§ 1 Scope

This Regulation shall apply to the renting and renting of recreational craft to participate in the inland waterway transport. Unofficial table of contents

§ 2 Definitions and applicable rules

(1) For the purposes of this Regulation:
1.
Establishment: Business office of the undertaking situated on an inland waterway or on a waterway connected to an inland waterway, and where the company offers recreational craft for hire;
2.
Inland waterways: the federal waterways according to § 1 (1) (2) of the Inland Waterways Act, with the exception of the Elbe in the Port of Hamburg and the shipping lanes,
3.
Recreational craft: watercraft used for recreational or recreational purposes with a length of less than 20 m without rudder and bow spriet, the product of which does not reach a volume of 100 cbm from the length x width x draught, with the exception of sailing surfboards,
4.
Entities: natural or legal persons, as well as partnerships, provided that they are equipped with the ability to acquire rights and to enter into liabilities, and their authorised representative, the recreational craft for use on the Renting inland waterways,
5.
Renting: the transfer of a recreational craft for use to changing tenants without the use of a boat driver or crew and without the renter using the sports boat for commercial purposes; a sports boat shall be used exclusively For testing purposes to a prospective person, there shall be no leasing within the meaning of this Regulation if the test drive does not exceed the period of 48 hours.

§ 3 Basic Rule, Responsibility

(1) A sports boat may only be leased if it is technically approved for it. The technical approval shall be granted, at the request of the company, by the Water and Shipping Office by the boat certificate according to the model of Appendix 1. (2) The Water and Shipping Office shall be responsible for the implementation of this Regulation.
1.
in the district of which the sports boat has its permanent berth or where the establishment is located, or
2.
that is closest to the headquarters of the company.

§ 4 Boat certificate

(1) A boat certificate may only be issued or extended if the company has demonstrated that the sports boat is suitable for driving (§ 5). (2) Without prejudice to paragraph 1, a sports boat which does not have a valid declaration of conformity in accordance with the model of Annex XV to Directive 94 /25/EC of the European Parliament and of the Council of the European Union shall be required to apply the certificate of conformity. Parliament and the Council of 16 June 1994 on the approximation of the laws, regulations and administrative provisions of the Member States relating to recreational craft (OJ L 327, 31.12.1994, p. EC No 15), a certificate of boating shall also be issued only if the sports boat has a sufficient residual buoyant which is also able to swim in the flooded condition, if not by other appropriate measures, such as (3) The company has to provide the water and shipping authority with any alterations to the construction or other changes in the safety level. Sports boats that can influence their fitness to be able to influence their fitness. It must be entered by the water and shipping authority on the boat's certificate if the company has demonstrated that the sports boat is still suitable for driving. If one of the changes referred to in the first sentence has not been notified, the Water and Shipping Office may revoke the issuing of the boat certificate. (5) The Federal Ministry of Transport, Building and Urban Development can offer boat certificates or recognise other registration certificates issued in accordance with national law. § 5 Proof of suitability for driving

(1) On the basis of the fitness of the recreational craft, the following are:
1.
a certificate of driving licence under the Inland Waterway Investigation Order;
2.
a valid acceptance protocol of the Germanic Lloyds or any other notified body referred to in Article 9 of Directive 94 /25/EC or of a publicly appointed and sworn expert or of an accredited expert in accordance with the EN 45013 standard Position certified boat and yacht experts with the contents of Appendix 2 or
3.
a valid declaration of conformity in accordance with the model laid down in Annex XV to Directive 94 /25/EC on the approximation of the laws, regulations and administrative provisions of the Member States relating to recreational craft.
By way of derogation from paragraph 1, the fitness for recreational craft without a driving machine and for recreational craft with an electric propulsion engine with a drive power of less than 1 kW may be replaced by an acceptance protocol containing the content of Appendix 3. are certified by the Water and Shipping Office. In the case of new boats, which are produced in series and which are provided with a serial numbering system, the manufacturer can have a prototype checked by the water and shipping office. Proof of driving fitness for vehicles in this series is the copy of the acceptance protocol for the prototype together with the manufacturer's certificate, which confirms the uniformity with the other vehicles in this series, if in the case of the vehicle. Acceptance record the serial numbers of the vehicles for which it is to apply. (3) The proof of fitness shall certify that the sports boat is at the time of acceptance or, in the case of paragraph 1, point 3, at the time of the acceptance. (4) acceptance protocols referred to in paragraph 1. No 2 for new vehicles and the declaration of conformity referred to in paragraph 1 (3) shall be valid for ten years. The period of validity of the acceptance protocols for the other vehicles referred to in paragraph 1 (2) shall be determined by the Germanischer Lloyd or by the expert, but at the latest for ten years. The acceptance protocols referred to in paragraph 2 shall apply to new vehicles for six years. For the rest of the vehicles, the Water and Shipping Office shall determine the period of validity, which shall be six years at the latest. (5) Protocols of acceptance from other Member States of the European Community or from the Member States of the European Community. The economic area, including the checks and inspections carried out, shall be recognised as equivalent by the Water and Shipping Authority if the level of protection of the evidence referred to in paragraphs 1 to 4 is attested in them. § 6 Procedure

