REGULATION of the MINISTER of FINANCE of the REPUBLIC of INDONESIA NUMBER 92/FMD. 05/2013 TECHNICAL INSTRUCTIONS ABOUT the IMPLEMENTATION of the GRANTING of SALARY/PENSION/ALLOWANCE THIRTEENTH MONTH in FISCAL YEAR 2013 to CIVIL SERVANTS, STATE OFFICIALS, and the RECIPIENT of a PENSION/ALLOWANCE with the GRACE of GOD ALMIGHTY the MINISTER of FINANCE of the REPUBLIC of INDONESIA, Considering: that in order to implement the provisions of article 10 the Government Regulation Number 48 by 2013 about Granting Salary/Pension/Allowance thirteenth month in fiscal year 2013 to civil servants , State officials, and the recipients of pensions/benefits, need to establish the regulation of the Minister of Finance on the implementation of the Technical Instructions of granting Salary/Pension/Allowance thirteenth month in fiscal year 2013 to civil servants, State officials, and the recipients of pensions/Allowances;

Decide: define: REGULATION of the MINISTER of FINANCE on the IMPLEMENTATION of the TECHNICAL INSTRUCTIONS of GRANTING SALARY/PENSION/ALLOWANCE THIRTEENTH MONTH in FISCAL YEAR 2013 to CIVIL SERVANTS, STATE OFFICIALS, and the RECIPIENTS of PENSIONS/ALLOWANCES.
CHAPTER I GENERAL PROVISIONS article 1 In this regulation of the Minister, is: 1. Public servants are civil servant (PNS), a member of the Indonesia national armed forces (TNI), and members of the State police of the Republic of Indonesia (the national police).
2. State officials is: a. the President and Vice President;

b. the Chairman, Vice Chairman, and members of the people's Consultative Assembly;

Chairman, Vice Chairman, and members of the House of representatives;

d. the Chairman and Deputy Chairman of the Constitutional Court, as well as Judges of the Constitution;

e. the Chairman, Vice Chairman, Chairman, and Chief Justice on the Supreme Court;
f. Judges on the judicial Bodies of the General State Administrative, judicial, religious courts, judiciary and Military judge who employed for judicial duties (yustisial); g. the Chairman, Vice Chairman, and the tax court judge;

h. the Chairman, Vice Chairman, and members of the body of the Financial Examiner;

i. the Chairman and Deputy Chairman of the corruption eradication Commission;

j. the Chairman, Vice Chairman, and members of the judicial Commission;

k. Ministers and Ministerial Office;

b.   Head of the Representation of the Republic of Indonesia who serves as Ambassador Extraordinary and Plenipotentiary;

m. Governor and Vice Governor; and n.  Regent/Vice Regent/Mayor and Vice Mayor.
3. Recipients are: a. Retired civil servants;

b. Retired State officials;

c. the recipient of a pension, the Widow/Widower/child of a recipient of a pension referred to in letter a and letter b; and d.  The pension recipient parents of CIVIL SERVANTS killed.
4. The recipient of the allowance is: a. the recipient Benefits Veterans;

b. recipients of Honorary Members Allowances Committee Indonesia Center;

c. the recipient of the Alimony Awards National movements of the Pioneers/Independence;

d. the recipient of the Allowance the Widow/Widower of a recipient of benefits as referred to in letter a, letter b, and the letter c;

e. a recipient of benefits is former Royal Nederland Indonesisch Leger/Royal Marine (ROYAL/KM);

f. Recipient Benefits Orphans/Orphan members of TNI/Polri;
g. Allowance Recipients Members of TNI/Polri for dismissed with respect keprajuritannya service between 5 (five) years up to less than 15 (fifteen) years;
h. Retirement Allowances are recipients of the TNI/POLRI for dismissed with respect keprajuritannya between service 15 (fifteen) years up to less than 20 (twenty) years; i. the recipient parents ' Allowances for members of the TNI/Polri which fall; and j.   Recipients Of Disability Allowances.
5. the Pay Warrant further abbreviated MSS is a document published by the Signatory Official SPM (PPSPM) to disburse funds sourced from the list field in the implementation of the budget (DIPA).
6. Warrants Disbursement hereinafter referred SP2D is a warrant issued by the Office of the Ministry of the Treasury of the State (KPPN) as the General Treasurer of the State Power to the execution of expenditure over the burden of Budget revenues and Expenditures of the State based on SPM.
CHAPTER II the GRANTING of SALARY/PENSION/ALLOWANCE THIRTEENTH MONTH of article 2 (1) of the civil service, State officials, and the recipients of pensions/Allowances given salary/pension/allowance thirteenth month in fiscal year 2013.
(2) civil servants referred to in subsection (1) includes: a. civil servants stationed or deployed abroad;

b. civil servants employed outside the Government agencies that his salary was paid by the parent agency;

c. civil servants who were laid off temporarily;

d. civil servants waiting money recipients; and e. Prospective civil servants.
(3) civil service referred to in subsection (1) does not include civil servants who are currently undergoing a leave outside the country or dependent seconded outside government agencies.
Article 3 (1) the magnitude of the salary/pension/allowance thirteenth month as referred to in article 2 is given of earnings a month received by June 2013.
(2) the Earnings referred to in subsection (1) for: a. civil servants and State officials include base salary, allowances, family allowances Office/common stipends, allowances and Special Allowances performance/Financial Coaching State (TKPKN); b. Recipients include family allowances, pensions, and allowances for additional income; and c.  The recipient of the Alimony received only benefits appropriate legislation.
(3) the Office of Allowances referred to in paragraph (2) letter a include: a. structural Office allowances;

b. functional Office allowances; and c. the allowance which is equated with the perks of Office.
(4) the allowances that equated with perks of Office as referred to in paragraph (2) Letter c is: a. Power Educational Allowances;

b. Allowances Office of Member and Secretary of the surrogate Court of the cruise;

c. Office of Allowances for Certain Officials who are assigned to the Agency's Financial Examiner;

d. allowance of judges;

e. Allowances Clerk;

f. Allowances Bailiff and the Bailiff's replacement;

g. Allowance for Volcano Observers PNS Group I and group II; and h. Perks Correctional Officers.
(5) the magnitude of the earnings referred to in subsection (1) does not include other types of allowances as follows: a. Alimony Archives Management for CIVIL SERVANTS at the national archives of the Republic of Indonesia environment;

b. the radiation Hazard Allowances for CIVIL SERVANTS in the Environment Agency Watchdogs of nuclear power;

c. Nuclear Danger Allowances for civil servants in the environment of the national nuclear power Agency;

d. Radiation Hazard Allowances for workers to radiation;

e. Benefits of risk safety and Health Hazards in implementing Persandian;

f. Persandian Security Benefits;
g. Allowance Risk safety and Health Hazards in the conducting of the search and Rescue for public servants in the national SAR Agency Environment; h. Perks of the profession of teachers and Lecturers, a special allowance of teachers and professors, as well as Honorary Professor of Allowances;

i. Additional Income for CIVIL SERVANTS;

j. special perks Papua Province;

k. Allowance for civil servants whose Devotion to work and live in remote areas;
b. the operating Allowance Safeguards For TNI Soldiers and CIVIL SERVANTS who served in the Security Operations on small islands Outlying and border regions; Special Allowances and m. area of Small Outlying Islands and/or the border region For public servants in the State police of the Republic of Indonesia in charge in full for the region of Small Outlying Islands and/or border regions.
(6) Additional earnings as referred to in paragraph (2) letter b is an additional income for the recipient of a retirement pension due to a new principal is not experiencing a rise in earnings, revenue decline, or increase revenue but less than 5% (five percent) in accordance with the legislation.

(7) in terms of revenue a month received by June 2013 referred to subsection (1) has not paid of rights which should be accepted, the corresponding to remain given the difference in lack of salary/pension/allowance thirteenth month.

Article 4 (1) in terms of civil service, State officials, and the recipients of pensions/Alimony received more than 1 (one) earning a salary with a retirement/benefits or some type of pension/allowance, salary/pension/allowance thirteenth month is awarded only to one that is more profitable.
(2) the amount of the more beneficial as referred to in subsection (1) is the greatest income received by civil servants, State officials, and the recipients of pensions/Allowances.
(3) if later turns out there are civil servants, State officials, and the recipients of pensions/allowances that already receive more than 1 (one) income in the form of salary/pension/allowance thirteenth month referred to in subsection (1), the overpayment is debt and mandatory return to the State in accordance with the legislation.
(4) in the event of civil service, State officials, the recipient of a pension/Allowance referred to in subsection (1) as well as the recipient of a pension/allowance the widow/widower, corresponding to the given also retired widow/widower allowance/thirteenth month.
Article 5 (1) the recipient's salary sign-on of civil servants/Officials who died or was killed given the salary of the thirteenth month of salary income of the Canal received in June 2013.

