A
Scope
A voting machine, which is used in accordance with § 1 of the filing and counting of the electoral votes, has the following properties for the implementation of the election:
.
Presentation of the election proposals according to ballot papers, the operation to select and submit a vote or the marking and operation for the submission of an invalid vote,
.
registration of any vote selected or deemed invalid by the voter from the nominations, and
.
Automatic counting of the total votes cast, with a corresponding display,
.
Automatic counting of the votes cast sorted by the election proposals or in the case of an invalid number of votes indicating the result of the meter,
.
automatic storage of the votes cast until they are erased by operation,
.
further properties only insofar as they are directly related to the election.
First and second votes for Bundestag elections can (also) be delivered separately to two voting machines of the same type of construction. Second votes delivered to the same voting device can be stored for the first part of the vote.
B
Design requirements
1
Identification
The design of the voting device and the components of the voting device belonging to the design are identifiable in a suitable manner, including the test documents. These include:
.
Type plates
.
Unique identification of installed software on computer-controlled voting device
.
Test documents:
-
Technical specifications,
-
Illustrations,
-
Operating instructions (s),
-
construction documentation (including for software),
-
function descriptions (including software),
-
Programme documentation (including programme development),
-
commented source code,
-
executable program.
2
Technical structure
2.1
Construction
In its construction, the voting device corresponds to the general state of the art and is constructed in accordance with the rules of the technology which are recognized for systems with serious damage sequences in the event of misconduct (high criticality).
The voting device shall be designed in such a way that a change in the technical structure and, in the case of computer-controlled devices, also the software installed by unauthorised third parties does not go unnoticed.
2.2
Load capacity
The device shall consist in all parts of materials and technical characteristics of sufficient load capacity and of sufficient immutability in relation to environmental influences, so as to prevent wear and wear occurring in the event of proper use, and A change in design is sufficiently secured and is sufficiently insensitive to the influences which occur during use, transport or during storage. This applies to mechanical, climatic and electromagnetic environmental influences (1) to be specified.
2.3
Durability, functional safety
The elective device can expect a long service life with sufficient care, maintenance and protected storage. In the case of mechanical, climatic and electromagnetic environmental influences, in the event of disturbances in the energy supply, during normal use and in the event of errors in operation, the functions of the voting device are maintained and the functions of the device are maintained. votes cast.
2.4
Freedom of action
In the event of connection of components not belonging to the design, the selector device operates without feedback. The same applies if a simultaneous implementation of several mutually independent electoral processes is provided.
2.5
Energy supply
An electrically operated selector device is secured against short-term power failure or voltage drop and remains operational in the event of a prolonged power failure by using a substitute current source or by mechanical operation. The voting device shall be equipped with a suitable connection for a replacement current source (e.g. Emergency power unit, batteries or accumulators).
The energy consumption is so low that the operational readiness of the voting device is maintained at least for the duration of thirteen hours in operation with a suitable substitute power source without any change.
2.6
Transport and storage
The voting machine can be transported well and stored in the appropriate packaging.
3
How the
3.1
Function principle, usage type
The following requirements apply accordingly in the simultaneous implementation of a nationwide election with a different choice.
The voting device is designed in such a way that a voter only has one vote or only one first and one second vote for Bundestag elections or in each case an invalid voice can be cast.
The order of operation for the selection of the first and second votes from the election proposals is not predetermined by the voting machine.
In the case of separate operation for selection and delivery of the votes, the delivery of the first and second voice can be effected by means of a common operating device.
3.2
Function control and error LED
When switching on, the voting device enables the control of its functional capability, in the case of an electronic voting device, to be supported by automatic function displays.
The voting device supports the display of if necessary failure of its components during the election, which may endanger or prevent proper use, and shall make it possible to diagnose problems.
3.3
Presentation of election proposals, operating devices
The voting device and the operating range for the voter are optically neutral.
All information contained on the official ballot papers may be clearly indicated on the front of the voting machine, for example: B. in a horizontal or vertical arrangement.
For each election proposal for which a voice can be cast, a defined field with a clearly assigned operating device for selecting the voting power is present. In addition, a field with an operating device for the identification is provided for the delivery of an invalid first or second voice in each case.
