Section 1
General provisions

§ 1 Scope

(1) This Regulation provides for the protection of animals during transport, in particular the implementation of Council Regulation (EC) No 1/2005 of 22 December 2004 on the protection of animals during transport and related operations, and on the protection of animals during transport and related operations. Amendment of Directives 64 /432/EEC and 93 /119/EC and Regulation (EC) No 1255/97 (OJ L 197, 21.7.1997, p. EU 2005 No L 3 p. 1; 2006 No 26). (2) This Regulation shall not apply to transports within the meaning of Article 1 (5) of Regulation (EC) No 1/2005, except for sections 7 and 8 of this Regulation. Unofficial table of contents

§ 2 Admission number

The approval number within the meaning of Article 13 (2) of Regulation (EC) No 1/2005 is twelfth and shall be made up of the official key number of the Federal Statistical Office designated for the transport operator's congregation. Section 3 Exceptions to road transport equipment

In the case of national transport of animals within the meaning of Article 18 (4) of Regulation (EC) No 1/2005, road transport equipment may be used which, by way of derogation from
1.
Article 18 (1) of Regulation (EC) No 1/2005 does not apply to proof of authorisation,
2.
Annex I, Chapter VI, point 3.3 of Regulation (EC) No 1/2005 does not cover equipment with a temperature monitoring system and a data recorder, or
3.
Annex I, Chapter VI, point 4.1 of Regulation (EC) No 1/2005 does not cover equipment with a navigation system

§ 4 Qualification certificate

(1) The evidence of formal qualifications referred to in Article 17 (2) of Regulation (EC) No 1/2005 shall be issued by the competent authority, on request, except in the cases referred to therein, even if:
1.
a successful completion of a university degree or a university of applied sciences in the field of agriculture or veterinary medicine after 5 January 2007,
2.
a final examination after 5 January 2007 in the professions of Fleischer (including slaughtering of animals), a farmer, a horse farmer, an animal keeper, an animal host or other recognised professional qualifications or evidence, which shall be the subject of the required technical certificate , or
3.
After 5 January 2007 and before 19 February 2009, an examination of the subject-matter in accordance with Section 13 (3) of the Animal Protection Transport Regulation as amended by the Notice of 11 June 1999 (BGBl. I p. 1337)
(2) Persons who have acquired a qualification within the meaning of paragraph 1 before 6 January 2007 shall be issued by the competent authority on request a certificate of formal qualifications if knowledge of Annex IV (2) (a) of the Regulation (3) The evidence of formal qualifications must be revoked if the holder of the certificate has repeatedly or grossly failed to comply with the provisions of Regulation (EC) No 1/2005 or this Regulation and if the facts justify the adoption of the facts, that this continues to happen. § 5 Rail transport

In addition to the Community rules or regulations on rail transport, the haulier within the meaning of Article 2 (x) of Regulation (EC) No 1/2005 (transporter) and the organiser shall have the right to: within the meaning of Article 2 (q) of Regulation (EC) No 1/2005 (organiser) in the case of national rail transport, to ensure that:
1.
Vertebrate animals or the containers in which vertebrate animals are located shall be loaded in such a way as to be accessible to a companion for the purpose of feeding, drinking and caring for the animals,
2.
In the case of transverse loading, they are transported to the same side of the wagon or face each other when they are loaded in a longitudinal direction.
Sentence 1 No 2 shall not apply to the extent to which the animals are placed in individual boxes in the means of transport. Foals and halfway uninhabited animals do not need to be linked.

Section 2
Transport in containers

§ 6 Special requirements for containers

In addition to the provisions of Community law or regulations on transport in containers, the sender shall ensure, in the case of national transport, that:
1.
animals of the species listed in Appendix 1 are only transported in containers which meet the requirements of Appendix 1; and
2.
as far as minimum or maximum numbers for animals per container are required in Annex 1, these are complied with.
If the transporter or the organiser takes over the loading of the animals into the containers, it shall ensure compliance with the requirements of the first sentence. The first sentence of paragraph 1 shall not apply in the case of air transport and the transport of land in connection with that transport. Unofficial table of contents

§ 7 Duties of the sender

(1) In addition to the provisions of Community law or regulations on the transport of animals in containers and the requirements of § 6, animals, other than farmed animals, may only be dispatched within the state. , if the sender is satisfied with the correctness of the addressee's address. The container must be provided with the appropriate addresses of the sender and the recipient. The consignor must inform the consignee about the time of dispatch and the estimated time of arrival, the place of destination and the shipping method. (2) The sender must ensure that:
1.
only those containers which protect the animals from foreseeable adverse weather conditions shall be used; or
2.
an equivalent level of protection is granted in other ways during transport.
(3) The shipper shall ensure that animals whose carriage is likely to take 12 hours or longer are fed and soaked before loading or acceptance by the transporter or the organiser. Animals must not be overfed. (4) The shipper must ensure that animals in the container are able to receive added feed and drinking water in sufficient quantities, even during an approximately necessary return transport. In addition, the sender must provide information on the type and number of the animals and on the supply in case of emergency. (5) The sender must ensure that, if a shipment is not accepted, the return shipment is required at the latest by the end of the shipment. to be completed on Fridays or on holidays. Section 8 Follow-up

