Subject: Approval of the statutes of the scientific, cultural and professional public institution "Paris-Est University".
Entry into force: the text comes into force on March 1, 2015.
Notice: this decree approves the COMUE statutes, in accordance with theArticle L. 718-8 of the Education Code. The establishment is composed of the following members:
Under higher education institutions: the School of Engineers of the Chamber of Commerce and Industry of Paris Ile-de-France, the National School of Bridges and Roads, the National Veterinary School of Alfort, the University of Marne-la-Vallée and the University of Paris-XII;
Research organizations include the National Centre for Scientific Research and the French Institute of Transport, Development and Network Sciences and Technologies.

"Paris-Est University" is a public institution of a scientific, cultural and professional nature, formed in the form of a community of universities and institutions, as defined in the articles L. 711-1 and L. 711-2 Education code.

    STATUS OF THE PUBLIC APPROACH WITH SCIENTIFIC, CULTURAL AND PROFESSIONAL "UNIVERSITY PARIS-EST"

    • Part I: LEGAL NATURE


      Article 1
      Legal nature


      Paris-Est University is a scientific, cultural and professional public institution (EPSCP). Type community of universities and institutions according to theArticle L. 718-3 of the Education Code, the institution takes the name of "Paris-Est University".
      Paris-Est University Headquarters is located 6-8 Blaise-Pascal Avenue, Champs-sur-Marne, 77455 Marne-la-Vallée. It may be transferred to any other place by the Paris-Est University Board of Directors.


      Article 2
      Composition


      On the date of approval of these statutes, Paris-Est University includes the following members:
      1° National Centre for Scientific Research (CNRS);
      2° National School of Bridges and Roadways (ENPC);
      3° National Veterinary School of Alfort (ENVA);
      4° École d' ingénieurs de la chambre de commerce et d'industrie de Paris Ile-de-France (ESIEE Paris) ;
      5° Institut français des sciences et technologies des transports, de l' aménagement et des réseau (IFSTTAR) ;
      6° Université Paris-Est Créteil - Val-de-Marne (UPEC) ;
      7° Université Paris-Est Marne-la-Vallée (UPEM).
      New members may join Université Paris-Est provided that their application is accepted by a favourable opinion of the two-thirds majority council and a vote of the board of directors rendered to the absolute majority of the members in office.
      No member may leave the community of universities and institutions for the duration of a multi-year contract. Any withdrawal will be communicated to the President of Paris-Est University no later than one year before the end of a multi-year contract. The terms of a withdrawal are then the subject of a deliberation by the board of directors, which sets the material and financial conditions of the withdrawal.
      The exclusion of a member institution, including the terms of this exclusion, may be pronounced by deliberation of the board of directors of Université Paris-Est. The heritage and financial consequences of the exclusion are treated under the same conditions as in the event of a member's withdrawal.
      The membership, exclusion or withdrawal of a member or the possible merger of two institutions within the scope of the community of universities and institutions necessarily implies a modification of these statutes and the renewal of the governance bodies of Paris-Est University. In accordance withArticle L. 718-8 of the Education Code, the statutes are amended by a vote of the Board of Directors of Université Paris-Est rendered to the absolute majority of the members in office, after advice from the boards of directors of the member institutions and favourable advice from the board of members rendered to a two-thirds majority. These amendments are approved by decree.


      Article 3
      Association policy


      In accordance with Article L. 718-16 and in accordance with the terms provided by law, Université Paris-Est may conclude association agreements with public or private institutions or bodies involved in the public service of higher education and research.
      Nominations from institutions or organizations wishing to join the Paris-Est University will be examined in particular with regard to criteria that respect a site logic with particular attention to the respect of the territorial dimension that characterizes it and/or complementarity with respect to the shared strategy, particularly expressed through the thematic hubs of Paris-Est University.
      Nominations are subject to acceptance by a favourable opinion of the Council of Members and a vote of the Board of Directors rendered by a two-thirds majority of the members present or represented.

    • Part II: MISSIONS


      Article 4
      Missions


      As part of the shared project defined in Article L. 718-2 of the law, Paris-Est University has the following tasks:
      1° Contribute to the radiation of all its members within local, regional, national and international spaces;
      2° Promote joint attractiveness to all public users, teaching and research personnel, and library staff, engineers, administrative, technicians, service and health, as well as academic and economic and social partners;
      3° Strengthen the coherence and complementarity of the activities of its members in the light of:
      (a) The requirement of excellence and quality for its audiences;
      (b) The relevance of proposed work organizations to staff.


      Article 5
      Jurisdiction


      As part of the above-mentioned missions, Université Paris-Est develops activities and programmes under three types of competence:
      1° Skills transferred by each of the member institutions for the duration of the multi-year contract in accordance with the terms specified for each institution within the multi-year contract; these competencies are:
      (a) The definition of the doctoral policy and that relating to the empowerment to lead research (in relation to the scientific policy of its members) and its implementation: porting of accreditation, registration of PhD students, distribution of allocations and doctoral funding between the doctoral schools by respecting the scientific policies of the member institutions implemented by the recognized research units, organization of training, grant of the doctoral degree, accompaniment to the start-up of the post-graduate degree Paris
      (b) The organization and implementation of cross-cutting activities to members and based on a share of joint funding, as part of a call for projects; the modalities for the management of these programs are defined in the framework of framework conventions approved by the Paris-Est University authorities;
      2° Training, research, development, digital development, student life, activities that are still being implemented by members, are coordinated by members at the request of members. This coordination can be strategic (contribution to policy definition) and/or focus on implementation modes.
      These competencies can be applied cross-cuttingly for all members, or for defined fields of activities and members, either within the community's thematic clusters or for more emerging fields within the framework of project groups. The multi-year contract and operational plans approved by the Board of Directors specify the framework and modalities for implementation.
      In this context, Université Paris-Est defines and implements the joint signature of scientific production from the staff on site of its members and those of its associates whose association agreement provides for participation in the joint signature;
      3° Induced skills needed to implement the previously defined competencies either by relying on priority and with their agreement on the skills and means of members, or by relying on community-specific means.


      Article 6
      Means of actions


      For the purpose of carrying out his duties and in accordance withArticle L. 711-1 of the Education Code, Université Paris-Est may, in particular, carry out in its own name within the scope of the shared project the following actions:
      1° Establish, manage, allocate funding to services or equipment that may or may not be common to members, such as technology platforms, hospitality and accommodation, support services and logistical facilities;
      2° Negotiate, conclude and manage any legal act with public or private, French or foreign partners;
      3° Acquire and manage buildings;
      4° Finance or contribute to the financing of research programmes conducted by members;
      5° Recruit and manage personnel in accordance with the rules of procedure and in accordance with the regulations in force;
      6° Provide financial assistance to students and teachers-researchers and invited teachers, as well as graduates of internships;
      7° Provide, by agreement, cost-effective services, the filing and operation of trademarks, patents and models, the granting of licences and the direct or indirect marketing of the products of its activities;
      8° Realize the publishing and marketing of scientific or technical books and periodicals, create and operate data banks;
      9° Provide services and facilities for the creation and development of businesses within the framework of thearticle L. 321-5 of the search code ;
      10° Take participations and create subsidiaries in the fields of activities of its members, under the conditions set by the articles 58 to 63 of Decree No. 2008-618 of 27 June 2008 relating to the budget and financial regime of public institutions of a scientific, cultural and professional character with expanded responsibilities and competencies and within its resources;
      11° Use arbitration in cases of disputes arising from the execution of contracts with foreign agencies and transfer within the meaning ofArticle 2044 of the Civil Code.
      Paris-Est University has all means of action granted to a public institution of a scientific, cultural and professional character by the education code.

    • Part III: GOVERNANCE
      • Chapter I: General Governance Mechanisms
        • Section 1: Board of Directors


