ARRETE
Decree of 27 January 2006 applying to the tiles of Decree No. 92-647 of 8 July 1992 as amended concerning the suitability for the use of construction products

Minister of Transport, Equipment, Tourism and the Sea and the Minister Delegate to Industry,
In view of the Council Directive 89 /106/EEC Of 21 December 1988 on the approximation of the laws, regulations and administrative provisions of the Member States relating to construction products, as amended by Directive 93 /68/EEC of 22 July 1993;
Having regard to Decree No 92-647 Of 8 July 1992 concerning the suitability for the use of construction products, as amended by Decrees Nos. 95-1051 of 20 September 1995 and No. 2003-947 of 3 October 2003, Stop:

Article 1

The provisions of the aforementioned Decree of 8 July 1992 shall apply from the date of publication of this Arrested on the tiles and accessories defined by the standards NF EN 490 and NF EN 1304.

Article 2

In accordance with the respective provisions Articles 2, 3 and 10 of the Decree of 8 July 1992 may, on their own, be equipped with the CE marking the tiles and accessories which have satisfied the conformity clearance procedure applicable to them.
The references of the standards, of the Decisions on certification of conformity applicable to the products referred to in Article 1, as well as those of the bodies notified by the French authorities, appear in an opinion in the Official Journal of the French Republic.

Article 3

By way of derogation from the provisions of Article 1 above and on a transitional basis, the products covered by this Decree which do not Comply with the provisions of the Decree of 8 July 1992 mentioned above may be placed on the market for the first time until 1 September 2006 for products defined by the NF EN 490 standard and until 1 February 2007 for the products defined By the standard NF EN 1304.
Products placed on the market for the first time before the end of the transitional period defined in the preceding paragraph and which do not comply with the provisions of that decree may be marketed until 1 January 2010.
