§ 1 General

(1) For the exercise of the radio and air navigation service (air service) at ground and air stations in the Federal Republic of Germany, a valid flight certificate or equivalent certificate is required. (2) excluded is the exercise of the air service
1.
in the case of air-radio stations on board, air-borne sports equipment and gliders, provided that they are not operated in the airspace of categories B, C and D;
2.
in the case of air radio stations on board aircraft used in the training of aeronautical personnel;
3.
in the case of radio stations in motor vehicles, which are operated exclusively for connection with radio stations in outdoor pools, air sports equipment and gliding aircraft;
4.
in the case of ground radio stations, which are used exclusively for the transmission of flight operating reports or which are used exclusively for training purposes;
5.
by authorized persons performing maintenance and repair work on radios and participating in the operation for inspection purposes in the framework of this activity;
6.
by the persons concerned who are moving on the premises of an airport with motor vehicles;
7.
in accordance with section 2 (3) of this Regulation.

§ 2 Types of air traffic certificates

(1) The following air-related products shall be issued:
1.
Limited valid radio communications certificate 11 (BZF 11),
2.
Restricted telephone certificate l for the air service (BZF l),
3.
Restricted telephone certificate e for the radio service in English (BZF E),
4.
General radio communications service (AZF),
5.
General speech radio certificate E for the air service in English (AZF E).
(2) Which of the certificates referred to in paragraph 1 is required shall be determined by the nature of the ground or air station to be served. Subject to the provisions of Article 26a (1) sentence 3 of the Air Traffic Order
1.
The BZF II, in the case of flights by visual flight rules, to use the radio station within the Federal Republic of Germany in German;
2.
the BZF I, in the case of flights by visual flight rules, to use the radio in German and English language;
3.
The BZF E, in the case of flights by visual flight rules, to use the radio in English;
4.
the AZF, in the case of flights according to sight and instrument flight rules, to carry out the radio;
5.
the AZF E, in the case of flights according to sight and instrument flight rules, to use the radio in English language.
(3) The following shall apply to valid military aircraft licence certificates, military aircraft crew certificates or military approval certificates for the air traffic control service of the Bundeswehr:
1.
If such a certificate entitles the holder to carry out the radio communication on flights by instrument flight rules, the holder shall exercise full exercise of the radiocommunication in the ground or air-radio stations.
2.
If such a certificate entitles the holder to carry out the radio in the case of a flight according to visual flight rules, the holder shall be allowed to use the radio telephone at an air station on board an aircraft flying by visual flight control or at a ground radio station with Air-radio stations of the above-mentioned type.

§ 3 Conditions for the acquisition of air traffic certificates

The conditions for the purchase of aircraft products are:
1.
the completion
a)
of the 15th Year of life for the BZF II, the BZF I and the BZF E,
b)
of the 18. Year of life for the AZF and the AZF E,
2.
for the AZF, the InneHave of the BZF I or BZF II,
3.
for the AZF E the Innehave of the BZF E and
4.
the existence of the prescribed test.

§ 4 Examination authority

(1) Examination authority is the Federal Network Agency for Electricity, Gas, Telecommunications, Post and Railways (Bundesnetzagentur). The German Federal Network Agency (Bundesnetzagentur) is announcted in its Official Journal. (2) The Federal Ministry of Economics and Technology can, in agreement with the Federal Ministry of Transport, Building and Urban Development, further develop further information on the Appoint authorities as audit authorities. § 5 Registration for examination

The registration for an examination for the acquisition of a flying radio certificate must be made in writing, stating the type of certificate requested, no later than 14 days before the examination date of the examination office. Unofficial table of contents

§ 6 Approval for Examination

(1) The Examination Authority shall decide on the admission to the examination. The authorisation shall be granted for the purpose of:
1.
the conditions laid down in Article 3 (1) (1), (2) and (3) are met,
2.
the registration documents according to § 5 are complete and
3.
the examination fees according to § 18 have been received.
(2) The examining authority may, at the request of the applicant, amend the authorisation decision for another type of aircraft, even after the authorisation has been granted in accordance with paragraph 1. Section 7 Examination Committee

(1) The examination board for the examination of the acquisition of a flying radio certificate shall consist of a chairman and at least one co-sitter. (2) The President of the Examining Authority shall convene the Chairperson and the co-chairpersons. The co-sitters shall be competent persons, in particular from the area of flight safety personnel or aeronautical personnel. Unofficial table of contents

