§ 1 Scope of application

(1) This Regulation goverts the efficiency of the Placing on the market of appliances and boilers which are charged with liquid or gaseous fuels and whose rated power is equal to or greater than 4 kW and is equal to or less than 400 kW.(2) Not covered by this Regulation:
1.
Heating boilers with different fuels, including solid fuels, can be charged;
2.
Hot water exclusive equipment;
3.
Heating boilers designed for charging with fuels whose properties differ significantly from the common market-based liquid and gaseous fuels (Industrial test gas, biogas, etc.);
4.
Kitchen stovings and appliances designed mainly to heat the room in which they are installed, but also Supply hot water for central heating and for utility purposes;
5.
Devices with a rated power of less than 6 kW to supply a hot water storage system with Gravity circulation;
6.
individually produced boilers.

§ 2 Definitions

For the purposes of this Regulation,
1.
Heating Boilers the heat generator consisting of boilers and burners, which is used to transfer the heat released by the combustion to the water;
2.
heating boiler types of the Standard boilers (No. 8), the low-temperature heating boiler (No. 9) and the condensing boiler (No. 10);
3.
Equipment of the boilers to be equipped with a burner and the boiler to be used for the Boiler equipment intended for a particular burner;
4.
rated power specified by the manufacturer and in continuous operation, in compliance with the manufacturer ' s specified Efficiency as a fully guaranteed maximum heat output in kW;
5.
Efficiency the ratio between the heat dissipated to the boiler water and the product from the product the lower calorific value (at constant pressure) of the fuel and the amount of fuel consumed per unit of time in the hundred;
6.
partial load the ratio between the fuel consumption and the fuel consumption. Useful power of an intermittent boiler or a boiler with a power below the rated power and the rated power in the hundred;
7.
Boiler temperature the mean value from the water temperatures at the inlet and at the outlet of the boiler;
8.
standard boilers a boiler, where the average the operating temperature can be limited by its design;
9.
Low-temperature heating boilers a heating boiler which is continuous with an entry temperature of 35-40 Grade C can be operated under certain conditions to condense the water vapour contained in the exhaust gases;
10.
condensing boiler Boilers constructed for the condensation of a large part of the water vapour contained in the exhaust gases.

§ 3 efficiency requirements

(1) Heating boilers must comply with the respective efficiency requirements for the different types of boiler of the Annex 1. Equipment must be designed in such a way that heating boilers assembled from them can meet the requirements of the first sentence.(2) The requirements shall be deemed to be fulfilled if the boilers and appliances comply with the harmonized standards drawn up on behalf of the Commission of the European Communities in relation to the requirements of Council Directive 92 /42/EEC, , in so far as the reference numbers of the harmonized standards are published in the Official Journal of the European Communities and the reference numbers of the national standards applying to them are published in the Bundesanzeiger.(3) In the case of boilers with a dual function-room heating and hot water preparation-the efficiency requirements relate only to the heating function. § 4 Requirements for placing on the market

