ARRETE
Order of 26 December 2003 approving bodies authorised to carry out checks on the concentration of benzene in the atmosphere of the workplace

The Minister of Social Affairs, Labour and Solidarity and the Minister of Agriculture, Food, Fisheries and Rural Affairs,
In the light of articles R. 231-55 and R. 231-55-1 of the Labour Code;
In view of Decree No. 2001-97 of 1 February 2001 laying down the special rules for the prevention of carcinogenic, mutagenic or toxic risks for reproduction;
In view of the Decree of 20 August 1996, Amended on 20 August 2001, relating to the quality control to be met by the bodies requesting authorisation for the control of chemical risks provided for in Article R. 231-55 of the Labour Code;
Having regard to the orders of 21 January 2002 and 31 December 2002 approving bodies authorized to carry out controls on the concentration of benzene in the workplace atmosphere;
In the opinion of the Senior Council on Occupational Risk Prevention;
In view of the opinion of the National Commission for Occupational Health and Safety in Agriculture,

Item 1


Approved for sampling and dosing of benzene in work atmospheres. Three years, from January 1, 2004 to December 31, 2006, the following organizations:
ATEST, Parc d' activités Forbach-Ouest, 57600 Forbach;
ALGADE, laboratory PRYSM, technopole Le Polygone, 46, rue de la Télématique, 42000 Saint-Etienne.

Article 2


Only samples of benzene content from working atmospheres are approved. For a period of three years, from 1 January 2004 to 31 December 2006, the following bodies:
AINF, ZI, rue Marcel-Dassault, BP 259, 59472 Seclin Cedex;
Norisko equipments, rue Stuart-Mill, Parc d' activity de Macc-Romanet, 87008 Limoges.

Item 3


Approved for sampling and dosing of benzene in work atmospheres. One year, from 1 January 2004 to 31 December 2004, the following organisations:
CETE APAVE Sudeurope, avenue Gay-Lussac, ZI, 33370 Artigues-près-Bordeaux;
APAVE alsacienne, 2, rue Thiers, BP 1347, 68056 Mulhouse Cedex.

Article 4


Only samples of benzene content from work atmospheres are approved for a one-year period. From 1 January 2004 to 31 December 2004, the following organizations:
APAVE Paris, 13 to 17, rue Salneuve, 75854 Paris Cedex 17;
IRH environnement (Agency Rhône-Alpes), 24, avenue du Dauphiné, 69360 Serezin-du-Rhône;
IRH environnement (Ile-de-France agency), 14 to 30, rue Alexandre, building C, 92635 Gennevilliers Cedex.

Article 5


Approval is taken in title Precarious and revocable at any time by the Ministers responsible for labour and agriculture.

Article 6


This Order is Granted without prejudice to the provisions of the orders of 21 January 2002 and 31 December 2002 referred to above.

Article 7


The body shall Notify the Ministry of Labour of any withdrawal or suspension of accreditation, regardless of the extent of this measure.

Article 8


The body that is the subject of a suspension or a withdrawal of accreditation no longer fulfils the conditions of approval and can no longer carry out the concentration controls in Benzene in the atmosphere of the workplace for the duration of this suspension or withdrawal.
This information is published in the Official Journal.

Article 9


The Director of Labour Relations and the Director General of Forest and Rural Affairs shall each have responsibility for the execution of this Order, which shall be published in the Official Journal of the French Republic.
