Decree No. 2015-611 of 3 June 2015 on the scale of family allowances, age increases and lump sum allowances

The public concerned: beneficiaries of family benefits.
Subject: scale of family allowances, age increase and lump sum allowance, defined according to the resources of the beneficiaries.
Entry into force: the provisions of this Decree shall apply to benefits due as of 1 July 2015.
Notice: This Order sets out the scale of family allowances, age increases and family allowances, the amounts of which vary according to the resources received during the reference calendar year. The defined resource ceilings are increased for each dependent child and revalued on January 1 of each year by interdepartmental order, in accordance with the annual average change in consumer prices. The amount of family allowances also varies according to the number of dependent children. A degressive supplement is paid when the recipient's resources exceed one of the ceilings, within a certain amount. The decree determines the method of calculating these amounts and the degressive supplement.

The Prime Minister,
On the report of the Minister of Finance and Public Accounts and the Minister of Social Affairs, Health and Women's Rights,
Vu le Social Security Codeincluding articles L. 521-1, L. 755-11 and L. 755-12;
Vu la Act No. 2014-1554 of 22 December 2014 Social Security Funding for 2015, including Article 85;
Considering the advice of the Board of Directors of the National Family Allowance Fund dated 7 April 2015;
Considering the opinion of the Central Board of Directors of the Agricultural Social Mutuality of April 15, 2015,
Decrete:

Section D. 521-1 of the Social Security Code is replaced by the following provisions:


"Art. D. 521-1.-I.-For the purposes of section L. 521-1, the amount of family allowances and the age increase provided for in section L. 521-3 shall be determined by the following scale:
« 1° Where the household or person has disposed of an amount of resources less than or equal to the ceiling defined in section D. 521-3, the rates for calculating family allowances shall be set, as a percentage of the monthly basis provided for in section L. 551-1, to:
"(a) 32% for the second dependent child;
“(b) 41% for the third dependent child and each of the following.
"The age increase is 16 per cent of the monthly basis for calculating family benefits;
« 2° Where the household or person has disposed of an amount of resources greater than the ceiling defined in section D. 521-3 I and less than or equal to that defined in section II of the same section, the rates used for calculating family allowances shall be set, as a percentage of the monthly basis provided for in section L. 551-1, to:
“(a) 16% for the second dependent child;
“(b) 20.5 per cent for the third dependent child and each of the following.
"The age increase is set at 8 per cent of the monthly basis for calculating family benefits;
« 3° Where the household or person has disposed of an amount of resources greater than the ceiling defined in Article D. 521-3 II, the rates for calculating family allowances shall be set, as a percentage of the monthly basis provided for in Article L. 551-1, to:
“(a) 8 per cent for the second dependent child;
“(b) 10.25 per cent for the third dependent child and each of the following.
"The age increase is set at 4% of the monthly basis for calculating family benefits.
"II.-In accordance with the sixth paragraph of Article L. 521-1, the monthly amount of family allowances and, if applicable, of the age increase is increased by a degressive supplement, where the annual resources of the household or the person exceed one of the ceilings defined in I or II of Article D. 521-3 of less than twelve times the monthly amount of the family allowances increased, if any,
"This degressive supplement is equal, for each month, to the twelfth of the difference between, on the one hand, this resource cap plus the amount defined in the preceding paragraph and, on the other, the amount of resources. »

Section D. 521-2 of the same code is amended as follows:
1° The first paragraph is replaced by six subparagraphs as follows:
"I. - The monthly amount of the lump sum allowance provided for in the second paragraph of Article L. 521-1 shall be determined by the following scale:
« 1° Where the household or the person has disposed of an amount of resources less than or equal to the ceiling defined in section D. 521-3, the monthly amount of the lump sum allowance shall be 20.234 per cent of the monthly basis for calculating family allowances per child;
« 2° Where the household or person has disposed of an amount of resources greater than the ceiling defined in Article D. 521-3 I and less than or equal to that defined in Article II, the monthly amount of the lump sum allowance shall be 10.117 per cent of the monthly basis for calculating family allowances per child;
« 3° Where the household or person has disposed of an amount of resources greater than the ceiling set out in II of section D. 521-3, the monthly amount of the lump sum allowance is set at 5.059 per cent of the monthly basis for calculating family allowances per child.
“II. - Pursuant to the sixth paragraph of section L. 521-1, the monthly amount of the lump sum allowance is increased by a degressive supplement where the annual resources of the household or the person exceed one of the ceilings defined in section I or II of section D. 521-3 of less than twelve times the monthly amount of the lump sum allowance to which the child opens.
"This degressive supplement is equal, for each month, to the twelfth of the difference between, on the one hand, this resource cap plus the amount defined in the preceding paragraph and, on the other, the amount of resources. » ;
2° The second paragraph of Article D. 521-2 is preceded by "III".

Chapter I of Book V title II of the same code is supplemented by two articles as follows:


"Art. D. 521-3.-I.-The ceiling provided for in 1° of I of articles D. 521-1 and D. 521-2 is set at 55,950 euros. It is increased by 5,595 euros per dependent child.
"II.-The ceiling provided for in 2° I of D. 521-1 and D. 521-2 is set at 78,300 euros. It is increased by 5,595 euros per dependent child.
"III.-The amounts of the ceilings and their respective increases set out in this article shall be revalued on January 1 of each year, in accordance with the annual average change in the prices for tobacco consumption of the calendar year of reference, by order of Ministers responsible for social security, budget and agriculture.


"Art. D. 521-4.-For the purposes of sections D. 521-1 and D. 521-2, household or person resources are valued under the conditions set out in sections R. 532-3 to R. 532-8. »

In article D. 755-5-1 of the same code, the words "of article D. 521-2" are replaced by the words "of articles D. 521-2 to D. 521-4".

The provisions of this Decree shall apply to benefits due on or after 1 July 2015.

The Minister of Finance and Public Accounts, the Minister of Social Affairs, Health and Women's Rights, the Minister of Agriculture, Agri-Food and Forestry, spokesperson for the Government, the Secretary of State responsible for the budget and the Secretary of State responsible for the family, the elderly and the autonomy are responsible, each with regard to it, for the execution of this decree, which will be published in the Official Gazette.
