REGULATION of the MINISTER of FINANCE of the REPUBLIC of INDONESIA NUMBER 40/FMD. 02/2013 ABOUT CHANGES to the REGULATION of the MINISTER of FINANCE NUMBER 35/FMD. 02/2011 ABOUT the PROCEDURES for calculation, provision, liquefaction, the STATE BUDGET FUNDING and ACCOUNTABILITY ACTIVITIES CARRIED OUT by PT ASKES (PERSERO) with the GRACE of GOD ALMIGHTY the MINISTER of FINANCE of the REPUBLIC of INDONESIA, Considering: a. that it is based on the regulation of the Minister of finance Number 35/FMD. 02/2011 has been set regarding the provisions of the Ordinance the calculation , provision, liquefaction, and accountability of the Fund's budget income and Expenditure the country that its activities are implemented by PT Askes (Persero);
b. that the accuracy of expenditure within the framework of the health insurance program administered by PT Askes (Persero), needs to be provisions on the calculation of quantity needs funds and the implementation of the reconciliation fund BUDGET the activities carried out by PT Askes (Persero);
c. that in connection with the letter b above, the need for changes to the regulation of the Minister of finance Number 35/FMD. 02/2011 about the procedures for calculation, provision, liquefaction, The STATE BUDGET Funding and accountability Activities carried out by PT Askes (Persero);
d. that based on considerations as referred to in letter a, letter b, letter c, and the need to set a regulation of the Minister of finance about the changes to the regulation of the Minister of finance Number 35/FMD. 02/2011 about the procedures for calculation, provision, liquefaction, The STATE BUDGET Funding and accountability Activities carried out by PT Askes (Persero);

Decide: define: REGULATION of the MINISTER of FINANCE ABOUT the CHANGES to the REGULATION of the MINISTER of FINANCE NUMBER 35/FMD. 02/2011 ABOUT the PROCEDURES for calculation, provision, liquefaction, the STATE BUDGET FUNDING and ACCOUNTABILITY ACTIVITIES CARRIED OUT by PT ASKES (PERSERO).
Article I a few provisions in the regulation of the Minister of finance Number 35/FMD. 02/2011 about the procedures for calculation, provision, liquefaction, The STATE BUDGET Funding and accountability Activities carried out by PT Askes (Persero) is amended as follows: 1. the conditions of Figure 1, Figure 3, Figure 4, and numbers 7 article 1 amended so that article 1 reads as follows: article 1 In this ministerial regulation does : 1. The STATE BUDGET Funds its activities Conducted by PT Askes (Persero) is sourced from STATE BUDGET funds allocated to pay Dues of health insurance, health maintenance Allowance veterans and Independence Pioneers, Minister of health care Assurance Program and Certain Officials, health care Assurance Program Chairman, Vice Chairman, and members of the House of representatives, the regional representative Council, the Judicial Commission, Financial Examiners, judges of the Constitutional Court , and Chief Justice of the Supreme Court as well as the help of Service Tools and Sophisticated Health Katastrofi.
2. The health insurance Contribution is a contribution of funds provided by the Government every month for conducting health insurance for civil servants and recipients of pensions included ministers and Officials, as well as Chairman, Vice Chairman, and members of the House of representatives, the regional representative Council, the Judicial Commission, Financial Examiners, judges of the Constitutional Court, and Chief Justice of the Supreme Court.
3. Health Care Benefits veterans and Independence Pioneers is the dues paid to the Government's governing body for the maintenance of the health of veterans and Independence Pioneers and their families including the widow/widower/orphans of veterans and Independence Pioneers.
4. Assistance Services health equipment and Sophisticated Katastrofi is the contribution of the funds is given every year to the Organization of the Government health insurance for civil servants, Pension Recipients, veterans and Independence Pioneers along with his family, including a widow/widower/orphans of veterans and Independence Pioneers.
5. PT. Askes (Persero) is the governing body that carries out the activities of the Organization of health insurance for civil servants, Pension Recipients, veterans, pioneer of Freedom with his family, Ministers and officials, as well as Chairman, Vice Chairman, and members of the House of representatives, the regional representative Council, the Judicial Commission, Financial Examiners, judges of the Constitutional Court, and Chief Justice of the Supreme Court.
6. Civil servant is a candidate for civil servants, a civil servant, and State officials as stipulated in Act No. 8 of 1974 about Staffing issues as amended by Act No. 43 of 1999.