The operating devices for selecting the voting power are numbered. The counter results displayed for each election proposal are unambiguously assigned to the operating devices and are numbered in the same manner. The same applies to the marking for the delivery of an invalid voice and for the result thereof.
The number of fields that can be used with the corresponding operating devices is as large as election proposals (in Bundestag elections: constituency candidates for the first vote or respectively) National lists of each party for the second vote; for European elections: list of candidates of each party or political association) are generally accepted for election.
3.4
Voice storage, counting and display
So many votes can be accepted by the voting machine and registered as voters as a rule to vote in a polling station.
The counting of the votes shall be carried out in such a way that only the following results are automatically determined and displayed by the voting device or two voting machines of the same type:
1.
the number of all votes cast, including the first votes marked as invalid,
2.
the number of all the votes cast, including the second votes marked as invalid,
3.
the number of first votes cast as invalid;
4.
the number of second votes cast as invalid,
5.
any number of the initial votes cast for each constituency candidate,
6.
any number of second votes cast for each Land list.
The same applies to the figures for the votes cast for a European election.
The counting of votes cast for each nomination, the invalid votes and the total votes cast shall be complete, clear and correct. The voice storage is carried out several times (redundant) in such a way that with certainty limiting probability no emitted voice is lost and thus the counting takes place correctly with high reliability.
Before, during and after the election, the total number of votes cast, if necessary separately after first and second votes, for the electoral board can be read from the outside at any time.
In the secured state during the election, a reading of the number of votes cast for an election proposal or of the invalid votes is not possible. The result of the vote shall be read immediately after a special act and shall be kept unchanged.
The voting device shall ensure the secrecy of the vote. No device or device can be seen as a voter chosen. The output anonymously will be allowed after the result reading for evaluation outside of the voting machine.
3.5
Lockout and backup
All count and memory contents for the voice registration can be deleted before the start of the election. The fact that this has been done can be controlled in a simple manner.
Before the start of the election, the effect of precisely those operating devices which are not required to select the votes for one of the election proposals can be blocked for the duration of the entire voting process.
Before the beginning of the election, the voting device can prevent any intervention, in particular against the filing and storage of votes and against reading, issuing and deleting registered votes, by multiple closure (at least two locks with different closures).
From the basic condition secured in this way, the voting device may be put into service for the purpose of carrying out the election in such a way that only a distribution and storage of votes, which can be controlled by the electoral head with respect to each individual voter, can be carried out. can.
After the election, the filing and storage of votes may be blocked and the reading and issuance of the meter result released, while the blocking shall be maintained for the prevention of a deletion of registered votes until these are separately is unlocked.
3.6
Cast of votes
The control devices of the voting device can only be used by the voter if the voting head has released the vote. After the release, the votes admissible for a voter can be selected and handed over to the vote registration alone. After registration of the ballot, the voting machine will lock itself again. The release may be withdrawn after a reasonable period of time in the event that the voter has not cast a vote, by a special act of the electoral board, so that the device is locked again. The release and blocking of the device are recognizable to the electoral presumption (e.g. For example, by means of sound and/or light signals).
The vote will take place in two phases, so that after the end of the first phase, the voter will be able to re-examine the selected, intended vote (e.g. For example, two handles or switching on of a print point).
Immediately after the vote, the voter shall be recognized by a sound or light signal or by a sign appearing on the voting device, that his vote is registered and that the blocking device is in effect again. The sign shall return as soon as the vote has been completed.
3.7
Ergonomics, operability
The device is ergonomically designed in such a way that it can also be operated without major difficulties by lower-average voters.
Operating actions of the voter do not result in error messages, but if necessary Information on the course of action.
Operating actions, mishandles and deliberate interventions, with the exception of forcible or special aids, do not result in any disturbances or even destruction.
4
Operating Instructions (s)
The voting machine shall be accompanied by:
.
a suitable operating manual with the following content:
1.
Installation and commissioning,
2.
Preparation for a choice: settings, backup and locking, function checks,
3.
Control by the electoral head before, during and after the election,
