Having regard to Decision No. 2010-408 of 11 May 2010 as amended and supplemented by Decision No. 2015-434 of 18 November 2015 attributing to the national programme company France Télévisions a radio resource for broadcast by way Terrestrial microwave and in high definition of the television service named France Ô;
Given Decision No. 2015-418 dated 18 November 2015 supplemented by Decision No. 2015-453 of 2 December 2015, authorizing the Société de gestion du Québec R1 (GR1) network to use a radio resource for multiplexing programs Editors of terrestrial terrestrial television services in digital mode of the R1 network;
Seen the deliberation n ° 2015-33 of 18 November 2015 of the Conseil supérieur de Audiovisual relating to the setting of rules for the sharing of radio resources for the multiplex of terrestrial digital terrestrial television;
After having deliberated,
Decides:

Item 1 deliberation n ° 2015-33 of November 18, 2015 ("thousandths"), the Conseil supérieur de l' audiovisuel has made an amendment to the rules for the sharing of the radio resource of terrestrial digital television. They anticipate that, as of April 5, 2016, the resource required for broadcasting in MPEG-4 of a standard definition television service (SD) will be 95 thousandths. The resource required to broadcast a high definition (HD) television service in MPEG-4 will be 195 thousandths.
By way of derogation, the resource required for the MPEG-4 broadcast of a metropolitan television service Local in high definition (HD), other than the service broadcast in Île-de-France on the national network R1, will amount to 160 thousandths. Indeed, the diffusion of local stalls in France 3 as well as that of local television services on the national network R1 impose, outside of Ile-de-France, constraints on the multiplexing techniques used which Make the latter less effective than those implemented on the other national DTT multiplexes. These technical specificities lead to a resource of 160 thousandths of the local stalls in France 3 and local television services when they are broadcast in high definition on the national network R1.
Stopping the MPEG-2 and the generalization of the MPEG-4 compression standard for the distribution of TNT services will make available thousandths available. In particular, this resource will enable the conversion of existing local television services of an SD format to an HD format, in accordance with the objective set out in Article 30-1 of the Act of 30 September 1986 that the Higher Council of Audiovisual aids in the development of the various innovative television broadcasting standards.
The resource on which this call for applications is based will actually be available in April 2016.


I. -2. The resource on which this call for applications is based


The call for applications is for the digital resource that will be available on the DTT R1 network on the Bayonne area, following the transition to the compression standard MPEG-4 scheduled for April 5, 2016.
On this horizon and on this zone, the R1 network will allow the broadcasting of four national high definition television services, including France 3, as well as the local television service that has Already a clear and standard definition (SD) authorization on the field.
Due to technical constraints on the national network R1, and in particular the impossibility of implementing a full statistical multiplexing leading to the consumption of a specific additional resource on this network of 50 Thousandths of the flows related to the broadcasting of the national television service France 3, the resource available in this appeal is 65 thousandths.
This limited available resource allows the only access to high Definition (HD) of a local television service that already has a Clear and standard definition (SD) authorization on the zone, with the HD authorization to replace the authorization in SD.
The authorized service must cover the geographic area of Bayonne referred to in Schedule 1.
For this purpose, The publisher of the authorized service shall distribute from all the sites and places of issue and the radio resources listed in Annex 1, respecting the technical characteristics which are defined in the Same appendix.


I. -3. Categories of services


Due to the technical constraints mentioned above, only the application of the local authorized television service in the Bayonne area can be submitted for broadcast in high Definition.


I. -4. Dissemination Standards


The technical characteristics of the broadcast signals must comply with the provisions of the amended December 24, 2001 Order.
In particular, the services must be broadcast according to the DVB-T standard on the basis of An encoding of the components according to the MPEG-4 standard.
They must also conform to the document entitled " Signage profile for the broadcasting of digital terrestrial television services and ultramarine " An electronic version is available on the Board's website (www.csa.fr).

The programs that have been converted to high definition by later digital processing ("upscaling") Are not considered to be high-definition programs.
b) High-definition broadcast obligations:
Eight hours of programming each day must be broadcast in full in high definition between 11 a.m.
However, the editor can broadcast standard broadcast programs, as long as it is:


-heritage works, that is:
-audiovisual works broadcast at least twenty years after their first operation by a television service;
-cinematographic works broadcast at least thirty years after their release in cinemas in France;
-broadcasts, That is, any dissemination of a standard definition programme which has already been broadcast on a television service falling within the competence of a Member State of the European Union;
-archives, that is, images, in particular Program extracts, the first release of which took place more than one year Before new use as part of a high definition program.


