On the report of the Minister of Social Affairs, Labour and Solidarity and the Minister of Health, Family and People with Disabilities,
In view of the Code of Social Action and Families, in particular Article L. 313-19;
In light of Decree No. 2003-1010 of 22 October 2003 on budgetary, accounting and financial management, and the financing and pricing arrangements for the Social and medico-social institutions and services referred to in Article L. 312-1 of the Code of Social Action and Families and of the institutions mentioned in Article L. 6111-2 of the Code of Public Health, in particular Articles 98 And 99;
Given the building and housing code,
Describes:
Item 1
In the event of the definitive closure of an establishment or a social or medico-social service falling within the scope of Article L. 312-1 of the Code of Social Action and of families under Title III and of the Section 4 of Chapter III of Title I of Book III of the Code of Social Action and of Families or Articles L. 621-24 and L. 621-40 of the Commercial Code, on the date of the said closure of the establishment, the investment grants referred to in 1 ° of Article L. 313-19 of the Code of Social Action and Families and the operating surpluses allocated to the investment referred to in its 3 ° shall be adjusted according to the cost of construction index published by the National Institute of Statistics and economic studies in the following manner:
The notified amount of each investment grant is multiplied by the index of the cost of construction of the closure quarter of the establishment to which it is subtracted The cost of construction of the subsidy notification quarter.
The amounts, for each fiscal year under consideration, of the operating surpluses allocated to the investment are multiplied by the construction cost index of the Closing quarter of the institution to which it is subtracted from the cost of construction of the quarter of the surplus allocation decision. For work aid centres, the operating surplus of the production and marketing annex earmarked for investment under Article 131 of the Decree of 22 October 2003 shall be repaid and revalued in accordance with the arrangements laid down in the last paragraph of Article 1 of this Decree.

For shelters and social reintegration centres, the operating surplus of the production and marketing annex related to the active life adjustment measures allocated to the investment Pursuant to Article 158 of the Decree of 22 October 2003 referred to above shall be paid and revalued in accordance with the arrangements laid down in the last paragraph of Article 1 of this Decree.
