CHANGES TO THE REGULATION OF COMMERCE MINISTER NUMBER 36/M-DAG/PER/5/2012 ON THE LAYOUT OF THE DESIGNATION

THE EXPORT BENCHMARK PRICE OF AGRICULTURAL AND FORESTRY PRODUCTS IMPOSED DUTIES

DRAW: A. DECIDED: Establishing: REGULATION OF TRADE MINISTERS ON

CHANGES TO THE TRADE MINISTER ' S REGULATION NUMBER 36/M-DAG/PER/5/2012 ON THE MANNER OF PRICING OF EXPORT BENCHMARK PRICES OVER AGRICULTURAL PRODUCTS AND THE FORESIGHT IMPOSED DUTIES.

Article I Some provisions and attachments in the Regulation of Trade Minister Number 36/M-M-DAG/PER/5/2012 on the Tata Way Pricing Benchmark Prices Export Over Agricultural Products and Forestry Imposed Bea are changed as follows: 1. The provisions of Section 4 are amended so that it reads as follows:

Section 4

(1) The HPE Penetration of agricultural and forestry products as referred to in Article 2 of the paragraph (1) is based on the reference price set by price. average during the last periodic prior to the designation of HPE.

(2) The reference price as referred to in paragraph (1) is proposed by the Ministry of Commerce, the Ministry of Industry, and the Ministry of Agriculture with the source of the price to be accounted for.

(3) The price-taking for the the pricing of the reference price as specified in the paragraph (2) is obtained as follows:

a. for the price of the Indonesian exchange and the Malaysian exchange is based on the closing price (settlement price) for the nearest month handover.

b. for the price of Rotterdam is based on the price of spot for the nearest month submission.

(4) The reference price as referred to in paragraph (1) is set as follows:

a. Cocoa Beans is based on the average Cost Insurance Freight (CIF) Kakao Intercontinental Exchange (ICE), New York;

b. Oil palm, crude palm oil (CPO), and its derivative products are based on the weighted average price of Cost Insurance Freight (CIF) Crude Palm Oil (CPO) from Rotterdam, the Malaysian exchange, and the Indonesian exchange with the disarmament of Rotterdam by 20% (twenty percent), the Malaysian exchange rate of 20% (twenty percent), and the Indonesian exchange by 60% (sixty percent).

(5) In terms of the average price difference that will be used in the weighting of more than USD 20 (twenty-dollar United States) between the three price sources as referred to in paragraph (4) letter b, The reference price calculation is obtained by using the average price of the two highest price sources.

(6) The reference price as referred to in paragraph (1) is calculated from 10 (ten) days before the periodic runs up to 10 (ten) the day before the expiry of the periodic walk.

2. Between Section 4 and Section 5 of each section of Section 4, Section 4A is the following:

Section 4A (1) HPE Penetration of agricultural products and forestry as

c. Palm, Seeds, and Palm kernel, Bunker (oil cake) and other solid residues of Sawit, Biji, and Palm kernel, crude palm kernel oil (CPKO), crude palm olein, crude palm stearin, crude palm kernel olein, Crude Palm Kernel Stearin, Palm Fatty Acid Distillate (PFAD) and Palm Kernel Fatty Acid Distillate (PKFAD), Refined Bleached Deodorized (RBD) Palm Olein, RBD Palm Oil, RBD Palm Stearin, RBD Palm Kernel Oil, RBD Palm Kernel Olein, RBD Palm Kernel Stearin, RBD Palm Olein in branded packaging with clean weight up to 20 kg, RBD Palm Olein in branded packaging with net weight above 20 kg up to 25 kg, Biodiesel, Wood, and Skin is based on market prices or exchanges in country and/or abroad;

d. Hydrogenated and RBD Palm Olein products in branded packaging are based on the price of raw materials plus production costs based on the HPE Redemption Team meeting agreement;

e. Mixed products of the Crude Palm Oil (CPO) and its derivative products are the highest HPE applicable to the mixed product components of the Crude Palm Oil (CPO) and its derivative products regardless of the composition of the mixture products;

(2) HPE of the agricultural and forestry products as referred to in verse (1) is calculated from 10 (ten) days before the periodic runs up to 10 (ten) days before the periodic end of the periodic walk.

3. The provisions of Article 5 are amended so that it reads as follows: Section 5

4. 5. In between Section 8 and Section 9 of the section 1 (one) of section, Article 8A thus reads as follows:
