Subject: extension of protection against occupational accidents and occupational diseases to persons benefiting from actions to assist in the creation of a company, guidance, evaluation or support in the search for employment, dispensed or prescribed by local missions for the professional and social integration of young people, placement organizations specializing in the professional integration of persons with disabilities or structures having entered into a convention with public service actors.
Entry into force: this decree comes into force on the day after its publication.
Notice: job seekers who benefit from actions to assist in the creation of a business, orientation, evaluation or support in the search for employment are covered under occupational accidents and occupational diseases, when these actions are dispensed or prescribed by Pôle emploi. Article 20 of the Act of 5 March 2014 on vocational training, employment and social democracy extends this coverage to the beneficiaries of these same actions, when they are dispensed or prescribed by local missions for the professional and social integration of young people, placement agencies specializing in the professional integration of persons with disabilities or structures having entered into a convention with the public employment service actors. The purpose of this decree is to clarify the declarative steps that now apply to these structures.

The Prime Minister,
On the report of the Minister of Social Affairs, Health and Women's Rights, the Minister of Finance and Public Accounts and the Minister of Labour, Employment, Vocational Training and Social Dialogue,
Vu le Social Security Codeincluding article L. 412-8;

Considering the opinion of the Board of Occupational Accidents and Diseases of the National Health Insurance Fund of Employees on 10 December 2014;
Based on the advice of the Board of Directors of the Central Agency for Social Security Organizations dated 19 December 2014,
Decrete:
The title I of Book IV of the Social Security Code is replaced by the following title:
"Subsection 11. Beneficiaries of actions to support the creation of companies, guidance, evaluation or support in the search for employment."
In Article D. 412-91 of the Social Security Code, the words: "by the ANPE" are replaced by the words: "by Employment Pole or by the organizations mentioned in 2°, 3° and 5° of Article L. 5135-2 of the Labour Code" and the words: "the applicant for employment" are replaced by the words: "people who receive assistance in the creation of enterprises,
Article D. 412-92 of the Social Security Code is amended as follows:
1° In the first paragraph, the words: "unpaid or unpaid job seekers" are replaced by the words: "the beneficiaries of the shares prescribed by the organizations mentioned in the 11th of Article L. 412-8";
2° In the second paragraph, the reference "L. 351-2" is replaced by the reference "L. 5421-2".
Article D. 412-93 of the Social Security Code is amended as follows:
1° In the second paragraph, the words "to Pôle emploi qui la verse" are replaced by the words: "to Pôle emploi or to the organizations mentioned to the 2°, 3° and 5° of Article L. 5135-2 of the Labour Code who pour it";
2° In the third paragraph, the words "job applicants" are replaced by the word "beneficiaries".
Section D. 412-94 of the Social Security Code is replaced by the following provisions:
"Art. D. 412-94.-The declaration of the accident at the primary bank of affiliation of the beneficiaries of the shares referred to in 11° of section L. 412-8 is the responsibility of the organizations that prescribed these shares. If the accident does not occur in the premises of these organizations, they must be informed within 24 hours by the action manager. »
Section D. 412-90 of the Social Security Code is repealed.
The Minister of Finance and Public Accounts, the Minister of Social Affairs, Health and Women's Rights, and the Minister of Labour, Employment, Vocational Training and Social Dialogue are responsible, each with respect to it, for the execution of this Order, to be published in the Official Journal of the French Republic.