(1) The application for the exhibition and extension of the boat certificate (§ 4 para. 1) and its amendment (§ 4 para. 3) must be submitted by the company to the water and shipping office responsible pursuant to § 3 paragraph 2. (2) In the application for the grant of the certificate A boat certificate shall be indicated:
1.
the name and address of the undertaking and of the persons authorised to represent, and the address of a special establishment, which is different from that,
2.
information as to whether a boat certificate has already been requested or issued for the sports boat;
3.
Details of the sports boat:
a)
the type of vehicle and the main building material,
b)
fabricate, manufacturer, year of construction,
c)
Construction or serial number or international boat identification number according to DIN EN ISO 10087, if available,
d)
Length, measured over everything without moving parts, width over everything and maximum draught,
e)
Number of persons admitted,
f)
technical specifications of all drive motors: engine number, manufacturer, factory, type of drive, power in kW, year of construction, type of engine,
4.
Information on the waterways on which the sports boat is to be leased.
(3) The request for the granting, renewal or amendment of the boat certificate shall be accompanied by proof of the fitness to be used in accordance with § 5. (4) Only the particulars referred to in paragraph 2 shall be included in a request for renewal or modification of the boat certificate. (5) If there is any doubt as to the suitability for travel within the meaning of § 5, the Water and Shipping Office may request the submission of further documents and expert reports. (6) Without prejudice to the undertaking ' s obligation referred to in paragraphs 1 to 4, it shall also require changes in the information referred to in paragraph 2 (1) to (4) within the framework of the four weeks in writing to the Water and Shipping Office. § 7 Flags

(1) The undertaking shall bear any sports boat with an identification mark in accordance with the marking regulation or with a rental mark referred to in paragraph 2. (2) The rental label, which is, moreover, § 2 (3), first sentence, of the labelling regulation , consists of a combination of
1.
one or more identification letters in accordance with Appendix 1 to the labelling regulation for the competent water and shipping office,
2.
the number of the boat which is to be connected to the hyphen; and
3.
the letter "V".

