Notice: This Decree updates the provisions on international cooperation of institutions in the regulatory part of the education code, following the amendment introduced by theArticle 84 of Act No. 2013-660 of 22 July 2013. Thus, it is no longer referred to only public higher education institutions under the Ministry of National Education but to all PHPRs. The proposed agreement may now be concluded if, upon the expiration of one month, and no more than three, after the receipt of the project by the Minister for Higher Education and the Minister for Foreign Affairs, the Minister for Higher Education has not notified a total or partial opposition of either.

The Prime Minister,
On the report of the Minister of National Education, Higher Education and Research,
Vu le education codeincluding articles L. 123-7-1 and D. 123-15 to D. 123-21;
Considering the opinion of the National Council for Higher Education and Research of 19 January 2015,
Decrete:
In section D. 123-15 of the Education Code, the words: "public higher education institutions under the Ministry of National Education" are replaced by the words: "public institutions of a scientific, cultural and professional nature, on the one hand, other public higher education institutions under the Minister responsible for higher education, on the other hand."
Section D. 123-17 of the same code is repealed.
In article D. 123-18 of the same code, the word "but" is deleted and the words "the Ministry of National Education and the Ministry" are replaced by the words "of the ministerial departments of which the institutions referred to in article D. 123-15 and "".
Article D. 123-19 of the same code is amended as follows:
1° In the first preambular paragraph, the words: "who seizes it" are replaced by the words: "to his guardianship authorities and";
2° In the second paragraph, the words ", guardianship authorities" are inserted after the words "higher education";
3° The third and fourth paragraphs are replaced by the following two paragraphs:
"The one-month period referred to in the third paragraph of Article L. 123-7-1 is applicable to the draft agreements of public institutions referred to in Article D. 123-15 other than public institutions of a scientific, cultural and professional character.
"If this agreement is renewed, it is again subject to the communication procedure. »
The Minister for Foreign Affairs and International Development and the Minister of National Education, Higher Education and Research are responsible, each with respect to it, for the execution of this Order, to be published in the Official Journal of the French Republic.
