I.

In accordance with Article 17 (5) sentence 2 of the General Administrative Regulation on aid in sickness, care, birth and death cases (State aid rules-BhV), the Federal Office for Central Services and Open Property Issues will be responsible for the processing of the State aid affairs of the active employees of the Federal Office of Justice and the assertion of claims for damages according to § 87a of the Federal Officials Act. In accordance with Section 126 (3) No. 2 sentence 2 of the Civil Service Law Framework Act in conjunction with Section 172 of the Federal Civil Service Act and with Section 46 of the German Judge Act, the Federal Office for Central Services and Open Property Issues shall be empowered to determine the opposition to an administrative act on state aid matters to the extent that it was responsible for adopting the administrative act. III.

Pursuant to Section 174 (3) of the Federal Civil Service Act, in conjunction with Section 46 of the German Judiciary Act, the Federal Office of Central Services and Open Property Issues shall be responsible for the transfer of the representation of the Federal Ministry of Justice to administrative proceedings, insofar as the Federal Office for Central Services and Open Property Issues was authorized to take a decision on the opposition in accordance with this order. IV.

Points I to III shall also apply to proceedings already under way by the employees of the Federal Office of Justice. This arrangement will take effect on 1 January 2007. Unofficial table of contents
