ABOUT
INDONESIA NATIONAL STANDARD ENFORCEMENT (SNI)
TECHNICAL SULFURIC ACID IS COMPULSORY

WITH THE GRACE OF THE ALMIGHTY GOD

MINISTER OF INDUSTRIES OF THE REPUBLIC OF INDONESIA,

Weigh: a.  that in order to improve the competuing of the national industry and ensure the quality of industrial output, protect consumers over the quality of industrial products and create a fair and fair competition in the field of chemical industry, needs to impose standards. National Indonesia (SNI) Technical Sulric acid compulsory;
B.   that based on consideration as intended in the letter a need to establish the Regulation of the Minister of Industry on the Treatment of Indonesian National Standards (SNI) The Technical Sulfate Acid Is Mandatory;

DECIDED:

Establishing: REGULATION MINISTER REGULATION ON THE IMPLEMENTATION OF THE INDONESIAN NATIONAL STANDARD (SNI) OF TECHNICAL SULFURIC ACID.

Section 1
In Regulation of the Minister this is referred to:
1. The SNI Use Product Certificate, which is further called SPPT-SNI, is the SNI Certificate Use Product Certificate issued by the Product Certification Institute to a manufacturer capable of producing Technical Sulfat Acid in accordance with the requirements SNI.
2. Product Certification Institute, hereafter called LSPro, is an agency that performs the SNI Use Product Certification activities.
3. The Laboratory of Testing is a laboratory conducting testing activities on the example of goods according to the specification/test method of the SNI.
4. The National Accreditation Committee, hereafter called KAN, is a non-structural institution, which is under and responsible directly to the President with the task of establishing an accreditation and certification system as well as the authority to Accredited institutions and laboratory testers to perform certification activities.
5. Technical Licensing is a letter from the Director General of the Industry Committee on the non-enaccation of the SNI provision in order to have the HS number Code which is subject to mandatory SNI enforcement provisions. based on the reasons specified.
6. Surveyances are periodically checking and or specifically against companies/manufacturers who have acquired SPPT-SNI for the consistency of the SPPT-SNI implementation performed by LSPro.
7. Product Standard Supervising Officer, next called PPSP, is a civil servant in the center or area assigned to conduct surveillance of goods and or services at the production site and outside of the locations of production activities that are SNPs. It has been mandatory.
8. Minister is the Minister who organizes government affairs in the field of industry.
9. Director General Pembina Industry is the Director General of the Manufacturing Industry Base, Ministry of Industry.
10. Directorate General Pembina Industry is Directorate General of Manufacturing Industry Base, Ministry of Industry.
11. Director Pembina Industry is the Director of Basic Chemical Industry, Directorate General of the Manufacturing Industry Base, Ministry of Industry.
12. BPKIMI is the Agency for the Study of Climate Policy and the Industrial Industry of the Ministry of Industry.
13. Provincial Service is the Department of the Province which is the management of the government affairs of the industrial field.
14. County/City Services are the Services at the Regency/City level that organizes the governance affairs of the industrial field.

Section 2
Mandatory SNI Technical Sulfat Acid with SNI and the Tarif/Harmonized System (HS) Post Number as follows:

Section 3
The company that produces Technical Sulfat Acid as referred to in Article 2 is mandatory:
a.  implement SNI and have a SPPT SNI Technical Sulchric acid in accordance with System 5 certification provisions or 1b; System certification requirements;
B.  grow the SNI sign on product packaging in a place that is easily read by means of tagging that results in an uneasily lost mark; and
c. application of SNI tagging for Technical Sulfat Acid in bulk form is evidenced by Copy SPPT-SNI which has been legalized.

Section 4
(1) Technical Sulfat Acid as referred to in Section 2 is required to be dated, month and year production on product packaging in place of easy reading in the manner of tagging results in an uneasily lost mark.
(2) The date, month and year of production as referred to in paragraph (1) is one of the product quality supervision objects for the implementation of the technical SNI of Sulfat Acid.

Section 5
The provisions as referred to in Article 3 and Section 4 apply to the Technical Sulfat Acid with the Tarif Post Number (HS Code) as referred to in Article 2 of the domestic production and import.

Section 6
(1) Technical Sulfat Acid with the Tarif Post Number (HS Code) as referred to in Section 2 used as an example of a research and development test test or in order for the publishing of SPPT SNI is not required to meet the provisions as contemplated in Section 2, Section 3, Section 4, Section 5, and Section 5.
(2) The Technical Sulfat Acid Importer as referred to in paragraph (1) is mandatory with the Technical Consideration Letter of the Director General of the Industrial Pembina.

