ABOUT

THE BARANG/SERVICE PROCUREMENT SERVICES UNIT

IN THE HEALTH MINISTRY ENVIRONMENT

WITH THE GRACE OF THE ALMIGHTY GOD

THE HEALTH MINISTER OF THE REPUBLIC OF INDONESIA,

DRAWS: that to implement the provisions of Article 14 of the paragraph (1) of the Presidential Regulation No. 54 of 2010 on the Procurement of Government Goods/Services, need to establish the Minister of Health Regulation on the Service Units/Government Services in the Environment Ministry of Health;

Given: 1. Law Number 36 Year 2009 on Health (State Sheet of the Republic of Indonesia Year 2009 Number 144, Additional Gazette Republic of Indonesia 5063);

2. Government Regulation No. 6 of 2006 on Management Of Goods Belonging To The State/Area (sheet Of State Of The Republic Of Indonesia Year 2006 Number 20 Additional Gazette Republic Indonesia Number 4609) as amended by Government Regulation (2006) Number 38 In 2008 (sheet Of State Of The Republic Of Indonesia In 2006 Number 78, Additional Page Of The Republic Of Indonesia 4855);

3. Presidential Decree No. 54 of 2010 on the Acquisition of Government Goods/Services;

4. Health Minister Regulation Number 462/MENKE/PER/IV/2010 on Exporting Goods/Services Electronics in the Ministry of Health Environment;

5. Health Minister Regulation Number 1144 /MENKE/PER/VIII/2010 on the Organization and the Ministry of Health Care;

DECIDED:

SET: THE HEALTH MINISTER ' S REGULATION ON THE BARANG/SERVICE PROCUREMENT SERVICES UNIT IN THE ENVIRONMENT MINISTRY OF HEALTH.

BAB I

provisions of UMUM

Article 1

In Regulation of this Minister referred to:

1. Subsequent Government Goods/Services Procurement/Services are activities to acquire Goods/Services by the Ministry/Other Regional/Institutional Workspace/Institutions whose process is initiated from planning a need Until the completion of all activities to obtain goods/services.

2. Electronically, the LPSE unit is a unit that serves electronically in the Ministry of Health's procurement process.

3. The Procurement Services Unit, which is further abbreviated to the ULP is a unit of government organization that serves to carry out the procurement of goods/services in the Ministry of Health environment.

4. The ULP Main Unit is the ULP responsible for organizing and coordinating the entire procurement of goods performed at the level of Eselon I.

5. ULP Technical Managing Unit (ULP UPT) is a ULP in charge of hosting and coordinating the entire procurement of goods performed at the Technical Managing Unit level.

6. The Regional ULP is the ULP responsible for organizing and coordinating the entire procurement of goods/services undertaken by local government.

7. The users of the Budget, which subsequently shortened to the PA are the Minister of Health.

8. The Power of the Budget User, subsequently abbreviated as KPA, is an official established by the PA to use the State Department of Revenue and the State Shopping Budget or be established by the Regional Head to use the Regional Revenue and Shopping Budget.

9. Officials of Commitment, later abbreviated as PPK, are officials responsible for the implementation of the Goods/Services.

10. Procurement Working Group, which is then called Pokja is a work team consisting of certified personnel of procurement, numbering at least 3 (three) people and acting to carry out the procurement of goods/services in the United States. In the ULP.

11. Procurement officials are personnel who have a Certificate of Granting Goods/Services that are assigned to carry out the procurement of barang/services.

12. The Minister of Health is the minister who organizes government affairs in the health field.

Article 2

The barang/service of the barang/service aims to conduct more integration/integrated, effective and fully integrated goods procurement processes. Efficient, open, competitive, non-discriminatory and accountable.

BAB II

FORMATION AND POSITION

Section 3

(1) In order to carry out the procurement of goods/services created ULP in each of the Major Units or UPT.

(2) The ULP as referred to in paragraph (1) is permanent and nonstructural.

