The Election Of The Members Of The LPSK. Selection. The Committee. The Ordinance.

REGULATIONS of the INSTITUTION of WITNESS PROTECTION and VICTIM number 1 2013 ABOUT the MAKEUP of the SELECTION COMMITTEE, the procedures for the IMPLEMENTATION of the selection, and the SELECTION of CANDIDATES for MEMBERS of the INSTITUTION of WITNESS PROTECTION and VICTIMS with the GRACE of GOD ALMIGHTY the CHAIRMAN of WITNESS PROTECTION and VICTIM INSTITUTION, Considering: that in order to implement the provisions of article 10 paragraph (8) Presidential Regulation number 30 in 2009 about the appointment and dismissal of members of the institution of witness protection and victims need specify the regulatory institutions of the witness protection and victims about the makeup of the selection Committee Implementation, the procedures for the selection and election of the members of the Agency members of the witness protection and victims;
Remember: 1. Act No. 13 of 2006 on the protection of witnesses and Victims (State Gazette of the Republic of Indonesia year 2006 Number 64, Supplement State Gazette Indonesia 4635);
2. Presidential Regulation number 30 in 2009 about the procedures for the appointment and dismissal of members of the institution of witness protection and victims;
Decide: define: REGULATION of the INSTITUTION of WITNESS PROTECTION and VICTIMS ABOUT the MAKEUP of the SELECTION COMMITTEE, the procedures for the IMPLEMENTATION of the selection, and the SELECTION of CANDIDATES for MEMBERS of the INSTITUTION of WITNESS PROTECTION and victim.
CHAPTER I GENERAL PROVISIONS article 1 In this regulation, the definition of: 1. The victims and Witnesses Protection Agency hereinafter abbreviated LPSK is the institution in charge and authorized to provide protection and other rights to Witnesses and/or Victims as provided for in Act No. 13 of 2006 on the protection of witnesses and victims. 2. The selection Committee is a Committee that is in charge of conducting the selection and election of the members of the LPSK.

3. Prospective Member is someone who signed up to follow the selection process a candidate Member of the LPSK.
4. The secretariat of the selection Committee is implementing elements in the administrative and financial affairs as well as support for other interests and smooth execution of duties of the selection Committee. 5. The day is a working day.

CHAPTER II COMPOSITION of the SELECTION COMMITTEE of article 2 (1) the implementation of the selection of candidates is done by members of the selection Committee.
(2) the selection Committee referred to in subsection (1) consists of 5 (five) members, in the order as follows: a. 2 (two) members come from elements of the Government; and b. 3 (three) members come from elements of the community. (3) the selection Committee composed of a Chairman and four (4) members.

(4) in carrying out its duties the selection Committee is assisted by a secretariat.

(5) the establishment and composition of the membership of the selection Committee established by the decision of the Chairman of the LPSK.

(6) Selection Committee Secretariat responsible to the selection Committee.

Article 3 (1) the selection Committee selects candidates LPSK members in accordance with the duties and selection stages based on this rule.
(2) prospective members of the LPSK is derived from elements of the professionals who have experience in the field of promotion, fulfillment, protection, rule of law and human rights, Police, Prosecutor's Office, Ministry of law and Human Rights Advocates, academics, or nongovernmental organizations.
(3) the selection and election of members of the LPSK is based on qualifications, skills, professionalism and high moral integrity and meets the following requirements: a. citizen of Indonesia;

b. healthy physical and spiritual;
c. never criminal sentenced for committing a crime a crime threat the shortest pidananya 5 (five) years; d. the lowest age of 40 years (four) and most high 65 (sixty-five) years at the time of the election;

e. the lowest Degree educated or holders;

f. experienced in the field of law and human rights the shortest 10 (ten) years;

g. has the integrity and personality which is not reprehensible; and h.  has the number of principal taxpayers.
Article 4 (1) the selection Committee is in charge of: a. draw up a plan of work and the selection procedures;

b. acceptance and registration of prospective members;

c. announced to the members of the community to get feedback;

d. selecting and specifying the names of the Candidates elected members in each stage;
e. delivering 21 (twenty one) the names of the members who have been assigned to the Chairman of the LPSK to be forwarded to the President; and f.   report on the implementation of its duties to the Chairman of the LPSK.
(2) in carrying out its work, the members of the selection Committee are independent and free from the influence of anyone from anywhere as well as upholding the principles of professionalism, transparency, accountability, and participatory.
Article 5 the selection Committee carrying out the stages of selection as follows: a. announcement;

b. registration and submission of papers;

c. Administrative selection;

d. qualifying expertise;

e. acceptance of community feedback at each stage;

f. paper writing;

g. assessment of the profile of candidates for members;

h. search track record;

i. implementation of the interview; and j.  delivery officially 21 (twenty one) the names of the Candidates elected members to the Chairman to be forwarded to the President of the LPSK and report the implementation of tasks to the Chairman of the LPSK.
Article 6 (1) in carrying out its duties the selection Committee do the stages referred to in article 5.

(2) the selection Committee in carrying out its duties are performed collectively.

