The Conseil d' Etat (Finance Section) heard,
Describes:
The number of jobs of Head of Mission for Agriculture and the Environment is fixed by an order of the Minister responsible for agriculture.
The list and location of jobs are set in the same Conditions, after the opinion of the Minister responsible for the environment, for those jobs which are under his authority.
Can be named in a job as Head of Mission for Agriculture and the Environment:
1 ° The Divisional Agriculture and Environment Engineers who have reached the 3rd step of their rank For at least eighteen months with a minimum of three years of effective service as divisional engineers; and
2 ° Central administrative officers of the Ministry of Agriculture who have reached the 5th echelon of the 2nd Class of their rank for at least 18 months and who have at least three years of effective service in this capacity;
3 ° Senior Administrative Attachés of the Depreates of the Ministry of Agriculture and Attachments Principal academic and academic administration of agricultural education who have attained the 4th level of the 2nd class of their grade for at least eighteen months and who have at least three years of effective service in this capacity;
4 ° Other employees belonging to a body classified in category A or equivalent level, holders for at least three years of a grade with a crude terminal index at least equal to the gross index 966 and which have reached at least the index Gross 759. Interested parties must demonstrate experience in the fields of agriculture or the environment with a minimum duration of three years.
The appointment of a Head of Mission for Agriculture and the Environment shall be made by order of the Minister responsible for agriculture for a term of five years, possibly renewable.
The Minister responsible for the environment is consulted prior to any assignment of a Head of Mission for Agriculture and the Environment to a service under his/her authority.
Employees appointed to the job of Head of Mission for Agriculture and the Environment are placed in a position of detachment from their original body.
They may be removed from the position in Service interest.
The job of the Head of Mission for Agriculture and the Environment consists of six echelons and an exceptional step.
The length of the actual service time spent at each step to access the echelon Is set at two years and six months.
The number of jobs providing access to the exceptional level is determined by the joint order of the Minister responsible for agriculture, the Minister responsible for the Public Service and the Minister responsible for the Budget.
Can be appointed at the exceptional level of officers seconded to the post of Head of Mission who have reached the 6th level for at least two years and six months.
Employees appointed in a job as head of mission for agriculture and the environment are classified at the level with an equal index or, failing that, Immediately greater than the one they held in their original bodies.
However, when this ranking modality is more favourable, those who previously occupied a job with a terminal index at least equal to the gross index 1015 are classified at the level with an equal index or, failing that, immediately higher than that which they held in that employment.
In the age limit required by section 6 for promotion to the next level, the Employees mentioned in the first and second subparagraphs retain seniority acquired in their previous grade or employment when the increase in salary resulting from their appointment is less than that which would result from a Career advancement in their old situation.
Employees appointed when they had reached the highest level of their original rank or employment retain their seniority in the same conditions and limitations when The increase in salary resulting from their appointment is less than that provided to them by the progress audit.
The Heads of Mission of the Ministry responsible for agriculture governed by Decree No. 96-487 of 19 September 1996 are held in office and classified as Head of Mission for Agriculture and The environment to an index equal to the one they previously enjoyed and retain the seniority acquired.
Decree No. 96-487 of 19 September 1996 on the employment of the Head of Mission of the Ministry of Agriculture is repealed.
The Minister of Economy, Finance and Industry, the Minister of Agriculture and Fisheries, the Minister of the Public Service, the Minister of Ecology and the Minister of Fisheries Sustainable development and the Minister responsible for the budget and the reform of the State, a spokesman for the Government, are each responsible for the implementation of this Decree, which will be published in the Official Gazette of the Republic French.
