RULES MINISTER FOR EDUCATION AND CULTURE OF THE REPUBLIC OF INDONESIA
No. 72 YEAR 2013
ABOUT
HOSTING THE SPECIAL SERVICES EDUCATION

WITH THE GRACE OF THE ALMIGHTY GOD

MINISTER FOR EDUCATION AND CULTURE OF THE REPUBLIC OF INDONESIA,

Weighing: that to implement the provisions of Article 142 of Government Regulation No. 17 of 2010 on Management and Hosting Education as amended by Government Regulation No. 66 of 2010, it is necessary establish the Education and Culture Minister ' s Regulation on the Hosting of Special Service Education;

Given: 1.  Law Number 20 Year 2003 on National Education System (Indonesian Republic of Indonesia Year 2003 Number 78, Additional Gazette Republic of Indonesia Number 4301);
2. Act No. 14 Year 2005 on Teacher and Lecturer (Sheet State Of The Republic Of Indonesia In 2005 Number 157, Additional Sheet Of State Republic Of Indonesia Number 4586);
3. Government Regulation No. 19 Year 2005 on National Standards of Education (State Sheet of Indonesia Year 2005 Number 41, Additional Gazette Republic of Indonesia Number 4496);
4. Government Regulation No. 17 Year 2010 on Management and Hosting Education (State Gazette 2010 Number 23, Additional Gazette Republic of Indonesia No. 5105), as amended by Regulation. Government Number 66 Of 2010 (Sheet State Of The Republic Of Indonesia 2010 Number 112, Addition Of State Sheet Indonesia No. 5157);
5. Presidential Regulation No. 47 of 2009 on the Establishment and Organization of the Ministry of State, as amended in the last few times with the Presidential Regulation Number 91 of 2011 (State Sheet of the Republic of Indonesia in 2011 Number 142);
6. Presidential Regulation No. 24 of 2010 on Occupation, Duty, and Functions of the Ministry of State as well as the Organizational Functions, Task and Functions of the Ministry of State, as amended by the Presidential Regulation No. 92 of 2010 (Sheet) Country of the Republic of Indonesia 2011 No. 142);
7. Presidential Decree No. 84 /P Year 2009 regarding the Establishment of the United Indonesia Cabinet II, as amended on the last few times with the Presidential Regulation Number 5/P of 2013;

DECIDED:

establish: MINISTRY OF EDUCATION AND CULTURAL REGULATIONS ON THE HOSTING OF SPECIAL SERVICES EDUCATION.

BAB I
UMUM CONDITIONS
Section 1
In this Minister ' s Rule, which is referred to:
1. The next special services education called PLK is an education for educated participants in remote or backward areas, remote indigenous peoples, and/or experiencing natural disasters, social disasters, and those who are incapable of economic terms.
2. The education unit is a group of educational services that organizes education on formal, nonformal, and informal lines on every level and type of education.
3. Long distance education is the education that participants in their protégations separate from the educator and his studies using various sources of learning through other communication technologies, information, and other media.
4. Small school is one of the forms of formal education units that organizes its own standing education to meet the educational needs of a community group with a minimum of 3 (three) people of a learnable.
5. Open school is one of the form of a self-established formal education unit but is part of the parent school whose education is using self-learning methods.
6. Emergency school is a form of formal education unit established at the time of the temporary natural disaster and/or social disaster situations.
7. The integrated school is one of the forms of educational unit that is carried out between education in one location and has one organization as well as one management.
8. The parent school is a qualified school to be a tamper of one or more PLK service forms.
9. Ministry is the Ministry that organizes government affairs in the fields of education and culture.
10.Ministers is the Minister of Education and Culture.
11.Government is the central government.
12.Government of the area is the provincial government, and the county/city government.

BAB II
THE DESTINATION AND SCOPE
Section 2
(1) The designation of PLK aims to provide educational access to the educated participants in order for the right to be granted education.
(2) The scope of the PLK includes formal, nonformal, and informal educational lines on all educational levels.

BAB III
INSTITUTIONAL
Section 3
(1) PLK is organized in the form of educational units and/or educational services programs.
(2) PLK is organized by the Government, local government, and/or society.

Section 4
(1) The form of holding unit education as referred to in Article 3 of the paragraph (1) on the formal educational path is:
a. little school;
B. open school;
c. emergency school; and
D. Integrated school.
(2) Small schools as referred to in paragraph (1) letter a host of educational services for the number of students of a minimum of 3 (three) persons.
(3) Open school as referred to in paragraph (1) letter b organizes the study of the parent school of the parent.
(4) Emergency school as referred to in paragraph (1) the letter c organizes the service at the time of the natural disaster and/or social disaster situations.
(5) Integrated School as referred to in paragraph (1) the letter d organizes an education that is carried out between the education of one location.

