Back NEWS REPUBLIC of INDONESIA No. 1330, 2012PERATURAN the HEAD of the Agency for meteorology, climatology and Geophysics NUMBER KEP. 13 in 2012 ABOUT COMMITTEE CONDUCT INTERNAL AUDITING APPARATUS of the GOVERNMENT Agency for meteorology, climatology and Geophysics with the GRACE of GOD ALMIGHTY HEAD of Agency for meteorology, climatology and Geophysics, Considering: a. that under article 15 of the regulation the head of Agency for meteorology, climatology and Geophysics Number KEP. 09 in 2012 about the code of ethics of internal auditing of the Government Apparatus at the Environment Agency for meteorology, climatology and Geophysics, and within the framework of the code of ethics enforcement apparatus of internal auditing in the Government Environment Agency for meteorology, climatology, formed committees need to conduct internal auditing the Government apparatus at the Environment Agency for meteorology, climatology and Geophysics;
b. that based on considerations as referred to in letter a, the need to establish Regulations Chief agency for meteorology, climatology and Geophysics Committee of ethics of internal auditing Authorities of the Government Agency for meteorology, climatology and Geophysics Given: 1. 8. The regulations of the Agency Head Number KEP. 09 in 2012 about the code of ethics of internal auditing of the Government Apparatus at the Environment Agency for meteorology, climatology and Geophysics;

Decide: define: HEAD REGULATORY Agency for meteorology, climatology and Geophysics COMMITTEE of ETHICS of INTERNAL AUDITING AUTHORITIES of the GOVERNMENT Agency for meteorology, climatology and geophysics.
CHAPTER I GENERAL PROVISIONS article 1 In this regulation, the definition of: 1. The Agency for meteorology, climatology and Geophysics Agency hereafter referred to, which is a Non Government agencies under the Ministry and is responsible to the President as well as the duty and responsibility in the field of meteorology, climatology, and geophysics.
2. Internal auditing Government Apparatus which further shortened APIP is Auditors and civil servants/officials who are tasked by the Agency's Inspectors to carry out supervision and monitoring follow-ups.
3. Code of conduct APIP agency hereinafter referred to as the code of ethics is the cornerstone, guidelines, and guidance for APIP in Environment Agency in think, behave, behave and act in the exercise of the duties, authorities and responsibilities both in person or organization.
4. the Committee of ethics of APIP agency hereinafter referred to as the Committee of ethics officials at the Environmental Agency is designated and appointed on the basis of the decision of the head of the Agency with the task of monitoring the implementation, examine the matter of violations, whether or not there is a set code of ethics Violations, and provide recommendations to the competent authority.

CHAPTER II ESTABLISHMENT and COMPOSITION of the MEMBERSHIP of the COMMITTEE of ETHICS of article 2 (1) of the Committee of ethics to perform tasks independently.

Article 4 in the event of an alleged violation of the code of conduct is carried out by the inspectors, then the Inspectors are not included in the inspection over alleged violation of the code of conduct in question.

CHAPTER III tasks, functions, AUTHORITY, and OBLIGATION of ETHICS COMMITTEE article 5 (1) of the Committee of ethics has the task of enforcing the code of conduct.
(2) in carrying out the tasks referred to in paragraph (1), the Committee of ethics has the following functions: a. monitor the implementation of the code of ethics;

b. checks over the dugaaan breach the code of conduct; and c. establish the presence or absence of violation of the code of conduct.

Article 6 in carrying out the functions referred to in article 5 paragraph (2), the Committee of ethics is authorized: a. call and request information and/or requesting data to: 1. the rapporteur;
2. Parties reported; and/or 3. the witnesses.
b. provide recommendations to the head of the Agency regarding the overthrow and the types of sanctions that can be imposed upon those who violate the code of conduct, in accordance with the legislation.

Article 7 (1) the requested Party information and/or data referred to in the article 6 letter a compulsory, provides information and/or data requested by the Committee of ethics.
(2) in the event that the complainant did not provide information and/or data requested by the Committee of Ethics referred to in subsection (1), then the report is considered fall and not acted upon.
(3) in the event that reportedly do not provide information and/or data requested by the Committee of Ethics referred to in subsection (1), then the report is deemed correct and followed up in accordance with the regulations of the Agency Head.

Article 8 in the exercise of the duties, functions, and powers of the Committee of ethics, obliged to: a. Sphinx: 1) identity of the complainant, the party that was reported, and a witness to anyone; and 2) information obtained because of his position as the Committee of ethics.
b. resigned from the inspection over alleged violation of the code of conduct when there is a conflict of interest that may compromise the objectivity of the inspection.

CHAPTER IV PROCEDURES for the EXAMINATION of VIOLATIONS of the CODE of CONDUCT Section I Report violations of the code of conduct article 9 (1) of the Committee of Ethics Violation report existing of accepting the code of conduct of: a. the APIP leadership; and b. the parties concerned or feel wronged.

b. other employees in the Environment Agency; or c. the community.
(3) the report referred to in subsection (1) must elaborate on: a. the identity of the complainant and the parties were reported; and b. chronological breach of code of ethics.
(4) a report referred to in subsection (1) is confidential.

