Judgment of 30 January 2015 amending various orders relating to hospital management officers

Minister of Social Affairs, Health and Women ' s Rights,
Considering the amended Act of 23 December 1901 punishing fraud in public examinations and examinations;
Vu la Act No. 83-634 of 13 July 1983 rights and obligations of civil servants, together with Act No. 86-33 of 9 January 1986 amended with statutory provisions for the hospital public service;
Vu le Decree No. 2001-1207 of 19 December 2001 modified with special status of the body of hospital management officers and amending the Decree No. 90-839 of 21 September 1990 bearing particular statutes of public service administrative personnel;
Vu le Decree No. 2007-196 of 13 February 2007 relating to the equivalences of diplomas required to present themselves to the public service access competitions and employment frameworks;
Vu le Decree No. 2007-704 of 4 May 2007 amended on the organization and operation of the National Management Centre (regulatory provisions);
Vu le Decree No. 2013-908 of 10 October 2013 relating to the appointment of members of the jury and the selection committees for the recruitment and promotion of public officials in the public service of the State, the territorial public service and the public hospital service;
In view of the decision of December 31, 2009 setting out the composition of the jury, the nature of the trials and the organisation of the professional examination provided for in theArticle 11 of Decree No. 2001-1207 of 19 December 2001 bearing the particular status of the body of the hospital administration officers and amending the Decree No. 90-839 of 21 September 1990 bearing particular statutes of public service administrative personnel;
In view of the decree of 14 December 2010 setting out the conditions of the examinations for access to the preparatory cycle for the internal competitive examination for the recruitment of hospital staff;
In view of the decision of February 15, 2012, setting out the composition of the jury, the program, the nature of the tests and the organisation of the competitions for access to the training cycle of students attached to hospital administration,

  • Chapter I: Provisions Amending the Decision of December 31, 2009 setting out the composition of the jury, the nature of the tests and the procedure for organizing the professional examination provided for in Article 11 of Decree No. 2001-1207 of December 19, 2001 establishing the specific status of the body of hospital administrators Article 1 Learn more about this article...


    Section 2 is amended to read:
    1° The words: "by insertion into the Official Journal of the French Republic and by posting in establishments where the posts are to be filled. » are deleted;
    2° After the first paragraph, the following paragraph shall be inserted:
    "Notices announcing professional examinations are posted, so as to be accessible to the public, at the premises of the institution organizing these examinations, in those of the regional health agency they report and in those of the prefecture of the department in which the establishment is located. They are also posted electronically on the website of the relevant regional health agency as well as on the websites of all regional health agencies. »

    Section 4 is amended to read:
    Before the last paragraph, the following paragraph shall be introduced:
    « 3° A member of the body of hospital management officers governed by the Decree No. 2001-1207in the department or region concerned. The composition of the jury is established in accordance with the provisions of Decree No. 2013-908 of 10 October 2013 on the modalities for the appointment of members of the jury and the selection committees for the recruitment and promotion of civil servants in the public service of the State, the territorial public service and the hospital public service. In addition, the organizing authority of the competition provides for an alternate presidency between men and women in the jury. »

    Section 5 is replaced by the following:
    "The professional examination for access to the rank of primary hospital administration has a single oral test lasting 30 minutes.
    The single oral test consists, after a presentation by the candidate of his or her career and training, in an interview with the jury on the basis of a dossier presenting the achievements of the candidate's professional experience, to assess the candidate's professional knowledge, his or her level of expertise in his or her field of practice, his or her qualities of reflection, his or her ability to organize, coordinate, manage and his or her professional project. If applicable, the jury may ask the candidate for his or her opinion on a practical case or issue relating to the professional exercise of a hospital administrator. The total duration of the test is 30 minutes, with a maximum of five minutes written by the candidate. She's rated from 0 to 20.
    Only the interview with the jury gives rise to notation.
    The record of recognition of the achievements of the professional experience is not noted. The form corresponding to the certificate of professional experience is available from the management of the organizing institution. It can also be posted on the website of the organizing establishment. The applicant's file comprising the entries listed in the appendix to this Order shall be submitted to the directorate of the organizing institution with the application for participation in the professional examination. »

    Section 6 is replaced by the following:
    "Candidates with a total of 10 or more points may only be declared admitted to the professional examination.
    The results of the professional examination shall be communicated to the appointing authority, which shall inform the competent parity administrative board. »

    Article 5:
    1° The words: "a general health institution advisor appointed by the head of the general social affairs inspection;" are deleted and replaced by the words: "a member of the general social affairs inspection; » ;
    2° The following phrases: "The jury chair is exercised by the director general of the care offer. In the event of the absence or incapacitation of the jury, the Director General of the National Management Centre shall designate the President of the jury as a member of the jury. are replaced by the following sentence: "The President of the jury is appointed by the Director General of the National Management Centre among the members of the jury. »

    Article 2:
    In the penultimate paragraph, the following phrases: "The jury chair is exercised by the director general of the care offer. In the event of the absence or incapacitation of the jury, the Director General of the National Management Centre shall designate the President of the jury as a member of the jury. are replaced by the following sentence: "The President of the jury is appointed by the Director General of the National Management Centre among the members of the jury. »

    The 1st of Article 3-B of the aforementioned Order of February 15, 2012 is replaced by:
    « 1° An interview with the jury to assess the candidate's personality, his potential and motivation to perform the duties of hospital administration attaché (duration: 30 minutes, coefficient 4) which is as follows:


    - on the one hand, the commentary on a text concerning the current contemporary health, social and mediocial problems (maximum duration: fifteen minutes after a fifteen minute preparation);
    - on the other hand:
    - for candidates for the external contest: an exchange on his academic and/or professional career and his motivations. To do so, the jury has the candidate's curriculum vitae showing his or her academic and/or professional curriculum (maximum duration: fifteen minutes, of which five minutes are no more presented by the candidate);
    - for candidates for the internal competition or the third competition: an exchange on his career and his professional achievements. In support of this exchange, the jury shall have the file constituted by the candidate for recognition of the achievements of the professional experience, the model of which is set out in Appendix V to this Order (maximum duration: fifteen minutes, of which five minutes shall be submitted by the candidate). Only the interview with the jury gives rise to notation. The RAEP file is not noted. »

    Professional examinations whose opening orders have been issued prior to the effective date of this Order remain governed by the provisions applicable to the date of publication of this Order.
