ABOUT
CHANGES TO THE TRADE MINISTER ' S REGULATION NUMBER 48/M-DAG/7/2012 ON THE TERMS OF THE EXPORT OF NON-SUBSIDY UREA FERTILIZER

WITH THE GRACE OF THE ALMIGHTY GOD

TRADE MINISTER OF THE REPUBLIC OF INDONESIA,

Weigh: a.  that in an attempt to provide certainty to seek and improve the effectiveness of the implementation of the Export Fertilizer Urea Non Subsidy, it needs to be made changes to some provisions in the Regulation of Trade Minister Number 48/M-DAG/PER/7/2012 about The Export Provisions Of The Urea Non Subsidy Fertilizer;
b. that under consideration as referred to in the letter a, need to establish a Trade Minister Regulation on the Change of the Regulation of Trade Minister Number 48/M-DAG/PER/7/2012 on the Provisions Of The Non-subsidized Urea Fertilizer Export;

DECIDED:

Establish: REGULATION OF TRADE MINISTERS ON THE CHANGE OVER TRADE MINISTER REGULATION NUMBER 48/M-DAG/7/2012 ON THE PROVISIONS OF EXPORT OF NON-SUBSIDIZED UREA FERTILIZER.

Section 1
Some provisions in the Regulation of Trade Minister Number 48/M-DAG/PER/7/2012 on the Non Subsidy Urea Fertilizer Export Provisions are changed as follows:
1. The provisions of Article 1 of the number 2 are amended, so that Article 1 reads as follows:

Section 1
In Regulation of this Minister, it is referred to:
1. Export is the issuing of goods from the customs area.
2. Pupuk Urea is a chemical fertilizer that contains high levels of nitrogen (N), in the form of white crystalline grains and liquids, with the chemical formula CO (NH2) 2, an easy soluble fertilizer in water and its properties are very easy to absorb water (higroscopic).
3. Urea Non Subsidy is the Urea Pupuk in which it is not contained a subsidy acquisition of the government.
4. Special Working Group of Fertilizer Policy Studies in order to support the Food Resistance that is next called Pokja is a working group formed by the Minister of Agriculture as the Daily Chairman of the Food Detainees Council.
5. PT Pupuk Indonesia (Persero) is the holding company of the State-owned Enterprises Agency (BUMN) manufacturer in the field of fertilizer.
6. Children of PT Pupuk Indonesia (Persero) are State-Owled Enterprises (BUMN) manufacturers in the field of fertilizer namely PT Fertilizer Sriwidjaja Palembang, PT Petrokimia Gresik, PT Fertilizer Kaltim, PT Fertilizer Kujang, and PT Pupuk Iskandar Muda.
7. Letter of Export Allocation Of Urea Non Subsidy which is subsequently called SKAE Fertilizer Urea Non Subsidy is a paper published by PT Pupuk Indonesia (Persero) which makes clear about the distribution of export allocation of Pupuk Urea Non-Subsidized Fertilizer Subsidies to his subsidiaries.
8. Urea Non Subsidy Fertilizer Export Export Approval Letter called SPE Fertilizer Urea Non Subsidy is a letter of approval for the implementation of non-subsidized urea fertilizer export.
9. The Minister is the minister who organizes government affairs in the field of commerce.
10. Director General is Director General of Foreign Trade Ministry of Commerce.

2. The provisions of Article 2 of the paragraph (1) are changed, so that Article 2 reads as follows:

Section 2
(1) Non-Subsidized Fertilizers that export only Urea Non Subsidies Fertilizer included in the Tarif/HS Post 3102.10.00.00; ex. 3102.90.00.00 and ex. 3105.10.90.00.
(2) All Subsidised Pupuk is forbidden to be exported.

Section II
The rules of the Ministry are effective on the date of the promulgations.
