ABOUT
DRAFTING GUIDELINES
KABUPATEN/CITY LEVEL FORESTRY PLAN
WITH THE GRACE OF THE ALMIGHTY GOD
MINISTER OF FORESTRY REPUBLIC OF INDONESIA,
Weigh: a. that as the implementation of the provisions of Article 43 of the paragraph (2) and Article 45 of the Government Regulation No. 44 of 2004 on Forestry Planning, it has been established Regulation Minister of Forestry P. 42/Menhut-II/2010 on the Forestry Planning System;
B. that under Article 32 of the Ordinance of the Forestry Minister Number P. 42/Menhut-II/2010 on the Forestry Planning System, the Regency/City Level Forest Plan is composed by the agency that has the authority of forestry planning in the regency/Kota;
c. that under consideration as referred to above, need to establish the Minister of Forestry Regulation on the Kabupaten/ City-level Forestry Plan Drafting Guidelines;
Given: 1. Law No. 41 of 1999 on Forestry (sheet of state of the Republic of Indonesia in 1999 number 167, additional state sheet number 3888), as amended by Law No. 19 of 2004 on the Redemption of Government Regulation ("Government of the Republic of Indonesia"). Successor Act No. 1 Year 2004 on Changes to Law No. 41 of 1999 on Forestry Act (Sheet State Republic Of Indonesia 2004 Number 86, Additional State Sheet Number 4412);
2. Law No. 26 Year 2007 on Alignment Of Spaces (State Sheet Of The Republic Of Indonesia Year 2007 Number 68, Additional Sheet Of State Republic Indonesia Number 4725);
3. Government Regulation No. 44 Year 2004 on Forestry Planning (State Of The Republic Of Indonesia 2007 Number 146, Additional Gazette Republic Indonesia Number 4452);
4. Government Regulation Number 45 Year 2004 on the Protection of Forest (Sheet State Indonesia Year 2004 Number 147, Additional Gazette Republic Indonesia Number 4453), as amended by Government Regulation Number 60 Years 2009 (sheet Of State Of The Republic Of Indonesia In 2009 Number 137, Additional Gazette Of The Republic Of Indonesia Number 5056);
5. Government Regulation No. 6 Year 2007 on Tata Forest and Drafting Forest Management Plan, as well as Forest utilization (Republic of Indonesia Gazette 2007 No. 22, Additional Gazette Republic of Indonesia Number 4696) as has been amended by Government Regulation No. 3 of 2008 (State Gazette of the Republic of Indonesia 2008 No. 16, Additional Gazette of the Republic of Indonesia No. 4814);
6. Government Regulation Number 38 Year 2007 on the Partition of Government Affairs between Government, Provincial Local Government, and District/City Local Government (Indonesian Republic of Indonesia Year 2007 Number 82, Extra State Sheet) Republic of Indonesia No. 4737);
7. Government Regulation No. 15 Year 2010 on the Hosting Of Space (Sheet State Of The Republic Of Indonesia 2010 Number 21, Addition Of State Sheet Indonesia Number 5103);
8. Presidential Regulation No. 47 of 2009 on the Establishment and Organization of the Ministry of State, as it has been several times amended last with the Presidential Regulation Number 91 of 2011;
9. Presidential Decree No. 84 /P Year 2009 on the Establishment of the United Indonesia Cabinet United II, as amended by Presidential Decree Number 59 /P Year 2011;
Ten. Presidential Decree No. 24 of 2010 on Occupation, Duty and Functions of the Ministry of State as well as the Organizational Functions, duties and functions of the Eselon I, as have been several times amended last with the Presidential Regulation No. 92 of 2011;
11. The Minister of Forestry Law Number P. 40/Menhut-II/2010 on the Organization and the Working Environment of the Ministry of Forestry (News of the Republic of Indonesia of Indonesia 2010 Number 405) as amended by the Ordinance of the Minister of Forestry P. 33/Menhut-II/2012 about the Change of the Regulation of the Forestry Minister Number P. 40/Menhut-II/2010 on the Organization and the Working Governance of the Ministry of Forestry (National News of the Republic of Indonesia 2012 No. 779);
Twelve. Regulation of Minister of Forestry Number P. 42/Menhut-II/2010 on Forestry Planning System (State News of the Republic of Indonesia 2010 Number 460);
Thirteen. Regulations of Minister of Forestry Number P. 49/Menhut-II/2011 on the National Forests Plan of Forestry (RKTN) 2011-2030 (State News of the Republic of Indonesia in 2011 Number 381);
14. Regulation of Minister of Forestry Number P. 01/Menhut-II/2012 on the Drafting Guidelines Of The Provincial Forestry Plan (the State News of the Republic of Indonesia 2012 No. 48);
DECIDED:
establish: FORESTRY MINISTER REGULATION ON THE GUIDELINES OF DRAFTING THE KABUPATEN/ CITY-LEVEL FORESTRY PLAN.
Article 1
Guidelines drafting the District/City Level Forest Plan as set forth in this Forestry Minister Regulation Attachment.
Article 2
The District/City Level Forest Plan Drafting Guidelines is a reference to the District/City Local Government and the parties in the drafting of the Regency/City Level Forest Plan on its territory.
Article 3
The district/City-level forestry plan that has been compiled before the Ordinance of the Minister of Forestry is declared to remain in effect, while the Regency/City Level Forests Plan is still in the drafting stage of adjusting to provisions in this Regulation.
Section 4
The Forest Minister ' s regulations come into effect on the date of the promulctest.
So that everyone knows it, instrucits the Ordinance of the Minister of Forestry Ordinance with its placement in the News of the Republic of Indonesia.
