REGULATION of the MINISTER of TRANSPORT of the REPUBLIC of INDONESIA NUMBER PM 55 2013 ABOUT GUIDELINES and STANDARD PROCUREMENT DOCUMENTS CONSTRUCTION WORK in the ENVIRONMENT MINISTRY OF TRANSPORTATION with the GRACE of GOD ALMIGHTY MINISTER of TRANSPORT of the REPUBLIC of INDONESIA, Considering: a. that in order to standardise the procurement documents and the draft contract for the construction work, the need for standard procurement documents for construction works in the Environment Ministry of transportation;
b. that based on consideration of these letters a need to set Rules, Transport Minister about the guidelines and Standard Procurement documents of construction work in the environment of the Ministry of transportation;

Decide: define: MINISTER of TRANSPORTATION RULES ABOUT GUIDELINES and STANDARDS DOCUMENT PROCUREMENT CONSTRUCTION WORK in the ENVIRONMENT MINISTRY OF TRANSPORTATION.
CHAPTER I article 1 in the SENSE of this regulation is: 1. The Ministry is the Ministry of transportation;

2. The Minister is the Minister of transportation;
3. the officials of the Echelon I is Secretary General, Inspector General, Director General and head of the Environment Agency in the Ministry of transportation;
4. The unit of work is the Satker hereinafter referred to as the organizational unit that has a work unit code approval of the Minister of finance;
5. Goods/Services Government Procurement hereinafter referred with procurement of goods/services is an activity to obtain goods/services by the Ministry that the process starts from planning needs until the completion of the entire activity to obtain goods/services;
6. Budget Users hereinafter PA is the holder of the official authorities of the use of the budget of the Ministry;
7. The power of the Budget Users hereinafter referred to KPA was determined by officials of budget Users (PA) to use the NATIONAL BUDGET;
8. a Commitment Maker Officials hereinafter PPK is officials who are responsible for the implementation of the procurement of goods/services;
9. the Procurement Officer is personnel who have Skills Certificate procurement of goods/services that carry out procurement of goods/services;
10. Goods/Services Procurement Contract is a written agreement between the PPK with goods/services Providers;
11. The work of the Complex is a job which requires high technology, has a high degree of risk, using specially designed equipment and/or employment which is worth over Usd 100,000,000,000.0.-(one hundred billion rupiah);
12. Construction work is the entire work related to the implementation of the construction of buildings or other physical form-making;
13. the Procurement Services Unit hereafter ULP was a functioning Government organizational units carry out procurement of goods/services in the K/L/D/I which is permanent, it can stand alone or attached to existing units.
CHAPTER II AIMS and OBJECTIVES article 2 purpose and objective of this Ministerial Regulation, as guidelines and standards document procurement construction work in the Environment Ministry of transportation.

CHAPTER III SCOPE article 3 scope of the enactment of this Ministerial Regulation, limited to the procurement of construction works through public auctions, auction limited and direct elections are the source of his funds partially or completely from the income and Expenditure Budget of the State (STATE BUDGET).

CHAPTER IV ASSIGNMENT METHOD the SELECTION of PROVIDERS of CONSTRUCTION WORKS article 4 (1) of the working group compiled a ULP and set the election method of the provider of construction work.
(2) the selection of providers of construction works referred to in subsection (1), performed by: a. Public Auction;

b. Auction Limited;

c. direct elections;

d. the appointment Directly; or e. a direct Procurement.
Chapter V ASSIGNMENT METHODS of DELIVERY of DOCUMENTS article 5 (1) of the working group compiled a ULP and setting infusion method of Bidding Documents.
(2) the method of Bidding document of incorporation referred to in subsection (1), consisting of: a. method one cover;

b. cover two methods; or c. a two stage method.
(3) a Method used to cover procurement of goods/services that are simple, where the technical evaluation is not affected by price and has the following characteristics: a. Work is simple with the standard rates established Government; or b. technical specifications construction work or volumes can be expressed clearly in the Procurement Documents.
(4) cover two Methods used for the procurement of goods/services where technical evaluation is influenced by price quote, and is used for construction work using the evaluation value system or the system cost over age economically.
(5) two-stage Method is used for construction work has the following characteristics: a. a job are complex;
b. meets the criteria of a particular performance of the overall system, including considerations of convenience or efficiency of operation and maintenance of the equipment;
c. has a number of alternative uses of the system design and application of different technologies; d. takes a long technical evaluation; and/or e. requires a technical.
CHAPTER VI article 6 EVALUATION METHOD of DETERMINATION (1) bidding evaluation methods in the selection of providers of construction works consist of: a. the knockout;

b. system of values; and c. the cost assessment system for age economically.
(2) evaluation method of bidding for construction work on the principle of using the assessment system.
(3) the evaluation of the system of values used for construction work that takes into account the technical excellence of value for money, considering the price quote was strongly influenced by the quality of the technical.
(4) the evaluation fee assessment system for economical age used for construction work that takes into account the age of the economical factors, prices, operating costs, maintenance costs and certain operating period.
(5) the system of values is done with the following conditions: a. the quantity weights costs between 70% (seventy perseratus) up to 90% (ninety-perseratus) of the total weight of the whole;
b. items must be appraised quantitatively or can be dikuantifikasikan; and c. the procedures and criteria for assessment must be attached with a clear and detailed in the Procurement Documents;
(6) the method of two-stage referred to in article 5 paragraph (5) be able to use the method of evaluation system of fall, the system value or cost assessment system for age economically.
CHAPTER VII ASSIGNMENT METHOD of ASSESSMENT of the QUALIFICATIONS of article 7 (1) Qualification is the process of assessment of competence and ability of the business as well as the eligibility of certain other providers of construction work.
(2) the qualification referred to in paragraph (1), can be done in two ways, namely: a. Prequalification; or b. Pascakualifikasi.
(3) the Prequalification process is the assessment of qualifications is carried out prior to insertion of the bidding.