11. Recipients are: a. the civil servant who quit with pension rights;

b. members of the INDONESIAN ARMY, police and civil servant in the Defense Ministry of the environment, the TNI and police who stop with retirement;

c. State officials who quit with pension rights, including members of the regional representative Council;

d. the widow or widower or orphan from civil servants, members of the INDONESIAN ARMY, police and civil servant in the Defense Ministry of the environment, the TNI and police and State officials who got the pension rights, including members of the regional representative Council.

2. 2. estimates of the number of civil servants and recipients of pensions included ministers and Officials, as well as Chairman, Vice Chairman, and members of the House of representatives, the regional representative Council, the Judicial Commission, Financial Examiners, judges of the Constitutional Court, and Chief Justice of the Supreme Court; and 3. defined contribution health rates in accordance with regulation perundangan-undangan.
b. quantity Allowances Healthcare veterans and Independence Pioneers are calculated based on: 1. the calculated earnings estimate of 45% (forty five percent) of the salary of CIVIL SERVANTS The IIIA with the working period of 15 (fifteen) years;

2. estimated number of veterans and Independence Pioneers; and 3. defined contribution health rates by 4% (four percent) of the estimated revenue referred to in number 1.
c. quantity Katastrofi assistance services and Sophisticated Health Tools are calculated based on: 1. the estimated cost of the Ministry of health equipment and sophisticated katastrofi; and 2. assistance provided most of 50% (fifty percent) of the estimated cost referred to in number 1.
(2) based on the needs of the Fund referred to in subsection (1), the proposed STATE BUDGET Funds the KPA That Activities Undertaken by PT Askes (Persero) to the Minister of Finance of cq. The Directorate General Of Budget.

(4) the results of the calculation referred to in paragraph (3) was poured in a news event which was signed by representatives of the Directorate General of the budget, KPA, and PT Askes (Persero).
(5) on the basis of the news event as referred to in paragraph (4) of the Directorate General of the budget allocate Funds The STATE BUDGET its activities Conducted by PT Askes (Persero) in the draft BUDGET.
3. The provisions of article 5 paragraph (4) are amended so that article 5 reads as follows: article 5 (1) on the basis of the notifications as referred to in article 4 paragraph (2), request the provision of the funds of the KPA on NATIONAL BUDGET The Activities carried out by PT Askes (Persero) to the Director General of budget.
(2) Upon request the provision of the funds referred to in subsection (1) of the Directorate General of the budget along with the KPA carry out examinations over the use of STATE BUDGET Funds allocation plan of The Activities carried out by PT Askes (Persero).
(3) based on the results of the review referred to in subsection (2), the Director General of the budget publishes a letter Assignment work plan Budget BUN for the purposes of The STATE BUDGET Funds its activities Conducted by PT Askes (Persero).

(4) Based on the letter of Assignment work plan Budget BUN referred to in paragraph (3), KPA composed and signed Checklist of implementation of the budget (DIPA) for endorsement in accordance with the provisions of the legislation.

4. 5. 6. The provisions of article 11 is amended to read as follows: article 11 The STATE BUDGET Disbursement Activities Implemented by PT Askes (Persero) that have been defined in the STATE BUDGET is implemented with the following conditions: a. to Help ministries of health equipment and Sophisticated Katastrofi conducted each month of 1/12 (one per twelve) from pagu; and b. for defined contribution health insurance, health maintenance Allowance veterans and Independence Pioneers, Minister of health care Assurance Program and Certain Officials, health care Assurance Program Chairman, Vice Chairman, and members of the House of representatives, the regional representative Council, the Judicial Commission, Financial Examiners, judges of the Constitutional Court, and Chief Justice of the Supreme Court are conducted every month based on estimated income of participants and data.

