DECRET
Decree n ° 2003-1373 of 31 December 2003 on the compensation regime for contract agents of public law of the National Employment Agency

On the report of the Minister of Social Affairs, Labour and Solidarity, the Minister of Economy, Finance and Industry and the Minister of The civil service, the reform of the state and spatial planning,
Having regard to Decree No 2003-1370 of 31 December 2003 laying down the provisions applicable to contract agents of public law of the National Employment Agency, and Article 19;
In view of the opinion of the National Joint Consultative Committee of the National Employment Agency dated 19 June 2003;
In view of the opinion of the Board of Directors of the National Employment Agency dated 20 June 2003,

Within the limits of the appropriations for this purpose, the Public Law Contract Agents of the National Employment Agency (ANPE), with the exception of agents recruited under the second subparagraph of Article 6 Act No. 84-16 of 11 January 1984 laying down statutory provisions relating to the public service of the State in order to meet occasional or seasonal needs, may benefit from premiums and allowances defined in this Decree.
These Premiums and allowances are indexed to the value of the public service.

  • Chapter I: Feature Bonus Article 2


    A function premium is assigned to the officers mentioned in item 1 based on the level of employment in which the agents are classified. This premium is paid monthly.
    The amounts of the function premium may be increased when the officers carry out their duties at the Audit Directorate, at the overseas departments of the ANPE headquarters, are assigned to the Conduct of service cars at ANPE headquarters on a permanent basis, in mobile teams or in the installation and maintenance of computer hardware in units.

  • Chapter II: Prime linked to Attendance, how to serve, or individual performance Article 3


    A variable premium related to attendance, the manner of Service or individual performance can be attributed to the agents mentioned in Article 1.
    Monthly amounts related to attendance are set by job levels. They may be subject to abbrations in the event of absenteeism.
    Monthly amounts related to the manner of service are set by employment levels and vary according to the results of the assessment of how to serve. They are paid semi-annually.
    Agents occupying jobs with specific leadership, coordination or facilitation responsibilities, defined by decision of the Director General after advice from the Joint Advisory Committee Member States, collect these amounts on a transitional basis and until 31 December 2003.
    The amounts of individual allocations related to attendance and service may not exceed a maximum amount determined by employment levels.
    The Annual amounts of individual awards relating to individual performance shall be determined on the basis, in particular, of the assessment of the individual performance of the agents, which shall be carried out in the light of the results obtained during the period of Reference to the objectives set and taking into account the way in which they were obtained.
    They may not exceed a fixed limit:
    -by job category or function for employees occupying jobs with Specific leadership, coordination or facilitation responsibilities;
    -by functions for departmental delegates, assistant regional delegates and regional delegates.

  • Chapter III: Executive Lump Sum Article 4


    An annual and flat-rate management premium, designed to recognise progress in the appropriation of job-related competencies in the context of occupational mobility, is attributed to the agents exercising the Functions of departmental delegates, assistant regional delegates or regional delegates.
    Annual average amounts of the lump sum management premium are fixed according to the classification of departmental delegations and delegations In one of the two groups defined in Article 18 of the aforementioned decree of 31 December 2003.
    The amount of individual awards may not exceed twice the average amount.

    An officer who has obtained a first certificate may apply every two years to prepare a new certificate.

  • Chapter V: Award for assignment in a unit Serving a sensitive urban area Article 6


    A specific premium shall be assigned to the agents mentioned in Article 1 assigned in Units serving sensitive urban areas, the list of which shall be fixed by decision of the Director General after the opinion of the National Joint Consultative Committee.
    The monthly amount of this premium is set by the level of employment in which the Classification of the officers referred to in this section.

  • Chapter VI: Mobility Compensation Item 7


    Agents classified in levels of employment IV B bis or IV B, V A and V B provided for in Articles 3 and 42 of the decree of 31 December 2003 referred to above and transferred in the interest of the service may receive a representative fee, Linked to geographical mobility within the framework of career paths aimed at developing skills and control of responsibilities.

    Item 8


    Agents Classified in the levels of employment I, II, III and IV A provided for in Article 3 of the decree of 31 December 2003 above which have to carry out frequent and distant occupational movements of at least forty kilometres of their administrative residence May benefit from a basic lump-sum allowance.     Article 9


    A specific allowance is assigned to deployed agents in the community of Mayotte. The monthly amount of this allowance shall be determined by decision of the Director General.

  • Chapter VII: Astreintes Item 10

  • Chapter VIII: Other allowances Article 11

    Article 12

    Item 13


    Agents ensuring The duties of an officer responsible for the development of the competences of the officers of the ANPE benefit, within the limit of a daily ceiling, of an allowance per effective hour of training.

    Article 14


    A Joint Order of Ministers responsible for Employment, Budget and Public Service sets the amount of premiums and Indemnities and the nature of the periodic penalty payments and interventions provided for in this Order.The

    Article 15


    The provisions of this Decree shall take effect on the date of entry into force of Decree No. 2003-1370 of 31 December 2003 laying down the provisions applicable to contract agents of public law of the National Employment Agency.

    Item 16


    The Minister of Social Affairs, Labour and Solidarity, the Minister of Economy, Finance and Industry, the Minister for the Public Service, State Reform and Spatial Planning, and the Minister for Social Affairs. Minister responsible for the budget and budgetary reform shall each have responsibility for the implementation of this Decree, which shall be published in the Official Journal of the French Republic.
