Decision n ° 2015-0830 of 2 July 2015 fixing the conditions of#039; use of radio frequencies by audio auxiliary equipment for programme design and broadcasting in the frequency bands 470-789 MHz, 823-832 MHz and 1785-1805 MHz

The Electronic Communications and Postal Regulatory Authority (hereinafter " The ARCEP "),
Having regard to Directive 1999 /5/EC of the European Parliament and of the Council of 9 March 1999 on radio equipment and telecommunications terminal equipment and the mutual recognition of their conformity, and in particular Articles 3.2, 4.1 And 6;
In view of Directive 2014 /53/EU of the European Parliament and of the Council of 16 April 2014 on the harmonisation of the laws of the Member States concerning the making available on the market of radio equipment and repealing the Directive 1999 /5/EC;
In view of Directive 2009 /140/EC of the European Parliament and of the Council dated 25 November 2009 amending Directives 2002/21/EC on a common regulatory framework for electronic communications networks and services, 2002 /19/EC on access to electronic communications networks and The associated resources and their interconnection, and 2002 /20/EC on the authorisation of electronic communications networks and services;

In view of the decision 2014 /641/EU of the European Commission of 1 September 2014 on the harmonisation of the technical conditions for the use of radio spectrum by wireless audio equipment for the implementation of programmes and events Special;
Due to report 53 of the CEPT " To develop technical conditions for the 694-790 MHz ("700 MHz) frequency band in the EU for the provision of wireless broadband and other uses in support of EU spectrum policy objectives" ;

In view of the decree of 18 March 2013 concerning the national distribution of frequency bands;
Given the decision No. 2012-0618 of the ARCEP as of 15 May 2012 Setting the conditions for the use of radio frequencies by auxiliary equipment for programme design and broadcasting in the frequency bands 470-789 MHz and 823-832 MHz;
In view of Decision No. 2012-0616 The ARCEP as of 15 May 2012 laying down the conditions for the use of frequencies Radio apparatus by auxiliary equipment for the design of programmes and broadcasting in the frequency band 1785-1800 MHz;
In view of Opinion No. 2015-8 of the Conseil supérieur de l' Audiovisuel dated 13 May 2015;
The Commission Advisory on electronic communications that was consulted on March 13, 2015;
After deliberation on July 2, 2015;
For these reasons:
Audio auxiliary equipment for program and broadcasting design, called Also equipment " PMSE " (for program making and special events), are a daily work tool for audiovisual and entertainment professionals. These are technical equipment, typically wireless microphones or stage returns, which are essential to the production of cultural content for television, theatres and operas, the coverage of media or sporting events, Etc.
The framework for the use of frequencies by these equipment is set by the ARCEP. The purpose of this Decision is to update the existing regulatory framework to take into account:
(a) The change in the allocation of the band 694-790 MHz (" 700 MHz band ") ;
(b) The adoption in 2014 of a European Commission harmonization decision;
(c) The renewal of a power-for-order waiver.


On the existing regulatory framework


Article L. 42 of the CPCE states that " For each of the frequencies or bands of radio frequency assigned to it pursuant to Article L. 41 outside the uses for experimental purposes, the Authority [...] fixes, under the conditions laid down in the Article L. 36-6:
1 ° The technical conditions for the use of the frequency or frequency band;
2 ° The cases in which the authorisation of use is subject to the declaration provided for in Article L. 33-1;
3 ° Cases in which The use of frequencies is subject to administrative authorisation ".
On these grounds, the ARCEP adopted, inter alia, two decisions laying down the conditions for the use of radio frequencies by the ancillary sound equipment of Program design and broadcasting:


-Decision No. 2012-0618 dated May 15, 2012, concerning the bands 470-789 MHz and 823-832 MHz;
-Decision No. 2012-0616 dated May 15, 2012, concerning the band 1785-1800 MHz.


These decisions provide that the Such frequency bands can thus be used " Freely " By professional users of PMSE equipment, i.e. without prior individual authorisation. These users, however, must comply with the technical parameters of use fixed by these decisions of the ARCEP, which consist mainly of maximum emission powers.
In these conditions, users of PMSE equipment Are not subject to the payment of royalties. However, they shall not cause interference to other uses of frequencies, and shall not be protected against interference.
This Decision, taken on the basis of the above provisions, aims to resume the framework laid down by the 2012-0618 and n ° 2012-0616 incorporating new conditions relating to the reassignment of the band 694-790 MHz to mobile service, compliance with the provisions of the decision of the European Commission 2014 /641/EU and The use of its return links and order links with a power Maximum 1 Watt


Band Reallocation 694-790 MHz


The 700 MHz band, used to date by terrestrial digital television (DTT) as well as by PMSE equipment, is the subject of work at the national level and International, since the 2012 World Radiocommunication Conference (WRC-2012), in order to allow its future use by mobile broadband networks.
In France, Annex 3 of the national distribution table for the Frequencies (TNRBF), arrested on 18 June 2015 by the Prime Minister, came to clarify the 700 MHz band reallocation scheme, which provides as follows:


-on the one hand, a gradual release, by geographical plates, of the entire 700 MHz band by TNT between April 2016 and June 2019;
-on the other hand, the exclusive allocation to the ARCEP of the frequencies 703-733 MHz and 758-788 MHz For mobile service, as a result of the release of the band by TNT.