          Article 7
          Composition


          The board of directors shall consist of thirty-eight directors divided according to the following decomposition:
          1° Seven representatives of higher education institutions and organizations members of the community of universities and institutions;
          2° Six qualified personalities selected for their involvement and skills in the areas of training and/or research and agreed upon by the members mentioned in the 1st, four of whom are designated as partners and partners;
          3° Three representatives of economic activities and three representatives of local authorities, including one representative from the Ile-de-France region;
          4° Ten representatives of professor-researchers, teachers and researchers serving at Université Paris-Est or in member institutions, or both at Université Paris-Est and one of the member institutions distributed as follows:
          (a) A college "university(s)" A1 consisting of three representatives of professors and similar staff;
          (b) A college "other institutions" A2 consisting of two representatives of professors and similar staff;
          (c) A college "university(s)" B1 consisting of three representatives of other teachers-researchers, teachers and similar staff;
          (d) A B2 College consisting of two representatives of other professor-researchers, teachers and similar staff;
          5° Four representatives of other staff serving at Université Paris-Est or in member institutions, or both at Université Paris-Est and one of the member institutions as follows:
          (a) A college "university(s)" consisting of three representatives of the other staff;
          (b) A college "other institutions" A representative of other personnel;
          6° Five representatives of users who attend training at Paris-Est University or a member institution distributed as follows:
          (a) A college "students" E consists of two user representatives following a degree or master course;
          (b) A doctoral college consisting of three representatives of doctoral students.
          The State is represented, without a deliberate vote, by the rector of the Creteil Academy. The State may also be represented by other ministries of guardianship of the member and associate institutions of Paris-Est University.


          Article 8
          Terms and conditions of election and designation


          The term of office of members of the board of directors of categories 1 to 5° is four years.
          The terms of reference of user representatives are two years.
          The mandates begin at the first meeting convened for the election of the Chairperson.
          Representatives of Class 1 shall be designated by each establishment in accordance with the rules of designation in force within the establishments.
          The personalities of category 2° shall be mutually agreed by the members mentioned in the 1° according to the terms specified in the rules of procedure.
          Territorial authorities, institutions and organizations shall designate the person or persons representing them referred to in category 3 and the person or persons of the same sex who replace them in the event of temporary incapacity. Representatives of local authorities or their groups are members of their legislative bodies.
          Respect for the obligation to ensure parity between women and men is assessed on all external personalities serving on the board of directors under the conditions prescribed by the regulations in force.
          When an external personality loses the quality under which it was designated, or ceases to sit for any cause, a representative of the same sex shall be designated for the remainder of the term.
          The members of the board of directors of categories 4° to 6° are elected by direct suffrage, by secret ballot of the list by separate colleges with proportional representation to the strongest remains, possibility of incomplete lists and without panaching.
          In order for the President of Université Paris-Est to stop the list of electors for the elections to the board of directors, the member institutions designate those of their staff who, as part of their involvement in Université Paris-Est, are electors and eligible. This designation is made in particular in relation to the list of their relevant research and training structures, as set out in the rules of procedure and which specifies, for each research agency and higher education and research institution, the entities under which it is a member of Paris-Est University.
          Each list of candidates is alternately composed of a candidate of each sex.


          Article 9
          Attributions


          The Board of Directors deliberately determines the Paris-Est University policy whose digital issues and resources, it approves its budget and controls its execution. In this regard, in particular:
          1° Determines the general orientations and shared project of Université Paris-Est, in relation to the institutions;
          2° Deliberates on the common part of the multi-year contract with the State and the effects of changing the legal status of a member or its scientific scope;
          3° Determines the general organization and operation of Paris-Est University, including the creation and suppression of its coordination structures as defined in Article 22 of these statutes;
          4° Deliberates on the offer of training and diplomas from Paris-Est University as part of the terms strictly defined in Article 5 of these statutes;
          5° Approves the adhesion of new members after favourable advice from the Council of Members;
          6° Approves the principle of the association, under theArticle L. 718-2 of the Education Codea higher education institution or a research organization or an organization involved in public service missions of higher education or research and the adoption of the association agreement;
          7° Approves the exclusion or withdrawal of a member after favourable advice from the Council of Members;
          8° Approves the Paris-Est University budget and its amendments, the financial account and the allocation of results;
          9° Adopts the rules of procedure of Paris-Est University and its amendments;
          10° Adopts the rules relating to doctorate and all courses carried or accredited by Université Paris-Est;
          11° Adopts general terms and conditions of employment for staff at Paris-Est University, including contractual agents;
          12° Vote acquisitions, alienations and exchanges of Paris-Est University buildings and leases and leases of buildings;
          13° Deliberates on the alienation of furniture from Paris-Est University;
          14° Vote acceptance of donations and bequests paid to Paris-Est University;
          15° Approves the participation of Paris-Est University in organizations with corporate personality as well as the participation and creation of subsidiaries;
          16° Approves the Paris-Est University conventions signed by the President;
          17° Authorizes the Chairperson to initiate any legal action, to transfer and to resort to arbitration in cases of disputes arising out of the execution of his contracts with foreign agencies;
          18° Approves the annual report of Paris-Est University submitted by the President;
          19° Creates any commission or committee that it considers useful or proposed to it by the Chairperson, placed directly under its authority in accordance with the terms and conditions set out in the rules of procedure;
          20° Modifies these statutes, after advice from the boards of directors of the member institutions and favourable advice from the board of members rendered by a two-thirds majority; these amendments are approved by decree.
          The Board of Directors shall elect the President(e) of Paris-Est University by a two-thirds majority of the members present or represented, in accordance with the terms defined by the rules of procedure.
          The board of directors may delegate to the president any or all of its powers, in the matters referred to in 14°, 15°, 16° and 17°. He then reports, at the next session, on the decisions he made under that delegation.
          The Chairperson may also receive delegation to make the changes to the budgets:
          1° The purpose of which is not to increase expenditures or transfers of credits between the operating, personnel and investment chapters;
          2° The purpose of which is to allow the execution of conventions, in accordance with the overall balance.
          At the next meeting of the Council, the Committee shall report on the decisions taken in the context of those delegations.


