§ 1 Definitions

For the purposes of this Regulation:
1.
BVDV-Undächtiges Rind: a bovine animal that
a)
with a negative result on the virus of bovine viral diarrhoea (BVDV) with one in the announcement of the official collection of methods for the examination of bovine viral diarrhoea of 30. October 2008 (BAnz. 3999) (official method collection) has been investigated, or
b)
a negative result with one of the methods described in the official method collection on BVDV has been born;
2.
Bovine spongiform bovine animals: a herd of bovine animals which satisfies the requirements of Appendix 1;
3.
persistent BVDV-infected bovine animal: a bovine animal which has been tested with a positive result on BVDV using a method described in the official method collection; and
a)
which, at the latest 60 days after the first examination, has been re-examined with a positive result method on BVDV, as described in the official method collection,
b)
where a repeat examination referred to in point (a) has not been carried out, or
c)
that has been diagnosed with Mucosal Disease,
as well as the offspring of a bark according to the letters a to c.

§ 2 Vaccinations

(1) The competent authority may vaccinate a bovine animal or bovine animals of a herd or of a particular area against BVDV infection
1.
shall, in so far as this is necessary on the grounds of animal disease control, or
2.
prohibit, to the extent that animal disease control issues are not in conflict.
(2) Insofar as female bovine animals are vaccinated against BVDV infection, vaccination should be carried out in accordance with the recommendations of the vaccine manufacturer in such a way that fetal protection against BVDV infection can be expected. (3) The owner has the competent authority. to provide, on request, immediately information on the number of vaccinated bovine animals, including their earmark numbers, the timing of the vaccinations carried out and the vaccine used. § 3 Investigations

(1) The owner shall have all bovine animals,
1.
born in his herd after the date of entry into force of this Regulation, until the completion of the sixth month of life, or
2.
that are to be brought out of the stock, before the transfer
with a method described in the official collection of methods, to be examined by BVDV. The owner shall ensure that the person under investigation is informed of the date of birth and the ear tag number of the bovine to be examined and the date of sampling with the transmission of the respective sample. The second sentence shall not apply with regard to the date of birth and the date of sampling, to the extent that ear tissue samples obtained in the context of the identification of bovine animals in accordance with Article 27 of the Animal Transport Regulation are to be examined. By way of derogation from point 1 of the first sentence, the owner of the calves of his stock who were born after the entry into force of this Regulation shall, immediately after birth, examine the BVDV with a method described in the official collection of methods (2) An examination referred to in the first sentence of paragraph 1, first sentence, point 2, shall be taken as necessary in the case of bovine animals or bovine animals born before 1 January 2011. an investigation has been carried out on BVDV with a negative result, which is one in the (3) The competent authority may, in so far as is necessary for reasons of animal disease control, examine a bovine animal or bovine animals of a herd or of a given area order. (4) If a BVDV infection has been identified in the case of an investigation pursuant to paragraphs 1, 2 or 3, sentence 1, the owner shall, at the latest 60 days after the first examination, once again have the affected bovine with one in the official collection of methods. Section 4 Placing of bovine animals

(1) bovine animals may be used in domestic animals
1.
from a stock only or are only set in a stock,
2.
to a livestock market, a livestock exhibition, an event of a similar nature or a livestock collection centre, or from one of the events mentioned, or from a livestock collection centre, or
3.
to a community pasture or other location with contact to bovine animals from other stocks, only to be exaggerated,
insofar as they are not subject to BVDV and are accompanied by proof in written or electronic form about the BVDV unsuspiciousness of the respective bovine. Where proof is provided in electronic form, the information required for the competent authority must be available at its request in an easily readable form at any time. (2) The first sentence of paragraph 1 shall not apply to a bovine animal which:
1.
from a stock is spent directly on slaughter,
2.
is exported directly or through an approved collection centre or is transferred to another Member State; or
3.
is taken directly to the veterinary examination or treatment, in so far as the bovine is examined in the course of this examination or treatment with a method described in the official collection of methods and, until the result has been obtained, the investigation is kept separate.
By way of derogation from the first sentence of paragraph 1, point 1, a bovine non-violable bovine animal may be brought back directly into the herd of origin. (3) (4) By way of derogation from the first sentence of paragraph 1, a bovine animal shall be allowed to enter into force until the end of the sixth month of life. where the bovine animal to be transferred is brought directly into a herd in which all bovine animals are exclusively kept in stable conditions and are released directly for slaughter and where the herd of origin has been

§ 5 Protection measures

(1) The owner has to immediately kill a persistent BVDV-infected beef. § 6 Administrative Offences

Contrary to the provisions of Section 32 (2) (4) (a) of the Animal Health Act, who intentionally or negligently is acting in accordance with the provisions of the Animal Health Act

a fully-enforceable arrangement in accordance with § 2 (1) or § 3 (3) sentence 1, also in conjunction with sentence 3,
2.
, contrary to Article 3 (1) sentence 1, paragraph 4 or 5, a bovine animal shall not be examined or cannot be examined in good time,
3.
Contrary to Article 3 (1), second sentence, it does not ensure that the institution referred to therein is not informed, not right, in full or in good time, of a claim referred to in that paragraph;
4.
, in accordance with Article 4 (1) (1) (1) (1) or (2) or (5), a bovine animal shall be

Contrary to Article 4 (1), first sentence, point 3, a bovine animal,

Section 7 Further measures

Appendix 1 (to § 1)
Conditions under which a bovine herd is considered to be BVDV-violently

Section 1
BVDV-incompatible bovine herd
1.
All bovine animals of the herd have been tested with a negative result method on BVDV with a method described in the official method collection, unless they are bovine animals, the calves of which are listed in the official method collection have been investigated with negative results on BVDV.
2.
Within a period of twelve months following the examination referred to in point 1, the following shall be:
a)
all bovine animals born in the herd have been examined with a negative result on BVDV at the latest six months after their birth, with a method of negative result described in the official method collection,
b)
all bovine animals of the herd are free from clinical manifestations indicating BVDV infection,
c)
only bovine animals which have previously been examined with a negative result method on BVDV in the official method collection have been placed in the herd,
d)
the cattle of the herd have been kept in such a way that they have not had contact with bovine animals outside the herd, which are not BVDV-forthright,
e)
the cattle of the herd were only beamed with seeds of BVDV-unsmiled bulls or only covered by BVDV-unsmiling bulls.
Section 2
Maintenance of BVDV-Unsuspility
The BVDV suspect of the bovine herd shall be maintained to the extent that the following requirements are met:
1.
All bovine animals of the herd are free from clinical manifestations indicating BVDV infection.
2.
All bovine animals born in the herd shall be examined with a negative result on BVDV at the latest six months after their birth with a method described in the official method collection.
3.
Only BVDV-uncontrolled cattle will be placed in the stock.
4.
The cattle of the herd shall not be in contact with bovine animals outside the herd, which are not BVDV-not-not-of-the-kind.
5.
The cattle of the herd may only be beamed with seeds of BVDV-unsuspecting bulls or be covered only by BVDV-unsmiling bulls.
