ASSIGNMENT TO PT INDONESIAN PORT II (PERSERO) FOR
BUILD AND OPERATE THE NEW KALIC TERMINAL
TANJUNG PRIOK PORT
WITH THE GRACE OF THE ALMIGHTY GOD
PRESIDENT OF THE REPUBLIC OF INDONESIA,
Weigh: a. That the capacity of Tanjung Priok Port is judged to be no longer able to accommodate the growth of the flow of goods, so that it may lead to a congestibility that can cause disruption to the national economy due to the lateness of the flow of goods;
B. that in order to prevent the agility of the current flow of goods as referred to in the letter a, the construction of the new Terminal Kalibaru which is an inseparable part of Tanjung Priok Port is urged to be implemented;
c. that to accelerate the construction of the new Terminal KaliAS in question b, necessary acceleration efforts as well as strategic measures through the assignment to PT Port Indonesia II (Persero) to build and operate New Kaliterminal at Tanjung Priok Port;
D. that under consideration as the letter a, the letter b, and the letter c, need to establish the Presidential Regulation on the Assignment To PT Port Indonesia II (Persero) To Construct And Operate The New Terminal of Tanjung Port. Priok;
Remembering: 1. Article 4 of the paragraph (1) of the Basic Law of the Republic of Indonesia in 1945;
2. Act No. 19 of 2003 on the State Governing Body (Indonesian Republic of Indonesia Year 2003 Number 70, Additional Gazette of the Republic of Indonesia Number 4297);
3. Undang–Invite Number 17 Year 2008 On The Voyage (sheet Of State Of The Republic Of Indonesia 2008 Number 64, Additional Gazette Of The Republic Of Indonesia Number 4849);
4. Government Regulation No. 61 Year 2009 on Kepelabuhanan (leaf of State of the Republic of Indonesia Year 2009 Number 151, Additional Gazette of the Republic of Indonesia Number 5070);
DECIDED:
SET: THE PRESIDENT ' S REGULATION ON THE ASSIGNMENT TO PT PORT INDONESIA II (PERSERO) TO BUILD AND OPERATE THE TERMINAL OF THE NEW PORT PORT OF TANJUNG PRIOK.
Section 1
(1) The Government assigned to PT Port Indonesia II (Persero) to build and operate the new Kaliport Port of Tanjung Priok.
(2) The scope of construction and operation and construction of the construction of the new Terminal of the Port of Tanjung Priok as referred to in verse (1), are established by the Minister of Transportation.
(3) The assignment of the construction and operation of the new Terminal of Tanjung Priok Port as referred to in paragraph (2), consists of a principal facility and a support facility in accordance with the laws.
(4) The implementation of the construction and operation of the new Terminal of Tanjung Priok Port as referred to in paragraph (1) is implemented in accordance with the provisions of the laws, the Priok Tanjung Port Master Plan, and the technical design By the Minister of Transportation.
Section 2
(1) In order for the implementation of the assignment as referred to in Article 1, PT Port Indonesia II (Persero) compiled the Construction Plan and Operations of the new KaliTanjung Port Priok Port which includes:
a. technical document;
B. financial document; and
c. legal documents.
(2) The construction plan and operation of the Terminal Kalibaru Port of Tanjung Priok as referred to in paragraph (1), delivered to the Minister of Transportation in the longest time of 1 (one) months since the Presidential Regulation is in effect, for Got approval.
Section 3
In the execution of the assignment as referred to in Article 1, PT Port Indonesia II (Persero) can partner with other business bodies by following good business rules.
Section 4
The funding of the construction and operation of the new Terminal of Tanjung Priok Port as referred to in Article 1 and the required land procurement costs, sourced and ushered by PT Port Indonesia II (Persero) in accordance with the provisions The laws and regulations are not sourced from the State Shopping Revenue Budget.
Section 5
(1) PT Port Indonesia II (Persero) gradually completed the construction and began operating the new Terminal Kalibaru Tanjung Priok as referred to in Article 1 in 2014.
(2) If PT Port Indonesia II (Persero) is unable to complete the implementation of the construction and operation of the Terminal Priok Port's new terminal as referred to in verse (1), it is conducted evaluation by the Minister of Transportation.
(3) Based on the results of the evaluation as referred to in paragraph (2), the completion of the completion steps of the construction and operation of the new Terminal of Tanjung Priok Port as referred to in paragraph (1) is based on the results of the meeting The coordination is led by the Coordinating Minister for Economic Affairs.
Section 6
In order for the implementation of the assignment as referred to in Article 1, the Minister of State's Governing Bodies conducts the coaching and supervision of the holding of PT Port Indonesia II (Persero).
Section 7
(1) In order for the execution of the assignment as referred to in Article 1 of the Minister of Transportation:
a. establish the scope of construction and operation as well as the construction of the Terminal Priok Port Kalibaru Terminal;
B. establish the construction permit and the operation permit of the Port of Tanjung Priok Port;
c. perform coaching, and oversight of the technical development and operation of the new KaliTanjung Port Priok Port; and
D. establish the granting of concessions or other forms of the Tanjung Priok Port Authority to PT Port Indonesia II (Persero).
(2) The consent of the permit and any other concession or form as referred to in paragraph (1) is held at least 1 (1) months after the receipt of the entire document which is required under the laws.
Section 8
PT Port Indonesia II (Persero) in order of assignment as referred to in Article 1, deliver the report periodically every 3 (three) months to the Minister of State-owned Enterprises and the Minister of Transportation.
Section 9
This President ' s regulation starts to apply to the date of the promulctest.
