Decree of 23 December 2005 on the declaration of vacancies as professor at the University-Hospital-Practitioner offered for transfer and for recruitment under the heading of the year 2006 and laying down the terms of Candidacy

The Minister of National Education, Higher Education and Research and the Minister of Health and Solidarity,
In light of Decree No. 84-131 of February 24, 1984, as amended Status of hospital practitioners;
Given the amended Decree No. 84-135 of 24 February 1984 on the status of teaching and hospital staff in hospital and university centres, and in particular Title III, Chapter III;
Given the decree N ° 86-10 of 3 January 1986 laying down the conditions for the cooperation of hospital and university staff;
Having regard to the order of 2 January 1986 laying down the conditions under which candidates of foreign nationality may be Authorised to take part in the competitions referred to in Articles 48 and 61 of Decree No. 84-135 of 24 February 1984;
In the light of the decree of 17 September 1987 laying down the procedure for the recruitment of teachers from hospital-medical practitioners and hospitals Conference masters of hospital-based university-practitioners;
In the light of the amended decree of 18 August 1988 fixing the lists of disciplines provided for in Articles 61 and 80 of Decree No. 84-135 of 24 February 1984 amending the status of staff Teachers and hospitals in hospital and university centres;
In the light of the decree of 30 December 1992 adopted pursuant to Articles 48 (2 °), 61 and 62 (a) of Decree No. 84-135 of 24 February 1984, amending the status of teaching staff Hospital and university hospitals;
In the light of the decree of 26 January 1993 amending the list of disciplines in which a practical pedagogical test is organised pursuant to Article 52 of Decree No 84-135 of the 24 February 1984 amending the status of teaching and hospital staff in hospital and university centres;
In the light of the decree of 3 December 1993 laying down the conditions under which foreign diplomas and diplomas are allowed in Dispensing from the authorisation to conduct research or a doctorate of state for the purposes of Article 63 of Decree No. 84-135 of 24 February 1984, amending the status of teaching and hospital staff in hospital centres and Academics;
In light of the amended July 23, 2003 Order, on the conditions of mobility required of candidates for university-hospital and university-hospital faculty appointments,
Stop:

Article 1


The teaching jobs of the hospital-based medical practitioners designated in the list annexed to this Order (Annex I) are declared vacant and may be filled in the following conditions.

  • TITLE Ier: MUTATION Item 2


    Professors of hospital-based practitioners who meet the condition of seniority provided for in Article 60 of Decree No. 84-135 of February 24, 1984, may request their transfer to the jobs set out in the Annex I, under the conditions defined below.
    However, in accordance with Article 1 of Decree No. 86-10 of 3 January 1986, employment with a cooperative assignment is not available for deployment.

    Article 3


    Within days of publication in the Official Journal of this Order, candidates for deployment Should address the Director of the Training and Medical Research Unit and the Director General of the University Hospital Centre:
    -a request for transfer, which can be downloaded from the website www.education.gouv.fr under " Administrative forms ";
    -a detailed curriculum vitae;
    -a list of their titles and works.
    Applicants shall, within the same time frame, send a copy of the application letter and the curriculum vitae:
    -to the Department De l' éducation nationale, de l' enseignement supérieur et de la recherche, DPE B12 (bureau des aries de santé), 34, rue de Châteaudun, 75009 Paris;
    -on the other hand, to the Ministry of Health and Solidarity, direction of hospitalization and De l' organisation des soins (bureau M 2), 8, avenue de Ségur, 75350 Paris Cedex 07.

    Item 4


    At the expiration of the Section 3 of this Order applies the following procedure:
    For each job to be filled:
    -the Director General of the University Hospital Centre shall immediately submit the application (s) received to the Commission Establishment medical which meets in limited training limited to inpatient-university staff performing duties at least equivalent to those to which the person concerned applies;
    -the Director of the Training Unit and Medical research immediately seizes the board of the unit that meets in restricted training for teachers at least equal to that of a teacher.
    Both instances have twenty-one days to advertise their Opinion, in the case of multiple applications, to a ranking of the candidates who have received a favourable opinion.

    Item 5


    The opinions expressed are attached to the applications and sent, within six weeks from the date of publication in the Official Journal of this Order, by the Director of the Training and Medical Research Unit, to the Ministry of National Education, Higher Education and Research and the Director General of the University Hospital Centre, Ministry of Health and Solidarity.