Section 5
The service program as referred to in Article 3 of the paragraph (1) among others:
a.   transfer of educated participants to other areas with funding aid facilities and/or dormitory;
B.   help of the tranportation fund;
c. educator visits;
D. remote education that organizes written educational services, radio, audio, video, TV, and/or IT-based; and/or
e.   other services that do not conflict with the provisions of the laws.

BAB IV
Host
Section 6
(1) The power of PLK can be carried out integrated between educational and/or intertype education types.
(2) PLK on a formal or nonformal educational path is organized by adjusting the time, place, means and infrastructure of learning, educator and educational, form, program and/or other learning resources. With the difficulty of an educated participant.
(3) PLK provides the learer service in the area:
a. remote or backward;
B. remote indigenous peoples;
c. which experienced a natural disaster;
D. who experienced social disaster; and/or
e. Which is not capable of economic terms.
(4) Remote or backward regions as referred to in paragraph (3) of the letter a is the region that has the following criteria:
a. Transportation access is difficult to reach and expensive due to the unavailability of the highway, depending on the particular schedule, depending on the weather, the only access by foot, have great obstacles and natural challenges;
B. not available and/or severely limited public facility services, educational facilities, health facilities, electrical facilities, information facilities and communications, and clean water means; and/or
c. High prices and/or difficult availability of the availability of food, stables, and board or housing for the fulfillment of life needs.
(5) The area of the remote indigenous peoples as referred to in verse (3) the letter b is a society with the criteria for local community resistance to changes in cultural, social, and customs values.
(6) Educable of natural or social disaster victims as referred to in paragraph (3) of the letter c and the letter d is an area of disaster disaster or social disaster resulting in:
a.   the minimum of security protection facilities, both physical and nonphysical;
B. the loss of a public service means of education facilities, health facilities, electrical facilities, information facilities and communication facilities, and the means of clean water; and/or
c. designated as an area of natural disaster, social disaster, or area that is in another state of emergency by authorized government officials.
(7) Educable educated participant in economic terms as referred to in paragraph (3) of the letter e is an educated participant in a society ' s environment that is among others:
a. the amount of its revenue is not enough to meet the minimum life needs;
B. have limited access to economic activities;
c. intentionally or accidentally being the victim of a social crime, and/or
D. Other circumstances, which led to economic deprivation.

Section 7
(1) The PLK Curriculum refers to the national standard of education.
(2) The PLK Curriculum is exercised with regard to its compliance with the needs of the educational unit and the educational services program.
(3) PLK level Curriculum is drafted following the applicable and/or following parent school curriculum.
(4) PLK learning materials are presented in the form of face-to-face learning and/or giving books, modules and/or other teaching materials that conform to the standard competency and competency standards.

Section 8
(1) PLK learning process exercised with regard to:
a.   Learning sites are tailored to availability and eligibility;
B.   Learning time is exercised based on an agreement between the organizers, educators and learners;
c. The learning system is performed in a clacyal, tutorial, face-to-face, remote, and/or independent form; and
D. The number of hours teaching educators has been adjusted to the PLK conditions without reducing the standard and competency standards.
(2) The practice of practice may be carried out on the nearest educational unit or other institution that has adequate facilities.
(3) Implementation of learning can use media based information and communication technology.
(4) existing educational units can propose to organize a PLK learning service program to the education service.

Section 9
(1) Sarana and the infrastructure used in PLK use means and infrastructure in accordance with local conditions and locations.
(2) The Sarana and PLK infrastructure as referred to in paragraph (1) will be further set up in the implementation guide.
Article 10
(1) Educency and education power in PLK is provided by the Government, local government, and/or society.
(2) PLK ' s education and workforce must meet the competences in accordance with the needs, conditions, and location.
(3) PLK ' s education and education personnel are obtaining benefits and awards, in accordance with the provisions of the laws.

Section 11
(1) The management of the PLK is implemented by implementing PLK-based management.
(2) The government and/or local governments provide PLK operational assistance.
(3) The PLK may cooperate with the educational unit or other institution that has an educational facility.

Article 12
(1) The assessment of the results of the study of educated participants in PLK is exercised by educators.
(2) Assessment of results learning learers for distance education units is exercised by educators.
(3) The final assessment of the study results at each PLK types are performed through school exams and national exams.
(4) The national exam on PLK follows the standard operating procedure in effect.