Article 7 (1) of the civil service, State officials, Recipients, and recipients of Benefits who receive income salary/pension/allowance thirteenth month exceed Income Not Taxable, the income tax is borne by the Government of the appropriate legislation. Article 8 the provisions in the regulations the Minister is valid also for the Chairman, Vice Chairman, and members of the regional representative Council, other officials of the financial rights/equality/administrative-level Ministers, and Deputy Ministers.

Article 9 the necessary Budget for the payment of salaries/pensions/alimony thirteenth month charged to: a. Budget revenues and State Spending for: 1. The Central CIVIL SERVANTS;

2. the members of the INDONESIAN ARMED FORCES;

3. Members of the national police;

4. The recipient of a pension;

5. The recipient of the alimony;

6. State officials other than the Governor and Vice Governor, Bupati/Walikota, and Deputy Regent/Deputy Mayor;

7. The Chairman, Vice-chairman, Member of the regional representative Council;

8. other Officials of the financial rights/equality/administrative Ministerial; and 9. The Deputy Minister.
b. income and Budget Shopping Area for: 1. PNS region;

2. the Governor and Vice Governor; and 3. Regent/Vice Regent and Mayor/Deputy Mayor.
CHAPTER III SALARIES/ALLOWANCES THIRTEENTH MONTH for CIVIL SERVANTS, members of a CLUB. TNI/POLRI, and STATE OFFICIALS article 10 (1) Salary/allowances thirteenth month for CIVIL SERVANTS, members of a Club. TNI/Polri, and State officials, payable in June 2013.
(2) in the case of granting salary/allowances thirteenth month has yet to be paid out in June 2013, the payoff can be done after June 2013.
Article 11 payment of salaries/allowances thirteenth month as stipulated in article 10 Work Units charged on TH regarding the fiscal year 2013.

Article 12 (1) PPSPM ask a SPM salary/allowance, the following salary/benefits, and the difference in the lack of salary/allowances thirteenth month to KPPN.
(2) For a unit of Work that have been using the Application Center of CIVIL SERVANTS Salaries (GPP), submission of SPM as referred to in subsection (1) is accompanied by a computer Data Archive (ADK) application GPP latest version.

Article 14 procedures for issuing and filing of SPP, SPM and SP2D the granting of salary/allowances thirteenth month is set as follows: a. for a work Unit in addition to the Defense Ministry and national army following the regulation of the Minister of finance Indonesia Number 190/FMD. 05/2012 about Payment Procedures in the framework of the implementation of Budget revenue and Expenditure of the State.
b. for a work unit of the Ministry of National Defense and the army of Indonesia following the provisions on implementation procedures of payment expenditure clerk in the Environment Ministries of defence and the national army of Indonesia.
c. for a work unit of the national police following the provisions on the mechanism of implementation of the Budget of the State Expenditures and Revenues in the environment of the Republic of Indonesia national police (Polri).
CHAPTER IV PAYMENT of the SALARY/ALLOWANCE THIRTEENTH MONTH to the REGIONAL CIVIL AFFAIRS OFFICERS, GOVERNORS and DEPUTY Governors, REGENT/VICE REGENT, and the MAYOR/DEPUTY MAYOR of article 15 (1) Salary/Allowances thirteenth month for CIVIL SERVANTS of the region, Governor and Deputy Governor, Governor/Vice Regent and Mayor/Deputy Mayor paid in June 2013.
(2) in the case of granting salary/allowances thirteenth month has yet to be paid out in June 2013, the payments referred to in subsection (1) is made after June 2013.
Article 16 salaries/allowances thirteenth month as stipulated in article 15 is charged to the income and Expenditure budget of the regions concerned.

Chapter V PAYMENT of PENSIONS/ALIMONY THIRTEENTH MONTH article 17 (1) the payment of pensions/alimony thirteenth month fiscal year 2013 by PT Taspen (Persero) and PT Asabri (Persero) was implemented in June 2013.
(2) the retirement pension granted to the recipient thirteenth month of retirement of principal plus additional allowances and family income and is not subject to discounted health insurance.
(3) to the recipient of the alimony awarded alimony thirteenth month of allowance appropriate legislation and is not subject to discounted health insurance.
(4) in the event of the grant of a pension/allowance thirteenth month has yet to be paid out in June 2013, the payments referred to in subsection (1) is made after June 2013.
Article 18 Liability of payment Letter (SPJP) Retired thirteenth month is made apart with SPJP monthly Pension.

CHAPTER VI CLOSING PROVISIONS article 19 this Ministerial Regulation comes into force on the date of promulgation.