(4) the Prequalification as referred to in paragraph (2), a, was carried out for Procurement as follows: a. the selection of providers of Construction Work that is both complex through Public Auction;
b. Election of the construction Work Providers that use the method of direct appointment, except for emergency handling; or c. the selection of Providers through Direct Procurement.
(5) the prequalification Process produces a list of prospective providers of construction work.
(6) Pascakualifikasi as referred to in paragraph (2), subparagraph b, qualification assessment process is conducted after the ingestion of a quote.
(7) Pascakualifikasi as referred to in paragraph (6), carried out for Procurement as follows: a. Public Auction Public Auction, except for the work of the complex;

b. direct elections.
(8) the assessment of qualifications is carried out with the method system of fall, for construction work.
Article 8 (1) the selection of providers of construction work in principle done via Public Auction with the Pascakualifikasi Method.
(2) for the work of the complex can use the election method as follows: a. incorporation Document Supply method using the cover 2 (two) or two (2) stages as stipulated in article 5 paragraph (2), subparagraph b and c; and b. the selection of its bid evaluation methods using the system value or cost assessment system for economical age referred to in article 6 paragraph (1), letter b and c; and c. an assessment of credentials using the prequalification as stipulated in article 7, paragraph (2) letter a.
CHAPTER VIII the COMPLEX JOB of article 9 (1) the construction works that are included in a complex Work as follows: a. the ship development work: 1) ship crossings with size e 100 GT, with the parent machine total e 250 HP, and the length of e 20 metres; 2) ship pioneer with size e 200 GT;
3) ship of State for a special purpose: a) ship kenavigasian;

b) patrol boats;

c) ship marine disaster prevention vessel; 4) ship of State class I s. d III. b. work of the construction of the seaport;

c. work of the construction airports;

d. job creation/modification of an aircraft;

e. job creation simulator.
f. the work development/improvement/rehabilitation of railways, which includes: 1) development of infrastructure of railways consists of: a) the construction of the railway;

b) the construction of the railway bridge;

c) development persinyalan;

d) construction of electrification (power flow);

e) construction of the station, Depot and yasa Hall;
2) constructing railways consists of: a) locomotive;

b) trains;

c) rolling stock;

d) special equipment;
(2) the details of the construction works referred to in subsection (1), the letter b and the letter e, defined more by the officials of the Echelon I related.
CHAPTER IX GUIDELINES and STANDARD PROCUREMENT DOCUMENTS article 10 (1) guidelines and Standard Procurement Documents construction work in the Environment Ministry, as contained in the annex to this regulation.
(2) the annex referred to in paragraph (1), include: a. Appendix I, guidelines and standards Documents the procurement of construction works consist of: Book 1: the guidelines and Standard Procurement documents of construction work, the method of Public Auction/direct election with Pascakualifikasi Infusion method of Bidding Documents, One Knockout Cover, which uses Contract Lump Sum;

Book 2: guidelines and standard Procurement documents of construction work, the method of Public Auction/direct election with Pascakualifikasi Infusion method of Bidding Documents, One Knockout Cover, which uses unit price Contract or a joint Contract Lump Sum and unit price.
b. Annex II, guidelines and Standard Procurement documents of construction works consist of: Book 1: the guidelines and Standard Procurement documents of construction work Method Public Auction/Auction limited with Prequalification, Bidding Document Infusion method of Two value systems, Cover/Assessment Fee For Age Economically, which uses Contract Lump Sum;

Book 2: guidelines and standard Procurement documents of construction work method of Public Auction/Auction limited with Prequalification, Bidding Document Infusion method of Two value systems, Cover/Assessment Fee For Age Economically, which uses unit price Contract or a joint Contract Lump Sum and unit price;

Book 3: guidelines and standard Procurement documents of construction work method of Public Auction/Auction limited with Prequalification, Bidding Document Infusion method of two-stage System, the value/cost of Assessment During the age of Economical, which uses Contract Lump Sum;

Book 4: guidelines and Standard Procurement documents of construction work Method Public Auction/Auction limited with Prequalification, Bidding Document Infusion method of two-stage System, the value/cost of Assessment During the age of Economical, which uses unit price Contract or a joint Contract Lump Sum and unit price.
CHAPTER X of the DRAFT CONTRACT of ASSIGNMENT section 11 (1) of the draft Procurement Contracts sets out PPK'S goods/services, before the package was delivered to the ULP's job to do the auction/selection.
(2) in drawing up the draft of the contract for the Complex Work, PPK may seek input first-echelon Officer I related.

CHAPTER XI TRANSITIONAL PROVISIONS article 12 Procurement Processes are being carried out during this ministerial regulation into force yet, still continued until the completion of the procurement process.

Article 13 with the establishment of this Ministerial Regulation, then the decision of the Minister of transportation KM Number 47 in 1996 about the standard Auction Documents for the auction of the Interior in the Environment Ministry of transportation, revoked and declared inapplicable.

CHAPTER XII CLOSING PROVISIONS Article 14 this Ministerial Regulation comes into force on the date of promulgation.

In order to make everyone aware of it, ordered the enactment of this Ministerial Regulation with its placement in the news of the Republic of Indonesia.
