Was the right to a pension on December 31, 1996, which is based on compulsory contribution periods for which a remuneration or a work income according to § 6 (2) or (3) of the Claim and Anwartschaftsübergoverning Act of 31 December 1996 is based on the earnings of the pension. This pension has been established in December 1996, when in those periods a wage or salary has been obtained, the amount of which is set out in Annex 4 to the right of entitlement, and The law on the transfer of goods was not reached. The newly established pension shall be based on at least the previous personal pay-points. The supplier shall communicate to the institution of the pension insurance institution responsible for the re-determination of the benefits, the data which are considered as merit in the case of the re-determination. The supplier shall notify the person concerned of the content of the communication as set out in the third sentence. The provisions of the Third Section of the First Chapter of the Tenth Book of Social Law shall apply. The pension is to be reestablished at the request of the beneficiary even if, for them, periods of belonging to a pension scheme are to be found in connection with the pension scheme (Section 5 (2a) of the German Eligibility And Benefit Transfer Act). shall be considered. The sentences 2 to 5 shall apply.