7. Between article 11 and article 12 pasted one article, namely Article 11A, so Article 11A read as follows: Article 11A (1) KPA and PT Askes (Persero) do a reconciliation or calculation of back Dues Fund health insurance, health maintenance Allowance veterans and Independence Pioneers, guarantee the maintenance of the Health Minister and Certain Officials, guarantee Healthcare Chairman, Vice Chairman, and members of the House of representatives , Regional representative Council, the Judicial Commission, Financial Examiners, judges of the Constitutional Court, and Chief Justice of the Supreme Court, which had been disbursed/invoiced with bills that are supposed to be filed based on the realization of income, and/or the realization of data retention.
(2) Reconciliation or the calculation of the return referred to in subsection (1) is carried out quarterly.
(3) In terms of the results of reconciliation or the calculation of the return referred to in subsection (1) indicates the amount of funds disbursed exceeds the amount of funds which should have been proposed based on the realization of income, and/or the realization of data retention, the benefits should be taken into account at the next quarterly Bill submission.
(4) In terms of the results of reconciliation or the calculation of the return referred to in subsection (1) indicates the amount of funds disbursed is less than the amount of funds which should have been proposed based on the realization of income, and/or the realization of data retention, the drawback can be added on the submission of bills next quarter.
(5) in the first quarter of next year, KPA and PT Askes (Persero) do a reconciliation or calculation of back Dues Fund health insurance, health maintenance Allowance veterans and Independence Pioneers, guarantee the maintenance of the Health Minister and Certain Officials, guarantee Healthcare Chairman, Vice Chairman, and members of the House of representatives, the regional representative Council, the Judicial Commission, Financial Examiners, judges of the Constitutional Court, and Chief Justice of the Supreme Court , which has been disbursed/invoiced on the previous budget year with a bill that's supposed to be filed based on the realization of income, and/or the realization of data retention.
(6) In terms of the results of reconciliation or the calculation of the return referred to in subsection (5) indicate the amount of funds disbursed exceeds the amount of funds which should have been proposed based on the realization of income, and/or the realization of data retention, the excess must be remitted to the State Treasury by PT. Askes (Persero).
(7) In terms of the results of reconciliation or the calculation of the return referred to in subsection (5) indicate the amount of funds disbursed is less than the amount of funds which should have been proposed based on the realization of income, and/or the realization of data retention, the drawback is proposed to be budgeted for the next year.
(8) The results of reconciliation or the calculation of the return referred to in subsection (1) and paragraph (5) should be poured in a news event which was signed by representatives of the KPA and PT Askes (Persero).

8. The provisions of article 2 is modified to read as follows: article 14 (1) in the framework of the implementation of the health security program for civil servants, Pension Recipients, veterans and Independence Pioneers, as well as the implementation of the Security Program and officials of the Minister of health maintenance, and health care Assurance Program Chairman, Vice Chairman, and members of the House of representatives, the regional representative Council, the Judicial Commission, Financial Examiners, judges of the Constitutional Court , and Chief Justice of the Supreme Court and their families, carrying out monitoring and evaluation of the KPA towards the implementation of the health insurance services and funding health coverage periodically.
(2) the results of the implementation of the monitoring and evaluation referred to in paragraph (1) may be used by the Directorate-General of budget and related institutions as material input in proposing the allocation of funds and implementation of the health insurance Contribution disbursements, benefits health care Veteran and pioneer of independence, Minister of health care Assurance Program and Certain Officials, health care Assurance Program Chairman, Vice Chairman, and members of the House of representatives, the regional representative Council Financial Examiners, the body, the judicial Commission, the judge of the Constitutional Court and the Chief Justice of the Supreme Court as well as the help of Service Tools and Sophisticated Health Katastrofi by Directorate General of the budget and the relevant agencies on the STATE BUDGET of the next fiscal year.

9. The provisions of article 16 is amended to read as follows: article 16 Ministerial Regulation applies throughout the health insurance Contribution funds, health care Benefits veterans and Pioneers of independence, Minister of health care Assurance Program and Certain Officials, health care Assurance Program Chairman, Vice Chairman, and members of the House of representatives, the regional representative Council, the Judicial Commission, Financial Examiners, judges of the Constitutional Court, and Chief Justice of the Supreme Court as well as the help of Service Tools and Sophisticated Health Katastrofi still budgeted/provided in the STATE BUDGET.
Article II of this Ministerial Regulation comes into force on the date of promulgation.