Section 13
(1) The Standard PLK Graduate Competence Standard is compiled by the National Standards Board of Education (BSNP) and is set by the Minister.
(2) PLK protéges are declared to pass the school exam/exam unit of education and meet the minimum value of the national exam.
(3) Graduated exam participants deserve a diploma and/or certificate of competence.
(4) The Ijazah and/or certificates as referred to in verse (3) are published by the unit of education that organizes a special service education, as a sign that the concerned learnperson has graduated from the unit of education.

Section 14
(1) PLK funding is sourced from Government, local government, and/or community, as well as other legitimate and non-binding sources.
(2) Funding is adjusted to the PLK requirement.
(3) The cost of PLK is set up with Special Cost Standards (SBK) set by the Minister.

Section 15
(1) PLK-educated participants are prioritised for early-age children, primary education, and secondary education.
(2) The number of PLK educated participants per study group/study group is tailored to the conditions and needs of educational services.
(3) Educable participants must be registered to PLK.
(4) Educated participants in PLK must obtain the National Student Master Number (NISN) of the Ministry.

BAB V
SET UP AND CLOSING WAYS
Section 16
(1) The establishment of PLK may be carried out by the Government, local government and/or society;
(2) PLK founding requirements include:
a. feasibility study;
B. PLK development master plan;
c. source of the leared participant;
D. educators and educationist;
e. curriculum;
f.   source of financing;
G. means and infrastructure; and
h. PLK organizers.
(3) Tata means the establishment of PLK covering the steps as follows:
a. the proposal of PLK ' s founding plan by the propavarsa;
B. Consideration by the head of the education department.
(4) The granting of the establishment of PLK organised by the public is carried out by the municipal/municipal government in accordance with its authority.
(5) The license of the PLK hosted by the county/city government is established by the regent/mayor according to its authority.
(6) In an emergency, the public can host the PLK first then take care of the licensing.
(7) The state of emergency as referred to in verse (6) is set by the bupati/mayor.

Article 17
(1) The licensing requirements document PLK consists of:
a.   the description of the type of education unit and/or the PLK program to be implemented;
B. The Establishment acte and AD/ART unit of education or educational services program, while the PLK that serves an early-age child hosted by individuals can use the KTP;
c. domicile captions;
D.   organization ' s organizational structure;
e.   list of educators and educationist;
f.    list of educated participants or prospective learers; and
G.   Inventory list-infrastructure.
(2) The document as referred to in paragraph (1) is delivered as an attachment to the establishment permit letter.

Section 18
(1) PLK ' s founding permit applies as long as it is still meeting the requirements.
(2) The local government/government can revoke the existing PLK establishment permit that is already not compatible with the need.
(3) PLK in the unit of education as referred to in Article 4 of the paragraph (1) which already has permission to obtain the National School Pokok Number of the Ministry.

BAB VI
COACHING AND EVALUATION
Section 19
(1) Coaching PLK becomes the responsibility of the Government and local governments in accordance with its authority.
(2) Coaching as referred to in paragraph (1) includes the coaching of learners, educators and educationist, learning processes, and institutional.
(3) Coaching PLK nationally becomes the responsibility of the Ministry.

Article 20
(1) Evaluation of the hosting of PLK carried out by the Government and local governments in accordance with its authority.
(2) Evaluation as referred to in paragraph (1) is done with the principle of transparency and public accountability.

BAB VII
QUALITY REPORTING AND WARRANTY
Section 21
(1) PLK must make a minimum hosting report one time in a year to the education service with a gust to the Ministry.
(2) Reporting consists of reporting a unit of penrefrigeration and/or educational services program.
(3) Reporting includes education subject data and PLK self-evaluation.
(4) Quality Assurance is performed jointly by the Government, local government, and organizers in accordance with the provisions of the laws.
(5) The local government guarantees the hosting of the PLK in accordance with the needs of the learer.
(6) The government and local governments provide the required PLK resources to achieve the quality of the required.

BAB VIII
THE ROLE AND THE SOCIETY
Section 22
(1) The public can participate in the expansion of access and quality improvement.
(2) Public Participation as defined by paragraph (1) may be performed in the form of hosting, socialization, advocacy and other activities that support the expansion of the access and quality improvement.

BAB IX
CLOSING PROVISIONS
Section 23
The provisions of the implementation of this Ministerial Regulation shall be further set up by the associated Director General.

Section 24
The rules of the Minister are in effect on the date of promulgations.