(1) The sender may only send animals with cash on delivery if they have been ordered in writing and the recipient has given the sender a written assurer that the animals will be accepted immediately after their arrival. If the consignor and the consignee have a permit pursuant to Section 11 of the Animal Protection Act or act on a commercial basis with agricultural livestock, the addressee may give this written assurance for a period of not more than twelve months in the Issue ahead. The order is not in writing. (2) With cash on delivery, animals must not be sent to a country which is not a member of the European Union (third country). (3) If the consignment is refused or the consignment is not collected, the consignment is not collected, Vertebrate animals shall be adequately controlled and cared for by the transporter or by the organiser. The animals are to be returned to the sender with the next possibility. (4) Shipments of vertebrate animals which cannot be delivered in the first delivery attempt shall be renewed at the next opportunity, at the latest after six hours have elapsed. or to return it with the next possibility.

Special provisions for the protection of livestock in national transport

§ 9 Space requirements and care

(1) In addition to the provisions of Community law or the provisions of Union law, the person who carries in domestic animals or animals of the genus bovine, ovine, caprine or porcine animals, in so far as they are domestic animals, shall be responsible for the transport of domestic animals or animals. § 10 Restriding of transport

(1) In addition to the provisions of Community law or the provisions of Union law, livestock animals may not be transported for more than eight hours in the context of national transport operations to a slaughterhouse. This shall not apply to the extent that the transport period is exceeded in unforeseeable circumstances. (2) Paragraph 1 shall not apply where:
1.
the farm animals are transported in means of transport authorised in accordance with Article 18 (2) of Regulation (EC) No 1/2005 and which meet the requirements laid down in Annex I, Chapter VI, points 1.1, 1.2, 1.6 to 1.8, 2, 3 and 4.1 of Regulation (EC) No 1/2005 meet,
2.
in the case of transport, the requirements laid down in Article 5 (4) and in Annex I, Chapter VI, points 1.3 to 1.5 and 1.9 of Regulation (EC) No 1/2005, are complied with, and
3.
the transporter carrying out the transport has an authorisation pursuant to Article 11 (3) of Regulation (EC) No 1/2005.
(3) In the cases referred to in paragraph 1, the animals shall be charged immediately upon arrival in the slaughterhouse. (4) Calves less than 14 days old may not, subject to the provisions of Article 1 (2) of Regulation (EC) No 1/2005, be within the national authorities shall be carried. Unofficial table of contents

§ 11 Eintagsküken

Section 4
Special provisions for the protection of animals other than farm animals

§ 12 Sea mammals and birds

(1) In addition to the provisions of Community law or regulations, marine mammals must be cared for by a competent person in the case of domestic transport. Containers in which marine mammals are transported must not be stacked. (2) In addition to the Community rules or regulations, other birds may be used as poultry and other birds of the Stubenz national transport only in darkened containers. However, so much light must be available to the animals that they can orient themselves and take up feed and water. Unofficial table of contents

§ 13 Invertebrate Invertebrates and invertebrates

(1) In addition to the Community rules or rules on Union law
1.
In the case of domestic transport, the shipper shall ensure that, with the exception of fish species of moderate climatic zones and invertebrate animals, intervertebral vertebrate animals are only transported in containers which are used to avoid severe temperature fluctuations are isolated,
2.
Fish may only be transported in the case of domestic transport in containers whose volume of water provides sufficient movement for the animals.
By way of derogation from the first sentence of paragraph 2, eels may also be transported in sufficiently moist packaging. Unsafe fish as well as fish of considerably different sizes must be separated from each other. The sender has to ensure that the particular water quality and temperature requirements of each species are taken into account. In particular, an adequate supply of oxygen to the animals must be ensured. (2) Crustaceans may only be transported in the water or temporarily on a damp substrate.

