Pursuant to Section 23 (1) of the Federal Immission Protection Act of 15 March 1974 (Bundesgesetzbl. 721, 1193), as amended by § 1 No. 14 of the Law amending the Introductory Act to the Penal Code of 15 August 1974 (Bundesgesetzbl. I p. 1942), is decreed by the Federal Government after consultation of the parties concerned with the consent of the Federal Council: Unofficial table of contents

§ 1 Scope

This Regulation shall apply to the erection, composition and operation of dust or late-emitting installations within the meaning of Section 3 (5) (1) of the Federal Immission Control Act for the processing or processing of wood or wood-based materials including the associated conveying and storage facilities for shavings and dusts. It does not apply to installations which require an authorization pursuant to § 4 of the Federal Immission Control Act. Unofficial table of contents

§ 2 Equipment

Installations within the meaning of § 1 shall be equipped with exhaust air purification systems in their construction which exclude the exceeding of the emission value in accordance with § 4. Sentence 1 shall not apply if the emission value according to § 4 is exceeded by other measures or modes of operation, in particular by the processing of forest-fresh wood, by wet grinding or by the use of mechanical conveying devices in each case. § 3 Storage

(1) Wood dust and shavings shall be stored in bunkers, silos or other enclosed spaces. (2) There shall be regular level checks on bunkers and silos, possibly with level measuring instruments and overfill fuses. (3) Storage facilities within the meaning of paragraph 1 and filtering equipment shall be so empty that emissions of wood dust or chips are avoided as far as possible, for example by filling in closed containers or by humidifying at the discharge point. § 4 Emission Value

(1) Equipment within the meaning of § 1 shall be operated in such a way that the mass concentration of dust and chips in the exhaust air, relative to the normal state (0 degrees C; 1013 millibars), shall be operated.
1.
a value of 50 milligrams per cubic metre of exhaust air is not exceeded if grinding dust or a mixture with grinding dust is contained in the exhaust air or
2.
does not exceed a value resulting from the following diagram, if the exhaust air contains no dust or dust, but other dust or chips.

I 1975, 3133) (2) Annexes referred to in paragraph 1 (1), established after 1 January 1977, shall, by way of derogation from paragraph 1, be operated in such a way that the mass concentration of dust and shavings in the exhaust air, related to the standard condition, has a value of 20 Milligrams per cubic metre of exhaust air is not exceeded. (3) If several installations are operated in a spatial and operational context, the sum of all the volume flows shall be based on the determination of the permissible mass concentration of these installations. . § 5 Further requirements

The power of the competent authorities to take other or more extensive orders on the basis of the Federal Immission Control Act remains unaffected. Unofficial table of contents

§ 6 Approval of exceptions

The competent authority may, on request, authorise derogations from the provisions of the Regulation, provided that, taking into account the particular circumstances of the case, adverse environmental effects are not to be feared or reasons for the protection of the labour market requiring this. § 7 Administrative Offences

Contrary to the provisions of Section 62 (1) (7) of the Federal Immission Protection Act, who intentionally or negligently is acting in accordance with the provisions of the German Federal Immission Act (
1.
Contrary to § 2, an installation is not equipped with an exhaust air purification system,
2.
Contrary to § 3 Wood dust and shavings not stored in bunkers, silos or other enclosed spaces, no regular level checks are carried out, bunkers, silos or other enclosed spaces as well as filter systems are not emptied in such a way that emissions to be avoided as far as possible, or
3.
Contrary to § 4 or § 8, an installation operates in such a way that the permissible mass concentration of dust in the exhaust air is exceeded.

§ 9 Berlin clause

This Regulation shall apply in accordance with Section 14 of the Third Code of Transfer Law of 4 January 1952 (Bundesgesetzbl. I p. 1) in connection with § 73 sentence 2 of the Federal Immission Protection Act, also in the Land of Berlin. Unofficial table of contents

Section 10 Entry into force

This Regulation shall enter into force on the first day of the third calendar month following the date of delivery.