(3) The ULP as referred to in paragraph (1) consists of:

a. Primary Unit ULP; and

b. UPT UPT.

Section 4

(1) The absence of barber/services executed by ULP includes:

a. Hosting/other job constructs with values above Rp 100.000.00 (100 million rupiah); and

b. the implementation of the consultancy services with a value above Rp 50,000.000.00 (fifty million rupiah).

(2) Other constructions/constructions/services with less/equal value of Rp 100.000.00 (one hundred million rupiah), or procurement of consulting services with less/equal value of Rp 50,000.000.00 (fifty million rupiah) It was implemented by the procurement of goods/services to the respective units of work.

Article 5

(1) ULP The Principal Unit for each General Directorate/Agency in each of the Directorate General/Agency Secretariat.

(2) The ULP of the Main Unit for the General Secretariat and the Inspectorate General located in the General Bureau.

(3) ULP UPT can be formed in each of the UPT located in the UPT Secretariat.

Section 6

(1) The formation of the ULP Main Unit and the ULP UPT in each of the Directorate General/Body is established by the Director General/Head of the Agency.

(2) The Establishment of the ULP of the Main Unit in the Secretariat General and the Inspectorate General specified by the Secretary General.

Article 7

(1) The Director General/Head of the Agency in forming the ULP UPT is mandatory to consider:

a. volume, amount of funds, and the procurement type of barang/jasa;

b. lean/quantity of job distribution;

c. availability of human resources in the procurement field;

d. availability of the means and mastery of information technology and communication; and

e. the efficiency and effectiveness of job execution.

(2) The absence of barang/services in UPT that is not formed ULP may be implemented at the ULP Primary Unit or ULP Region.

(3) UPT may submit the implementation of the procurement of goods/services to the ULP Unit Utama/ULP The region if there are limitations to the procurement capabilities of barang/services.

(4) The absence of barang/services in UPT exercised by ULP area must be preceded by a cooperation agreement between the Chief UPT

with Head of the ULP Regional.

(5) The head of the UPT in conducting a cooperation agreement must receive the approval of the Director General/Head of the Agency.

BAB III

THE DUTY AND AUTHORITY OF THE ULP/PROCUREMENT OFFICIALS

Section 8

ULP has a task:

a. Build a new provider's selection plan;

b. analyze and establish the procurement document;

c. announce the implementation of the procurement of goods/services at website Ministry of Health and official announcement board for the public as well as relay to the LPSE to be announced in Portal National procurement;

d. Assessment of the goods/services providers through prequalification or pasciqualification;

e. conducting administrative, technical and pricing evaluations of the incoming offering;

f. replied to the disclaimer of the barang/jasa;

g. submitted a copy of the selection document of the goods provider/services to PPK;

h. archive the original provider's selection/jasa;

i. Make a report on the process and the procurement results to the Secretary General/Director General/Head of the Agency and provide liability for the implementation of the goods/services procurement activities to PA/KPA;

j. conduct consultation to PA/KPA/PPK in order to resolve the issues encountered in the procurement process;

k. proposed HPS changes and job technical specifications to PPK;

l. carry out the dissemination of strategy, policy, standards, systems, and the government goods procurement procedures;

m. carrying out human resource coaching the procurement field; and

n. carry out the procurement of goods/services by utilizing information technology via LPSE (e-procurement).

Article 9

In carrying out ULP duties authorized:

a. establish the procurement document;

b. establish the nominal amount of guarantee of the offering;

c. sets the goods provider/other construx/service job valued at least Rp 100,000.000.00 (one hundred billion rupiah) and the highest valued consulting services Rp 10.000.000.00 (ten billion rupiah);

d. propose the assignment of a winner to the Minister of Health for other construction/service providers/services valued above Rp 100,000.000.00 (100 billion rupiah) and the consultancy services valued above Rp 10,000.000.00 (ten billion rupiah); and

e. propose a provider of goods/services that conduct acts and actions such as fraud/forgery and other offenses, to PA/KPA to be subject to sanctions.