Article 10 the Committee of conduct mandatory checks over reports of alleged violation of the code of conduct referred to in article 9 at least 10 (ten) working days since the receipt of the report.

The second part of the inspection Over alleged violation of the code of conduct article 11 (1) of the Committee of conduct set examination of alleged violations of the code of conduct.
(2) the Ethics Committee delivered a summons to the rapporteur as well as those who reported to follow a code of conduct examination.

(4) in the case of parties who are reportedly not present at the time of examination, the Committee postponed the examination of ethics and set the time of the next inspection.
(5) the Ethics Committee delivered a second summons to the parties who were absent to attend the next examination.
(6) the second summons referred to in subsection (5) must be received by the concerned no later than 3 (three) working days before the examination.
(7) the Format of the summons to the rapporteur as referred to in paragraph (3) and subsection (4) is made in accordance with the example A as contained in the annex to the regulation of the Agency Head.
(8) the receipt of the summons referred to in subsection (3) and paragraph (6) as intended is evidenced by the sign of the acceptance of the call letters organized in the Format token of receipt of Summons as listed in the example A Regulatory Agency Head Attachment.

Article 12 (1) the inspection over alleged violation of the code of conduct is carried out in closed.
(2) the examination of the complainant parties and parties who reportedly carried out in a different time.
(3) the examination referred to in subsection (1) is done in the position of the Committee of ethics.

Article 13

(1) the party reportedly obliged to present in the examination of the code of ethics and can not be represented or accompanied by other parties.
(2) the party reportedly has the right to conduct self-defense.
(3) in self-defence as referred to in paragraph (2), the party that reportedly has the right to ask a witness and/or other evidence.

Article 14 in the case of the second call letters referred to in article 11 paragraph (6) was submitted to the parties that reported and remain absent for no reason should be reasonable, the Committee of ethics and can perform the examination without the presence of the concerned.

Article 15 (1) in conducting the inspection, the Chairman of the Committee of ethics obligated: a. lead the examination of violations of the code;
b. explain the reason and purpose of the inspection; and c. coordinate Ethics Committee members to ask questions to the rapporteur, the parties that reported, or witnesses.
(2) in conducting the inspection, the members of the Committee of ethics can be: a. ask questions to the rapporteur, the parties that reported, and/or witness for the purpose of inspection over alleged violation of the code of conduct; or b. submits suggestions to the Chairman of the Ethics Committee.

Article 16 (1) the results of the checks poured in a news Event inspection results signed by the parties, the Rapporteur reported, or witnesses and Committee members Conduct the checks.
(2) the Format of News Events Results Examination referred to in subsection (1) is made in accordance with Example B as contained in the annex to the regulation of the Agency Head.

Chapter V the VERDICT and the EXECUTION of the RULING of article 17 (1) of the Committee of ethics take the verdict over the breach of a code of conduct based on the results of the inspection.
(2) the taking of the verdict as mentioned in subsection (1) must be attended by at least three (3) members of the Committee of ethics.
(3) the taking of the verdict is carried out by a deliberation.
(4) in terms of the taking of the verdict not reached consensus, then the verdict was taken based on most votes.

Article 18 (1) the award shall include: a. a party reportedly stated that violate the code of conduct; or b. declare that party reported does not violate the code of conduct.
(2) the ruling referred to in paragraph (1) a letter was delivered to the head of the Agency.
(3) the ruling referred to in paragraph (1) is final.

Article 19 (1) the ruling referred to in Article 18 read out the verdict of the Committee of ethics in the meeting which was attended by the Party reported.
(2) the Committee of ethics specifies the time of the meeting of the Committee of ethics Verdict.
(3) the Ethics Committee delivered a summons to the Parties reported to follow a meeting of the Ruling will be read out the verdict.
(4) the first call Letter must be received by the party are reportedly at least 3 (three) working days before the meeting of the ruling was implemented.
(5) in the case of parties who are reportedly not present at the meeting of the Ethics Committee of the verdict, delaying the Verdict and set a meeting time meeting the next Verdict.
(6) the Ethics Committee delivered a letter to the second call reported to attend the next meeting of the Committee of ethics Verdict.
(7) the second summons referred to in subsection (6) must be received by the concerned no later than 1 (one) working day before the meeting of the ruling Committee of ethics.
(8) If a party does not attend the meeting reported the verdict the next, then the verdict was read without the presence of the Parties reported.

Article 20 (1) Ruling as referred to in article 18 paragraph (1) was signed by all the members of the Committee of ethics.
(2) the ruling referred to in paragraph (1) is submitted to the head of the Agency.
(3) the Format of the verdict as mentioned in subsection (1) made to Example C as listed in the annex to the regulation of the Agency Head.

Article 21 in the event the verdict stated that the reported party violate the code of conduct, then the head of the Agency dropped the appropriate sanctions legislation.

Article 22 of the Environmental Inspectorate in Structural Officials noted the ruling of the Committee of conduct referred to in Article 21 in violation of discipline and the employee continues to work unit responsible in the field of employment.

CHAPTER VI CLOSING PROVISIONS Article 23 Regulation Head the Agency took effect on the date set.