          Article 10
          Meetings. - Decision-making


          The Board of Directors meets at least three times a year on the convocation of its Chairperson who sets the agenda for it. It is also convened at the request of a third of its members on a specific agenda.
          The Accountant Officer, the members of the Executive Committee, the Chair(s) of the Academic Council and, in general, any person whose Chair(s) wishes to collect the notice may attend the sessions of the Board of Directors with an advisory vote.
          The Chairperson may, in particular, invite a representative of a member or associate institution where the member institution is particularly concerned by a matter or decision to be taken by the board.
          A representative appointed by the regional research and technology delegate from the Ile-de-France region is invited to the Council meetings.
          When the Chairperson is unable to preside over a meeting of the Board, his or her functions shall be performed by the First Vice-Chairperson under the conditions set out in the rules of procedure.
          Board directors may give power to another board member. No one can carry more than one proxy.
          The Board shall meet validly if at least half of the directors in exercise are present or represented or participate in the session by means of videoconferencing or electronic communication allowing the identification of the directors and their effective participation in a collegial deliberation.
          If the quorum is not reached at the opening of the session, the board will be reconvened on the same agenda within one week. It then meets validly, regardless of the number of directors present or represented.
          Each administrator has one voice.
          The deliberations are taken by a simple majority of directors present or represented. In the event of a vote sharing, that of the president is preponderant.
          By exception to the above, a two-thirds majority of directors present or represented are required to deliberate on:
          1° The election of the President of Paris-Est University;
          2° The adoption of the common component of the multi-year contract;
          3° The adoption and amendment of the rules of procedure of Université Paris-Est.
          By exception to the above, any amendments to the statutes, including the membership of new members or the exclusion of members, shall be adopted by an absolute majority of the directors in office. The same voting terms apply to the deliberations on the consequences of a change in legal status or the scientific perimeter of a member within Paris-Est University.
          Subject to the legislative and regulatory provisions in force, decisions of the board of directors shall be enforceable without delay.

        • Section 2: Council of Members


          Article 11
          Composition


          The Council of Members shall bring together a representative of each of the members of Paris-Est University, designated in accordance with the rules of designation in each institution.
          When a member of the Council of Members loses the quality for which he or she has been designated or when his or her seat becomes vacant for any cause, a new member is designated in accordance with the designation rules in force in each institution.