§ 8 Examination

(1) The examining authority shall determine the date and place of the examination and shall inform the applicant thereof. The examining authority may place the date and place of the examination at the request of the applicant. The examination may not be taken until three months before reaching the minimum age pursuant to Section 3 (1). The Federal Network Agency publishes details in its Official Journal. (2) The applicant must show his/her identity card or passport before the examination begins. (3) The examination consists of a written and a practical one. Part. The test parts to be detected will result from the Appendix 1. (4) The examination board decides on the result of the examination. The examination has been passed if the applicant has demonstrated sufficient knowledge and skills in all parts. If a unanimous decision of the Audit Committee cannot be brought about, the Chairman of the Audit Committee, in consultation with the advisers, shall decide on the outcome of the examination. (5) Applicants who have received foreign assistance in the examination, or Use or try to deceive unauthorized aids, can be excluded from the examination. In the case of exclusion, the examination shall be deemed not to exist in all parts. The decision shall be taken by the examination board. Before the examination begins, the candidates shall be informed of this provision. (6) The flight certificate requested shall be issued after passing the examination by handing over. § 9 Repeal examination

(1) If the applicant has not passed the examination, he may repeat the examination. The test parts in which the applicant has not passed are to be repeated. The earliest time of the repeat examination is usually seven days, the latest time six months after the date of the non-passed examination. (2) The registration for the repeat examination must be completed within three months at the latest. shall be carried out after the initial examination. § 10 Additional examination

(1) holders of valid radio communications certificates for the air traffic service can acquire a higher-value speech radio certificate for the air service by means of an additional test. (2) The provisions of § § 6 and 8 are to be applied accordingly for the admission to the additional examination and for the performance of the additional examination. § 11 Post-examination

(1) The holder of a valid air service certificate, whose operational management has given rise to complaints several times or where there is evidence that he is no longer in a position to properly carry out the air service service is subject to a review at the request of the Federal Network Agency. The content and scope of the investigation shall be determined in the individual case by the Federal Network Agency in accordance with the conditions laid down in Appendix 1. § 12 Recognition of examinations for the acquisition of a permit for aircraft drivers or for the acquisition of instrument flight authorization

(1) Examination in accordance with the Regulation on aeronautical personnel as amended by the Notice of 13 February 1984 (BGBl. 265), as last amended by Article 1 of the Regulation of 2 October 2009 (BGBl I). 3536) and in accordance with the provisions of Section 20 (2) of the Air Traffic Authorisation Order, as amended by the Notice of 10 July 2008 (BGBl. 1229), the provisions of the Joint Aviation Requirements-Flight Crew Licensing (JAR-FCL) may be recognized as tests in accordance with § 8, if the examination contents of the practical part listed in Appendix 1 are examined in accordance with § 8 (3) . In this case:
1.
the examination for the acquisition of the permit for private aircraft drivers, private helicopter guides, professional aircraft guides, professional helicopter guides, traffic helicopter guides, airship guides or on-board waiting on helicopters in the Federal Police and at the Police officers of the countries of the examination for the acquisition of BZF II or BZF I;
2.
the examination for the acquisition of the licence for the driver of the glider or the Freiburg-based pilot of the examination for the acquisition of the BZF II or BZF I and
3.
the examination of the acquisition of the licence for the commercial aircraft driver or the acquisition of the instrument flying authority of the examination for the acquisition of the AZF.
(2) The flying radio certificate shall be issued by the Federal Network Agency and handed out to the applicant. The Federal Ministry of Economics and Technology may, in agreement with the Federal Ministry of Transport, Building and Urban Development, stipulate that the authority for the exercise of the flight service shall be granted by the competent aviation authorities and is entered in the aviation industry. Section 13 Acquisition of air traffic certificates by the holder of a certificate from the Bundeswehr

(1) The holders of a certificate issued by the Bundeswehr concerning the possession of a military aircraft driver's licence, military aircraft crew certificate or military approval certificate for the air navigation control service shall be issued on request:
1.
the BZF I, if they are entitled to exercise the speech radio in accordance with Section 2 (3) (2), or
2.
the AZF, if they are entitled to exercise the radio communication in accordance with § 2 (3) (1).
(2) The Federal Network Agency shall decide on the application. (3) The application for the issuing of a flying radio certificate shall be accompanied by the certificate of the Bundeswehr pursuant to paragraph 1, stating the type of certificate requested. Unofficial table of contents