§ 8 obligations of the company

(1) The company may not order or permit the rental of a recreational craft if it is known or has to be aware that the sports boat is not suitable for use in accordance with the generally accepted rules of technology. (2) The company shall be entitled to: Sportsboat only rent if
1.
a valid boat certificate issued by a water and shipping office or a certificate issued in accordance with section 4 (5) is issued for the sports boat,
2.
the conditions and conditions laid down in the certificate of boat or of the certificate of approval are fulfilled; and
3.
the equipment on board, registered in the certificate or certificate of approval, is in the ready-to-use condition.
(3) The company shall not hire a sports boat to
1.
persons who do not appear to possess the necessary knowledge and skills to operate the sports boat,
2.
persons who, as a result of physical or mental deficiencies or the enjoyment of alcoholic beverages or other intoxifiable means, cannot safely lead the sports boat in a safe way,
3.
a)
Children under 12 years of age,
b)
Children under 14 years of age, if it is a sports boat with a sail,
c)
Young people under 16 years of age, if it is a sports boat with a driving machine.
Number 3 does not apply on the Eder and Diemeltal barriers. (4) The company shall be entitled to a sports boat
1.
with a length of less than 15 m only to persons who, according to the sports boat licence, are entitled to carry out a recreational craft,
a)
have the driving licence required under the sports bootdriving licence, with the provisions of Section 3 (1) (1) of this Regulation not being applicable,
b)
on the Rhine, irrespective of the place of residence, have a certificate of competency corresponding to the national rules of the Rhine States and of Belgium for inland waters, provided that the sports boat with a propulsion engine with an effective net power is equipped with more than 3.68 kW (5 hp),
c)
in the case of foreign domials, the driving licence referred to in (a), or an official certificate for the internal waters of their country of residence, or, where such a certificate is not issued there, of a certificate of competence for inland waters of a the water sports association of their country of residence,
2.
With a length of 15 m and more only to persons who
a)
at least one sports patent on the Rhine according to section 6.04 (1) (c) of the shipowners ' regulations-Rhine,
b)
on the other inland waterways via the required driving licence pursuant to § 3 (1) or a certificate of competency in accordance with § 4 (3) No. 1, § 5 (1) No. 1 to 3, para. 3, § 6 (1) of the Internal Schifferpatentverordnung
(5) At the berth the company has a running boat according to the standard DIN EN 1914: 1997 and at least one rescue ring according to DIN EN 14144: 2003 ready to be kept. Depending on the type and extent of the rental operation, the water and shipping office can determine deviating from it. (6) The company has to ensure that
1.
a)
the text of this Regulation shall be clearly visible at the place of business and shall be protected against the effects of the weather; and
b)
the tenants are informed of the text of this Regulation, in particular their obligations under Section 10, before the start of the journey, or in any other appropriate manner,
2.
in the case of a sports boat with a propulsion engine, which is not only rented for hours, the documents referred to in point 1 and a certified copy of the boat certificate are on board and the tenants are referred to it before the start of the journey,
3.
a recreational craft not covered by point 2, on the inside, permanently and clearly legible, with the name and address of the undertaking, the number of persons admitted and the number of driving areas registered in the certificate;
4.
the tenants are referred to the local characteristics of waterways or shipping prior to the start of the journey, the consideration of the relevant shipping regulations as well as the behaviour which is appropriate for nature protection,
5.
At the berth, the boarding and exit is monitored.
(7) The company shall inform the lessee or the boat driver prior to their journey that:
1.
the number of authorised persons shall not be exceeded; and
2.
the minimum crew required by the certificate must be on board during the journey.
(8) In so far as the certificate of boat for a sports boat does not require or otherwise prescries an equipment requirement with life jackets, the company shall have a sufficient number of lifejackets in different sizes at the plant, the minimum number of lifejackets being at least comply with the DIN EN 395 standard. The life jackets are to be made available to the tenants free of charge on request. The company has to make a clear indication of this by means of a curtain. Unofficial table of contents

Section 9 Charterattestation

(1) In the cases referred to in Article 8 (4) (1) (a) and (c), the officially recognised certificate issued by the reliable company shall be sufficient to ensure sufficient competence of the tenderer or of the competent authority in place of the driving licences and certificates referred to in paragraph 8 (1) (a) and (c). (2) The reliable undertaking may issue a certificate of charter only:
1.
on the inland waterway routes referred to in Appendix 5;
2.
for recreational craft which have permanently installed sleeping places and meet the requirements of Appendix 6,
3.
to persons,
a)
whose fitness and reliability are not clearly excluded,
b)
for the inland waterway and the sports boat to be driven, the company has been satisfied and has carried out a briefing in accordance with Appendix 4.
The reliable company has to produce a second copy of the charter certificate and to keep it for a period of six months after the exhibition and to hand it out to the water and shipping office for examination on request. (3) Water and Shipping Office may prohibit the issuing of charter certificates to the company if the facts justify the assumption that it does not possess the reliability required. As a general rule, the required reliability does not have a company which repeatedly or grossly violates the provisions of paragraph 2 or § 8, or where the staff of the Water and Shipping Office are in breach of the provisions of paragraph 2 or § 8. Instruction refused in the context of the supervision according to § 6 para. 2 of the Inland Navigation Task Act. The company has to comply with the prohibition in accordance with the first sentence. (4) The company and its authorized representative shall be deemed to be the other person responsible for the duties of the sports boat. (5) The sports boat leader must be in charge of the charter certificate be taken into account. Unofficial table of contents

§ 10 Duties of the Mieters and the Sportbootführer

(1) The tenant must not allow a sports boat to be led by persons who, according to § 8 (3) or (4), are not allowed to rent a sports boat. (2) The sports boat leader has to ensure that:
1.
the number of authorised persons shall not be exceeded,
2.
the minimum crew required by the certificate of the boat is on board during the journey; and
3.
do not leave the driving ranges registered in the boat certificate.