  • TITLE II: COMPETITION RECRUITMENT Article 6


    Persons of French nationality and nationals of the European Union or other States party to the The Agreement on the European Economic Area may apply to the competitions for the recruitment of teachers from hospital-based practitioners, under the following conditions defined by type of competition.
    These conditions, to The exception of the age-specific condition, is appreciated by the deadline for submission of the candidature files set out in Article 7 below.


    Type I competition organized pursuant to Article 61
    of Decree No. 84-135 of 24 February 1984 (see Annex II)


    A. -Can be applied for:
    I.-In all disciplines:
    Associate professors of French nationality or national of the European Union or of the other States party to the agreement on the European Economic Area which have Completed in this capacity at least three years of effective service either full-time or part-time (section 71).
    II. -In biological and mixed disciplines:
    Masters of conferences of hospital-based practitioners justifying at least two years of effective functions in this capacity.
    They must have the clearance to lead Research or doctorate of state.
    It is accepted that foreign degrees and diplomas can be obtained from these French diplomas in order to gain access to teaching-researcher functions of the same rank in the country's higher education institutions. In which they are issued. Candidates must provide to this effect a certificate from the embassy of the country under consideration in France that expressly certifies that the diploma or title obtained in that country by the person concerned provides access to the functions of a teaching-scientist of the same rank That those entrusted to the professors of the university-medical practitioners in the higher education institutions of the country concerned.
    III. -In the clinical disciplines and in the mixed disciplines included in the list established by the decree of 18 August 1988 as amended (see Annex III):
    Clinical heads of universities-hospital assistants, former heads of clinics of the Universities-hospital assistants, university hospital practitioners, former university hospital practitioners and conference masters of hospital-based university-practitioners with at least two years of effective function in Any of these qualifications.
    They must have the authority to conduct research or doctorate of state.
    The diplomas and foreign titles available for access to foreign diplomas are granted in French. Functions as a teacher-researcher of the same rank in the higher education institutions of the country in which they are issued. Candidates must provide to this effect a certificate from the embassy of the country under consideration in France that expressly certifies that the diploma or title obtained in that country by the person concerned provides access to the functions of a teaching-scientist of the same rank That those entrusted to the professors of the university-medical practitioners in the higher education institutions of the country concerned.

    Clinical Heads of Universities-Hospital Assistants and Former Clinical Leaders of the University assistants must also be under forty-five years of age on January 1 of the year of the competition. This age limit, however, is not binding on hospital practitioners governed by Decree No. 84-131 of 24 February 1984, former heads of clinics of the universities' assistants in hospitals.
    IV. -In clinical disciplines:
    Hospital practitioners who meet the conditions laid down in Decree No. 86-10 of 3 January 1986 concerning the service in cooperation.
    B.-Candidates must also meet the obligation For a period of one year at least one of the activities of care, teaching or research, in France or abroad, outside the university hospital in which they are assigned or, for the former heads of the University assistants and former university hospital practitioners, in which they were last assigned. Care activities in private health facilities that do not participate in hospital or city public service are not taken into account.
    The conditions under which this mobility obligation applies shall be fixed By the Order of 23 July 2003 as amended by the Order of 29 October 2004.


    Type 2 contest organised pursuant to Article 62 (a)
    of Decree No. 84-135 of 24 February 1984 (see Annex II)


    Applications can be made:
    Incumbent and former researchers of scientific public bodies, researchers and former researchers at the Pasteur Institute and cancer control centres, as well as Centres or establishments of blood transfusion in the headquarters cities of university hospitals and teaching staff not covered by Decree No. 84-135 of 24 February 1984, justifying two years of effective functions in one or more The other of these qualifications.
    Candidates who have exercised, for at least two years, in a foreign institution of higher education or research, teaching or research functions at least equivalent to those entrusted to them Conference masters.

    Type 3 contests organized pursuant to Article 62 (b)
    of Decree No. 84-135 of 24 February 1984 (see Annex II)


    Can make an application:
    Hospital practitioners governed by Decree No. 84-131 of 24 February 1984, classified at least at the 6th echelon of their bodies on 1 January The year of the competition, having carried out a university teaching activity under the conditions laid down by their special status.