Section 7
(1) The technical and technical support of the Cloud Service is provided in accordance with the terms of the IBM International Code of Technology ("IBM").
(2) A request as referred to in paragraph (1) must be supplemented by a sufficient Letter of Statement stating that the imported product is an example of a research and development test or in the framework of the publishing of SPPT SNI as referred to in Section 6 of the paragraph (1) accompanied by the proof that may be accounted for and the licensing of the applicant company as well as the volume information of the product to be imported.
(3) The Directorate General of Industrial Pembina may be numbered with the related agencies In proving the truth over the whole document requirements to obtain the Technical Perscales as referred to in paragraph (1).
(4) The Technical Perconsideration Letter as referred to in paragraph (1) at least contains the following information:
a.   company identity;
B.   usage;
c. The company ' s capacity and production plan;
D.   import volume; and
e.   product specification.
(5) In publishing the Technical Letter of Perscales as referred to in paragraph (1) the Director General of the Industrial Pembina may bestow the authoring authorization referred to the Director of Industry Pembina.
(6) The terms and requirements of the Technical Consideration Letter as referred to in paragraph (3) are further regulated in the Regulation of the Director General of the Industry Pembina.

Section 8
(1) The SNI Certification Request is addressed to the LSPro which has been accredited by the KAN and appointed by the Minister.
(2) The SNI Certification Request as referred to in paragraph (1) must be supplemented with the SPPT-SNI Request Letter from the Director of Industrial Pembina.
(3) The SPPT-SNI Request (s) as referred to in paragraph (2) is issued under the request.
(4) The invocation as referred to in paragraph (3) at least should inform the Program Certification (LSPro) that will perform the certification equipped with:
a.   For the SPPT-SNI application performed directly by the manufacturer consists of:
1. Copy the SPPT-SNI request form which has been filled by the applicant and is legalized by the concerned LSPro;
2. Photo copy of Technical Sulfat Acid Industrial Permit or a similar permit from abroad;
3. Letter of the mark list mark/Sertfikat brand and or License Agreement that has been registered at the Directorate General of Intellectual Property Rights, Ministry of Law and Human Rights;
4. List of production equipment owned in support of the fulfillment of the terms of the SNI as referred to in Section 2;
5. List of product types to be certified;
B.   For SPPT-SNI applications performed by the manufacturer representatives (Representative or Importers Companies) are equipped:
1. All requirements as specified in the letter a;
2. The appointment letter of the Technical Sulfat Acid manufacturer to the Representative or Importers Company as the party responsible for the certification application process and the quality of the production product of the intended manufacturer outstanding. In the Indonesian region and;
3. The manufacturer representative company's licensing of the company, which consists of:
a) Industrial Business Permit if the manufacturer's representative company is an industrial company;
B) A Trade Business License (SIUP);
c) The number of Importer Identifiers if the manufacturer's representative company is the Importers Company.
(5) The SPPT-SNI invocation letter as referred to in paragraph (1) of the minimum load of information:
a.   The name and address of the SPPT-SNI; s Applicant Manufacturer;
B.   Name and address of the Representative Company or importer responsible in Indonesia for the import products;
C.   LSPro that will perform the SNI Certification in accordance with the pleas; and
D.   The type of product to be certified.