          Article 12
          Attributions


          The Council of Members is associated with the preparation of the work and the implementation of the decisions of the Board of Directors and the Academic Council.
          He issues an opinion on the applications to the Chair of the Board of Directors.
          It may also be seized at any time by the President of Université Paris-Est, prior to the deliberations of the Board of Directors on all or part of the draft deliberations of the Board of Directors.
          It may also be seized, in the same manner as those provided for in the previous paragraph, by the academic council.
          The Board of Members is consulted by the Board of Directors prior to:
          1° To the definition and implementation of the shared projectArticle L. 718-2 of the Education Code ;
          2° The adoption of the joint component;
          3° When the multi-year contract is signedArticle L. 718-5 of the Education Code ;
          4° Any changes to these statutes including, inter alia, the accession of new higher education institutions or research organizations, the withdrawal or exclusion of a member;
          5° To adopt the general orientations of Université Paris-Est;
          6° At the adoption of the Paris-Est University budget after agreement of each member concerned on his contribution;
          7° The adoption of an association agreement with an institution or organization involved in public service missions of higher education or research.
          A two-thirds majority approval of the deliberations submitted to the Board of Directors is required to:
          1° The adoption of the common component of the multi-year contract;
          2° An amendment to the statutes, including membership, withdrawal or exclusion of a member;
          3° Adoption or amendment of the rules of procedure;
          4° The association of a higher education institution or a research organization or an organization involved in public service missions of higher education or research;
          5° The consequences of amending legal status or the scientific perimeter of a member of Paris-Est University.


          Article 13
          Opinion and vote


          The Council of Members shall meet at least three times a year, at the convocation of its (sa) President who shall determine its agenda. It is also convened at the request of at least one third of its members on an agenda determined in accordance with the terms and conditions specified in the rules of procedure.
          It is chaired by the Chairperson of the Board of Directors who, however, does not have a deliberate vote. The Accountant Officer, the members of the Paris-Est University Management Committee and the Chair of the Academic Council may attend the meetings of the Council of Members without a deliberate vote.
          When the chair(s) cannot preside over a meeting of the board, his or her functions shall be performed by one of the members of the board under the conditions referred to in the rules of procedure.
          Council members may give power to another board member. No one can carry more than one proxy.
          The Board shall meet validly if at least half of the members are present or represented. If the quorum is not reached at the opening of the session, the board will be reconvened on the same agenda within one week. It then meets validly, regardless of the number of members present or represented.
          Each member serving on the board has a voice.
          Counsel's notices are obtained by a simple majority of its members present or represented unless a qualified majority of the members present or represented is required by the regulations in force or by these statutes.

        • Section 3: Academic Council


          Article 14
          Composition


          The academic council consists of fifty and one member divided as follows:
          1° Seven representatives of higher education institutions and organizations members of the community of universities and institutions;
          2° Five qualified personalities selected for their involvement and skills in the areas of training and/or research and agreed to by the members mentioned in the 1st, four of whom are designated as partners and partners;
          3° Two representatives of economic activities and a representative of the Ile-de-France region;
          4° Twenty-two representatives of professor-researchers, teachers and researchers serving at Université Paris-Est or in member institutions, or both at Université Paris-Est and one of the member institutions divided as follows:
          (a) A college "university(s)" A1 consisting of six representatives of professors and similar staff;
          (b) A college "other institutions" A2 consisting of five representatives of professors and similar staff;
          (c) A college "university(s)" B1 consisting of six representatives of other teachers-researchers, teachers and similar staff;
          (d) A B2 College consisting of five representatives of other assimilated teachers, teachers and staff.
          5° Six representatives of other staff serving at Paris-Est University or in member institutions, or both at Paris-Est University and one of the member institutions as follows:
          (a) A college "university(s)" consisting of four representatives of the other staff;
          (b) A college "other institutions" consisting of two representatives of other staff;
          6° Eight representatives of users who attend training in Paris-Est University or in a member institution distributed as follows:
          (a) A college "students" E consisting of four user representatives following a degree or master degree course;
          (b) A college "doctoral" F consisting of four representatives of doctoral students.


          Article 15
          Terms and conditions of election and designation


          The term of office of the members of the academic council shall be four years, with the exception of the representatives of the users whose term is fixed at two years. The warrants begin at the first meeting convened for the election of the Chairperson.
          Representatives of Class 1 shall be designated by each establishment in accordance with the rules of designation in force within the establishments.
          The personalities of category 2° shall be mutually agreed by the members mentioned in the 1° according to the terms specified in the rules of procedure.