(1) Boilers and appliances may only be placed on the market if they are are accompanied by the CE marking in accordance with Article 5 (1) and (2) and are accompanied by an EC declaration of conformity in the German language by which the manufacturer or his/her in a Member State of the European Union or any other Contracting State of the Agreement on the European Economic Area (European Economic Area) confirms that
1.
Boilers comply with the requirements of § 3 (1) sentence 1 and the devices comply with the requirements of § 3 (1) sentence 2,
2.
the standard-produced boilers or the Equipment conforming to the type tested for which an approved body has certified, after carrying out an EC type-examination (module B) in accordance with Annex III to Council Directive 92/42/EEC, that the design of the boiler meets the requirements of: § 3 (1) sentence 1 and the design of the device complies with the requirements of § 3 (1) sentence 2 and
3.
the procedure according to Annex IV Module C, D or E of the Directive Council Directive 92 /42/EEC, in the case of gas-fired boilers and burners, also the EC verification referred to in Annex II (5) of Council Directive 90 /396/EEC of 29 June 1991, June 1990 on the approximation of the laws of the Member States relating to gas consumption (OJ L 327, 31.12.1990, EC No 15) (Directive on gas-fuel consumption), as amended by Article 10 of Council Directive 93 /68/EEC of 22 June 1992 on the application of the directive on the protection of the environment 1 July 1993 (OJ C 327, EC No 1).
In the EC declaration of conformity attached to the equipment, the parameters must be set according to which the boilers assembled from the equipment are subject to the requirements of § 3 (1) sentence 2 can be fulfilled.Boilers which are fitted with a device fitted with a CE marking in accordance with this Regulation shall be placed on the market only if they are marked with the CE marking in accordance with Article 5 (1) and (2) and if: the boiler is accompanied by an EC declaration of conformity in the German language by which the manufacturer or his/her in a Member State of the European Union or of another State Party to the Agreement on the European Economic Area confirmed representative confirms that
1.
of the standard heating boilers the parameters referred to in the second sentence of paragraph 1 have been assembled and
2.
the procedure referred to in Annex IV, Module C, D or E of Council Directive 92/42/EEC, in the case of gas-fired Boilers have also been complied with in accordance with the EC verification referred to in Annex II (5) of Council Directive 90 /396/EEC (Directive on gas-fuel consumption). In this connection, the testing, monitoring and certification body operating within the framework of the C module must verify the heating boilers taken from the current production for compliance with the requirements of point 1.
(3) The boiler, attached to the boilers, has been added to the boiler. The EC declaration of conformity must show the type of boiler; the EC declaration of conformity attached to the boilers must be equipped with the boiler type of the boiler to be produced. Non-official table of contents

§ 5 CE marking

(1) The CE marking required in accordance with Section 4 (1) and (2) is clearly visible, readable and durable on the boilers and equipment.(2) The CE marking shall consist of the letters "CE" in accordance with Annex 3 (1).(3) No other marks, signs or indications may be affixed to the boilers and equipment which may be confused with the CE marking in respect of the meaning or the character of the document. Any other marking may be affixed to the boiler or to the appliance if it does not adversely affect the visibility and legibility of the CE marking.(4) In the case of boilers and appliances falling within the scope of other legislation which prescribe the CE marking, the CE marking in accordance with this Regulation shall also ensure the conformity of the boilers and appliances with the provisions of the other legislation. Where, in accordance with one or more of the provisions of this legislation, the manufacturer is free to choose the rules to be applied during a transitional period, the CE marking shall be subject only to conformity with the rules laid down by the manufacturer. Legislation is displayed. In such a case, the documents, instructions or instructions accompanying the boilers or appliances shall be accompanied by the numbers of the acts of the European Communities on which the legislation applied by the manufacturer is based, their publication in the Official Journal of the European Communities.(5) If boilers or appliances have been unauthorised with the CE marking, the authority responsible under national law or designated by the Land Government may prohibit the placing on the market of these products and devalue their CE marking. or have it removed. The same shall apply where boilers and appliances are marked with a mark which can be confused with the CE marking. § 7 Testing, monitoring and certification bodies

(1) The recognition authority, which is responsible under national law or is designated by the national government, may, upon written request, be a person, place or Monitoring Community as
1.
Type-checking verification point according to Module B,
2.
Acknowledgment Verification Point by Module C, D, and E,
3.
Certificate Authority in accordance with Module C, D and E
, if they or the persons employed in their employees, after their training, expertise, personal reliability, impartiality and performance, provide assurance that these tasks are appropriate , and they shall have the means necessary for the appropriate performance of the technical and administrative tasks associated with the performance of the audits, as well as sufficient liability insurance to be provided for . The existence of liability insurance can be proven by professional indemnity insurance. The recognitions are also valid in the other countries.(2) Testing, monitoring and certification bodies which have been recognised by another Member State of the European Union or by another State Party to the Agreement on the European Economic Area shall be subject to the provisions of this Regulation recognition shall be the same as those recognised in accordance with paragraph 1.(3) § § 3 to 12 of the BauPG-PÜZ-Recognition Ordinance of 6. § 8 Administrative Offences
