The Federal Minister of Food, Agriculture and Forestry prescries on the basis of § 3 (1) No. 1 of the Plant Protection Act of 15 September 1986 (BGBl. 1505) and on the basis of § 3 (1) No. 16 in conjunction with Section 2 of the Plant Protection Act and in conjunction with Article 56 of the Law on Jurisdiction Adjustment of 18 March 1975 (BGBl. 705) and the organisation of the organisation of 23 January 1991 (BGBl. 530) in agreement with the Federal Ministers for Health and the Environment, Nature Conservation and Nuclear Safety: Unofficial table of contents

§ 1 Definitions

For the purposes of this Regulation:
1.
plant protection products which are dangerous:
a)
Plant protection products, which the Federal Office for Consumer Protection and Food Safety approved with the obligation to label it as "bee dangerous",
b)
other authorised plant protection products in a higher than the highest level of use in the instructions for use
aa)
Application rate or
bb)
concentration, if an application rate is not provided;
2.
flowering plants: plants in which open flowers are located, except hops and potatoes.

§ 2 Application

(1) Bee dangerous plant protection products shall not be allowed to:
1.
flowering plants,
2.
other plants, if they are floated by bees,
(2) Bee dangerous plant protection products must not be used in such a way that plants are taken along in accordance with paragraph 1. (3) Within a radius of 60 metres around a bee level, bee-dangerous plant protection products within the time of daily bee flight only with the consent of the beekeeper. (4) Bee dangerous plant protection products must not be handled, stored or disposed of in such a way that bees can come into contact with them. (5) Paragraphs 1 to 4 shall not apply to the application, handling and storage (6) is a plant protection product that is dangerous to the bee, in accordance with a condition issued by the Federal Office for Consumer Protection and Food Safety, stating that: "bee dangerous, except in the case of application after the end of the daily bee flight until 11 p.m. (also with the addition of the words" Central European Time "or the abbreviation" CET ") in the stock to be treated", paragraphs 1 and 2 shall not apply for the use of this plant protection product during the specified time of day. § 3 Exceptions

The competent authority may allow exceptions
1.
§ 2 (1) for research, examination and testing purposes,
2.
Article 2 (1) to (3), in so far as it is necessary to prevent serious damage or loss of plants by harmful organisms.
It has to combine the derogation with the necessary conditions to ensure that the beekeeas whose bee stands are within a radius of 3 kilometres, at the latest 48 hours before the start of the application of the plant protection product shall be informed. It may provide the derogation with conditions to ensure the interests of nature conservation and the maintenance of the countryside. Unofficial table of contents

§ 4 Administrative Offences

Contrary to the provisions of Section 68 (1) (3) (a) of the Plant Protection Act, who intentionally or negligently acts
1.
, in accordance with Article 2 (1), (2) or (3), a plant protection product which is dangerous to the
2.
Contrary to § 2 (4), a plant protection product that is dangerous to the bee is used, stored or disposed of.

§ 5 Entry into force, detached provision