Article 7 (1) to perform the tasks referred to in article 6, the Chairman of the selection Committee led the each stage of selection.
(2) the Chairman of the selection Committee as referred to in subsection (1) is in charge of: a. lead the selection Committee;

b. publish the Decree on behalf of the selection Committee based on the results of the meeting of the selection Committee;

c. coordinate the execution of the duties of the selection Committee and oversight;

d. acting as a spokesman for selection Committee; and e. carry out other duties specified and agreed upon in the meeting of the selection Committee.
Article 8 (1) in carrying out its task, the selection Committee is assisted by a secretariat.
(2) the Secretariat of the selection Committee is in charge of: a. perceived secretarial administrative tasks;

b. do the technical and substantive pembantuan against the execution of the duties of the selection Committee; and c. other duties specified and agreed upon in the meeting of the selection Committee.
CHAPTER III IMPLEMENTATION of SELECTION PROCEDURES and the SELECTION of CANDIDATES for MEMBERS of Section 9 (1) in carrying out the duties of the announcement referred to in article 5, the selection Committee a set of at least 2 (two) national print media and three (3) national electronic media.
(2) in carrying out the task of registration referred to in article 5 of the letter b, the selection Committee: a. prepare an announcement for posted at media referred to in subsection (1);
b. in addition, the selection Committee announced also do networking Candidates eligible in accordance with these regulations; c. set the conditions that must be met by the members;

d. publish forms that must be filled out by Prospective members;

e. assign the title of the paper should be submitted at the time of registration;

f. receiving registration file of Prospective members; and g.  other tasks set out in the meeting of the selection Committee the selection Committee.
(3) in carrying out the task of selection is administratf referred to in article 5 of the letter c, the selection Committee: a. check the completeness of the data and administrative terms;

b. reviewing data and information in the registration file of prospective members;

c. studying and assessing working paper;

d. specify the members that pass administrative selection; and e. Announces prospective members who graduated administrative selection.
(4) in carrying out the task of qualifying the skills referred to in Article 5 and the letter d, the selection Committee: a. elucidate the life of aspiring members; and b. examines the experiences of the members in the field of law and human rights.
(5) in exercising the duties to obtain community feedback at each stage as referred to in article 5 of the letter e, the selection Committee accommodating and discuss inputs community.
(6) in carrying out the task of review and assessment of the writing paper as stipulated in article 5 of the letter f, the selection Committee: a. prepare a term paper title;

b. read and evaluate papers of prospective members; and c. set the Candidate members who pass the selection paper writing.
(7) in carrying out the task of scoring Candidates Member profile search and track record as stipulated in article 5 of the letters g and h, the selection Committee: a. preparing prospective members profile assessment criteria and search track record;

b. receiving reports and input regarding the profile of the members of the search and track record;

c. reviewing the assessment and report against the profile of the members of the search and track record; and d. using the results of the assessment of prospective members profile search and track record as a consideration in the selection process.
(8) in carrying out the duties of the interview referred to in article 5 of the letter i, the selection Committee: a. assign material interviews Prospective members;

b. conduct interviews;

c. assign the name of the Candidate members who pass the selection interview; and (9) in carrying out the task of delivery officially 21 (twenty one) name of Candidate Members to the Chairman of the LPSK, as stipulated in article 5 j, the selection Committee: a. set 21 (twenty one) name of Candidate members who pass the selection;

b. announced 21 (twenty one) name of Candidate members who pass the selection;
c. prepare a letter to the Chairman of the LPSK file and all completeness of 21 (twenty one) Members who pass; and d.  deliver reports throughout the Organization of the activities to the Chair of the LPSK.
Article 10 in terms of doing networking as referred to in article 9 paragraph (2), the selection Committee:


a. conduct socialization; and b. appealed to residents or community leaders who meet the requirements to sign up and follow the selection of prospective members.
Article 11 in the event required, the selection Committee can ask for the members to get a recommendation from someone who is competent in the field of Justice and human rights, both academics as well as practitioners.

Article 12 selection Committee announced the acceptance of the registration of prospective members for a period of not longer than 40 (forty) working days counted since the formation of the selection Committee.

Article 13 the acceptance of registration of a candidate Member implemented 14 (fourteen) days counted since the announcement was made.

Article 14 administrative Selection, selection, selection and skill qualification integrity exercised in writing within 45 (forty five) days as of the expiration date of the registration acceptance since its prospective members.

Article 15 (1) during the selection process referred to in article 12, article 13, and article 14 of the public can give a response to the prospective Member submitted to the selection Committee, either by mail, email, or facsimile by calling its identity.
(2) upon the written request of the concerned, the selection Committee is obligated to ensure the confidentiality of identity referred to in subsection (1).
CHAPTER IV article 16 FINANCING all the costs necessary for the implementation of the duties of the selection Committee in this regulation be imposed on the budget of the State Expenditures and Revenues through Budget and other sources the LPSK is not binding in accordance with the legislation.

Chapter V miscellaneous PROVISIONS article 17 in respect of the registration period of candidates for members as referred to in article 13 have not been deemed sufficient, then the registration period can be extended for 14 (fourteen) days.

Article 18 (1) in the event that a member of the selection Committee died, stopped at the request of its own, physical or spiritual pain that resulted in the Pansel task cannot start, the selection Committee may soon propose members of the selection Committee the successor to Chairman of the LPSK with attention to the composition of the corresponding provision of this regulation.
(2) the proposed name of the substitute members of the selection Committee as referred to in paragraph (1), presented the selection Committee to the Chairman of the LPSK no later than three (3) days after the meeting of the selection Committee.

Chapter V CLOSING PROVISIONS article 20 this Regulation comes into force on the date of promulgation.