This high definition program delivery volume, between 11 a.m. and midnight, can be reached at the end of a supported increase ending on 31 December 2019. It cannot be less than two hours a day from 1 January 2018. The candidate brings all of the elements in support of his/her request for ascent.


I. -6. Anticoncentration device

The candidate who wishes to withdraw his or her application must, without delay, notify him by registered mail with an acknowledgement of receipt by the Board, which takes note.
If the withdrawal is effected after the issuance of the Authorization, the resource intended for the service that is the subject of the discontinuance can be allocated only after a new call for applications.


II. -1.3. Contents of the Candidator File


The application template is presented in Appendix 2.

II. -2. Admissibility of applications


The board establishes a list of eligible candidates.
Applications that meet all of the following conditions are acceptable:
1. File filing, in French, within the time limits set out in II. -1.1;

3. Effective existence of the candidate corporation on the application deadline.

. Elaboration of the amendment to the Convention


The Council shall define with the selected candidate the provisions of the amendment to the Convention provided for in Article 28 of the Law of 30 September 1986

II. -6. Authorization or rejection of applications


In the case of a service that is already authorized in a standard definition to which the same high definition service is substituted, the Board makes a decision to amend the authorization and publishes it, with The amendment, in the Official Journal of the French Republic.
The criteria taken into consideration by the Council for the granting of authorisations are defined in Article 30-1 of the Act of 30 September 1986

    This map Identifies the geographical areas on which it is estimated that the level of theoretical signal received will be a priori sufficient for the good reception of the service. Persons in these areas will normally be able to receive the channel if their receiving antenna is directed to the affected emitters. In addition, it should be recalled that this map is derived from a theoretical computer simulation. The reality on the ground may therefore vary from this theoretical estimate.

    III. -1. Actual High Definition Delivery Commitments


    First-broadcast local programs are broadcast in high real definition.
    The publisher agrees to broadcast in full, in real, eight hours of programs Per day, between 11 a.m. and midnight.
    This hourly volume can be reached at the end of a ramp-up that ends on December 31, 2019. It shall not be less than 2 hours per day as from 1 January 2018.
    For the purposes of calculating this obligation, no account shall be taken of the works of heritage, rebroadcasts and archives defined in paragraph I-5.2 of this Article. Decision.

    The candidate presents the requested documents by distinguishing:


    -the financial information that relates to the preexisting digital terrestrial television activity (standard definition broadcast over the TNT network);

    -finally, the financial information that relates to all other activities performed by the company.

    V.-Technical Specifications


    Program delivery occurs in high definition Using MPEG-4 video encoding standard.
    The Technical characteristics of broadcast signals shall comply with the provisions of the Decree of 24 December 2001 on digital terrestrial television setting out the characteristics of the signals emitted.
    In order to ensure implementation Of its service with other authorized services, the characteristics of the signals issued by the candidate must also be in accordance with the document entitled " Signage profile for the broadcasting of digital terrestrial television services and ultramarine " An electronic version of which is available on the Council's website (www.csa.fr).
    The programmes broadcast must respect deliberation n ° 2011-29 of 19 July 2011 of the Conseil supérieur de l' audiovisuel on the technical characteristics of the sound intensity of television programmes and advertising messages.


    V. -1. Technical and Financial Resources


    The candidate describes the technical and financial means that he or she plans to implement to ensure the operation of his or her service. In particular, it describes the estimated delivery costs, as contemplated.
    It also presents the technical solutions that it intends to implement to forward its signal to the emitters.


    V. -2. Interactivity engine


    The candidate indicates, on the one hand, all the information, in particular the technical process, concerning the interactivity engine and, on the other hand, the means which it intends to implement to ensure a Compatibility of service with other authorized services.


    V. -3. Use of the radio resource


    The candidate indicates his need for bandwidth to broadcast the service concerned (expressed in hundreds of kilobits per second), detailing the distribution of the flow for the video, Sound and associated data.
