ABOUT
COORDINATING INDONESIAN LABOUR REPATRIATION
BY THE GRACE OF THE ALMIGHTY GOD
PRESIDENT OF THE REPUBLIC OF INDONESIA,

Weigh: a.   that in order of repatriation of Indonesian labour from abroad in special situations, the Government and the Local Government need to cooperate co-ordinarily;
B.   that the Presidential Decree No. 106 of 2004 on the Indonesian Labor Player's Coordination Team, and his family from Malaysia have been unsuitable for the development of the state;
c. that under consideration as referred to in letter a and letter b, need to establish the Presidential Regulation on the Coordination of Indonesian Workforce Auction;

Remembering: 1. Section 4 of the paragraph (1) of the Basic Law of the Republic of Indonesia Year of 1945;
2. Law Number 39 Year 2004 on Indonesian Occupation and Protection of Labour Abroad (State Sheet of the Republic of Indonesia Year 2004 Number 133, Additional Gazette Republic of Indonesia Number 4445);
3. Government Regulation No. 3 Year 2013 on the Protection of Indonesian Labour in Foreign Affairs (State Sheet of the Republic of Indonesia Year 2013 Number 3, Additional Gazette Republic of Indonesia Number 5388);

DECIDED:

SET OF THE PRESIDENT ' S RULES REGARDING THE COORDINATION OF INDONESIAN LABOUR AUCTIONS.

BAB I
UMUM CONDITIONS
Section 1
In this Presidential Regulation referred to:
1. Indonesian Labour which is further referred to as TKI is any Indonesian Citizen eligible to work abroad in a working relationship for a certain period of time by accepting wages.
2. The auction is the repatriation of TKI from abroad to the origin area.
3. The Origin area is a place of origin of residence or domicile TKI in the county/city area.

BAB II
SCOPE
Section 2
(1) The scope of the TKI repatriation, includes the repatriation of TKI from the debarcation point to the origin area in a special situation.
(2) The special situation as referred to in paragraph (1) includes:
a. a natural disaster, disease outbreak, war;
B. large-large ports; and/or
c. The placement state no longer guarantees the safety of TKI.
(3) The Deportation as referred to in paragraph (2) of the letter b, occurs because the TKI in question do not have a work permit and/or a valid document to work, or that works does not conform to a valid work permit and/or document.

Section 3
The repatriation, as referred to in Article 2, is only done for the large number of TKI repatriation and cannot be handled by a ministry/agency, thus requiring a unified coordination.

Section 4
The repatriation of TKI in addition to the ones referred to in Article 2 and Section 3 is done in accordance with the provisions of the laws.

TKI REPLAY COORDINATION TEAM

Establishment, Occupation, and Duty
Section 5
In order to improve the coordination of the repatriation of TKI, the current TKI Coordinating Team Coordination Team in the Presidential Regulation is called the Coordination Team.

Section 6
The Coordinating Team has a task:
a.   coordinate and synchronize the planning, drafting, and execution of TKI repatriation from the debarcation point to the original region;
B. coordinate the replay of the TKI from the debarcation point up to the origin area;
c. coordinate the supervision and control of TKI repatriation from debarcation up to the area of origin;
D. conduct the evaluation and reporting of TKI repatriation from the debarcation point up to the origin area.

Section 7
The Coordination Team is located below and is responsible to the President.

The Second Part
Organizational Structure
Section 8
(1) The TKI Coordinating Coordinating Team is composed of Pengarah and Executing.
(2) The direction of being referred to in paragraph (1), consists of:

Secretary III:Head of the National Body of Placements and Protection of Indonesian Workforce
Membership :1.Foreign Minister;
2.Ministers of Law and Human Rights;
3.Social Ministers;
4.Ministers of Health;
5.Minister of Transportation;
6.Ministers of Women ' s Empowerment and Child Protection;
7.Secretary of the Cabinet;
8.Commander of the Indonesian National Army;
9.Head of the Indonesian National Police.
(3) The Executable as referred to in paragraph (1), consists of:
Speaker: Secretary of the Ministry for Coordinating People's Welfare
Vice Chairman I:Director General Coaching Workforce of Workforce, Ministry of Labour and Transmigration
Deputy Chairman II:Director General of the General Governance, Ministry of the Interior
Deputy Chairman: Deputy Director of Protection, National Agency for Occupation and Protection of Indonesian Workforce
Secretary: Deputy Field of Coordinating Women ' s Empowerment and Child Welfare, Ministry of Coordinating Minister for People Welfare
Membership :1.Director General of the Protocol and Consuler, Ministry of Foreign Affairs;
2.Director General Bina Nutrition and Health of Mother and Child, Ministry of Health;
3.Director General of Protection and Social Security, Ministry of Social Affairs;
4.Director General of Immigration, Ministry of Law and Human Rights;
5.Director General of the Occupation and Civil Seekers, Ministry of the Interior;
6.Director General of the Sea Relations, Ministry of Transportation;
7.Director General of Land Relations, Ministry of Transportation;
8.Director General of Air Relations, Ministry of Transportation;
9.Deputies of Women ' s Protection Field, Ministry of Crossfire Empowerment and Child Protection;
10.Deputies of the People ' s Welfare Field, Cabinet Secretariat;
11.Assistant Operations of the Indonesian National Army;
12.Assistant Operations of the Republic of Indonesia.
(4) The Chair of the Director as referred to in paragraph (2) as well as serving as Chairman of the Coordinating Team.

Section 9
Acting in carrying out his duties got the direction of the Director.

The Third Part
Set of Work
Section 10
(1) The direction of the Cloud Service is not available for use in the Cloud Service.
(2) Executing at least 2 (two) times in 1 (1) year or at any time if required.
(3) In the course of coordination as referred to in paragraph (1) and paragraph (2), the Coordination Team may include the ministry/agency, or the other related parties.

The Fourth Part
Same Work
Section 11
The Coordination Team in carrying out the task can work with the Governor, the Regent/Mayor and/or the other related parties.

The Fifth Part
Secretariat
Section 12
(1) To support the agility of the execution of the Secretariat of the Coordination Team is assisted.
(2) The Secretariat as referred to in paragraph (1) is implemented functionally by one of the working units in the environment of the Coordinating Ministry of People's Welfare.
(3) The Secretariat as referred to in paragraph (1) is tasked with providing technical and administrative support to the Coordinating Team.
(4) The membership and work of the Secretariat as referred to in paragraph (1) is set by the Coordinating Minister for the People ' s Welfare Field.

BAB IV
COORDINATE TKI REPATRIATION IN THE AREA
Section 13
(1) The Governor, Regent/Mayor form Task Force of TKI Admission in their respective regions.
(2) The Establishment of the Task Force as referred to in paragraph (1) is exercised in accordance with the provisions of the laws.
(3) In carrying out its duties, the Task Force conducted coordination with the Ministry of the Interior and the Coordination Team.
(4) The Task Force as referred to in paragraph (1) reports the execution of its duties to the Home Minister periodically at least every 3 (three) months.

BAB V
REPORTING
Section 14
Chairman of the Coordination Team reports the results of the task execution to the President periodically at least 1 (one) times in 1 (one) year or at any time if required.

BAB VI
MONITORING AND EVALUATION
Section 15
(1) The Coordination Team performs monitoring and evaluation of the implementation of the TKI repatriation from the debarcation point to the original area.
(2) The monitoring and evaluation results were used as input in the TKI repatriation policy retrieval.

BAB VII
FINANCING
Section 16
(1) All costs required for the TKI repatriation of the debarcation point to the area of origin sourced from the State Budget and Shopping Budget, and the Regional Revenue and Shopping Budget.
(2) All costs required for the execution of the Coordination Team are sourced from the State Budget and Shopping Budget in accordance with the duties and functions of the respective ministries/agencies.
(3) All costs required for the implementation of the Task Force are sourced from each of the Provincial Regional Revenue and Shopping Budget, and the District/City Regional Revenue and Shopping Budget.

BAB VIII
OTHER PROVISIONS
Section 17
(1) In terms of the TKI that will be repatriated to have a family, the repatriation includes the family up to the original area.
(2) The family referred to as the (1) verse, including his wife/husband and son.

BAB IX
CLOSING PROVISIONS
Section 18
At the time the Presidential Regulation is in effect, the Presidential Decree No. 106 of 2004 on the Indonesian Labor Player Coordination Team, and his family from Malaysia, were revoked and declared to be not applicable.

Section 19
This President ' s regulation starts to apply to the date of the promulctest.

In order for everyone to know it ordered the invitation of the Presidential Regulation with its placement in the State Sheet of the Republic of Indonesia.
