I p. 157), enacted by the Federal Ministry of food, agriculture and forestry: article 1 prohibition of the placing on the market (1) it is prohibited, contrary to article 116 in connection with annex XIV part C Chapter I number 1 of Regulation (EC) No 1234/2007 of the Council of 22 October 2007 establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (single CMO Regulation) (OJ L 299 of November 16, 2007, p. 1), most recently by Regulation (EU) No. 513/2010 (OJ L 150 of the 16.6.2010, p. 40) has been modified, in conjunction with 1 annex XIV, section C, chapter II, point 1 hatching eggs are not individually marked, 2 or 3 eggs for hatching unpacked or in packs, which are not completely clean or not the prescribed content exhibit 2. (2) it is prohibited to hold 1 hatching eggs for sale, to offer, keep Feil, to deliver, sell or otherwise to bring in the traffic which in article 3 (1) or (2) of Regulation (EC) No. 617/2008 of the Commission of 27 June 2008 with detailed rules for the application of Regulation (EC) No 1234/2007 of as regards the marketing standards for eggs for hatching and chicks of domestic poultry (OJ L 168 of the 28.6.2008, p. 5), which by Regulation (EU) No. 557/2010 (OJ L 159 of the 25.6.2010, p. 13) is changed, these labelling requirements do not meet, 2. hatching eggs contrary to article 3 No. 617/2008 without packaging or in packaging which are not completely clean, not the prescribed contents (4) or (6) of Regulation (EC) or are not right or not in the prescribed manner, to deliver, to introduce 3. hatching eggs , the or their packaging do not the article 3 paragraph 8 of Regulation (EC) No. 617 / 2008 requirements on the marking comply with, 4. hold chicks for sale, to offer, to keep Feil, deliver, sell or to bring in the traffic not according to the article 4 (1) of Regulation (EC) are packed No. 617 / 2008 requirements , 5 chicks for sale in stock to keep, to offer, to keep Feil, to deliver, for sale or otherwise to place on the market, their packaging to provide in article 4(2) of Regulation (EC) No. 617 / 2008 mentioned requirements on marking do not comply with, 6 eggs for hatching or chicks without accompanying document, no. 617/2008 fulfils the requirements of article 5 of Regulation (EC) , 7 hatching eggs or chicks for sale to keep in stock, to offer, to keep Feil, to deliver, for sale or otherwise in the traffic without to meet that in article 6 of Regulation (EC) No. 617 / 2008 requirements on the management of registers.
(3) paragraphs 1 and 2 do not apply hatching eggs for breeding and multiplication farms with less than 100 birds and hatcheries with a capacity of less than 1 000.
(4) by way of derogation from article 3 (2) of Regulation (EC) No. 617/2008 may be hatching eggs for sale of stock held, offered, displayed f, supplied, sold or otherwise marketed, if this before inserting it in the incubator at the producer's premises or in the hatchery with a clearly visible indelible color black point are marked. (2) any person who is against the Regulation (EC) is, no. 617/2008 of the Commission of 27 June 2008 laying down detailed rules for the application of Regulation (EC) No 1234/2007 of as regards the marketing standards for eggs for hatching and chicks of domestic poultry (OJ L 168 of the 28.6.2008, p. 5), which by Regulation (EU) No. 557/2010 (OJ L 159 of the 25.6.2010, p. 13) has been changed, violates, by he 1. contrary to article 4 paragraph 3 introduces sentence 1 in conjunction with sentence 2 or sentence 3 chicks, which not or not properly sorted or are packaged in cardboard boxes that are not or not properly marked, 2. contrary to article 7 1 hatching eggs removed from the incubator set provides the human consumption or paragraph 1 a 3. contrary to article 8 there called indication not , incorrectly, incompletely or not timely submitted.