          Article 16
          Attributions


          The academic council exercises, for the skills transferred to the community of universities and institutions, the advisory role envisaged in theArticle L. 712-6-1 of the Education Code and gives its opinion on the proposed shared project and multi-year contract, respectively, to the articles L. 718-2 and L. 718-5 Education code.
          In accordance withArticle L. 712-6-1 of the Education Code, the academic council is consulted or may wish on:
          1° Guidance on training, research, dissemination of scientific, technical and industrial culture and scientific and technical documentation;
          2° The qualification to be given to the job of teachers and researchers who are vacant or requested;
          3° The application for accreditation of the institution with respect to the general rules for the issuance of diplomas;
          4° The multi-year contract;
          5° All measures to guarantee the exercise of university freedoms and political and trade union freedoms of students.
          He proposed to the Board of Directors a multi-year framework for disability policy, covering all areas of disability. After advice from the technical committee referred to in theArticle L. 951-1-1 of the Education Code, this outline defines the objectives that the institution must implement in order to meet the employment obligation of persons with disabilities and assimilated.
          In order to carry out its duties, the academic council may organize itself in commissions according to the rules of procedure.


          Article 17
          Meetings and decision-making


          The academic council shall meet at least three times a year on the convocation of the president of the academic council on an agenda determined by it, or at the request of a third of its members. Meetings and agendas are mandatory for board members at least eight frank days before the date of the meeting.
          The academic council may meet only if the quorum is found at the beginning of the session, more than half of its members in exercise being present or represented or participating in the session by means of videoconference or electronic communication allowing the identification of these administrators and their effective participation in a collegial deliberation. Otherwise, the board is convened a second time, not earlier than a week later, on the same agenda but without a quorum condition.
          A member of the board may be represented by another member of the board by giving him a written power of attorney. No one can carry more than one proxy. In case of equal sharing of voices, the president of the academic council has a predominant voice.

        • Section 4: Other advice


          Article 18
          Council of members and associates


          The Council of Members and Partners includes:
          1° Members of the Council of Members;
          2° A representative of each of the institutions associated with Paris-Est University whose association agreement provides for participation in this council.
          The Council of Members and Associates has an advisory role on areas of common interest, both in terms of policy and project, as well as in terms of implementation modalities. The exchange statement and recommendations are forwarded to the Board of Directors.
          The Council of Members and Partners meets at least three times a year. It is convened and chaired by the President of Paris-Est University.

      • Chapter II: Presidency and Vice-Chairmen


        Article 19
        President of Paris-Est University


        The President of Paris-Est University is elected by the Board of Directors by a two-thirds majority of its directors present or represented for a term of four years renewable. He (she) may be an external qualified personality to the board or as a member of the board.
        When the Chairperson reaches the age limit of sixty-eight years in the current term, he or she may hold office until 31 August after the date on which he or she reaches that age.
        It (it) provides direction to the establishment as part of the directions defined by the Board of Directors.
        As such:
        1° He (she) chairs the board of directors, prepares and executes its deliberations. It (she) prepares and implements the common part of the multi-year contract;
        2° He (she) represents the establishment in justice and in respect of third parties in all acts of civil life;
        3° He (she) prepares the budget, presents it to the board of directors, and executes it;
        4° He (she) reports annually to the Board of Directors on the execution of decisions and its management;
        5° It (it) develops the rules of procedure of the community, which it (it) submits to the approval of the board of directors, and ensures its implementation;
        6° He (she) has authority over the staff of Université Paris-Est and the agents designated by the members who exercise all or part of their duties within the community for the activities carried out within the community and appoints to all the functions of the institution for which no other authority has been granted the power of appointment;
        7° He (she) is the principal sponsor of income and expenditure;
        8° He (she) is responsible for the proper functioning, maintenance of order and security in the establishment;
        9° It (it) signs the contracts, conventions and transactions authorized by the Board of Directors;
        10° He or she may propose, after approval by the Board of Directors, the establishment of any commission or committee that he or she considers appropriately placed under his or her authority in accordance with the terms and conditions set out in the rules of procedure;
        11° He or she may carry out any mission to be delegated to him by deliberation of the board of directors;
        12° He or she may delegate his or her authority or signature to any person designated to carry out liability missions at Paris-Est University, in particular to the Vice-President(s).
        In the event of a temporary incapacity, the functions of the chair(s) shall be performed by the first vice-president or, if not, by one of the directors of the board of directors under the conditions defined by the rules of procedure. In the event of a vacancy, new elections are held as soon as possible for the remaining term of office.
        In addition to the elected Vice-Presidents provided for in the following articles, the Chairperson shall be assisted by the Vice-President(s) appointed by the rules of procedure.