§ 11 Administrative Offences

Contrary to the provisions of Section 7 (1) of the Act on Inland Waterways, those who intentionally or negligently act in the same way
1.
as a company
a)
Contrary to § 6 (6), an advertisement is not reimbursed, not correct, not complete, not in the prescribed manner or not in due time,
b)
According to § 8 para. 1, the rental of a sports boat is ordered or allowed,
c)
, contrary to § 8 (2), 3 sentence 1 or (4), a sports boat is leased,
d)
Contrary to § 8 (5), first sentence, a boat or a rescue ring referred to in that paragraph shall not be available,
e)
Contrary to Article 8, paragraph 6, point 1, point (a), does not ensure that the above-mentioned slope is appropriate,
f)
Contrary to Article 8 (6) (1) (b), (2) or (4), it does not ensure that the indications referred to therein are given,
g)
Contrary to Article 8, paragraph 6, no. 2, it is not ensured that the documents mentioned there and a certified copy of the boat's certificate are on board,
h)
Contrary to Article 8, paragraph 6, point 3, it is not ensured that the sports boat is provided with the information specified therein,
i)
contrary to Article 8 (7), there is no indication, not correct, not complete or not in good time,
j)
issue a charter certificate in accordance with the first sentence of Article 9 (2),
k)
, contrary to the second sentence of Article 9 (2), a second copy referred to therein shall not be retained or not, or shall not be handed over in good time, for at least six months
l)
an enforceable arrangement in accordance with § 9 (3) sentence 1.
2.
as a tenant, contrary to § 10 (1), allows the sports boat to be run by a person named therein, or
3.
as a sports boat guide
a)
Contrary to Section 9 (5), it does not comply with a restriction on the charterbill,
b)
it does not ensure that the number of persons admitted is not exceeded, contrary to Article 10 (2) no.
c)
Contrary to Section 10 (2) no. 2, it does not ensure that the required minimum crew is on board during the journey, or
d)
Contrary to Section 10 (2) no. 3, it does not ensure that the registered riding areas are not abandoned.

§ 12 Transitional Regulation

According to the sports boat rental ordinance-Binnen vom 11. October 1996 (BGBl. 1518), boat products shall continue to apply without a formal extension until the expiry of the acceptance protocol, when a copy of this acceptance protocol is attached to the boat products. General
A special experience is for the beginner the sluice. The initial discomfort can be avoided if one considers the basic rules to be observed and the practical handling. In any case, carry during the sluice life jacket.
Basic Rules
.
The driveway into the lock is regulated by signal lights. Also, only a red light means:-no driveway. Therefore, when approaching the sluice area, slow down and, if necessary, , at the latest where the holding sign stands.

Lock chambers only on the instructions of the lock staff, or drive if there are no boat locks. In case of self-service locks, note signs in the sluice ports.
.
As a rule, small vehicles are not carried out individually, but together with other small vehicles. Are they together with vehicles of the major shipping, e.g. Passenger ships, towed, take it first.

Keep the landing places of ferries and passenger ships free.

Reduce speed in such a way that safe stopping is possible even without the power of a machine, and a collision with the lock gates or other vehicles is excluded.

Slowly drive.
Let a member of the crew get out on the side of the ladder or on the embankation in front of the lock.
The ship's guide throws the lees, the person on land puts the lees around the polls and returns the ends back to the boat.
In the case of self-service locks, follow the instructions of the scoreboard.
Each one person on board takes the front and the back lees and keeps them more densely when the boat descend. Keep the boat tight on the chamber wall.
After permission to exit or hint at scoreboard, take care that no leein falls into the water and gets into the propeller. Slowly and carefully run out. Down-locks
At the front and back of the boat, one lear each at one end on a cleat.
Slowly drive. Stop the boat with the engine.
Place the lees in each case around a poller and take the ends back on the boat.
In the case of self-service locks, follow the instructions of the scoreboard.
One person in each case serves a leeway. During the sinking of the leek, let loose. Keep distance to the Drempel and to the floodgates.
After permission to take the exit Leinen, take care that no leein falls into the water and gets into the boat propeller. Slowly and carefully run out.
If you have a leash with your hand, always put your end around a cleat on board to keep the boat even under heavy load-injury risk: squeeze-.