Section 9
(1) The Issuer Of SPPT-SNI Technical Sulfuric Acid through System 5 Certification as referred to in Article 3 performed by the LSPro which has been accredited and appointed by the Minister according to the scope of the Technical Sulfat Acid SNI, through:
a.  Technical-Sulfat Acid quality fitness testing in accordance with the provisions of the SNI as referred to in Section 2;
B.   audit production process; and
c. audits of the SNI ISO 9001:2008 or other recognized quality management systems or other quality management systems.
(2) Publishing SPPT-SNI Technical Sulfuric Acid through the 1b System Certification as referred to in Section 3 performed by the LSPro which has been accredited and appointed by the Minister according to the scope of the technical SNI of Sulfat Acid, through quality testing products per the SNI provision on the production lot provided the provision:
a.   1 (one) lot of production for the production product in the country is the total production amount for 6 (six) months; and
B.  1 (one) lot production for imported products is the total number of products on any of the shipping arriving on the arrival month.
(3) Technical Sulfat Acid sampling via the 1b System Certification at:
a.   Domestic production products are performed at the plant;
B.   import products in the arrivals port;
(4) Testing of the Technical Sulfat Acid taken under the terms of the paragraph (3) is executed by:
a.   Test Lab which has been accredited by the RIGHT with the scope of SNI Technical Sulfat Acid and is appointed by the Minister; or
B.   Test Lab abroad, provided:
1) has been accredited by the accreditation institution by the state government where the laboratory is referred to be; and
2) the country where the laboratory is referred to is having:
a) The Mutual Recognition of Arrangement (MRA) with KAN, such as the International Laboratory of Accreditation (ILAC) or The Asia Pacific Laboratory Accreditation Cooperation (APLAC);
b) a bilateral or multilateral agreement in the field of technical regulation with the Government of the Republic of Indonesia and appointed by the Minister.
(5) The application of the Quality Management System as referred to in paragraph (1) the letter c may be proven based on:
a.  Letter of self-statement on the application of the Mutu Management System pursuant to SNI ISO 9001:2008 or its revision or other quality management system recognized; or
B.  Certificate of application of the Mutu Management System pursuant to SNI ISO 9001:2008 or its revision or other quality management system recognized from the Certification System Certification System (s) which have been accredited by the Program or the Management System accreditation institution The qualities that have signed the Treaty of Confession are hereby recognized.
(6) If the LSPro and/or the tester Laboratory is accredited by the Technical Sulas is not available or insufficient need, the Minister may designate the LSPro and/or the Test Laboratory whose competitors have been was evaluated by BPKIMI.
(7) The LSPro and/or the designated Test Laboratory as referred to in paragraph (6) the longest 2 (two) years since the appointment must have been accredited.

Section 10
SPPT-SNI Technical Sulfuric Acid published LSPro as referred to in Article 9 of at least information about information about:
a.   company name and address;
B.   factory address;
c. the company name of the company;
D.   brand;
e.   name and address of the importer;
f.    SNI number and title; and
G.   type of product.

Section 11
(1) The LSPro as referred to in Article 9 is required to notify and deliver to the Head of the Policy Review Board, Climate and Industrial Mutu, to the Director General Manufacturing Industry Ministry of Industry and the applicant company about the publishing decision, the delay, rejection and the Abundance of SPPT-SNI 7 (seven) working days since the publication of the kepusan was referred to.
(2) The LSPro as referred to in Article 9 is responsible for the published SPPT-SNI.

Section 12
(1) The technical Sulfat Acid that enters the Indonesian customs area is required to meet the provisions of the SNI as referred to in Article 3 and Section 4 or the provisions as referred to in Article 6.
(2) The imported Technical Sulfat Acid that has had an SPPT SNI must be listed in accordance with the provisions of the laws.
(3) The imported Technical Sulfat Acid that does not meet the provisions as referred to in paragraph (1) is prohibited from entering the Indonesian customs area.
(4) The import, non-production, and/or third-party data that is not in compliance with the terms of the IBM International Program (s).

Section 13
(1) Technical Sulfat acid as referred to in Article 2 of the domestic output produced since it was enacted in the Ordinance of this Minister and does not meet the provisions of the SNI are prohibited from circulating and must be exterminated.
(2) Technical Sulfat acid production in the country produced after the Ordinance of this Minister and has been circulating on the market but does not meet the provisions of the SNI must be withdrawn from circulation and annihilated by the producers in question.

Section 14
(1) The coaching and supervision of the implementation of the application of SNI as referred to in Article 2 is done by the Directorate General of Industry Pembina exercised by the PPSP.
(2) The monitoring as referred to in paragraph (1) is performed against the product starting at the production site with the product circulation outside of the production site at least one (one) time of the year.
(3) In conducting oversight as referred to in paragraph (1) the Directorate General of Industrial Pembina can coordinate with the Provincial Service and or the County/City Service or related agencies.
(4) BPKIMI carries out coaching on the Institution Assessment of Conformity in order to apply the technical SNI of the Technical Sulfat Acid.
(5) In carrying out coaching as referred to in paragraph (4), BPKIMI may provide a written reprimand and sanction to the LSPro that does not address the report as referred to in Article 11 in accordance with the laws.

Section 15
Director General Pembina Industry sets the technical instructions of implementation and supervision of application of the technical SNI of Sulfat Acid.

Section 16
The attempted perpetrator, LSPro and or Laboratory of Testing which carried out violations of the provisions in the Regulation of the Minister are subject to sanction under the provisions of the laws.

Section 17
The rules of the Minister's rule came into effect 6 (six) months after being promulred.