        Rule 20
        First Vice-President


        The Chairperson shall be assisted by a Vice-Chairperson elected on his proposal by the Board of Directors by an absolute majority of the members present or represented. Its powers are set by the rules of procedure.
        Its mandate is four years.


        Article 21
        Vice-President, Digital Issues and Resources


        In accordance withArticle L. 718-10 of the Education Code, the Chairperson is assisted by a Vice-Chairperson in charge of digital matters and resources. Its powers are set by the rules of procedure.
        The Vice-President of Digital Issues and Resources shall be elected by the Board of Directors by an absolute majority of the members present or represented on the proposal of the President(e) of Paris-Est University.
        Its mandate is four years.

      • Chapter III: Sectoral governance mechanisms


        Article 22
        Coordination structures


        The coordination structures of Université Paris-Est are dedicated to the exercise of the transferred skills and coordinated skills by Université Paris-Est.
        As such, the doctoral studies department, the "health and society" pole and the "city, environment and their engineering" pole are respectively organized within coordination structures.
        Each coordination structure is the main task of proposing a strategy in its area of competence and coordinating its implementation by the community of universities and institutions and by each member and associate of the community.
        Paris-Est University puts in place any coordination structure that it deems useful in carrying out its missions, after favourable advice from the board of members rendered by a two-thirds majority and vote of the board of directors by an absolute majority of the members present or represented.
        Each coordination structure is administered by a board and is moderated by a director under the conditions prescribed by the establishment's rules of procedure. The composition of the executive and the advice of these coordinating structures is defined by the rules of procedure of the Université Paris-Est.
        The piloting of each coordination structure involves the members involved in the area of competence in question and the institutions associated according to the provisions of the previously concluded association agreements. Similarly, the representation of PhD students will be ensured in the co-ordinating structure for doctoral studies.

    • Part IV: FINANCIAL PROVISIONS


      Article 23
      Budgetary and accounting management


      Paris-Est University provisions of Article L. 719-5 of the Education Code and those of its implementing texts and the provisions of Article L. 719-9 of the same Code relating to a posteriori financial control.


      Article 24
      Resources


      Paris-Est University resources include:
      1° Contributions of any nature of its members;
      2° Public subsidies;
      3° Financial participation in operating expenses and equipment paid by private, legal or physical persons, public authorities or international organizations;
      4° tuition fees and registration fees;
      5° Learning Tax products;
      6° The product of participation in continuing vocational training;
      7° Resources obtained for participation in national or international research programmes;
      8° Products from the valuation of research and conventions and contracts, including studies or research, carried out on behalf of third parties;
      9° Products of patents and licences;
      10° Compensation for services rendered;
      11° Resources from various congresses and events organized by the institution;
      12° Contributions freely subscribed by companies in the framework of sponsorship agreements or as patronage;
      13° Donations and bequests;
      14° The proceeds of transfers of property, furniture and buildings, rental of premises and sales of publications of the establishment;
      15° The proceeds of the participations, in particular the contributions of the associated institutions as provided by the association agreements and, in general, any other income authorized by the laws and regulations in force.


      Rule 25
      Expenditure


      The expenses of Université Paris-Est include the establishment's own personal expenses, equipment and operating expenses and, in general, all expenses required for the activity and the operations of the establishment.


      Rule 26
      Accountant


      The Accountant Officer shall be appointed by joint order of the Minister for Higher Education and the Minister responsible for the budget, on the proposal of the President of Paris-Est University.


      Rule 27
      Rules of advances and recipes


      Advances and receipts may be created from the establishment under the conditions prescribed by the Decree No. 92-681 of 20 July 1992 modified for revenue-based authorities and public bodies' advances.

    • Title V: TRANSITIONAL PROVISIONS


      Rule 28
      Transitional provisions


      These statutes come into force from the publication in the Official Journal of the French Republic of the decree approving them.
      In accordance withArticle 117 of Act No. 2013-660 of 22 July 2013 As amended on higher education and research, the members of the board of directors in exercise on the date of publication of the decree continue to serve until the appointment of the new directors of that body.
      The new Board of Directors, the President and the Academic Council shall be appointed within one year of the approval of the new Statutes of Paris-Est University.