Section 14 Recognition of aviation products

(1) Air-related products not granted in the scope of this Regulation may be recognised. The condition is that the valid flying radio certificate has been obtained under examination conditions which are at least equivalent to those of a corresponding aircraft radio certificate of the Federal Republic of Germany. Equivalence and recognition of valid aviation products which have not been granted within the scope of this Regulation shall be examined and determined by the Federal Network Agency. The general recognition may take place on the understanding that the holders of valid aviation products which have not been granted in the scope of this Regulation are only entitled to carry out the service in English. The recognition can be made informally. The recognition on a case-by-case basis shall be determined in accordance with paragraphs 2 to 6. (2) Insofar as the equivalence is not given, the issuing of a flying radio certificate may be subject to a simplified examination. If the applicant does not have the simplified examination, he may take it repeatedly. The scope of the simplified test shall be obtained from Appendix 1. In the case of simplified tests, the provisions of § 8 shall apply accordingly. (3) The holder of a valid flying radio certificate, which is not granted in the scope of this Regulation but has been acquired under examination conditions which are independent of of skills in the German language equivalent to those of a corresponding flying radio certificate issued by the Federal Republic of Germany, an identity card may be issued at the request of the holder only for the purpose of carrying out the air service in (4) The authorization card shall only apply in The Federal Network Agency shall decide on the application for the issuing of a flight certificate or a certificate of authorisation. The application shall be accompanied by the valid flight certificate referred to in paragraph 3 or by its obligation to consult it. In so far as this certificate is valid only in connection with a valid aviation licence, the application shall be accompanied by a copy of the valid aeronaine licence. (6) The valid air traffic certificates issued by a Member State of the European Union shall be subject to the following conditions: , and shall entitle them to the exercise of speaking radio in the English language, shall be recognised in general and informally in the extent laid down by the Member State concerned. § 15 Examination of knowledge of the English language

(1) The examination authority may also carry out the language examination and the extension examination in accordance with Section 125 of the Regulation on Aviation Staff, as amended by the Notice of 13 February 1984 (BGBl. 265), as last amended by Article 1 of the Regulation of 2 October 2009 (BGBl I). 3536). The language test may be linked to the examination for the acquisition of air certificates in accordance with the provisions of this Regulation. § § 5, 6 (2) and (3), § 8 (1), (2), (4), (5) and (7), § § 19 and 20 shall apply accordingly. The language test may be filed repeatedly. (2) In order to carry out the examination referred to in paragraph 1, the examination board shall be filled with at least one member who is sufficiently qualified to have knowledge of the English language in accordance with (3) The content requirements for the language test are laid down in the ordinal on aeronautical personnel. (4) If the language test is successful, the Bundesnetzagentur (Federal Network Agency) shall be responsible for the a certificate attesting the proof of the application of the Regulation aeronautical staff required knowledge of the English language. (5) The Federal Network Agency shall, in agreement with the Federal Aviation Authority, establish details of the validity of the proof of validity.
1.
the content and scope of the language test referred to in paragraph 1;
2.
the possibility of repeatedly taking the language test referred to in paragraph 1 in the event of non-existence, and
3.
The content and scope of the extension test referred to in paragraph 1.

§ 16 Second copies

A second copy may be issued for a loss-in-flight certificate, for a loss-rendered authorization card, or for a certificate of language examination which has been lost in loss of a certificate. The same shall apply if the certificate, the authorization certificate or the certificate of the language test has become unusable. In the case of unusefulness, the original copy must be returned prior to the exposition of the second copy. Unofficial table of contents

Section 17 Withdrawal of a flying radio certificate

(1) The Federal Network Agency may withdraw a flying radio certificate if the holder
1.
in a rough way against important radio regulations, in particular against the provisions of § 26a of the Air Traffic Order as amended by the March 27, 1999 (BGBl. 580), as last amended by Article 1 of the Regulation of 18 January 2010 (BGBl I). 11), has been or has been amended; or
2.
Contrary to the provisions of Article 2 (2) and (3) of this Regulation, the telephone traffic is exercised.
(2) The Federal Network Agency shall withdraw the flight certificate if the holder refuses to undergo an ordered inspection in accordance with § 11, or if it does not exist. (3) In the case referred to in paragraph 1 or 2, the flying radio certificate shall be immediately sent to the The Bundesnetzagentur (Federal Network Agency) shall be returned. § 18 Fees and Deposits

(1) The fees to be charged for official acts pursuant to this Regulation shall be determined in accordance with the list of fees in Annex 2. In addition to the stated fee rates, expenses shall be determined in accordance with the Administrative Cost Act in the period up to 14 August. (2) The fee liability arises with the receipt of the application to the Federal Network Agency. Section 19 withdrawing an application for examination

If the applicant withdraws his application for examination after admission, the examination fee is reduced by one quarter; it may be reduced to a quarter of the intended fee, or it may be waivred by the application of the application, if this corresponds to the equity. Unofficial table of contents

Section 20 Transitional provisions

The flight certificates issued after 30 April 1955, but before 16 May 1968 by the Deutsche Bundespost, as well as the registration certificates issued by the Bundesanstalt für Flugsicherung (Federal Agency for Air Traffic Control) for the telephone service are to be sent to new applications in new Radio certificates in accordance with § 2 exchanged. Section 21 Entry into force, external force

