DECRET

The Prime Minister,
On the report of the Minister of State, Minister of the Interior and Spatial Planning, and the Minister of the Public Service,
Given the EC Directive n ° 88/2003 The European Parliament and the Council of 4 November 2003 concerning certain aspects of the organisation of working time;
Law No. 84-53 of 26 January 1984 laying down statutory provisions relating to the territorial civil service, as amended Act No. 2001-2 of 3 January 2001, in particular its Article 7-1;
In light of Law No. 2004-809 of 13 August 2004 on local freedoms and responsibilities, in particular Articles 18, 19, 30 and 104;
In light of Decree No. 2000-815 On 25 August 2000 on the development and reduction of working time in the public service of the State, in particular Article 3;
Having regard to Decree No. 2001-623 of 12 July 2001 adopted for the application of Article 7-1 of Act No. 84-53 of the 26 January 1984 concerning the development and reduction of working time in the territorial civil service, in particular Article 3;
Having regard to Decree No. 2002-259 of 22 February 2002 on derogations from minimum guarantees for the duration of the Work and rest applicable to certain categories of personnel of the Ministry of Equipment, Transport and Housing;
In view of the opinion of the Joint Committee on the follow-up of transfers of personnel between the State and the communities Territorial as of 14 November 2006;
In view of the opinion of the Higher Council of the Territorial Civil Service of 29 November 2006;

In services or parts of services transferred to local authorities pursuant to Articles 18, 19, 30 and 104 of Act No. 2004-809 of 13 August 2004, the rules on derogations The minimum guarantees laid down for the application of Article 3 of Article 3 of the Decree of 25 August 2002 referred to above shall be determined in accordance with the conditions laid down in Decree No. 2002-259 of 22 February 2002 on derogations from minimum guarantees of duration Applicable to certain categories of personnel of the Ministry of Equipment, Transport and Housing.