In addition, the TNRBF provides that the ARCEP may continue to authorize professional users of PMSE equipment to use frequencies until July 1, 2019 700 MHz band (1).
The redeployment from the 700 MHz band to the New mobile services will ultimately prevent PMSE equipment from continuing to use these frequencies. However, a transient use of the 700 MHz band is possible during the frequency reallocation process, subject to appropriate technical conditions. This transient use of the 700 MHz band thus allows PMSE users to continue to use equipment operating in the 700 MHz band for several years only.
However, the frequencies used by PMSE equipment will evolve as the timing of the release of each geographic plate by DTT is set out in Annex 3 of the TNRBF. Thus, for a given geographic location, prior to the release date, the entire spectrum of the band 700 will be usable, subject to appropriate technical conditions. On the other hand, the day after the release of this geographic plate by TNT, the PMSE equipment will no longer be able to use the bands 703-733 MHz and 758-788 MHz for the deployment of high-speed mobile networks.
This To amend the existing framework for the use of the band 470-790 MHz by equipment PMSE:


-taking into account the change in the assignment of the band 694-790 MHz, which leads to no longer allowing PMSE equipment on these frequencies after July 1, 2019;
-by maintaining the authorization to use the frequencies 470-694 MHz, without change from the conditions set out in the ARCEP Decision No. 2012-0618;
-by making it possible for the transitional use of 700 MHz band PMSE equipment up to July 1, 2019, taking into account the Frequency reallocation schedule by geographic plate.


The Technical conditions associated with the transitional use of the 700 MHz band by PMSE equipment until 1 July 2019 are defined in the Annex to this Decision.
These conditions of use depend on the date of termination of the Audio-visual broadcasts in the band 694-790 MHz for each geographical plate, as set out in Annex 3 of the TNRBF.
Prior to that date, the conditions for the use of the PMSE equipment on the geographical plate considered remain Similar to those provided for by ARCEP Decision No. 2012-0618.
After This date, the technical conditions for the use of the PMSE equipment on the geographic plate under consideration are being modified to take into account the need to protect the services that will be authorized by the PFRA on the frequencies 703-733 MHz And 758-788 MHz in this geographic plate.
As from the date of the termination of the audio-visual broadcasts in the band 694-790 MHz on a given geographic plate, and until July 1, 2019, the use of the PMSE equipment is thus limited The frequency bands 694-703 MHz and 733-756.8 MHz and the conditions Techniques are those from Tables 13 and 14 of the report of CEPT 53 ("To develop technical conditions for the 694-790 MHz (" 700 MHz) frequency band in the EU for the provision of wireless broadband and other uses in support of EU Spectrum policy objective "), which was developed in response to a mandate from the European Commission.


Implementation of the decision of the European Commission 2014 /641/EU


This Decision also aims to update the existing regulatory framework for Take account of the adoption in 2014 of a European Commission harmonisation decision.
The European Commission adopted, on 1 September 2014, Decision 2014 /641/EU on the harmonisation of technical conditions Use of the radio spectrum by wireless audio equipment for The delivery of special programs and events.
This decision harmonizes the technical requirements for the use of the 800 MHz and 1800 MHz mobile bands by PMSE equipment, providing for 1 of its Article 3, " Member States shall designate and make available, without interference and without protection, within six months of the taking of effect of this Decision the frequency bands from 823 to 832 MHz and from 1 785 to 1 805 MHz for audio PMSE equipment Without wire, in accordance with the technical conditions laid down in Annex [of Decision 2014 /641/EU] ".
This Decision thus alters the conditions for the use of the frequency bands 823-832 MHz and 1785-1805 MHz, as determined by decisions No. 2012-0618 and 2012-0616 of the ARCEP, to implement the provisions of the European Commission decision 2014 /641/EU. These new conditions include the authorization to use the band 1800-1805 MHz by PMSE equipment, as well as the limits of off-band emissions to ensure the protection of authorized mobile networks above 832 MHz.
Consistency with the harmonised framework of Decision 2014 /641/EU, this Decision also consolidate within the same decision of the ARCEP the conditions for the use of the two frequency bands 823-832 MHz and 1785-1805 MHz.