    Type 4 contests organized pursuant to Article 63
    of Decree No. 84-135 of 24 February 1984 (see Appendix II)


    Can be considered as a candidate:
    University-university lecturers with ten years of seniority in this capacity and holders of the empowerment to lead Research or doctorate of state.
    The degree to which foreign degrees and diplomas can be granted access to the duties of a teaching-researcher of the same rank in the higher education institutions of the country is allowed to be granted in French.     Item 7


    The Candidatee File is addressed, preferably in a simple recommended mailing (without notice of receipt) no later than January 20, 2006, at midnight (the postmark), to the addressee named below on the basis of The discipline of competition:
    -for the biological and mixed disciplines on List A (Annex III) and the disciplines component of an intersection, the Ministry of National Education, Higher Education and Research (Office for the organization of recruitment of higher education staff, DPE A 10), 110, rue de Grenelle, 75357 Paris 07 SP;
    -for the clinical disciplines listed in List B (Annex III), to the Ministry of Health and Solidarities, direction of hospitalization and the organization of care (office of medical competitions, M 4), 8, avenue de Ségur, 75350 Paris Cedex 07.

    Article 8


    The Candidatory File must contain the following documents:
    (a) A declaration of application made in duplicate, which can be downloaded from the website: http://www.education.gouv.fr, under the heading " Administrative forms ";
    (b) A photocopy of the national identity card or, failing that, a certificate of nationality;
    (c) A photocopy of the diplomas (for foreign degrees and diplomas: certificate of the embassy of the country concerned) In France);
    d) An administrative certificate showing the duration of the duties required to present itself, a copy of the appointment orders;
    e) For candidates in the type 2 competitions organised pursuant to Article 62 (a) of the Decree No. 84-135 of 24 February 1984 in respect of the teaching or research functions carried out in a foreign institution of higher education or research, an attestation by the head of the institution concerned Expressly certifying that the teaching or research functions performed by the person concerned are at a level equivalent to those entrusted to the lecturers. Applications that do not include this certification cannot be declared admissible;

    Any document in foreign language must be translated into French.
    Only files with all required parts will be examined.

    Article 9


    For the purposes of Articles 61, 62, 63 and 64 of Decree No. 84-135 of 24 February 1984, the date of commencement of the tests shall be as at 29 March 2006.
    Candidates in a discipline where at least one job has been filled by way of deployment are notified, by individual letter, either of the decrease in the number of jobs offered, or of the elimination of the competition if all the jobs offered are Provided by means of a transfer. In the latter case, the application is automatically cancelled.
    Candidates who wish to withdraw may do so before the date fixed for the start of the tests, exclusively by registered letter to the office that registered Their registration.

    Article 10


    The list of candidates allowed to compete is jointly decided by the Minister of Education National, higher education and research, and the Minister of Health and Solidarity.

    Item 11


    The Candidates who are allowed to compete are required to send directly, at a date and at the addresses indicated to them:
    1 ° To all the members of the competent jury:
    a) A statement of their titles and works;
    b) If applicable, a Copy of the application referred to in item 8, above.
    2 ° To the chairperson of the competent jury and to the rapporteurs, in addition to the document referred to above:
    a) A copy of the certificates, diplomas and certificates deposited at the time of registration ;
    b) At their choice, all or part of their works and prints other than their publications.

  • TITLE III: FOREIGN CANDIDATES Article 12


    Persons of foreign nationality, fulfilling the conditions laid down in the second subparagraph of Article 1 of the decree of 2 January 1986, may present their To be nominated for the designation of a Professorship of University-Medical Practitioner abroad.

    Item 13


    For All disciplines, the files must be addressed by the department responsible for relations between the French Republic and the country concerned, no later than 20 January 2006, at midnight (postmark), at the latest.     Only files with all required parts will be examined.
    All documents in the foreign language must be translated into French.

    Article 14


    The provisions of Articles 9, 10 and 11 are Applicable to candidates in a foreign capacity.

    Article 15


    The Director of Teachers and the Director of The hospital and the organisation of care shall each be responsible for the execution of this Decree, which shall be published as well as its annexes in the Official Journal of the French Republic.