(1) This Regulation shall enter into force on 30 August 2008, unless otherwise specified in the following paragraph. (2) § 15 shall enter into force on 29 November 2008. Unofficial table of contents

1.1

the legal basis for mobile radio service in the national and international fields;
1.1.2
Operating procedures for mobile communications in the mobile service;
1.1.3
the application of the emergency and urgent procedure in the field of mobile radio communications;
1.1.4
the main provisions and operating procedures in the field of air traffic control:
1.1.4.1
the air traffic control system and airspace organisation in the Federal Republic of Germany, including search and rescue services (SAR);
1.1.4.2
Air traffic order, including the implementing regulations adopted thereto, to the extent that they are applicable to flights by visual flight rules;
1.1.4.3
Regulation on the air navigation equipment of aircraft for flights by visual flight rules, including the implementing regulations issued for that purpose;
1.1.4.4
Radio navigation on flights by visual flight rules.
1.2
FinelyIn the practical part, the following skills are to be proven:
1.2.1
preparation of a flight by visual flight rules from and to an aerodrome with air traffic control, using official documents and publications, to the extent necessary for the performance of the radio communications;
1.2.2
Handling of a radio communication in German with the acceptance of a flight by visual flight rules and using the phrases, expressions and abbreviations defined for this purpose, as well as procedures, including emergency and Urgent procedure.

Examination for the acquisition of the BZF I
2.1
Knowledge in accordance with 1.1; in additional examinations for applicants who are holders of the BZF II, and in the simplified examination referred to in Article 14 (2) for applicants who are holders of a flying radio certificate which has not been granted in the scope of this Regulation , 2.1 is deleted.
2.2
FinelyIn the practical part, the following skills are to be proven:
2.2.1
Skills referred to in 1.2.1;
2.2.2
Handling of a radio communication in German and English with the acceptance of a flight by visual flight rules and using the phrases, expressions and abbreviations defined for this purpose, as well as procedures, including emergency and Urgent procedure; in additional exams for applicants who are holders of the BZF II, the handling of a radio communication in German is no longer required;
2.2.3
Reading a text in English from the airfare manuals (about 800 characters [letters, numbers and signs]) followed by oral translation into the German language;
2.2.4
In the simplified examination referred to in Article 14 (2) for applicants who are holders of a flying radio certificate which has not been granted in the scope of this Regulation, only skills in accordance with 1.2 shall be proven.

Examination for the acquisition of the BZF E
3.1
Proficiency In the written part, the following knowledge is to be proven in English:
3.1.1
the legal basis for mobile radio service in the national and international fields;
3.1.2
Operating procedures for mobile communications in the mobile service;
3.1.3
the application of the emergency and urgent procedure in the field of mobile radio communications;
3.1.4
the main provisions and operating procedures in the field of air traffic control:
3.1.4.1
the air traffic control system and airspace organisation in the Federal Republic of Germany, including search and rescue services (SAR);
3.1.4.2
Air traffic order, including the implementing regulations adopted thereto, to the extent that they are applicable to flights by visual flight rules;
3.1.4.3
Regulation on the air navigation equipment of aircraft for flights by visual flight rules, including the implementing regulations issued for that purpose;
3.1.4.4
Radio navigation on flights by visual flight rules.
3.2
FinelyIn the practical part, the following skills are to be proven:

4.1

4.1.1
Air traffic order, including the implementing regulations issued thereto, to the extent that they are applicable to flights in accordance with instrument flight rules;
4.1.2
Regulation on air traffic control equipment for aircraft in the event of flights by instrument flight rules, including the implementing regulations issued for that purpose;
4.1.3
Radio navigation on flights by instrument flight rules, including radar procedures;
4.1.4
in the simplified examination referred to in Article 14 (2), for candidates who are holders of a flying radio certificate which has not been granted within the scope of this Regulation, 4.1 shall not be granted.
4.2
FinelyIn the practical part, the following skills are to be proven:
4.2.1
preparation of a flight by instrument flight rules between two airports, using official documents and publications, in so far as it is necessary for the operation of the radio communications;
4.2.2
Handling of a radio communication in English with the acceptance of a flight by instrument flight rules;
4.2.3
in additional exams for applicants who are holders of the BZF II, reading a text in English from the aviation manuals (about 800 characters [letters, numbers and signs]) followed by oral translation into the German Language;
4.2.4
In the simplified examination referred to in Article 14 (2) for applicants who are holders of a flying radio certificate which has not been granted in the scope of this Regulation, only skills in accordance with 1.2 shall be proven.