Cross-border transport

Section 14 Exports on certain supervisory bodies

(1) The export of animals is permitted only through customs offices with assigned border inspection posts or other exit points, which the Federal Office for Consumer Protection and Food Safety (Bundesamt für Consumer and Food Safety) in agreement with the Federal Ministry of Finance in the Federal Gazette (Bundesanzeiger). The Federal Ministry of Finance may delegate the grant of the agreement to the central authorities of its business unit. (2) The exporter of animals shall have the estimated arrival of the border inspection post or other point of departure. Transport by indicating the type and number of animals at least one working day before. The competent authority may allow exceptions to the extent that animal welfare concerns are not in conflict. § 15 Display of arrival

(1) If animals are received from a third country in the course of an economic activity, the competent authority of the place of destination shall have the estimated time of arrival, indicating the type and number of animals, at least one working day before the date of arrival. . The obligation to notify in accordance with the provisions of the first sentence shall not apply to animals whose arrival is to be notified in accordance with the Single Market Animal Health Regulation. (2) The importer of animals shall have the border inspection post the expected arrival of the transport, indicating the nature of the animal. and the number of animals must be displayed at least one working day before. The competent authority may allow exceptions. The obligation to notify in accordance with the provisions of the first sentence shall not apply to animals whose arrival is to be notified in accordance with the Internal Market Animal Health Regulation. Section 16 Imports of certain supervisory bodies

The import of animals as part of an economic activity is permitted only through customs offices with assigned border inspection posts, which the Federal Office for Consumer Protection and Food Safety (Bundesamt für Consumer and Food Safety) in agreement with the Federal Ministry of Finances in the Federal Gazette has announced. Section 17 Import document

In the case of imports of calves or pigs, the transport must be accompanied by a certificate issued by the competent authority of the country of origin, confirming that the animals are in each case at least in accordance with the provisions of animal protection law of the European Union. Section 18 Requirements for imports

The importation of animals shall be permitted only if the necessary import documents are carried out in accordance with Article 17 and the competent authority has established, in an investigation pursuant to section 19, that the provisions of Regulation (EC) No 1/2005 and of this Regulation shall apply. Section 19 Import investigation

In the case of import and transit, the competent authority shall verify, at the border inspection post, through inspection of the animals and the means of transport, as well as through document verification and inspection, whether the animal protection provisions are complied with. The control shall be carried out in accordance with Annex 3. (2) By way of derogation from paragraph 1, animals from third countries which are party to the Agreement on the European Economic Area shall be subject, on importation, in addition to the document verification procedure, to: (3) Article 21 of Regulation (EC) No 1/2005 shall remain unaffected.

Section 6
Powers of the Authority, Administrative Offences

Section 20 Powers of the Authority

(1) Transport may be stopped and checked at any time. (2) If the competent authority is in breach of the provisions of this Regulation or if it finds that there is a risk of an infringement of Article 10 (1), it may, in particular: order that
1.
the further transport or return of the animals to the place of dispatch shall be carried out in the shortest possible way, provided that the physical condition of the animals permits,
2.
the animals are unloaded, housed and supplied until such time as the animals are kept in a way which is appropriate to the requirements of this Regulation; or
3.
the animals are slaughtered or killed in the prevention of pain or suffering.
In the event of a return to a third country, the border inspection body responsible shall inform the border inspection posts for the importation of the animals concerned of the refusal of the consignment, indicating the identified (5) Articles 23, 24 (1) and 26 of Regulation (EC) No 1/2005 shall be taken into account in the case of infringements. § 21 Administrative Offences