BAB IV

ORGANIZATION

Article 10

(1) The ULP Organization consists of from:

a. ULP head;

b. ULP secretariat; and

c. pokja.

(2) The Secretariat as in the intent of paragraph (1) letter b may consist of:

a. Administrative/administrative/financial/administrative staff;

b. Planning staff; and

c. Legal and sanggah staff.

(3) Pokja as referred to in paragraph (1) the letter c can be shaped as required of any other form of pokja:

a. procurement of goods;

b. procuring construction work;

c. procurement of consulting services; and

d. Other procurement services.

(4) If the pokja may be required to form a sub-pokja whose membership can be taken from several different pokja.

(5) The member of the pokja number is gasal and consists of at least 3 (three) persons and can be augmented by the needs of the job complexity.

Article 11

The ULP head has a task:

a. lead and coordinate the entire ULP activities;

b. oversee all procurement activities of goods/services at ULP;

c. guarantee the security of procurement documents;

d. exercised the tasks PA/KPA;

e. carrying out the development and coaching of the ULP human resources;

f. forming the procurement work group;

g. Make clarification of the results if needed, assisted by the procurement verification team; and

h. take the necessary steps if found any deviation and/or indication of deviation.

Article 12

The Secretariat has a task:

a. carrying out financial affairs management, staffing, tools, equipment, and household;

b. carry out the function of the company;

c. provide and maintain an office tool and infrastructure;

d. setting up supporting documents and information the work group needs;

e. coordinate the conduct of the selection of the goods/services provider executed by the procurement labor group;

f. provide and manage the information systems used in the implementation of barang/jasa;

g. Coordinate and coordinate community complaints;

h. Coordinate and coordinate the disclaiers that are delivered by the barang/jasa;

i. conducting monitoring and evaluation of the implementation of the procurement of goods/services at ULP;

j. Drafting a work program and the ULP budget;

k. setting up a ULP head letter for the proposed issuer of the Goods/Services Provider (SPBJP) Letter by PPK;

l. make periodic reports on the results of the procurement implementation executed by the ULP; and

m. setting up a data center to support the evaluation of related goods/services; specification, HPS;

n. Coordinate with LPSE related to the implementation of electronic goods/services procurement (e-procurement);

o. coordinate expert power in the barang/jasa;

p procurement process. receive and assist in the completion of the complaint; and

q. assist with the resolution of the appeal.

Article 13

The working group has a task:

a. inventorized packages that would be removed/selectin;

b. Compiling and setting up the procurement document, including at least:

1) the selection method

2) document entry method

3) evaluation method

d. announces it openly through website Ministry of Health, the official announcement board for the community and passing to the LPSE to be announced in the national procurement portal;

e. carry out the procurement of goods/services by utilizing information technology through electronic procurement services (e- procurement);

f. received registration;

g. judge the qualifying of the goods/services through prequalification or pasciqualification;

h. doing aanwijzing;

i. receive an income or make an opening of an offer;

j. conduct an evaluation of the incoming offer;

k. announces and establishes a barang/jasa;

l. deliver the result of the performance of the auction/selection to the ULP head;

m. replied to the disclaimer of the goods provider/services if any;

n. propose the assignment of a winner to the Minister of Health for other construction/service providers/services valued above Rp 100,000.000.00 (100 billion rupiah) and the consultancy services valued above Rp 10,000.000.00 (ten billion rupiah); and

o. created a report on the process and the procurement results to the ULP head.

Article 14

(1) In terms of procurement of goods/services is special and/or requires special expertise, the ULP may use a team or technical explanation expert (aanwijzer) team.

(2) The team or the expert power as referred to in paragraph (1) is specified by the Commitment Officer.

BAB V

APPOINTMENT AND DISMISSAL

Section 15

(1) Primary Unit ULP Membership is appointed or terminated by the Secretary General/Director General/Head of the Agency;

(2) The ULP Chief UPT is appointed or dismissed by the Director General/Head of the Board as the UPT chief of the UPT.

Article 16

(1) To be able to be appointed as the Head of the ULP must meet the following requirements:

a. status as a civil servant;

b. minimum bachelor education (S1);

c. have technical and managerial qualifications;

d. have the ability to make decisions;

e. have moral integrity, honest, disciplined and responsible for carrying out tasks;

f. have experience as a barang/barang/procurement committee;

g. understand all types of work being the task of Pokja Pengadaan;

h. has no family relationship with the official who raised it and established it as the head of the ULP; and

i. other terms specified in the employment rule for the equivalent office.

(2) The ULP Secretariat must meet the requirements as follows:

a. status as a civil servant;

b. have moral integrity, honest, disciplined and responsible for carrying out tasks;

c. understand the whole type of work that is the task of Pokja Pengadaan; and

d. Other terms defined in the employment rule for the equivalent position.

(3) Members of the ULP Working Group must meet the following requirements:

a. status as a civil servant;

b. have a government goods/services procurement expertise certificate;

c. has a moral integrity, honest, disciplined and responsibility in carrying out tasks;

d. understand the overall job of the Procurement to be implemented;

e. understand the specific type of work that is the task of Pokja Pengadaan;

f. understand the content of procurement documents/methods and procurement procedures under applicable procurement regulations; and

g. not having a family relationship with the official who raised it and established it as a member of the ULP working group;

Article 17

(1) The ULP member is banned as:

a. LPSE member;

b. PPK;

c. Financial maintainer; and

d. member of the government's internal surveillance apparatus.

(2) Excluded from the provisions referred to in paragraph (1) letter d, for members of the government's internal surveillance apparatus appointed as procurement officials or ULP members.

Article 18

The ULP membership has a 3 (three) year term of duty and may be re-elected during the meeting of the requirements.

Article 19

The ULP member stops or is dismissed if:

a. expires a term as a member;

b. resigned;

c. passed away;

d. unable to perform the task continuously for 3 (three) months due to illness or without clear reason;

e. breaking/abusing tasks; or

f. Convicted of a felony criminal offence threatened with a prison criminal 5 years or more, based on a court ruling that has obtained a fixed legal force.

BAB VI

TATA WORKING RELATIONSHIP ULP

Article 20

Each working unit in the holding of compulsory goods/services is coordinating with the ULP in each of the respective working environments.

Article 21

(1) ULP Unit Utama/ULP UPT is required to coordinate with the LPSE.

(2) ULP Unit Utama/ULP UPT is required to coordinate with the Government's Goods/Services Policy Institute (LKPP).

(3) ULP UPT can coordinate with the ULP Main Unit in its work environment.

BAB VII

FINANCING

Article 22

Financing arising in the implementation of ULP duties in the Ministry of Health's environment, be charged on the DIPA of each eselon II or UPT in accordance with the position of the ULP in question.

Article 23

Civil servants assigned to the ULP as an official or executor are entitled to receive an honorarium that is large in accordance with the The General Cost Standards of the Ministry of Finance.

BAB VIII

TRANSITIONAL provisions

Article 24

(1) ULP The primary unit was mandatory at the latest in 2012.

(2) ULP UPT is mandatory the slowest in 2014.

(3) In terms of ULP not yet formed or yet able to serve the overall requirement of the Procurement as set forth in this Minister's Regulation, the PA/KPA sets out the procurement committee to carry out the procurement of barang/services.

BAB IX

CLOSING provisions

Section 25

At the time the Ministerial Regulation is in effect, the Decree of the Minister of Health Number 246 /Menkes/Per/IV/2010 on the Devolution Authority and Responsibility to the Under-Name of Minister of Health Forming the Ministry of Health ' s Goods/Services procurement services unit revoked and declared not in effect.

Article 26

The Regulation of the Minister goes into effect on the date of the promulcity.
