Unless otherwise provided by federal legislation, the Federal Government shall be represented in the division of the Federal Minister for German-German Relations as follows:
1.
Representation in judicial and arbitral proceedings
a)
In proceedings concerning the Federal Ministry of Inner-German Relations, the Federal Minister of Inner-German Relations is appointed to represent the Federal Republic of Germany.
b)
The President of the German Federal Institute for German Tasks (Bundesanstalt für Gesamtdeutsche Tasks) has been appointed to represent the German Federal Institute for the German Federal Institute for the General Tasks of the Federal Republic of Germany in proceedings.
c)
The representation shall be reserved to the Federal Minister for German-German relations if:
aa)
the Federal Minister of Inner-German Relations has concluded the underlying contract itself,
bb)
A decision of the Federal Minister of Inner-German Relations is the subject of the dispute,
cc)
the President or Vice-President of the Federal Institute for General German Tasks is personally involved.
2.
Representation in administrative proceedings The Federal Office of the Federal Republic of Germany shall be represented in administrative proceedings. However, § 174 of the Federal Officials Act and Section 126 (3) of the Civil Service Law Framework Act remain unaffected.
3.
Legal business representation In the case of legal transactions, the Federal Government shall be represented by the President of the Federal Institute for General German Tasks insofar as the Federal Institute for Legal Transactions is responsible for legal transactions in so far as the Federal Institute for Legal Affairs is acting in accordance with Section 27 (1) Economic provisions for the Reich authorities are conferred on the power to issue acceptance and payment orders. In addition, the Federal Minister for German-German Relations represents the Federal Government. This shall also apply to legal transactions relating to the acquisition or disposal of a property.
4.
Deviating rules The Federal Minister for German-German Relations may, in individual cases, regulate the representation or take over the representation of the representation.
5.
Entry into force This arrangement shall enter into force on the day following its publication in the Federal Gazette.
