§ 1 Prohibition of placing on the market

(1) It shall be prohibited, contrary to Article 116, in conjunction with Annex XIV, Part C, Chapter I, Chapter I, point 1 of Council Regulation (EC) No 1234/2007 of 22 June 2007. 1 October 2007 on a common organisation of agricultural markets and on specific provisions for certain agricultural products (Single CMO Regulation) (OJ L 327, 28.12.2007, p. 1), as last amended by Regulation (EU) No 513/2010 (OJ L 299, 16.11.2010, p. 40) has been amended, in conjunction with
1.
Annex XIV, Part C, Chapter II, paragraph 1, Bruteier, which are not individually identified,
2.
Annex XIV, Part C, Chapter II, point 2 or 3 Bruteier unpacked or in packs which are not completely clean or which do not have the required content, or
3.
Annex XIV, Part C, Chapter III, point 1, 2 or 3, second sentence, chicks
a)
unpacked or not properly packaged, or
b)
in cartons which do not have the required content or which are not marked in the correct manner or not in the prescribed manner,
to sell, offer, supply, supply, sell or otherwise place on the market.
(2) It is prohibited to:
1.
To hold, offer, offer, supply, sell or otherwise place a bruteier in stock for sale or otherwise placed on the market as referred to in Article 3 (1) or (2) of Commission Regulation (EC) No 617/2008 of 27 June 2008, Detailed rules for the application of Council Regulation (EC) No 1234/2007 as regards the marketing standards for hatching eggs and chicks of poultry (OJ L 327, 30.11.2007, p. 5), as amended by Regulation (EU) No 557/2010 (OJ L 168, 28.6.2010, p. 13), does not comply with the requirements for labelling;
2.
Bruteier in breach of Article 3 (4) or (6) of Regulation (EC) No 617/2008 unpacked or in packages which are not entirely clean, do not have the required content or which are not correct or not in the prescribed manner are to be supplied,
3.
bruteis which do not comply with the labelling requirements referred to in Article 3 (8) of Regulation (EC) No 617/2008, or which are not in conformity with the requirements of Article 3 (8) of Regulation (EC)
4.
to keep, supply, supply, supply, sell or otherwise place on the market chicks for sale, which are not packed in accordance with the requirements of Article 4 (1) of Regulation (EC) No 617/2008,
5.
Holding, offering, holding, supplying, selling or otherwise placing on the market chicks for sale, the packaging of which does not comply with the labelling requirements referred to in Article 4 (2) of Regulation (EC) No 617/2008. corresponding to
6.
deliver bruteis or chicks without accompanying paper, which complies with the requirements of Article 5 of Regulation (EC) No 617/2008,
7.
To keep bruteis or chicks available for sale, to offer, to supply, supply, sell or otherwise to be placed on the market without complying with the registration requirements set out in Article 6 of Regulation (EC) No 617/2008.
(3) Paragraphs 1 and 2 shall not apply to breeding and propagating holdings of less than 100 animals and hatcheries with a capacity of less than 1 000 hatching eggs. (4) By way of derogation from Article 3 (2) of Regulation (EC) No 617/2008, Bruteier for sale held, offered, delivered, delivered, sold or otherwise placed on the market, if it is placed in the incubator in the producer holding or in the hatchery with a clearly visible black Point made of unwielable color. § 2 Accompanying paper for chicks

The accompanying paper for chicks referred to in Article 5 of Regulation (EC) No 617/2008 must be drawn up in duplicate on import and export (Article 4 (1) and (2) (a) of the Market Organisation Act). For the purpose of forwarding to the Federal Institute for Agriculture and Food (Bundesanstalt), the double of the accompanying document is to be delivered to the customs office, which produces the chicks for import or export. § 3 Monitoring by the Federal Institute for Agriculture and Food

The monitoring of compliance with the acts of the European Community or of the European Union and of this Regulation on imports of hatching eggs and chicks
1.
from third countries within the scope of this Regulation, as long as the products are customs,
2.
from the scope of this Regulation to those countries

§ 4 Administrative Offences

(1) The order is contrary to the provisions of Annex XIV, Part C, Chapter III, Chapter III, paragraph 3, sentence 1 of Council Regulation (EC) No 1234/2007 of 22 June 2007. 1 October 2007 on a common organisation of agricultural markets and on specific provisions for certain agricultural products (Single CMO Regulation) (OJ L 327, 28.12.2007, p. 1), as last amended by Regulation (EU) No 513/2010 (OJ L 299, 16.11.2010, p. 40), it introduces chicks that are not or are not properly sorted. (2) The anti-law enforcement authorities are acting in breach of Commission Regulation (EC) No 617/2008 of 27 June 2008 laying down detailed rules for the application of the Council Regulation (EC) No 1234/2007 as regards the marketing standards for hatching eggs and chicks of poultry (OJ L 327, 30.11.2007, p. 5), as amended by Regulation (EU) No 557/2010 (OJ L 168, 28.6.2010, p. OJ L 159, 25.6.2010, p. 13), by:
1.
, contrary to the provisions of the first sentence of Article 4 (3), in conjunction with the second sentence or sentence 3, imports of chicks which are not or are not properly sorted or packed in cartons which are not marked or not correctly marked,
2.
, contrary to Article 7, first sentence, eggs taken out of the incubator shall be fed to human consumption, or
3.
the information referred to in Article 8 (1) shall not be provided in a timely manner, not in full or in good time.
(3) In the sense of Section 7 (1) (3) of the Commercial Code Act, who, contrary to § 1 of the Bruteier or Küken, holds for sale, offers, offers, offers, sells, sells, otherwise places on the market or introduces them.
