Pursuant to Article 4 (1) of the Device Safety Act, which is defined by Article 1 (6) (a) of the Law of 26 August 1992 (BGBl. 1564), the Federal Government, after consulting the Committee on Technical Work, is responsible for: Unofficial table of contents

§ 1 Scope

(1) This Regulation shall apply to the provision of new appliances (appliances and equipment) on the market. (2) Equipment within the meaning of this Regulation shall be equipment for cooking, heating, hot water, cooling, lighting and lighting. or for washing purposes, and are operated with gaseous fuels and, where water is heated with them, the water temperature does not exceed 105 degrees C. Gas-blower burners and the associated heat exchangers are equivalent to the equipment. (3) Equipment within the meaning of this Regulation are safety, control and control devices as well as assemblies-with the exception of gas blower burners and their (4) gaseous fuel within the meaning of this Regulation (4) gaseous fuel, which is to be installed separately on the market and installed in or assembled into a gas-consuming device. is any fuel that is at a temperature of 15 degrees Celsius and below a pressure of a bar in a gaseous state. (5) Equipment used in accordance with this Regulation shall be equipment which:
1.
are properly installed in accordance with the instructions of the manufacturer and are regularly maintained,
2.
are operated with the usual fluctuations in gas quality and input pressure, and
3.
shall be used in a suitable manner or in a foreseeable manner.
(6) This Regulation shall not apply to equipment specifically intended for use in industrial processes in industrial plants. Unofficial table of contents

§ 2 Security requirements

Equipment and equipment may only be made available on the market if it meets the essential requirements set out in Annex I to Directive 2009 /142/EC of the European Parliament and of the Council of 30 November 2009 relating to gas-consuming devices (OJ L 327, 30.12.2009, p. 10), and which, in the event of proper use, do not endanger the safety of persons, domestic animals and goods. § 3 Conditions for the provision on the market

(1) A device may only be made available on the market if it is accompanied by the CE marking in accordance with Article 4 (1) and (2) by which the manufacturer or his/her in the Community or any other Contracting State of the Agreement shall be provided with the Authorised representative established in the European Economic Area confirms that:
1.
the safety requirements laid down in § 2 are met;
2.
the equipment manufactured as a standard conforms to the type of design tested for which an approved body has certified, after carrying out an EC type-examination in accordance with Annex II (1) of this Directive, that the design of the device is subject to the conditions laid down in of this Directive,
3.
the procedure of
a)
EC type-conformity declaration in accordance with Annex II (2) of Directive 2009 /142/EC,
b)
EC type-conformity declaration in accordance with Annex II, point 3 of Directive 2009 /142/EC (assurance of production quality),
c)
EC type-conformity declaration in accordance with Annex II, point 4 of Directive 2009 /142/EC (product quality assurance), or
d)
EC verification referred to in Annex II (5) of Directive 2009 /142/EC
has been met and
4.
the manufacturer has fulfilled its obligations in relation to the approved body which it has authorised.
(2) In the manufacture of a single-production or small-number device, the manufacturer may, instead of the procedures referred to in paragraphs 1, 2 and 3, choose the device-specific EC verification referred to in Annex II (6) of Directive 2009 /142/EC. (3) the instrument shall also confirm, by means of the CE marking, other legislation which prescribates the CE marking, that the instrument is also in conformity with the provisions of those other relevant legislation. However, where, in accordance with one or more of these laws, the manufacturer is free to choose the applicable rules during a transitional period, the CE marking shall, in this case, only confirm that the equipment is used by the manufacturer. Legislation in accordance with the first sentence. In such cases, in the written information referred to in Article 5, all the numbers of the Community directives on which it applies, as published in the Official Journal of the European Community, shall be subject to the following conditions: (4) The equipment may only be made available on the market if it is accompanied by a certificate referred to in Article 8 (4) of Directive 2009 /142/EC with which the manufacturer or his/her in the Community or any other Contracting State of the Agreement on the European Economic Area established Authorized representative confirms that the essential requirements for equipment referred to in § 2 are met. § 4 CE marking

(1) The CE marking required pursuant to Article 3 (1) and the inscriptions referred to in Annex III to Directive 2009 /142/EC shall be visible, legible and permanently affixed to the device or to a data plaque attached to the device. The data badge shall be designed in such a way that it cannot be re-used. (2) The CE marking shall consist of the letters 'CE' in accordance with Annex III to Directive 2009 /142/EC. The CE marking indicates the identification number of the notified body responsible for the monitoring of production. (3) No markings may be affixed on the device, and the third parties may not be marked with regard to the meaning and the character of the document. could be misled. § 5 Written information

Equipment may only be made available on the market if they are accompanied by the documents in German language listed in point 1.2 of Annex I to Directive 2009 /142/EC. Unofficial table of contents

§ 6 Administrative Offences

Contrary to § 39 (1) (7) (a) of the Product Safety Act, anyone who provides a device or equipment on the market in breach of § 3 (1) or (4) sentence 1 or § 5. Unofficial table of contents

Section 8 Entry into force
