§ 1 Conversion of the pension fund of German Railways and trams

(1) The pension fund of German Railways and trams (cash register), body of public law, will be converted into an insurance association on reciprocity with effect from 1 January 2006. The provisions of the Transformation Act shall not apply. The members of the association are the administrations and members of the statutory bodies involved to date. (2) The Federal Ministry of Finance is authorized, by means of a decree law without the consent of the Bundesrat, to the statutes of the Federal Republic of Germany, which apply from 1 January 2006. To determine the payment of the cash register, taking into account the minimum requirements applicable to the mutual insurance association, and to determine that and how it can be changed by the cash register. (3) The members of the Board of Management shall remain in order. up to the end of the term of office for which it is before the transformation (4) The previous members of the Board of Trustees of the cash register are members of the Supervisory Board. (6) The cash register shall be deemed to have been admitted to the business operation in the insurance division 19 of the Annex Part A of the Insurance Supervision Act. The cash register shall comply with the requirements of Section 53c (1) to (3c) and the Capital Payment Regulation no later than 31 December 2007. If the cash register has not yet fully reached the required solvency margin by 31 December 2007, the supervisory authority of the cash register may grant a period of not more than two years if the cash register has submitted a solvency plan in accordance with Section 81b (1) . § 2 Continuation of supply services

(1) The insurance relationships of the departments D, E, F of the cash register shall be transferred to the Deutsche Rentenversicherung Knappschaft-Bahn-See with effect from 1 January 2006. Section 6 Reregulation of supply services

(1) For the beneficiaries of Division D, the insurance conditions set up to date in the annex to section 33 (1) of the cash register shall apply. If the public service obligations of the Federal Government's suppliers are changed, the Deutsche Rentenversicherung Knappschaft-Bahn-See has to re-regulate the current pension benefits from the insurance relationships of the D department. In so far as the current pensions are not based on the basic salaries of a particular grade, the changes made as part of the increases or reductions in pensions must be those of the recipient of the federal government's supply. (2) The beneficiaries of the departments E and F shall be entitled to the benefits which they provide to them in the maintenance of the existing pension scheme in accordance with the provisions of the Articles of Association of the European Parliament and of the Council of Bavarian Supply Association or the retirement pension-and Supplementary pension fund of the Saarland, Department of Retirement Pensions, would be entitled if the conditions prescribed by Bavarian or Saarland civil service law are fulfilled. If the pension rights are received by the beneficiaries of the Free State of Bavaria, or of the Saarland, the Deutsche Rentenversicherung Knappschaft-Bahn-See has to adjust the supply services from the departments E and F accordingly.
