the Federal Ministry of Food, Agriculture and Consumer Protection in agreement with the Federal Ministry for the Environment, Nature Conservation and Nuclear Safety and the Federal Ministry of Finance on the basis of Section 63a (2) (2) of the Renewable energy law, the most recent of which is Article 1 (40) (a) of the Law of 28 July 2011 (BGBl. 1634), and

the Federal Ministry of Finance in agreement with the Federal Ministry for the Environment, Nature Conservation and Nuclear Safety and the Federal Ministry of Food, Agriculture and Consumer Protection on the basis of section 37e (2) sentence 1 in conjunction with Article 1 (1) of the Federal Immission Control Act, which is defined by Article 1 (7) of the Law of 15 July 2009 (BGBl). 1804), and § 66a (2), first sentence, in conjunction with paragraph 1 of the Energy Tax Act, which is defined by Article 2 (5) of the Law of 15 July 2009 (BGBl. § 1 Collection of fees

(1) The Federal Agency for Agriculture and Food shall charge fees in accordance with this Regulation to cover the administrative burden for official acts

1.

according to § § 33, 36 sentence 2, § § 43, 55 (1) and § 60 of the Biomass Power Sustainability Ordinance of 23 July 2009 (BGBl. 2174), as last amended by Article 2 (70) of the Law of 22 December 2011 (BGBl). 3044), as amended, and

2.

in accordance with § § 33, 36 sentence 2, § § 43, 55 (1) and § 59 of the biofuel sustainability ordinance of 30 September 2009 (BGBl. 3182), as last amended by Article 2 (71) of the Law of 22 December 2011 (BGBl I). 3044), in the current version.

(2) The fees referred to in paragraph 1 (1) or (2) shall be charged

1.

of certification systems within the meaning of § 32 (1) of the Biomass Power Sustainability Regulation and section 32 (1) of the Biofuels Sustainability Ordinance and

2.

by certification bodies within the meaning of § 42 (1) of the Biomass Power Sustainability Regulation and § 42 (1) of the Biofuels Sustainability Regulation.

(3) Where a certification system within the meaning of paragraph 2 (1) is not legal, the fee shall be levied by the natural or legal person who is responsible for the certification system. (4) The fee-based Facts and rates of charges shall be derived from the list of fees charged to the annex to this Regulation. Unofficial table of contents

§ 2 Entry into force