Using the order and return links sound, With a maximum power of 1 Watt

In its opinion No. 2011-13 of 19 July 2011, The Conseil supérieur de l' Audiovisuel (CSA) had expressed its reservations about the risk of this power derogation for the reception of TNT. Studies were launched at the request of the National Frequency Agency, the result of which was the subject of a report adopted by the Electromagnetic Compatibility Commission in May 2014. This technical report concluded " That a typical channel-adjacent use of such equipment (i.e., in the white space of the UHF band) does not present any harmful interference with the reception of TNT. "
On the basis of this technical conclusion, This Decision authorizes, for the band 470-694 MHz, the use of order and return links with a maximum effective radiated power of 1 Watt,
Decides:

Item 1 In particular, professional users within the meaning of this Decision shall be considered as professional users Living within the meaning of article L 7122-2 of the job code.

Article 2


The use of the frequency band 470-694 MHz by audio auxiliary equipment for program design and broadcasting is authorized subject to compliance with the technical requirements specified in the paragraph And, under these conditions, is not subject to Individual authorisation.
The technical conditions applicable to the use of frequencies referred to in this Article consist of a limitation to 50 mW (17 dBm) of the effective radiated power, with the exception of audio equipment without Wire for return and order connections, whose effective radiated power is limited to 1W.

Article 3


Usage Of the frequency band 823-832 MHz by equipment Audio auxiliaries of programme design and broadcasting shall be authorised subject to compliance with the technical conditions laid down in Table 1 of the Annex to Decision 2014 /641/EU of the European Commission referred to above and, in these Conditions, is not subject to individual authorization.

Use of frequency band 1785-1805 MHz by equipment Audio helpers for program design and broadcasting is Authorised subject to compliance with the technical conditions laid down in Tables 2 and 3 of the Annex to Decision 2014 /641/EU of the European Commission referred to above and, in these circumstances, is not subject to individual authorisation.

Item 5


Until July 1, 2019, the use of the frequency band 694-789 MHz by auxiliary sound design equipment Programs and broadcasting is authorized subject to compliance with Conditions of use specified in the Annex to this Decision and, in these circumstances, is not subject to individual authorisation.

Article 6


The audio auxiliary equipment for the design of programs and broadcasting authorized pursuant to this Decision shall not cause harmful interference to the stations of a licensed radiocommunication service A primary allocation in the national table of Frequency band distribution. They shall not be entitled to any guarantee of protection against harmful interference.
In particular, equipment authorised pursuant to this Decision shall not prevent the deployment of localized applications or the Conduct of technical experiments that would be conducted on the frequencies 694-790 MHz in order to meet short-term needs or to study possible future uses.

Article 7


Decisions N ° 2012-0618 et n ° 2012-0616 suscribed for the ARCEP are repealed.

Article 8


The Director General of the ARCEP is responsible for the execution of the This decision shall be published in the Official Journal of the French Republic after approval by the Minister responsible for electronic communications.

    ANNEX


    Appendix 3 of the National Table of Frequency Allocations (TRNBF) specifies the schedule for phasing out, by geographic plate, of the audio-visual broadcasts in the band 694-790 MHz, to confer on the ARCEP the status of only primary assignment Blocks 703-733 MHz and 758-788 MHz as the tape is released.

    A. -Prior to the termination date of the audio-visual broadcasts in the band 694-790 MHz on a given geographic plate:
    The use of the band 694-789 MHz is authorized under the following conditions:
    The effective radiated power is limited The following values:


    -in the band 694-786 MHz: 50 mW (17 dBm);
    -in the band 786-789 MHz: 12 mW (10.8 dBm).


    The level of out-of-band emissions must not exceed the level of e.i.r.p shown below:


    -above 791 MHz: - 43 dBm/5 MHz


    B. -After the termination date of the audio-visual broadcasts in the band 694-790 MHz on a given geographic plate, and until July 1, 2019:
    The use of the sub-bands 694-703 MHz and 733-756.8 MHz is authorized, as required
    The equivalent effective isotropic radiated power (e.i.r.p) is limited to the following values:


    -in the band 694-703 MHz: 19 dBm/ 200 kHz;
    -in the band 733-753.8 MHz: 19 dBm/ 200 kHz;
    -in the band 753.8-755.2 MHz : 13 dBm/ 200 kHz.


    In the case of equipment worn in the body, p.i.r.p is limited to the following values:


    -in the band 694-703 MHz: 19 dBm/ 200 kHz;
    -in the band 733-756.8 MHz: 19 dBm/200 kHz.


    The The level of off-band emissions shall not exceed the level of e.i.r.p shown below:


    -in the band 703 -733 MHz: - 45 dBm/ 200 kHz;
    -above 758 MHz: - 45 dBm/ 200 kHz
