Vu la Act No. 2012-226 of 17 February 2012 authorizing the approval of the offender to the agreement between the Government of the French Republic and the Government of the Kingdom of Morocco on assistance to detained persons and on the transfer of convicted persons;
Vu le Decree No. 53-192 of 14 March 1953 amended on the ratification and publication of international commitments undertaken by France;
Vu le Decree No. 86-49 of 7 January 1986 issuing the agreement between the Government of the French Republic and the Government of the Kingdom of Morocco on assistance to detained persons and on transfer of convicted persons, signed in Rabat on 10 August 1981, as amended by an exchange of letters dated 31 July 1985,
Decrete:
The amendment to the convention between the Government of the French Republic and the Government of the Kingdom of Morocco on assistance to detained persons and on the transfer of convicts, signed in Marrakech on 22 October 2007, will be published in the Official Journal of the French Republic.
The Prime Minister and the Minister for Foreign Affairs and International Development are responsible, each with respect to him, for the execution of this decree, which will be published in the Official Journal of the French Republic.
AVENANT
TO THE CONVENTION ON THE GOVERNMENT OF THE FRENCH REPUBLIC AND THE GOVERNMENT OF THE GOVERNMENT OF THE GLOBALLY ON THE ASSISTANCE OF DISCOVERY PERSONS AND ON THE TRANSFERING OF CONDAMNED, SIGNED TO MARRAKECH 22 OCTOBER 2007
The Government of the French Republic and the Government of the Kingdom of Morocco, below designated the Parties,
Desirous of amending the Convention between the Government of the French Republic and the Government of the Kingdom of Morocco on assistance to detained persons and on the transfer of convicted persons signed in Rabat on 10 August 1981 (hereinafter referred to as "the Convention"),
The following agreed:
Article 1
Paragraph (c) of Article 6 of the Convention is deleted.
Article 2
Paragraph (f) is added to article 7 of the Convention as follows:
“(f) If the convicted person has the nationality of the sentencing state."
Article 3
Article 12 of the Convention is thus supplemented:
"However, in the event of a re-expenditure of less than one year, Parties may agree to a transfer in exceptional cases. »
Article 4
1. Each Contracting State shall notify the other of the fulfilment of the necessary constitutional procedures with regard to the implementation of this Advant. The latter will enter into force on the first day of the second month following the month of receipt of the last notification.
2. This Avender shall apply as long as the Convention remains in force.
In faith, the undersigned, duly authorized, have signed this Advant.
