, to the Secretariat of State of the Ministry.

CHAPTER IX FINANCING article 20 (1) the financing of study sourced from: a. Budget Revenues of State Spending (BUDGET);

b. Revenue Budget Shopping area (BUDGETS);

c. Aid Agency/Foundation/Institute/company/private organizations both in and outside the country; and/or d.  Government assistance of foreign countries.
(2) the financing of the task of learning that comes from aid agency/Foundation/Institute/company/private organizations both in and outside the country as referred to in paragraph (2) Letter c through the NATIONAL BUDGET, first there must be an agreement with the head of the Agency's Technical Executing Unit/head in accordance with those powers.

CHAPTER XIII TRANSITIONAL PROVISION of article 24 (1) employees of the learning task at the time of the enactment of this regulation of the Minister has had the task of studying, stated remains valid until the expiry of a period of learning tasks that have been set.
(2) CIVIL SERVANTS that are in the process of filing a learning task must follow the provisions in the regulations of the Minister.

CHAPTER XIV CONCLUDING PROVISIONS


Article 25 with the establishment of this Ministerial Regulation, then the decision of the Minister of marine and Fisheries the number KEP. 35/DOWNLOAD/2001 on the guidelines of the task of studying for the civil servant at the Ministry of maritime and fishery, was revoked and declared inapplicable.

Article 26 this Ministerial Regulation comes into force on the date specified.