(1) Contrary to the provisions of Section 18 (1) (3) (a) of the Animal Welfare Act, those who intentionally or negligently act in accordance with the law of the law
1.
Contrary to Article 5, sentence 1, point 1, it does not ensure that vertebrate animals or the containers in which vertebrate animals are located are loaded in such a way that they are accessible to a companion,
2.
Contrary to Section 5, sentence 1, no. 2, it does not ensure that solipeds are transported in the manner referred to therein,
3.
Contrary to Article 6, sentence 1, it does not ensure that an animal is transported in a container referred to therein,
4.
a provision in Section 7 (1), (2), (3), (4) or (5) relating to the obligations relating to the dispatch of animals,
5.
, contrary to § 8 (1) sentence 1 or (2), an animal is sent,
6.
Contrary to Section 8 (3) or (4), an animal is not nourished or returned,
7.
Contrary to Section 9 (1), there is no provision for a specification referred to therein
8.
Contrary to § 9 (2) sentence 1, the minimum floor area referred to therein shall not be maintained,
9.
Provides more than twice the minimum floor area, contrary to Article 9 (2) sentence 2,
10.
, contrary to the first sentence of Article 10 (1) or Article 12 (2) sentence 1, a so-called animal is transported,
11.
Contrary to Section 11 (2), it does not ensure that the temperature referred to therein prevails or
12.
Contrary to Section 13 (1), it does not ensure that a named animal is transported in a container named therein.
(2) Contrary to the order of § 18 (1) (3) (b) of the Animal Welfare Act, who intentionally or negligently
1.
in accordance with Article 14 (1) sentence 1, an animal or
2.
, contrary to the first sentence of Article 15 (1) or (2) sentence 1, an indication is not reimbursed, not correct, not complete or not in good time, or
3.
In contrast to § 16 sentence 1, an animal is introduced.
(3) Contrary to Council Regulation (EC) No 1/2005 of 22 December 2004 on the protection of animals during transport and related operations, which is contrary to Article 18 (3) (2) (a) of the Animal Welds Act (Tierschutzgesetz), amending Directives 64 /432/EEC and 93 /119/EC and Regulation (EC) No 1255/97 (OJ L 197, 21.7.1997, p. EU 2005 No L 3 p. 1; 2006 No 26), by intentionally or negligently
1.
contrary to Article 3, first sentence, in conjunction with the second sentence of sentence 2 (c) or (d), animal transport in a means of transport which does not comply with the requirements referred to therein or using a loading or unloading device which does not comply with the requirements referred to in does not comply with, carries out or arrangles requirements;
2.
, contrary to Article 4, does not carry a paper or does not provide it or does not make it available in time
3.
accept an animal transport contract, contrary to Article 5 (1),
4.
, contrary to Article 5 (3) (b), does not ensure that a person is responsible for providing the information referred to therein,
5.
contrary to Article 5 (4) or Article 8 (2), second sentence, respectively in conjunction with Annex II, point 1, this in conjunction with No 2, a logbook not, not correctly or in good time, does not or does not stamp out a page in good time, or not signed or not signed in due time,
6.
the organiser, contrary to Article 5 (4), in conjunction with Annex II (3) (d) or (e), does not ensure that a travel book is stamped or that a travel book accompanies the animal consignment,
7.
in the case of transport operators, in accordance with Article 5 (4), in conjunction with the first sentence of Annex II, point 7, a travel book shall not be handed over or shall not
8.
in accordance with Article 5 (4) in conjunction with Annex II (8), first sentence or (2) or (8), third sentence, a copy, a control sheet or a control statement shall not be retained or shall not be kept for at least three years, or a document shall not be retained, or shall not be returned in time,
9.
, contrary to Article 5 (4) in conjunction with the second sentence of Annex II, point 8, does not make a document accessible or not accessible in good time
10.
, contrary to the second sentence of Article 6 (1), second sentence, sentence 2 or paragraph 8, a copy, proof of competence or proof of authorisation shall not be presented in due time,

13.
, contrary to Article 6 (4), in conjunction with Annex I or II, entrusts the handling of animals to a non-trained person,
14.
, contrary to Article 6 (6), does not ensure that any animal consignment is accompanied by a carer,
15.
shall not, contrary to the second sentence of Article 6 (9), keep a record, or not at least three years, or shall not make it available in good time,
16.
Contrary to the provisions of Article 7 (1) or (2), including in connection with paragraph 3, an animal shall be transported,
17.
, contrary to Article 8 (1) or Article 9 (1), in conjunction with Annex I, Chapter I, No 5, does not ensure that animals are not given a tranquilizer,
18.
, contrary to Article 8 (1) or Article 9 (1), in conjunction with Annex I, Chapter I, No 6, does not ensure that animals are milked in good time,
19.
, contrary to Article 8 (1) or Article 9 (1), in conjunction with Annex I, Chapter III, point 1.2 (b), does not ensure that animals are monitored by a veterinarian,
20.
, contrary to Article 8 (1) or Article 9 (1), in conjunction with Annex I, Chapter III, point 1.8 (a), does not ensure that animals are not beaten or kicked,
21.
contrary to Article 8 (2), second sentence, in conjunction with Annex II, No 5, does not comply with a provision relating to the travel book,
22.
, contrary to Article 9 (1) in conjunction with Annex I, Chapter III, Chapter III, point 1.10, first sentence, does not ensure that devices are kept ready,
23.
, contrary to Article 9 (1) in conjunction with Annex I, Chapter III, point 1.10, sentence 2 or 3, does not ensure that animals are not linked or have access to water,
24.
Contrary to Article 9 (2) (a) in conjunction with Annex I, Chapter I, Chapter II, Nos. 1 and 2, Chapter III, Chapter V or Chapter VI, does not ensure that the handling of animals is entrusted only to personnel who have been trained,
25.
a sedative is administered as a transporter, contrary to Annex I, Chapter I, No 5,
26.

Separation and space requirements

One-hug road, rail and boat transport Up to five adult solipeds are to be separated by a stable separating device, which either extends to the floor of the vehicle and must be interrupted at a height of 120 centimetres, or which can be broken down by a single-hoist. is at least 60 centimetres above the vehicle floor and is at least 60 centimetres high.
2.
Cattle road, rail and ship transport Up to 25 calves or up to six adult bovine animals for cross-loading or up to eight adult bovine animals during transport in the group are each carried by a stable separating device in the case of road transport .
3.
Sheep and goat road, rail and boat transport Up to 50 adult animals must each be separated by a stable separating device.

Pork road, rail and boat transport
4.1
The piglets shall be separated in accordance with the following table:
